A prosecutor left the courtroom after an argument with the judge about protocol. The judge was giving his decision on a motion from #MatheauMoore's defense team to dismiss the charges against their client.

That guy that walked out was also a prosecutor. He probably told her an alternate would be fine but he didn't want to stay there.
Told the LEAD prosecutor. At that stage she didn't truly need to be there. Everything was wrapped up, he was just reading the ruling.
I think his defense attorney is very good! Yeah I’ve flipped back and forth about him being guilty or innocent. Due to lack of evidence against him though, id say innocent

Why is the Judge being a hard ass on waiting until the other Prosecutor is there? It must be on record somewhere that he agreed for the Prosecutor to attend her appointment. If this is so why go back on his word.

Idk maybe cuz there's other cases to be judged and not all your legal team needs to be there for the ruling. The guy is also a prosecutor and neither side had anything to do but listen to the judge make the ruling.
Judges should make the ruling first, then explain the reason.
For example, "The motion to dismiss is granted. The reasons are..." Or, "The motion to dismiss is denied. The reasons are..."
That accomplishes the same goal: inform the parties, and give reasons for the appellate court to consider, if necessary.
But, judges who love being the center of attention with a captive audience will reverse this. They love watching people hang on to their every word in suspense and trying to guess which way they will go with the decision.
Right! If I was that guy I'd just want to know the verdict. The reasons can be told when I'm not holding my breath.
@@FreeWorldSpirit313People love attention. Some judges are attention seekers. One judge I know gets off the bench and paces in front of the attorney tables while he pontificates. It's ridiculous. We're all human, and some of us absolutely crave attention.
If you tell people your conclusion before your reasoning they will tune out.
Circumstantial isn't enough.
People want to send this dude away for life because his behavior doesn't fit the grieving husband character in their Hallmark films.
You do know that this guys son( the son who he complained about and wanted to “ get rid of him “) died suspiciously as well , right ? Two people he’s close with and then are angry they want to break away from him end up “ committing suicide “? Seems like a pattern with this guy
@@SD0224 They have to meet a burden of proof to convict someone of murder. Behavior is heritable so things like mental illness and suicide can be patterns in families. This is not unheard of. I completely agree it seems suspicious but I've not seen them prove it beyond a reasonable doubt.
@@iammrpositive5108 I agrée with most of your points with the exception of referencing mental health issues and suicide as a result seem to have some familial pattern ( genetics ?). Emily and Michael’s son were of no blood relation . Michaels son who “ committed suicide “ was the son he had with a former wife/girlfriend. Cops assumed it was suicide and never fully investigated. Many similar circumstances between the two suicides and the one person linking them is Michael .

Not having a Prosecutor present in a hearing is unconscionable. I am glad the defenses motion to dismiss this case was denied.
Wait, isn't he a prosecutor from the same office? Why can't he fill in to hear a motion decision?
I can't imagine he will be found guilty. Based off of the jurors questions they are very smart.
Watched the whole trial, and the judge is annoyed because the state's case is extremely weak. The judge here was considering a Rule 29 motion to acquit, and the prosecution thought they were going to have their case dismissed.
It seems fairly clear that the cops got Matheu Moore in their sights, and manufactured a case against him based on questionable expert opinion and circumstantial evidence; and the prosecution behaved badly presenting the case.
We didn't find out until closing arguments that the state contend that, on his wife's birthday, after a very long day the couple spent together - collecting spring water, taking photos at the field of heroes, they visited his father, went out for a meal and a few drinks, drove home, at 8:40pm the prosecution say the wife, Emily - changed into walking clothes and set off into the woods.
The sun set at 8:49pm that day - and they're saying, Moore - a large man with a big beard, followed her into the woods, killed her, dragged her into an overgrown thicket, and staged her suicide by hanging in the dark.
Next day he phoned the police around 5pm and reported her missing; and the day after that he was interviewed by police, and took his shirt off and showed he didn't have a scratch on him. Police disregarded that fact, and just kept coming after him - relying ultimately on a paid expert to testify that the skeletal damage was caused by manual strangulation to bring a murder charge.
Otherwise there is no evidence against Moore. No witnesses, no CCTV, no forensics - nothing, and every indication he spent the night on the couch watching youtube and messing around on his phone.
It's simply not possible that such a large man carried a body into that overgrown area - police had to crawl on hands and knees to get to, and not get all scratched up. Less yet is it possible he could have staged a hanging in the dark. It's not likely, after such a long day Emily went into the woods at sunset.
Nonetheless, the judge refused the motion to acquit, and allowed the case to continue. The jury are now considering their verdict. In my opinion (if I were on the jury) he should be found not guilty.
100 % agree. No evidence given to court during the proceedings. If you change mattheau’s with anyone (bob, Michael, Jane)….no evidence given. Not guilty.

This is not how court is supposed to proceed. The judge is in the wrong on this.
The prosecutor does not need to be present for a judge's ruling, including a motion to dismiss.

The lead prosecutor was not in attendance. The judge had told her that she didn’t need to be there that day and then on the day he told her she didn’t need to be present , he then decided to make a ruling in her absence

The Judge's long-winded, yet incomplete explanation for his determinations demonstrates that this matter required greater wisdom than he alone possessed. Therefore it should be tried by a jury of the defendant's peers. His social and economic and cultural peers. Most judges even if they are good when they start out end up becoming full of pride, and have bigotry and contempt for juries. The Almighty law giver of Creation says that there is wisdom in the counsel of many. This judge should have heeded that advice.. notwithstanding all of this I do not know all of the ins and oats and particulars nor do I know all of the evidence presented thus far. Thus I can only draw my conclusions from what was presented in this video and what I have gone it from the comments of others who appear to have more insight.

At first I was with the lawyer because I thought the judge was allowing the case to happen without the main lawyer but that’s not what’s happening…the case is done and the judge is just giving his decision so tbh the judge was right in telling the prosecution that it ain’t a big deal if someone else takes her place to hear his decision
