Wrongfully Convicted People Have No Idea They’re Owed Back Thousands In Taxes (HBO)

  • Jon Eldan, a lawyer who runs a one-man nonprofit named After Innocence, spends his days making hundreds of phone calls to men and women who were wrongfully incarcerated, then exonerated and released from prison. Every now and then, if he’s lucky, he finds who he’s looking for - and if they’re lucky, he tells them the government owes them back taxes, sometimes to the tune of hundreds of thousands of dollars.
    For years, some exonerees who were compensated for their time in prison had to pay federal income taxes on that money. That changed in 2015 with the Wrongful Conviction Tax Relief Act. Congress made the law retroactive, meaning exonerees could apply for refunds - but it didn’t come up with a way to let people know they were entitled to the money.
    So Eldan took it upon himself to survey as many publicly known exonerees as possible to find those the government failed to alert.

    Wrongful conviction is a moral crime. It's a sad thing that these things inevitably happen. The person should be compensated for all the suffering and indignation that he went and will go through the rest of his life.
    This man is doing great work.

    Going to prison for a crime I didn’t commit is my biggest fear in life. I would not survive in prison. These people deserve the money for being wrongfully put in jail.

      @@PresidentialWinner Well, that depends if your in jail or in prison. In prison you dont get much freedom at all, your very isolated. While in jail you get someone to talk to at least, and are not isolated 23hrs like in prison. None of this is as bad as u.s though, that seems like hell to me.

    IMHO The man at the end who cannot seem to obtain a copy of the return he filed,may be able to gather his wage and earmings info for that year and file an amended return.Also Social Security Administration will give you a statement of all the wages and earnings as reported to them by employers or payors, the latest contact numbers for those employers could be obtained there.Most importantly you must request payment in writing repeatedly and you may prevail.

    WTH, why put a deadline on this money? If they owe u on Friday, guess what,? They owe u on Monday in the real world. Why does the government get to say when they will not owe money anymore?     Should have a govt agency doing this. They always find you when you owe THEM! Our criminal justice system is seriously flawed. I would volunteer to help find these folks, they deserve this & so much more!

      Katie Kane yep IRS maintains that we must request our refund within 1 year I believe unless we had an extreme event which prevented us from filing yet IRS can and will collect from us for any year of tax.

    Remember: that up until recently, Texas had a law still on the books that said when you are released from prison (for a RIGHTFUL conviction), they owed you a horse, some cash, and a loaded gun so you could get out of town.

      I hate to hear that so many people or in prison .wrongfully convicted.but I went to share I Willie Moses Anderson .also was wrongfully accused of a crime I did not committed I did 28 years in prison for a crime I never did committed.for armed Robbery.Back in October 8 1989 at 11 00 clock At night a woman was Rob in her yard .In the month of October 8 1989 at 11 00 clock I was on my job at work 3 miles away getting ready to get off from work at 11 00 clock.and I walked home from work like I always do .when I get down town manning .behind manning police department .a cop on foot run up to me .he stop me and question me .then let me go on my way.he stop me around 12 15 that morning.7 month later May 16 1990 .I being arrested for armed Robbery assault battery with intent to kill.I was Never placed in a picture line up .or pick out of a picture line up either.in September 27 1990 I had a jury trial and the jury found me guilty .I was sentenced 45 years in prison.doing the time I been fighting for my freedom .the innocence project in New York accepted my case.in 2013 2015 I had a. Hearing for the judge could giant the order for my Attorneys .could have the evidence send to Texas to the DNA Laboratory to be test.which they did and all the evidence came back clean.there was know DNA on the evidence to link me at the crime scene..and the sled have a Latent finger print card that is also negative. Instead my Attorneys get my case over turn.their. sold me out and give me they ass.to kiss to white. Attorneys from the innocence project in New York and one white male Attorney from South Carolina..I maxout 28 years March 1 2018. Last year .yes I did.and I am still fighting to prove my innocent I have my time sheet off my job to prove I was at work on my job at 11 00 clock .and I have my witness to prove it also.and I have my trial transcripts also.I. myself or know one else and be to places at once at 11 00 clock if it can be done please prove it to me and every one in the world .that someone can be to places at once at 11 00 clock.it just can't be done.I Willie Moses Anderson or from manning South Carolina I am age 53 now I been ages 23 years old when I was wrongfully accused of a crime I did not committed.and every Attorney in South Carolina is given me close doors in my face .I just want to share this with you all I am actually innocent.I am willing to take a polygraph test anytime to prove my innocent.again my name is Willie Moses Anderson number 803 603 4065.I still trying to get justice.

    Unfortunately, the government will have to rescind those type of laws, e.g., taxation on compensation paid to wrongfully convicted persons, and refund those in that position because the logic is erroneous per se. Compensation for wrongful conviction is not an income subject therefore to theFederal Income Tax stature. These are compensation or damages handed to individuals for a mistake in judgments and for the pain and suffering inflicted. They were not designed to fill in the gap for lost wages.
    Quite unusual in most countries, people who are convicted wrongfully or correctly will never receive some form of compensation because of the principle of non-suability (State immunity). The rule that any act committed by the state or agents in the exercise of their public functions, no matter how bad, are non-suable. There simply is a firewall.
