    Anytime an arrest turns out to be false, it should be expunged from the records when it is shown to be false.

      I’ll go you one further. Unless CONVICTED it shouldn’t be on your record.
      I had a student in a class for a license that you have to report any convictions for a felony, EVER. So the student was arrested and convicted of a felony but ultimately his conviction was overturned.
      He still has to answer “yes” to “have you ever been convicted of a felony” when ultimately he was acquitted.
      Totally bogus.

      No need to imagine. There are tons of videos here on YT for victims to whom this has happened.
      Mr Elias in this case is a pilot. He may well have lost his job just because he was falsely arrested even if he blew all Zeros.
      This is the USA showing the rest of the world how citizens and residents are truly treated. Almost like a police state already.

      In Canada, I was falsely arrested and after my charges were dropped, as far as I know, it's off my record. I did a vulnerable sector's check for a job (a criminal check plus more) afterwards, and it came back clean, so it must not be on my record. How is it fair that it remains on your records? That means that even though you're not convicted, just having an ACCUSATION against you can be used against you. That's so WRONG.

    I'm a nurse. If I were arrested for any reason, I would have to report that for the rest of my career for employment and licensing, even if the charges were dropped, or even if no charges were filed. False arrests ruin lives.

      Until you got the arrest expunged from your record. Any damages encountered from the false arrest would likely be handled through a civil rights lawsuit.

    What happened to the office statement that he smelt a strong odor of alcohol. Then after that statement by the officer, the alleged offender blows 0.000. so what happened to the strong odor of alcohol if there was actually legally no alcohol present in this alleged defenders system. Was the officer actually smelling his own breath?

    I was arrested for DUI and in court the first image on the cops dash cam while he was pulling up was me sitting in the passenger seat of another car. I also blew .000 and was still arrested. Taken to jail. Was taken by force to have blood test and was denied access to the results. It’s getting ridiculous. I think if a cop falsely arrests someone for DUI/DWI they should be responsible for all the court cost and fines.

      I know gangsters are bad but at least innocent people who are victims of gangsters would not be stigmatized for life like criminals after being victimized by gangsters, but innocent people falsely accused and falsely arrested for DUI by gangster-like cops have their lives ruined or stigmatized for life even after the charges were dropped. Worse still, the gangster-like cops face no punishment at all most of the time as their superiors ganged up with them to scam money from the city as extra funding for their false good work against DUI. Those cops who falsely accuse people of DUI or other violations are criminals who should be put in jail. The fact that any of those gangster-like cops can keep their jobs and face no jail time at all for trying to scam money from the city while ruining innocent people's lives is a travesty of justice and a justified reason why many law-abiding citizens do not trust cops.

      Crooked state and city politicians need cops who are ruthless and unconscionable to the people being subjugated while being absolutely obedient to the crooked politicians controlling them in order to stay in power.
      As long as the crooked politicians who need absolutely obedient cops to help them to stay in power, they would turn a blind eye to the bad cops oppressing the people under the false color of law enforcement.
      Therefore, police reform is not possible when crooked state and city officials are in control.
      Vote crooked state and city officials who are apathetic towards victims of police brutality and police corruption out of office is the first step towards police reform.

    I had almost the same thing happen to me 5 years ago. A stare trooper stopped me on the highway, and the trooper asked me to do roadside test. I told him my balance was affected by two surgeries, and the cop called me a liar, handcuffed me, and had my car towed. We went to a police station and I blew 00 and the trooper took me for a blood test. It came back clean. The the trooper told me I could not drive for 8 hours. I told him to screw off and I was going to get my car. Once I got my car for 200 bucks the trooper was waiting for me and stopped me again. Another trooper came and told me I was driving after being told not to drive. He said it was policy to do that. I told him a policy is not a law. The second trooper finally told the 1st trooper he had to let me go. The last thing a said to them was at least I kept them from violating anyone's else's rights for 5 hours. They were passed. I did a formal complaint, but it was a waste of time because the police check the police with no outside review. What a joke.

    My dad was a police officer and later of detective Sergeant for 31 years.
    When he was retiring I asked him why? His answer was " son when I got on the police force I wanted to make the town safer, the police force Now isn't about putting bad guys in jail (rapist burglars, child molesters and murderers)
    It's now about creating Revenue from the working class and filling traffic court rooms".

      The car was parked in a parking lot a taxi was called and the driver was instructed that if the car moved by the end of his shift at 7 a.m. he/she was going to jail.

      Did anyone ever think of pursuing charges against the cops themselves? Process of elimination after all if there is only the cop and the victim, there is a strong smell of alcohol, and the victim is proven to not be the source of it. That leaves only the cop as the potential source of the alcohol then doesn't it?

      Alcohol has no smell. Now beer or other drinks could have a smell. So exactly what does a cop smell? Also it is not unlawful to have a drink or two and drive. A certain amount according to your weight is lawful. Therefore the accusation and arrest for alcohol on the breath is bogus.

    If there was a court date and the judge didn't drop the charges completely with the court's deepest apologies to where his job as a pilot is still in jeopardy when he blew zeros twice and the forced blood test was negative of EVERYTHING, then I would say he/she needs to be removed from the bench and never be a judge ANYWHERE ever again.

    HEADS UP! The THC DUI law in Pennsylvania needs to be fixed. You can get a DUI in PA for having THC in your blood even if you are not actively intoxicated, have a STATE ISSUED medical card and haven’t used your MEDICATION in a week. If you refuse blood test automatic DUI. It’s policing for a profit‬. This ruined my life

Say you were high on drugs you wouldn't want the police to investigate the source and finances of.     I’ve been falsely and unlawfully arrested twice for DWI, one went to trial and was acquitted the other was dismissed after they saw I was fighting!

      I was arrested while walking across a street and the sheriff deputy tried to charge me with a DUI. I saw him typing it into the computer as we drove. He took me to jail and told the intake it was a DUI. They kept trying to get me to take a breathalyzer. I refused and kept insisting the cop was lieing and finally they put me back in the car with HIM and didn’t tell me where I was going. He drove around go awhile and finally took me to a hospital, walked me through the security in handcuffs, didn’t say a word the whole time and then set me in a chair, un cuffed me, and left. Then he comes back and leaves me wirh two tickets for resisting arrest and disorderly conduct. Never said a word. He knew he completely fucked up. Security guards said they had never seen anything like that. I wonder how many people he’s done they same thing too that didn’t put up the fight I did and got false charges.

    "he's now resigned and gone to another police department" is the biggest problem with law enforcement in America. It's literally a rotating doorway for corruption, because any time someone gets caught doing these things or violating civil rights or making false arrests or even shooting and killing people, they just 1) go on paid leave, 2) resign, and 3) relocate to the next county over.

      in many cases it could merely be a training/ignorance issue. perhaps a little less severe on the first instance.
      THE KEY IS TRAINING AND ATTITUDE. Watch the audit videos... how many cops think filming in public might be a crime. They aren't taught the constitution; that's obvious. And I kinda wonder if they read it once before they swear the oath to support it as NUMBER ONE DUTY.

    The officer claimed he smelled An Odor of alcohol coming out of the car.That didn't work No alcohol was found in his Breathalyzer. Officer decided to lie and say the driver's eyes are glassy Assuming hes on drugs. Once cops start paying out of their paycheck for their own acriminal act And getting prosecuted And jailed . then they will respect people's rights.

    There was a POS officer in Corvallis Oregon writing false DUI. Got all kinds of promotions and awards. However, he tried it on an older adult rather then a college student. He no longer has a badge thank goodness

      There was one in Florida pulling over people saying it was a DUI stop, asking to search and then planting drugs. It took years to figure out but he finally got fired and charged I think. Crazy.

      Not necessarily out of his jurisdiction. Joint task force members have much wider jurisdictions and depending on your local state laws and local ordinances sworn certified LEOs can have jurisdiction in the whole state, entire county, judicial circuit etc…. Then there are memorandums of upstanding or cooperation an officer can respond or patrol a “jusrisdiction not normally part of his departments territory.

    My brother was banned from driving in England when his blood test showed he was way under the limit. He lost his job and things went further down hill. He could not afford a solicitor. I found out judges in England try and go along with police if they can and ignore 'irrelavent details like that, even if a barrister tries to correct them in court.

      Then no one can take the job. There are other options that should be taken. But end of the day they are fucking up a job and as long as no one died and it is a tort level inconvenience (ie you are out time and money but NOTHING ELSE) then other options are possible.     Just saw his case settled for 400k. Something I also found out was a year latter he was pulled over at a town close by ( they probably saw his arrest when the ran his tags) . Arrested for a DUI and again blew a 000. Was told he couldn't drive with his kids in the car pending the outcome, monitored etc. Another investigation by FAA. I believe it cost him his job.

    A good friend of my Father almost died in the back of a Police car. They didn't bother to check his wrist medical alert tag and he almost died of Diabetic shock because they thought he was drunk. He was staggering down the sidewalk trying to get home a half a block away. They should give these idiots IQ tests before hiring them.

      Taylor, Michigan a few years back, 2 cops beat a guy for not responding to them. He was sitting at a light. Turns out he was slipping into a diabetic coma, EMS recognized He was in diabetic shock right away and saved his life. Don't know what awards the Taylor cops got for beating a middle aged guy going into a diabetic coma but they damn sure could've killed him.

      Taya here! I completely agree with you. And the patience and politeness that he displayed I think was absolutely amazing. He was held against his will for almost 4 hours forced to take 2 Breathalyzer tests and a blood test I have to say I don't know if I would have maintained my politeness and calm demeanor as well as he did.

      I’ve seen this video before.
      At what point will organizations like this, the institute for justice, and many other join forces to make more noise?
      A 30 second commercial highlighting these videos will reach far more people ignorant of these issues.
      My mother for the longest time until I started showing her videos like these was like the marine who was robbed by LE. She believed if you do nothing wrong they are the “good guys”, and you talk to them like friends.

Heck, cops should not get awards. the MADD money could go into better breathalyzers, or DUI awareness. but incentivizing DUI arrest even if they are none is going to perpetuate the issue

      I've been saying this for years. Incentivizing incarceration, driving up bodies to prison cells, all connected. Follow the money, how can we allow this in our country? Mainly because it disproportionately affects minorities so many blame the victims instead of policing which is a damn shame. Empathy rarely happens unless it happens more to individuals with more voting power.

    When the cop said he smelled an overwhelming odor of alcohol, then the breathalyzer and blood test came back negative, he should've been deemed incompetent to do any more traffic stops whatsoever.. the treachery of the systems that allows these kinda things to continue happening knows no bounds.. it's an egregious abuse of people's constitutional rights and liberties and completely unacceptable.. it really seems that an utter lack of integrity, honor and morality must be the requirements to become an officer..

      The issue with saying you smell the odor of alcohol, is that alcohol doesn’t have a smell per se. I worked as an EMT for over 12 years, and in my reports I NEVER stated I smelled alcohol, I would report “a smell consistent with having consumed an alcoholic beverage”.
      I’ve dealt with intoxicated persons on the ambulance many times, but never once said I smelled alcohol.
      But yeah ethyl alcohol has NO odor. You cannot actually SMELL alcohol on someone or coming from the vehicle. You can smell an odor consistent with an alcoholic beverage due to the other ingredients in the drink.
      So this innocent man here could have put up a defense of that right away on scene. There are MANY good officers out there that do their jobs professionally and I’ve known and worked along side lots of them, but there are some, like this one that erode trust in all law enforcement, even the good ones.

Now if he wrote it on a sworn statement as part of the arrest report, then there would be an offense that could be prosecuted. But what are the odds of a prosecutor taking that case to court? Zero.

    The saddest part is that this will forever be on his record! The lawsuit should push for absolute removal of this from his record. It is not enough to show case was dismissed/dropped. There should never be a permanent mark on someone's record for wrongful arrest! Never acceptable.

      YUP. Like how I was arrested for rape.... The DNA wasn't even the same race. It was the girl's BF!!! She was just afraid to tell her parents she had sex with him. So, she decided my LIFE didn't matter, and said I raped her, to get out of trouble.... GOD BLESS DNA! Cause my DNA wasn't on the condom they found in her trash.
      She didn't care how hard I had worked to move thousands of miles away, on my own, without my parent's help. Nor that I went to night and day school to graduate early. NO NO. She cared more about not getting in trouble with her parents. OH, and I was on SOMA, and OXYCONTIN at the time of said "rape" I wasn't aroused at all. I was recovering from a painful accident.

    I experienced something like this in Greenville Tennessee. I was accused and arrested for suspicion of being under the influence but I wasn't. Had to take a blood test and wait for the results to come back and then the charges was dropped. The Trooper that pulled me over was unprofessional and disrespectful

      I live in Morristown, not far from Greenville,Tennessee. I’ve had a couple of people tell me that very same thing about the state troopers through there. They did a woman that I used to work with the same way with the false DUI. The other guy I talked to said it was profiling. Pulled him over at night for no reason or no probable cause and harassing him on the side of the road before finally letting him go. It was all because of his older model car at the time.

      They actually had to close down a police station in a small town in Alabama for this very reason. They messed around and pulled over the wrong person they pulled over a pastor and accuse him of all kind of things when they finally went to court they had to close the entire police station and they found that the police station had so much money they had a tank what town that only has 1000 people in the city limits needs a tank they found police chiefs with summer homes with boats it was ridiculous they had to go back and release all the people they arrested dropped all the charges which was something that should’ve never Happened in the first place. So this is definitely a trend this is not something that is just being ear marked at certain police stations this is nationwide

      I was arrested for suspicion of dui in Greeneville, Tn. 3 weeks ago, Greeneville city PD arrested me at 10:30 at night on US11E, he said i was driving erratically, weaving and speeding. When he walked up to my door i already had it down and he said How you doing tonight? I said i was doing great, until now. He says the usual, license, registration and insurance, i already had it in hand and gave it to him, he goes back to his cruiser. Comes back a few minutes later, telks me he can smell the odor of alcohol, how much have i had to drink? I said I havent had a drink in almost 6 years because i have an auto immune disease that is destroying my liver, and literally cant drink without getting deathly sick. He says i need to step out of the vehicle, then wants me to do a field sobriety test , i said just give me a breathalyzer, he says i dont have one with me id have to take you to the hospital, i said what about my dogs because i had them with me, he tells me he has already called animal control, they were on the way to get them. I said, so you telling me youve already decided you are arresting me for dui, and have an snimal control officer coming for my pets, with absolutely no evidence whatsoever that im intoxicated. He said i know your on something, it may not be alcohol but no matter what it is your intoxicated and yes im arresting you for dui, by this time there are 4 other cops there and arrest me he does. He pulls up in the Sally port at the jail and gets me out, we go in to the booking desk. A female jailer says what did he arrest you for, i said dui, she looks at me funny, and says something very interesting. YOU DONT SEEM DRUNK TO ME. Yep, you read that right, i said young lady, you should be the police cheif around here, because it appears some of the patrolman are not really clear on what a drunk looks like. Anyway, when yhey are processing me, i said i need to get a phone number off my phone so i can call for my daughter to come bail me out, they tell me the cop did not turn in a phone with my belongings which is funny because i sat and watched him trying to unlock my phone in his cruiser for 5 minutes after he cuffed and stuffed me, he demanded that I give him the password to unlock it but i refused , he threatened me with obstruction, blah blah blah i said go fuck yourself, yada yada yada. So i told them fine ill just call one of the bail bondsman you have on the wall they said ok but it will be a while before I can do that, but guess what. I never got my phone call, they held me for 5 days before i went to a video appearance before the judge, when he saw i had been in jail for 5 days he says i guess you need a court appointed lawyer, i tell him no your honor i can afford one in fact i have an attorney, but i havent been able to call hom or a bondsman or anything, TIME STOPS FOR ABOUT 30 SECONDS, the judge said, are you telling me you have been in jail for 5 days, since Friday night and you were never allowed to make a phone call ? I said YES YOUR HONOR, THATS EXACTLY WHAT IM TELLING YOU. The judge tells the jail balliff that brought us to the video hearing to take me back to my seat snd bring up the next prisoner. He does, i sit there for about another hour and a half until all the prisoners have had their appearance, then i go and sit in the video spot again, the judge starts reaming out the DA, tells him to get the arresting officer to the courthouse now, yesterday wont be fast enough. He was pissed, they get the cop there, and then the judge started asking me a lot of questions, the arresting officer starts to interupt me to orevent me from answering, the judge tells him, YOU SIT DOWN AND DONT SPEAK UNTIL I TELL YOU TOO! I CONTINUE TELLING THE JUDGE THAT I ASKED FOR A BREATHALYZER, THAT HAVE AN AUTO IMMUNE DISEASE AND MY DRs NAME SO HE CAN VERIFY THAT, WHICH HE ORDERS THE DA TO DO, I THEN TELL HIM THAT THE COP HAS MY PHONE, HE TOLD THAT COP, OK NOW, AFTER I ASK THIS QUESTION YOU CAN SPEAK, DO YOU HAVE THIS MANS TELEPHONE IN YOUR POSSESSION? THE COP KIND OF WEASEL LIKE SAYS, YES YOUR HONOR, I MUST
      HAVE DROPPED IT IN MY CRUISER WHEN I WAS TRANSPORTING HIM TO THE JAIL, I SAID YOUR HONOR CAN I ADD SOME INFORMATION TO THAT? HE SAYS I CAN, WHEN I TELL HIM THE COP WAS TRYING TO UNLOCK MY PHONE AND DEMANDED THAT I GIVE HIM THE PASSWORD THEN THREATENED ME WITH OBSTRUCTION BECAUSE I WOULDNT, THE JUDGE WENT FUCKING BALISTIC, HE TOLD THE BALIFF TO TAKE ME TO PROCESS ME FOR RELEASE, AND AS I WAS WALKING OUT OF THE ROOM HE TOLD THE COP, OFFICER, DONT SAY ANYTHING ELSE, IM ADVISING YOU TO GET YOURSELF A LAWYER BECAUSE YOU AND I HAVE A SERIOUS PROBLEM. SO I HAVENT HEARD ANYTHING YET BUT I GOT A LETTER FROM THE DAs OFFICE TELLING ME ABOUT MY COURT DATE, ILL KEEP YOU UP TO DATE AS I KNOW MYSELF.

    Back in college, me and my ex would do our laundry at a 24 hour laundromat, and usually clean my car while we waited.
    Cops pulled us over after leaving one night around 1am, and claimed our car smelled like alcohol.
    It was lysol.
    They also sat and watched us the last 20 or so minutes we folded and got ready to leave the laundromat, from across the road.
    Their only reason to pull us over was "because its late".
    Wed see them all the time outside watching the laundromat, and just assumed tbey were doing it to keep it safe. Nope. They were being lazy and trying to profile students as junkies and alcoholics. Because what other reason does someone go out at 1am?

And about the income on arrests, just recently it was on our RSA radio station about a town in America that had made SO much money that.       DUI isn't just alcohol, it's also narcotics, medicines or sleep deprivation. That last one would have cleared up the moment you were stopped due to adrenaline and thus very hard to prove unless driving alongside the car for a bit, but any chemicals would have shown up on the blood test.

Holding doors for me and letting me go for minor infractions. However my family has received plenty of abuse from cops and they used every classic line: "wanna go to jail?"

    I was falsely arrested in Henry County Alabama, cost $335 to bond out and another $300 to get my vehicle out, the trooper didn't have probable cause to stop me so he made up interfearing and resisting, led violation and no d.l.,
    At my fake trial judge Peterson said his opinion is that i violated a light violation that the trooper used to stop me, he sent me to jail 12 months interfearing 6 months resisting and i went straight to jail, my bondsman filed an appeal for me and got me out of jail, i still have a jury trial coming, will be 2yrs since the stop in october. I have spent $3,000 on an attorney, missed 5 days from work over this, the police care less what they cost you, they don't care if you are fired over them false arresting you, no public servant gives a crap for the people that pays their salaries, its all a money making system for public servants.

      That's our anti-justice system at work. A cop murders someone, gets paid vacation, a free lawyer (an actual lawyer, not a pretender) and a slap on the wrist.
      Sorry that this happened to you. I've also had some horror stories. It seems almost inevitable these days.

    This happened to me in Fayette Co., Tennessee. Turns out that the word is that the prosecutor's office gets grant/money from the state according to the number of D.U.I convictions. I couldn't afford an attorney that could have (relatively) easily get it thrown out or found not guilty. It happened September 2020 and I was forced to plead guilty. Attorney fee:$750. Civil fines:$1000, probation fees monthly for a year, restricted license fee, intoxilock requirements $45 every 2 weeks, sr22 insurance expenses, license reinstatement fee, and when i sold my vehicle and no longer had a vehicle they revoked my license again for failure to maintain sr22. I still have no valid license today and I don't forsee it possible in the near future.

      Happen to me in hawkins county. Failed physical roadside tests because of my disability which I told cop of, blood draw came back with small amount of prescription medication. Result im on probation for about the next 3 years. Fuck these jokers

    An alderman in my city was arrested for dui after a cop called in a tip about the man walking out of a bar in a drunken state. After passing all of the physical tests, the alderman asked the cop if he sounded drunk. The cop admitted that he did not slur any words. Dude tested at .04%, but state court said cop was right for putting him under arrest--solely based on the original tip.

    Officer Gates needs to be arrested and put in jail, or given some 'true justice' by somebody to stop him doing it again and to protect the public. Such a shame that so many USA police officers are corrupt, but it is the same here in the UK as well.

      I know our police force is far, far from perfect, but its nowhere near as bad as america. You get pulled over here for drunk driving, you'll get tested there an then, and if its a low or zero score, you'll be on your way straight away.

      Right. It's called defuding the police. Contrary to popular belief? It means to stop incentiving police. The police in your municipality is federally funded and property taxes funded. Which means they'll most likely to funded, however when they seizure property, money, or assets? 90% goes back to there department, which is a surplus on top off all there funding. Now what do you think are they doing with this surplus money for legal, or illegal seizure surplus money? I'll give you a hint; militarization.

    I am an aircraft mechanic and we face similar scrutiny. However, if the FAA was allowed to come into any facility and declare all of us out of regulations, while we're in regulations... well, you would'nt be able to fly anywhere.

    We had this happen to one of our employees. She was closing up the bar after a long shift and was pulled over. The police officer said she was speeding and said her eyes were red. She passed the field sobriety test and blew 0.00. Then they took her in for a blood test. She passed that too, but they still had me come pick her up since her license was suspended while this was all sorted out. They had her take an additional blood test which also came back negative. It took 5 weeks to get everything dropped and sorted out. I called the Lieutenant and tried my best to help her in this situation. Once the officer had a "hunch" and thought she had committed an OWI, there was no turning back or any kind of further analysis. Guilty till proven innocent.

    As someone who has gone thru the misery of getting a legitimate DUI, makes me sick thinking someone who did nothing wrong going through that horrible process. Losing your license is huge and can have devastating effects on your ability to do so much. They hold us accountable for what we do but that accountability needs to go in their direction when policy is abused and lives get ruined.

      I have PTSD from the cops that harassed me for five years while the husband (dentist) and I divorced was petrified of being arrested again. He was very creative with his lies. So yes I feel bad for you to have been subjected to cop abuse, I hope someday for you to come to peace with the memories. 😢😢😢 It took many years to be at peace with the situation.       I was taken to jail one night because the police officer said that he thought I was trying to steal a car. I’m sitting in the passenger side seat dome light on radio playing keys in the ignition yeah I was really trying to steal the car
