  • During her opening statement, defense attorney Diane Menashe asserted that the state’s theory of a staged suicide and murder is based on speculation and inferences. “Their theory doesn’t make sense,” Menashe said in opening statements. "There is no evidence connecting Matt Moore to the scene."

Statistics are a funny thing: if you driving down a dangerous road looking for the safest way to travel and come to an intersection with many forks in different directions and not knowing the safest way to travel but one of the roads clearly has more tire tracks than the rest then it would be reasonable to conclude that road is probably the safest. Just because statistically the spouse is usually responsible police should still start from a neutral position but they never do. Their first assumption is always the spouse. Police like to say they start from from the inside and expand out, this is misleading. They start with the husband is guilty and has to prove his innocence. Very rarely does the train get off that track. Judges are supposed to be impartial but they rarely are. You could hear the extreme disappointment in the judge's voice as he read the verdict.
