      The idea of squatters rights comes from ancient laws of adverse possession; which actually exist to prevent somebody from digging up a thirty year old claim on your house against a former owner and taking it from you.

      @@joshuahudson2170 Granted. However, the traditional interpretation of squatters rights has been perverted by well meaning, but short-sighted, legislation in recent decades. In some states onus of proving a claim is placed on the property owner. Even after the property owner has won their case in court, the eviction process can take years.

      I’m assuming the new hearing was to solely question the evidence of the woman being served the lawsuit. And it wasn’t a hearing to re-litigate the entire case. I’m not a lawyer but I’m guessing reversing a courts verdict is a completely different set of rules Have you ever seen how hard it is for a innocent person to reverse a criminal conviction even when they have solid proof they didn’t do it. I’d imagine the same kind of nonsense might happen in civil cases but to a lesser degree

      Because regardless of all this the judge ruled in the prisoners favour that's why all this is screwed up because the judge screwed up if you go look back 3 years ago when he 1st screwed up and this was brought to everyone's attention and yes I said 3 years ago.... This is how broken Justice system is

    Really how can a prisoner refuse to go to court. The state has the responsibility to take him to court. You put him in the van and drive him to court. The state is settling up a laws suit on both partys against the state.

      He only has to be forced to appear on criminal charges. This was a civil lawsuit. If he gets charged with fraud for this case then it becomes criminal and he will have to answer that charge.

We live in a country that has ordinances to follow but Judges are allowed to Follow common sense in their decisions... when they fail to follow common sense and act like freaking robots that is when poor judicial decisions are made... law abiding peoples rights get trampled all on.. that is why lawyers and judges are hated so much... their failure to act on merits sometimes and other times to make the most ignorant rulings from the bench that make no damn sense in the world is why the legal profession is full of criminals hiding in suits and Black robes

      Not trying to take attention away from this story but I have another one that's not equal to but is news worth when it comes to wasting tax payers money. So first off you have to be in the correct frame of mind, which is, Wendy (or as Eric Ross says, the dead woman) was my common law wife and the property in question was where we both resided. So this entire story is a lie and that's why it doesn't make sense. If I moved in that home after Wendy's death and stole her car the cops would obviously have arrested me... Then, not being able to arrest me for that, some other charges were trumped up which not only did I not do but I was actually helping the alleged victim. So I'm sitting in jail trying to learn the law to understand how the he'll all this could be happening to me. I requested to use the jails law library and I requested some envelopes so I could write some attorneys asking for help. The lady in charge of those request was Janet King. She refused both my request so I filed several grievances trying to obtain the two items I needed. Evidently she is related to some man of power so no one would go over her head to give me an envelope. Allow me also to remind you using the library would obviously be free, but an envelope would cost approximately less than a dollar. Once my grievances were denied my only option then was to file a complaint to the district court to ask them to make her give me the envelope. Typically to defend a civil action an attorney would charge $10k-$50k. This burden is born to the El Paso County Attorneys Office. I assumed they would see the issue and instantly give me an envelope then case closed we all go home for under $5k. But boy was I wrong... Turns out there was over one hundred filings and then the case after a year ended up in the court of appeals. I'm not sure the cost to draft briefs in the Colorado court of appeals but I'd estimate around $50k. The county attorneys office has managed to rack up at least $75k in tax payers money and after its all said and done guess what happens if they actually do win? Yep, I'm not going to get an envelope. But the case is far from over and they could very well end up blowing another $75k going to federal court after the state level is cashed. Now I'm not the sharpest tool in the shed but if I had the power to determine the proper allocation of tax payer funds how many would have opted to surrender the envelope, shit I might even throw in a stamp for good measure. Now that's a story.

    Squatters are a pain in the UK. You can't get rid of them and they trash your house before they leave. They even have an association here to assist them. Squatters shouldn't have rights.

I refused transport from my safe prison cell to the El Paso County jail because upon intake at the jail at that time staff would confiscate the face mask you brought with you and the jail had an uncontrolled outbreak. I also months prior moved the court to allow me to conduct the hearing via video to circumvent the the aforementioned issues. Further, Wendy was my common law wife and we shared the home I was allegedly squatting in prior to Ms. Clark removing her life support on the first day in the hospital. The Clark's prevented me from coming to the hospital because they knew I'd not allow them to kill her. They took my wife my home and my life. Eric Ross and the Clark's are the dishonest ones.       in USA if a person stays 48+ hours in a house they are a resident and cannot be thrown out without a court order which they can appeal and claim hardship and this can go on for years all they have to do is keep filing and present new information when their appeals run out so they get more appeals

      I remember one case when I was in prison the guard escorted an inmate out the front gate to go to court sheriff deputies were there to take him to court by force that they had to well when he got in the courtroom he was allowed to speak and he told the judge and everybody in the courtroom I'm not supposed to be taking out of prison he said the court order signed by the judge in the Park county says I am to remain there until I am deaf or no longer living and he told the judge from a different district and that's why I'm supposed to be back in prison just like the judge in that case originally ordered the warden to take me to custody I don't want nothing to do with this courtroom I'm not supposed to be here you're breaking another judges court order either now send me back to prison where I'm supposed to be not to be coming here at your beck and call and I thought to myself man that's a real soldier there he's right the judge ordered him to be in prison. The judge was kind of pissed off but what could he do hold them in contempt LOL

      No, they don’t. It’s called a default judgment. They’re entered automatically, usually by a clerk, when the defendant fails to respond to the lawsuit in any way. This is how shady debt collectors run about collecting on bad debt incidentally. The judge didn’t do anything wrong. The judge can’t consider the merits of a case to dismiss it where the defendant never responds. Here there was fraud which has now been uncovered once the defendant learned of the judgment and a hearing has been scheduled. Don’t make assumptions when you don’t know how the judicial process works to begin with.

The fraudulent document was apparently notarised AFTER it was served... The ONLY people not at fault here are the family concerned. they have been BADLY let down by supposed legal professionals.

      Also keep in mind different states have different court systems in place. They work the same basic way but not all are the same process.

      She is actually close to being correct. But the judge can consider the merits in determining the degree of damages which usual come with a default order. And when that degree needs further exam, an additional hearing can be set which even in default the defendant can participate in.

    My martial arts instructor is a former prison guard. I asked him about the whole not wanting to come out of his cell and he said that's BS. He said if they wanted him out of that cell they could get him out with no problem.

    Is the judge his grandpa or something? Who thinks it makes sence even if the documents were legit that the family should pay 400k to him for hurting his feelings?     Refusing to leave prison? How is it possible he has any say in the matter. Drag him there, he is in custody of the prison. If there is actually some law that allows this then have the trial in absentia, without him there. The same exact way the trial went on against the Clark family that resulted in a default judgement against them for $400K. They need to get a judge that has a brain to hear the case. This is Outrageous.

      @@TheRockinDonkey I didn't file any fraudulent documents sir. A party to a suit can't serve process. It is still unknown to me if the server I hired followed the rules or not. But I do know when the defendant claimed she was unaware of the suit until she was in default was another dishonest statement. I am the one that updated her address to the court early in the proceedings so she was mailed and made aware of every action taking place in the suit then decided to protest once judgment was entered. As for your disrespectful attitude all I can say is grow up. Anything else?

    The judge needs to have more training on spotting fake/suspicious documents or have his law license temporarily suspended and also charges should be brought against the criminals for submitting fake documents and committing perjury in court.

    any documents coming out of jail should be checked by a lawyer for the inmate or a public defender, once they in jail its for punishment not a vacation...

      They have to be in court to be charged. What they need to do is add one more day in prison to their sentence until they show up in court for the contempt charge.

      Maybe because the whole thing has become so confusing... I mean I tried every way from Sunday to get the defendants properly served and thats well shown in the record. I do realize it looks like the two prison men conspired to misrepresent the proof of service but in reality thats not the case. If I wanted to obtain default judgement against someone I would not take any measure to make sure the defendant's are aware of the action. In short, it was soley me that located and provided the court with the defendant's address. And notice she says "did not know about the suit until mail came". Well that mail was from my doing, and I did that because I wholeheartedly thought the prisoner properly served the suit. The courts are supposed to assist prisoners in effecting service but I could never get any assistance from El Paso's 4th JD so I started paying inmates to serve papers. All the papers in all the other cases were properly served by the inmates. But this suit came from a criminal assault which the Clarks plead guilty to so the civil case was going to be an extremely easy win, the only way out of it was to make up all these service of process issues... SO I hope that answers your question.

      Technically they are suppose to drag them out of the cell if they do not obey a lawful order. That to me would be a crime in itself and would be in favor of the family. Also, the judge should be forced out of his position, and there should be an investigation into El Paso Courts. It sounds like someone on the inside is working with this crook.

    Its there to protect people but people take advantage. If you were living somewhere and that person without notice just kicked you out even though you had paid rent. They can't call the police to throw you out bc the police don't know the situation. Thats why you go to court where they can figure it out. It protects people from being thrown out on the street. It also hurts owners though and that should be looked at. My family rents out houses and they've had to take many people to court to get them out. The problem is when they make up shit and refuse to leave after 30 days.

    A lot of these aren't really squatters, they're fraudsters. Squatters rights take decades to develop. Most of these claims are based on fraudulent leases or deeds, which is a different thing.

You cannot refuse to go to court, the deputies or SRT would literally rip you out of your cell, hogtie you, and drag you to court.
