    I am betting the lack of quality control of the repair is Magnanni's issue. They would be lucky to be able to name you as an official repair station and allow the stamp. Other repair guys though.. well, you have shown us their work and Magnanni would not want their name on it. I suspect that is the reason. Outstanding work as always, Vatche!

  • @jokers7890
    @jokers7890 3 года назад +72

    I have taken some business law courses and researched the legality a bit online. My basic conclusion is the courts have determined it is ok to repair or refurbish a product and use the logo so long as it is obvious to the consumer it is not a brand new product. Meaning, you are clearly a repair shop, customers are obviously aware their shoes are being repaired and are not brand new, so there is no trademark infringement by using the product logo. Using your own Bedo Repair logo only reinforces this case, meaning it would be ok to only use the product logo on a repair, but it is especially ok for you to also add 'Bedo Repair' which only further clarifies it is not a brand new product. The ONLY case a company has over trademark infringement with using a logo is if you are trying to commerically sell their products as brand new when they are not. If someone had a LV bag repaired by you and then tried to sell it on Ebay as a brand new LV bag, the case would be taken up with the individual seller or the platform doing the selling (ebay), but not with you for making the repair with the product logo because you had nothing to do with the deception or use of the logo for a commercial sale. A company would have to prove in court that you were clearly trying to deceive customers it was a brand new product and not a repair, which obviously you would never do. They have no case, but they do have money to intimidate you is basically all they are doing. This is also bad PR for this company because they really should be spending money on their product quality, not a popular shoe repair guy on YT that really only promotes their product and does nothing to hurt their sales. Ridiculous company really and I will never buy their shoes. I find it especially laughable since it has been widely known around the world for hundreds of years that quality shoes go through repairs and nobody is confused that a repaired shoe is a brand new shoe. Lastly, using a product logo on a repair is not even remotely considered marketing by having a YT channel. Really, YT should provide legal support for channels which they clearly do not.

      Some companies do not like their name being present on products that have been 'modified', aka that is not strictly a 1:1 repair because they think somehow it does not reflect totally their brand identity anymore. it's not a real copyright infringement issue, it's a grey area.

    • @bills6093
      @bills6093 3 года назад +6

      @@guezojacky Well, as Steve alluded to, you can crash your Audi with lots of damage, have it totally rebuilt by a local mechanic with non-OEM parts, (and possibly shoddy work, making it unsafe), and you still don't have to take the Audi badges off. Audi's lawyers can't call you up and say "That isn't an Audi any more, don't put our logos back on it.". At least Steve marks the shoes so it is obvious they've been repaired.

    • @spamham1976
      @spamham1976 3 года назад +1

      In this case the car analogy isn’t really a good one. For example if you crashed your Audi and get it fixed at a mechanic. The mechanic doesn’t put his logo, the OEM hood ordinate logo and the Audi logo on the hood. That is the difference.

    I am not a lawyer but I don't believe that any company can legally stop you from putting their name on a shoe made originally by them as long as you are not claiming it is a factory restoration. So if you want to tell them to go pound sand & keep doing what you want to they can't really do anything about it.

    I think the more appropriate question would have been " If I have a BMW .. get into an accident and replace the fenders and good with a new or used or aftermarket part by the body shop... Does BMW say I cannot re install the BMW logo?... or if I take it to a shop to replace brakes and/or shock absorbers... Do I need to remove the BMW logos?"
    Pretty much what it equates to since repairing and/or re crafting a shoe or automobile does not change its provenance, characteristics or attributes.

    The issue is most probably that the design of the shoes has changed. It’s better now than before, but it’s not the original Magnanni design. Also, if they were stamped “Magnanni, re-crafted in the USA”, then this would imply an agreement between you and the manufacturer, which does not exist. That’s where the “approved service centre” comes in. Those who are approved also get certain logo lockups that they can use. Apple certified is another example. If approved, you get a licence to use a particular logo lockup.

    I sharpen utilityblades too. I start with a 1000 then 3000 and 6000 grit stone and finish them with a leather strop with green compound. A box can last a lifetime. Or spend 5 bucks occasionally for new ones.
