63) What can I do while on House Arrest / Community Control? ~ Michael A Haber Miami Lawyer

  • While on CC you can only leave your approved residence to do specific, pre-approved activities like go to work, attend school, medical, legal or court appointments, comply with treatment obligations or perform court ordered community service... In short you can do whatever you have been approved to do, but at all other times you are on virtual lock down inside of your approved house.
    And when I say inside of your house I mean ir literally... inside does not mean at your pool, or in your garden, or at the community gym, or laundry facility, mail room or any other common area. It means that you must be physically inside of your home.
    You need to think of your house as your private jail cell because while on CC you are confined to your approved residence except for one-half (1\2) hour before and after any “approved” escapade.
    Of course you are free to ask the Court for permission to engage in other activities (like going to the gym), but absent either a Court Order or permission from your CCO, anytime that you leave the house you are literally on the clock, and if you have GPS monitoring then you are also on the map. And if you screw up then you can expect to go to jail, directly to jail, you will not collect $200 and you will not be sip a mojito on Boardwalk...
    Before you accept a CC sanction make sure that you are prepared to deal with the realities of home lock down. It sounds easy in theory but in practice it is much harder than you would think.

    We have a girl in our home going on house arrest trying to get ideas for her to stay busy while on it...the only lucky thing for her is she has six other girls to keep her busy so she's not home

    Can a person on community control have friends visit them at home? Been trying to find an answer to this question yet no one ever talks about it.

      Unless there is some form of "No Contact" / "Stay Away" Order or the visitor is a disqualified person (e.g. a convicted felon, someone involved in criminal activity and possible someone who's also serving a community based sanction) then I see no legal barrier to being visited while on home confinement.
      That observed, what I think is likely irrelevant to your PO / CCO and as s/he is effectively "the boss" of you while you're under her / his supervision you'd be wise to assume nothing, ask first and then act accordingly. More particularly stated, if your PO /CCO gives you the thumb's up then great, but you'd be wise to get it confirmed in writing (email will do) to protect yourself down the pike and if your PO /CCO gives you the thumb's down then know that while s/he is "the boss" of you your Judge is the boss of your PO /CCO, and as such you can always have a lawyer file a motion seeking permission for person X, Y or Z to visit. Note also that going to the Judge for clarification or permission is always the safest, least potentially problematic and most certain way to know (not guess or rely on the advise of others, including your PO / CCO).

      House arrest is tough. I advise plenty of clients to do time instead.

    What are ways to get off community control early in Florida?

      The issues of probation (or community control) enforcement, modification, ET and transfer are all 100% discretionary with the Court - that is to say that the Judge is free to say either yes or no without fear of appellate action... it is entirely the Judge's call. Good mood, bad mood, bias, prejudice, sleep, lack of sleep, etc... all of these intangibles can effect the Judge's attitude and ultimate decision.
      Still, if there is an unwritten rule then it is this: ET / conversion will generally NOT be granted until at least 50% of the CC / probationary term has been successfully (without any allegations of violation) served AND all conditions having been completely satisfied. Again, this is not set in stone, but it is a generally reliable guideline.
      The best way for you to hedge your bet and to accomplish your objective is for you to hire yourself a dialed-in criminal defense lawyer who can stitch together a comprehensive and persuasive packet of materials geared toward skewing the ruling in your favor. As with most things in criminal court, your odds are likely to exponentially increase with a skilled and experienced criminal defense lawyer at the helm.

      Hello Gaetano.
      The rules (yes, there are only two) while on house arrest are that (1) you can do anything that your Judge authorizes you to do and (2) you will be violated if you do anything that your Judge has not authorized you to do.
      Sounds simple right? Sadly it's far more difficult for way too many folks.
      The best answer that I can offer is that if you want to "work for yourself on house arrest or a family member" then you should hire a lawyer to prepare a legally sufficient motion, electronically file it, serve it on all relevant parties, calendar it for hearing (with sufficient time for all other parties to respond and appear) and then litigate it. That is the legal process.

      Thank you for your information I did file a motion to judge did Grant me permission to work at the restaurant but the halfway house that I am still on their bop custody because I am out on cares act and are giving me a hard time I sent a letter to the bop and I'm waiting on a response to see if I will be around to work at the restaurant. The letter was sent to be okay by the halfway house

      If it's BOP (as opposed to DOC) then you're in the federal system, and the rules in fed-land are oftentimes whacky.
      Hopefully you'll get this straightened out soon.

      Who ever said it does?
      House arrest as a condition of bond has no necessary bearing on a sentence, although a smart lawyer will argue that if you made house arrest for a period of months then you have proven your ability to follows rules and are more likely to make straight probation as opposed to house arrest as a sentence.
      Still, I find that focusing on sentences before verdicts is counterproductive and foolish; your time is much better spend working on how to beat or mitigate your case.

      The decision as to conditions of a given sentence lie exclusive with the sentencing Judge. As to notice, you are placed on notice the moment that the Judge pronounces the sentence, but your PO / CCO will no doubt re-notice you when you formally register.

      This is a common reaction to house arrest and I routinely warn my clients about precisely what you are feeling.
      As nice as it is to sleep in your bed, to be able to cook or order in what you want, to have company and engage in consensual adult behaviors, it is brutally tough to police yourself, and that is precisely what you must do.
      You cannot go tot he pool, go to the gym or even walk the dog without permission, and when you do have permission it is only to get from point A to point B in an allotted amount of time without deviating from a set path (GPS tells your supervisor precisely where, and when, you are...).
      I have defended house arrest violations for more then one client who thought that it would be okay to go through a fast food drive through on the way to or from work - NOT.... "point A to point B, without the slightest deviation absent express permission).
      As you have not asked a question all that I can say is to remind you that being in jail sucks a whole hell of a lot worse. Think about it this way, at home you get what I described above (to sleep in your bed, to be able to cook or order in what you want, to have company and engage in consensual adult behaviors) and in jail you get, well not that....

Think about it this way, at home you get what I described above (to sleep in your bed, to be able to cook or order in what you want, to have company and engage in consensual adult behaviors) and in jail you get, well, not that....

      Tyvm. Admittedly I am not always as calm and compassionate (in fact most would say that I am usually direct and, er, "colorful"...).
      That said, please note that I agree with your final analysis wholeheartedly. Were I in a position to choose I would take house arrest every day and twice on Sunday over jail.
      I have spent a lot of time in jail and I am 1,000% certain that I do not want to be there 1 minute more than I have to, I do not want to sleep there, go to the bathroom there, eat meals there and, um "socialize" there.
      Call me crazy... but that's me being honest.

      Hello Jasmine.
      Are you referring to me? To you? To someone on House Arrest?
      As to me I could go on my porch if I had one, as to you I have insufficient information to offer an answer and as to someone on House Arrest, "it depends".
      First the Judge get to determine the parameters, literally. Second, whoever installs the equipment should survey the area and advise - with no room for interpretation and absolute specificity, were the individual is permitted to be and where s/he will alert.
      If it works out that the porch is in the "safe space" then so be it and if not then you one can always "ask" the Judge to redefine the parameters by way of preparing and electronically filing a legally sufficient motion, serving it on all relevant parties, calendaring it for hearing (with sufficient time for all other parties to respond and appear) and then litigating it. That is the legal process. (Whether or not the Judge agrees is anyone's guess but whatever the case, porch or not, it seems to me that if the choice is in between being locked in one's home or inside of a jail cell - where there definitely are no porches - then it should be a no brainer.)
