While it's true that Mojang doesn't appear to care, as evidenced by the disregard of customers petitioning for their accounts in the migration disaster, what they fail to realize is that their opinions do not trump the contract or the law. As an alpha customer, I'm not prohibited from firearm mod use, creation, sale, etc. And that's likely the next lawsuit that should go forward, because the mass termination of customer accounts was fraudulent since Mojang didn't have an actionable cause in the contract to argue that those terminations were valid or legal.

@@plebisMaximushere's the thing: they are not, legally, allowed to enforce the rules however they want. The EULA is a contract, and as such it must follow certain laws to be considered valid. In practice they can enforce rules however they wish, but legally that's not the case

Mojang had no contractual authority to set a deadline or mass delete accounts, period. Deleting accounts impacted everyone who lost an account, and the statute of limitations is not over on that yet. Alpha customers were not required to migrate. Their contracts promised them service without jumping through more hoops to receive it. When Mojang went on twitter and said migrating was mandatory, they hit the final nail in the coffin of their position by openly breaking the law. Nobody has a right to force or coerce someone into entering a third party contract under threats or duress to invalidate another contract.
All who owned legacy accounts that were deleted received account codes to get a new account for free so there wouldn't even be any monetary losses making a case for that situation harder to make.
remember, DO NOT HARRASS ANY EMPLOYEES ESPECIALLY DEVELOPERS FOR THIS. they have NOTHING to do with mojangs issues, the people that are responsible for it are the lawyers and higher ups

I mean yeah, it’s a follow up video but explaining where things are at. Phoenix wasn’t in an obligation giving context about the previous video cause there’s just so much to go off of. He can’t control the algorithm, he certainly can link the video going into details of what is happening in the description and he did so. It’s up to you read it and click the video before commenting a complaint about not knowing anything.
1) I wasnt expecting to ever be this excited about a lawsuit that while not directly including me will still have a major impact on my life. 2) I wasnt expecting it to be completed so damn fast, people must really want Mojang to be held accountable if they are willing to put so much money together.
It was at 50% done in less than 30 hours, people really want justice, not only for the crimes Mojang has committed but also because the community is fed up after everything they’ve done.
I imagine they'll probably need a lot more than $100,000 for a full legal trial with mojang, however I doubt it'll ever get to that. The case will either be dismissed, mojang will just reach an agreement, or the person who's meant to be filing this lawsuit just doesn't do it(I personally believe he'll try but it's possible)
If it does end up working, it'll give hope about people coming together to sue other companies and such with similar issues (law breaking companies and such)
Happened with activison a few years ago so definitely possible ( basically a zombie dlc keep crashing at the end of the level and they fix it only on pc because they didn't wanted to pay the update fee, they were force to fix it)
Honestly Mojang is likely to fall back to Microsoft to defend them in this Lawsuit, which what seems like the crowdfunding only gained about 90k usd, which isn't much in terms of a legal battle against one of the most well known game studios in the world
2:22 there is the third option which is also definitely possible that the lawsuit is settled out of court and in some way the eula is changed &/or the suing party gets monetary compensation. this is bad press for mojang, so they may just want to get ahead of it before it gets bigger. maybe not the most likely but possible.
@@PineaFan Settling out of court isn't brushing it under the rug. Mojang still have to pay, and the suing party still negotiates terms. It just means instead of negotiating with a third party that decides what the outcome is, you're directly negotiating with each other.

In the US there is case law 'Douglas v US District Court' which informs similarly on the matter of clear notice of EULA and changes to the contract. Part of it states that it is onerous/unreasonable to expect a party to have to read/review a contract every time they intend to benefit from the agreement, or to review the contract under a particular set schedule. Therefore, case law was established increasing the obligation of the company to inform the customer. If it went to court and the lawyer did their homework, a similar result could be achieved.
My favourite thing about the internet is that people genuinely expect a billion dollar company to respond to a potential lawsuit outside a court room. Regardless of what happens with this lawsuit, Mojang was never going to respond in a youtube video expecting that is just silly.
Getting negative press and fighting a battle against the community for years hurts your PR a lot more than saying "oops some low-down underlings didn't understand what the law meant, ok you can have an obscure gun server if you want."
Don't forget: This isn't about the guns. It's about the SUPER VAGUE rules in the eula having cost mod creators and server owners their livelihoods/income. @fldom4610 As someone who played Destiny (1&2), I've come to learn that the fault doesn't rest solely with the bigger daddy after a couple years under a parent company. People with different ways of practicing business will change in that time, and creative people whose contributions weren't fully defined may slip out in that time too. Even if you were to separate them now, you can't guarantee things will go back to before, and could even get worse.

It is common practice throughout time that companies who rely on public opinion to turn a profit adress allegations when they reach a pitch fever in news cycles. If your customer base is trying to sue you generally you want to calm them down by making a statement. If for nothing else but to save face. Get it yet?

I just want the Minehut servers that are all pay2win to be more focused on actual good games rather than the same copy n paste just to make a quick profit. Correction: It's only against EULA for customers who are subject to revision of their EULA/contract. The early adopters of the game have broad rights in terms of development, modification, add-ons, publishing, monetization, etc. Mojang has no contractual authority to dictate or limit what content early adopters can use/create/share outside of redistribution of their game.
Roughly from what I can remember, they are being sued for : withholding info in the Eula and rules n' stuff AND changing with Eula without notifying customers If anybody knows anything else in the original video I missed that Mojang is being sued for or can perhaps even dig up some dirt on Mojang that the original vid didn't, that'd be neat!

no, I doubt it because this isnt american courts (im uninformed on swedish courts though) and in most of these "drag out" cases, its because they're suing with little evidence and you have to prove the people are guilty. In this case we actively are shown the fact they're guilty and their own admission of guilt has been shown as well.
Funny that while this was happening I went to my state court for a tour of how their court system works, and the night before I got my house searched by US Marshals & police about a suspect under warrant which didn't live or know in my place. The December of all time.

The only money I have ever and will ever pay for Minecraft was deposited into Notch's bank account 13 years ago. Still don't this really getting anywhere. There's many reasons why huge companies rarely get sued, one being that they can afford to delay stuff until you run out of funds, which is especially likely for a crowdfunded campaign like this
You don’t really get to see many court cases happen of this scale happen frequently, but they’re handled professionally, they do not get delayed at any circumstance unless one of the party members can’t attend the date, but even so the date can be moved around, just not by years like what happens in America
I really hope SOMETHING comes of this. It doesn’t need to be major, but mojang is flying way too close to the sun and if the people don’t stop them, they’ll destroy themselves.

I hope they, us, can win the lawsuit, this is big, I wish I and others like me can help but unfortunately we can't (I am from a third world country). The best I and others like me could do is translate videos like these and spread proper awareness (news like these are unknown to people like us due to a language barrier, 80% of the time). Minecraft is my childhood, it's my everything, and seeing Mojang do things like this and try to get away with them, that's just bad, it makes me really upset, and that's why I really want the lawsuit to commence, even if it won't turn out as a win I hope it'll be a reminder to tell Mojang that we don't tolerate such unfairness.

im a bit scared on what this lawsuit could start, on the one hand I think its great that we are trying to force mojang to be more accountable and make their EULA a lot more consumer friendly, but on the other hand i fear that this lawsuit can cause a chain reaction leading to mojang to be a lot more enforcing with its EULA since if mojang starts to crack down on gambling its going to crackdown on other things like anarchy servers such as 2b2t or chat moderation is going to be a lot more heavily enforced. Idk maybe its just an irrational fear of mine but i hope the best course of action is that mojang just backtracks on its changes, makes its EULA consumer friendly and actually tell you if they are making any changes to it, and finally just leave their focus on making minecraft more child friendly because minecraft's community is not child friendly or made of only children

Mojang/Microsoft do not realize that just because they have language in their EULA covering how you are allowed to title, display, or represent media content that this does not prove that the person who posted a video on RUclips is a customer of Mojang. Furthermore, such terms don't apply to people with contracts prior to May 24, 2011. Microsoft and Mojang are required to play by the rules like everyone else and operate with respect towards fair use statutes, unless they can prove that the customer published the video AND that the customer is subject to the terms.

If the lawsuit is in Sweden, $90 000 is probably to also cover if the person suing loses. EU does not scam their citizens as USA does. To sue a company here for big money it will cost you around $250 paid to the court. Then if you lose the case you have to come up with a lot of money to pay for everyone there + an eventual fine, mostly from your own pocket and that would probably be around @$90k. Your home insurgence can cover parts of it, and if you have low income the government can pay for some of it.
Lawyers have a high hourly salary, and you need lawyers to get anywhere in court. So no, this is not for fines, this is for making the court case happen at all. Check the explanatory video linked in the description if you are interested in the details.

Mojang had no contractual authority to set a deadline or mass delete accounts, period.
Deleting accounts impacted everyone who lost an account, and the statute of limitations is not over on that yet.
Alpha customers were not required to migrate. Their contracts promised them service without jumping through more hoops to receive it. When Mojang went on twitter and said migrating was mandatory, they hit the final nail in the coffin of their position by openly breaking the law. Nobody has a right to force or coerce someone into entering a third party contract under threats or duress to invalidate another contract.
All who owned legacy accounts that were deleted received account codes to get a new account for free so there wouldn't even be any monetary losses making a case for that situation harder to make.

This is in Europe so I'm guessing this is going to go way differently than we all expect it to be if it were a US case
In the US there is case law 'Douglas v US District Court' which informs similarly on the matter of clear notice of EULA and changes to the contract. Part of it states that it is onerous/unreasonable to expect a party to have to read/review a contract every time they intend to benefit from the agreement, or to review the contract under a particular set schedule. Therefore, case law was established increasing the obligation of the company to inform the customer.
If it went to court and the lawyer did their homework, a similar result could be achieved.
My favourite thing about the internet is that people genuinely expect a billion dollar company to respond to a potential lawsuit outside a court room.
Regardless of what happens with this lawsuit, Mojang was never going to respond in a youtube video expecting that is just silly.
Not only a billion dollar company, but one whose owner is Microsoft.
Getting negative press and fighting a battle against the community for years hurts your PR a lot more than saying "oops some low-down underlings didn't understand what the law meant, ok you can have an obscure gun server if you want."

People with different ways of practicing business will change in that time, and creative people whose contributions weren't fully defined may slip out in that time too. Even if you were to separate them now, you can't guarantee things will go back to before, and could even get worse.

Correction: It's only against EULA for customers who are subject to revision of their EULA/contract. The early adopters of the game have broad rights in terms of development, modification, add-ons, publishing, monetization, etc. Mojang has no contractual authority to dictate or limit what content early adopters can use/create/share outside of redistribution of their game.

no, I doubt it because this isnt american courts (im uninformed on swedish courts though) and in most of these "drag out" cases, its because they're suing with little evidence and you have to prove the people are guilty. In this case we actively are shown the fact they're guilty and their own admission of guilt has been shown as well.

I hate to be a buzzkill, especially when it comes to doing damage to Microsoft, but if this doesn't get tossed out as a frivolous lawsuit, it's just going to be Kian getting absolutely minced in the courtroom. He's got pocket change against a 3 trillion dollar corporation and he's trying to sue for a consumer rights violation when his entire case looks more like a copyright issue. This money is going right down the drain.
What matters is also the backlash. I’ve completely stopped playing the game (and won’t come back to it unless they get their shit straight), and many have started to do the same.

@definitely_just_floating Unfortunately, I don't think they care about grizzled old Java veterans not playing the game anymore. The only money I have ever and will ever pay for Minecraft was deposited into Notch's bank account 13 years ago. They care a lot more about the children and their parents who are the primary audience for Bedrock Edition's in-game store and all the merchandise, the kind of people who wouldn't be following a consumer rights lawsuit in Sweden. Granted, I'm just one example. Maybe you're an Emirati oil Sheikh buying minecoins for half a million every week and they really will panic over you pulling out, I just think it's a statistically sound bet to assume you're not and you're closer to a case similar to mine. I want you to be right though, would give anything to make Microsoft see consumers as people for once.

Still don't this really getting anywhere. There's many reasons why huge companies rarely get sued, one being that they can afford to delay stuff until you run out of funds, which is especially likely for a crowdfunded campaign like this
Mojang is Swedish, so this Lawsuit will be handled by EU courts.
They are known for not allowing corporations to bully the little guy.
That's not how it works here in Europe, here big corpos get smacked in the courts all the time.
You don’t really get to see many court cases happen of this scale happen frequently, but they’re handled professionally, they do not get delayed at any circumstance unless one of the party members can’t attend the date, but even so the date can be moved around, just not by years like what happens in America
I really hope SOMETHING comes of this. It doesn’t need to be major, but mojang is flying way too close to the sun and if the people don’t stop them, they’ll destroy themselves.

I hope they, us, can win the lawsuit, this is big, I wish I and others like me can help but unfortunately we can't (I am from a third world country). The best I and others like me could do is translate videos like these and spread proper awareness (news like these are unknown to people like us due to a language barrier, 80% of the time). Minecraft is my childhood, it's my everything, and seeing Mojang do things like this and try to get away with them, that's just bad, it makes me really upset, and that's why I really want the lawsuit to commence, even if it won't turn out as a win I hope it'll be a reminder to tell Mojang that we don't tolerate such unfairness.

im a bit scared on what this lawsuit could start, on the one hand I think its great that we are trying to force mojang to be more accountable and make their EULA a lot more consumer friendly, but on the other hand i fear that this lawsuit can cause a chain reaction leading to mojang to be a lot more enforcing with its EULA since if mojang starts to crack down on gambling its going to crackdown on other things like anarchy servers such as 2b2t or chat moderation is going to be a lot more heavily enforced. Idk maybe its just an irrational fear of mine but i hope the best course of action is that mojang just backtracks on its changes, makes its EULA consumer friendly and actually tell you if they are making any changes to it, and finally just leave their focus on making minecraft more child friendly because minecraft's community is not child friendly or made of only children
Enforcing rules even more harshly is a very dumb decisions economically, but I can see it happening because companies don't think with their brain
If they crack down then Minecraft is _definitely_ going to be on the decline. Already their crackdowns have seriously pissed off the community and sent people looking for alternatives. I could definitely see them going down that route, but in case that happens just switch to Vintage Story.

Mojang/Microsoft do not realize that just because they have language in their EULA covering how you are allowed to title, display, or represent media content that this does not prove that the person who posted a video on RUclips is a customer of Mojang. Furthermore, such terms don't apply to people with contracts prior to May 24, 2011.
Microsoft and Mojang are required to play by the rules like everyone else and operate with respect towards fair use statutes, unless they can prove that the customer published the video AND that the customer is subject to the terms.

If the lawsuit is in Sweden, $90 000 is probably to also cover if the person suing loses. EU does not scam their citizens as USA does.
To sue a company here for big money it will cost you around $250 paid to the court. Then if you lose the case you have to come up with a lot of money to pay for everyone there + an eventual fine, mostly from your own pocket and that would probably be around @$90k. Your home insurgence can cover parts of it, and if you have low income the government can pay for some of it.
Lawyers have a high hourly salary, and you need lawyers to get anywhere in court. So no, this is not for fines, this is for making the court case happen at all. Check the explanatory video linked in the description if you are interested in the details.

I feel like most of the things that brought me joy in my childhood and teen years are either dead or otherwise a warped shadow of what they once were. So having some changes to make at least one of them be less scummy would be nice.
But that's also a lot of money to go to something that might lead to nothing.
