I told you that I don't know if you remember me my name is james. I have a hard time watching your show because my blood pressure shoots up. I love your show. That said, I suggest you read a good criminal defense book, and it will explain how things like double-jeopardy work. The reason Jack Smith can appeal in the documents case is because jeopardy doesn't attach until the jury is sworn in or the defendant pleads guilty. Unless Trump wins the appeal and gets a per se reversal, Jack Smith can refile (or the original indictment will be kept in place). Outright dismissals "per se" are rare. Most cases are remanded for futher proceedings.
The case was not refiled, rather the dissmissal is appealable. Even if Canon dismissed the case with prejudice, Smith couid appeal. Dismissal without prejudice means the case can be refiled without appealing.
This is an extremly ironic comment considering how much more educated on law the host is than you. Not saying you are wrong, just that you are hilarious in pretending to inform the hosts on something they clearly already know.
