Opening Statement: Matheau Moore’s Defense Says State’s Murder Theory Makes No Sense

- During her opening statement, defense attorney Diane Menashe asserted that the state’s theory of a staged suicide and murder is based on speculation and inferences. “Their theory doesn’t make sense,” Menashe said in opening statements. "There is no evidence connecting Matt Moore to the scene."

I am here after the fact, but she is an incredible Attorney. Wow. Just an amazing job of defending an innocent man.
Actually she seems as great as Elaine, AH lawyer.
Pretty basic, nothing special or standout about her at all. Pretty below average average actually.

Cause he thought he did a great job of getting rid of all the incriminating evidence.

I am reading these responses and really annoyed. People saying she is “shrill” she could “catch more flies with honey” would anyone say that about a male lawyer? She seems excellent to me. And very convincing
Stop making it about gender. She is hated because she's on the "bad guy" side.

Yes, annoying male lawyers get attacked all the time in youtube comments.
Stop playing the victim, you western women are always looking to start arguments because your lives are too easy and comfortable.

I don’t know anything about this case, but she is far more dynamic and charismatic than the prosecution. However, he might be the world's best at cross examination even if he is poor at opening statements.
Diane Menashe got William Husel acquitted, I loved watching her during that trial. I liked her better than Jose Baez, who got Casey Anthony acquitted. He represented Dr. Husel. Just watched the prosecution opening and it was as weak as it gets.

I agree. Im surprised more people don't choose a bench trial! A judge tends to follow the law not emotions.
1:48 the State didn’t mention reasonable doubt? Why would they lol? Why would the State even want those words in the jurors minds?
Because they're supposed to be justice seekers, not conviction seekers. Prosecutors routinely mention reasonable doubt in their opening. Watch more court if you don't believe me.
Because prosecutors role is to achieve justice not unwarranted punishment
Usually being THAT cooperative, leading Police to the corpse etc, are a strong sign for guilt.
Wouldn´t be the first time that a guilty person tries to appear overly unsuspicious and achieves the opposite.
But we´ll see...
He didn't lead her to the corpse, he just told her where she might be and she did end up being there. The search team told him they looked where she was found, even though they didn't search there. That led most of the people looking for her to overlook the place she was actually in. It was a real screwup. He was incredibly cooperative though. Willing to let them have full access to his home, phones, and vehicles as well as take pictures of his body or anything else they wanted. He didn't become defensive until they started to accuse him of crimes.
The defense lawyer is very unpleasant to listen to. I wonder if the jury minds being barked at.
I think she's shouting because she's away from the microphone.
@@geoffpoole483 Uh, no. Have seen her before. Shouting. Shrill. Demeaning. Her trifecta. 🤮

It's hanged not hung when it's a person
It's interchangeable in UK English grammar however.
She reminds me a lot of the defense attorney Lyann Goudie , who represented Michael Keetley and got a hung jury for him...she gave so much doubt just in opening statements just like this attorney did. In fact, Lyann's opening statement was so strong that Michael told her not to do a closing statement, he thought her opening was good enough lol.
this is a good example of how dangerous it is to be a married man in the United States.
Defence is good, I got in to the case half way...had to go back see both sides, so open ...but what a sad case of these people...
Usually defense attorneys are cringeworthy but this one she's good I like her tone her speech is spot on. She's very easy to listen to.
I watched both opening statements and this woman presented her case 10 times better than the prosecution. She is amazing. I will keep an open mind but I hope this man did not do it and that his wife took her soul to a beautiful place on her own vallition
Election time is coming up, they wanted to prosecute this case. A win would be very valuable for those who could use it.
Opening statements are not evidence and I urge you to watch the full case and consider the evidence - maybe inconsequential ultimately but perhaps good practice for a case where you’re a juror in the future.
@@brady3126 that is good advice. I am aware that opening statements are not evidence. I just felt that the defense seems to present a much better case than the prosecution. I only said I hope that he did not do it for all the families sake. I do need to watch much more of the case. If he is guilty he deserves to spend the rest of his life in prison
She completely annihilated the state! It’s funny every time she’s up and talking you to see the state with the look on their face like we are in over our heads with her!!
Why would she walk all that way to kill herself, when she had everything at home to do the job??????
Also I'm not saying he is innocent or guilty just saying it isn't and a unheard of phenomena
Because she was obsessed with nature and the outdoors. She insisted they make love, outdoors. Her stepson killed himself, outdoors. You'd know this if you watched any of the trial and didn't make assumptions.
Can someone tell me the reason or logic behind repeatedly saying "members of the jury" over and over...and over. Is it simply to keep their attention, or is there more psychology behind it that a leyman wouldn't think about? Obviously, she does it for a purpose...and she's one of the best there is, so she knows what she's doing... Just interested in the psychological purpose it serves, assuming it's for that reason.
Gets their attention
It's a way to break up her speech and emphasize she's now making a new point, just like someone would say first, second, third, or a, b, c. It's also to keep their attention for each new, unique argument.
Yes. He took them to the area where he put her......'where he took her'
I’m surprised this ever made it inside a courthouse wtf??? Am I missing something??? I’m pretty much pro prosecution but this is a bad case!
The state doesn't really care if they have a good case or care about the harms done to someone forced to go through a trial while innocent. Their take is that if the person is innocent or guilty the jury will figure that out and there job is just to make the best case they can against the most likely suspect. They often times charge and try multiple people for a single crime in an attempt to find a resolution to the case.
Was "where did he take her" a Freudian slip there? She's did well with the evidence part but he wouldn't be the first killer to lead the police to a victim nor move one.
Agree, now you're thinking correctly!
That was interesting, I caught that too!
Please, for u future defense attorneys. Do not use Reasonable Doubt in ur opening statement.
Also don't take advice from someone who can't spell "your"
I wonder why the procecution takes the case if there is no clear evidence? I would not like to take such case...
I'm gonna tell the world right now that if my wife ever goes missing I WILL NOT COOPERATE WITH POLICE FOR ONE SECOND and I WILL NOT BE TAKEN INTO CUSTODY ON THEIR TERMS if I can help it.
i am so glad Matt was found innocent, poor guy suffered enough & had to sit through all this after losing Emily.. what the judge said after the verdict was so poignant ... ''we all want justice for Emily, but that does not mean injustice for you''... hope you can begin healing now Matt 💔much love ❤

What is this defense attorneys name? I love her! I’m hooked
It took me 10 minutes to get over her yelling at the beginning.
She slipped up a lot when cross examining the first witness; lost her way a bit.
Interesting to see where it goes.
This is the defence lawyer who allowed the killer doctor William Husel (14 deaths) to run free. And I don’t understand why she was so hostile to the victim’s sister as if she was the murder suspect. She’s got the worst crossing style by asking “Did you not”, Do you not” with every single question. And her grating voice doesn’t help. This is going to be a hard trial to watch with this awful woman in it.
To be fair, she is effective at her job of being a defence attorney. Whether you like her style or not.

Statistics are a funny thing: if you driving down a dangerous road looking for the safest way to travel and come to an intersection with many forks in different directions and not knowing the safest way to travel but one of the roads clearly has more tire tracks than the rest then it would be reasonable to conclude that road is probably the safest. Just because statistically the spouse is usually responsible police should still start from a neutral position but they never do. Their first assumption is always the spouse. Police like to say they start from from the inside and expand out, this is misleading. They start with the husband is guilty and has to prove his innocence. Very rarely does the train get off that track. Judges are supposed to be impartial but they rarely are. You could hear the extreme disappointment in the judge's voice as he read the verdict.
