    The daughter is right. Even without the bragging , it's in extremely poor taste to have a celebration party in a case where someone died. Reprehensible. Another notch in the bad image of lawyers,

      For me, this behaviour was egregiously unethical, and I hope Mr. McKenna gets some form of punishment for it. I wish he gets disbarred for that, but that ain't happening. I get if an attorney celebrates with a client e.g. if they get a guilty verdict for a crime he didn't commit overturned, but not if you lie youself to a victory in a civil suit for what was basically negligent homicide.

      Imagine being the Doctor and the CEO being sued and about to lose everything from this million dollar lawsuit. Their lawyer handled that victory in very poor taste. There is no win/lose in a situation like this, kudos the human who recorded this video.

    Imagine laughing and admitting that yes the doctor killed your dad, all the evidence points to it, the corner report states the same thing but we said no it's not and those fools in the jury bought it. And then posting it on their social media page. The attorney is lucky the victim's family are good people somebody else might took revenge on him personally. It wouldn't be the first time that has happened.

      Both sides got to argue at the trial and the jury was free to believe either side. The other attorneys should have done a better job if they had a case that was as easy as it's being made out to have been.

      @@Karamarika You’re not wrong, as that is how the American “justice” “system” works - however, you’ve gotta admit it’s *really* bizarre once you start digging in to it. It’s unlike anything I expected, and I think many just presume it’s the greatest legal system in the world, when it’s actually far from that. It’s quite f’d up tbh.

      @@fang_uk well, this is civil court, not criminal, so they aren't getting "justice." It's for damages. So they have to prove that the doctor was negligent and that there were damages as a result. I'm not sure which part of the system you have issue with or what you think would be better. I think it's fair that two sides get to argue their case and a group of people make the decision. The biggest problem in any jury trial (civil or criminal) is the jury not having any background knowledge and believing something that they really shouldn't. But the only way to remove that would be to have a panel of experts. However, that would be extremely complicated and difficult to pull off and, depending on how it's done, rife for corruption.
      So what is a good alternative?

      The report says that they posted this video on the law firm’s social media page. The person who recorded it was paid to record it by this slimy lawyer, who then posted it on the firm’s page. It wasn’t done by some rogue hero employee fighting for justice.

      His mouth got his client off then his mouth got his client facing retrial. This bragger attorney will most likely face no disciplinary action. Unless the doctor can file a claim against the attorney, hopefully the Barr in his state will sanction this attorney. Attorneys are a necessary evil.

      I'd be interested to know if the video would be allowed at all. There's also the possible issue of recording without permission. Could the video be thrown out if the videographer was recording and releasing the video without permission to do such. Also if the video is not admissible, could we have a case of the jury being so tainted that the defendant can't have a reasonably fair trial?

      Lawyers can not provide testimony. Lawyers are held to a higher expectations. Expect a complaint be filed, and follow up. None of that is dealt with in the trial.

      Lawyers do expect to tell the truth. He/she cannot bend the facts to say "orange means apple", he/she can only say that "orange has similar size to an apple". So that's the difference. Whereas this lawyer essentially warped reality to such a fashion that there was no medical malpractice - which there were. But it is not entirely this lawyer's fault, as the opposite side's lawyer also didn't do his job well to fight for his client to say there was malpractice.

      I think it *is* actually illegal for a lawyer to lie, or encourage his client to lie. they can omit, distort, and twist, but I'm pretty sure actually lying is at least an ethics violation. Never seen any evidence that that is particularly well enforced, though.

      According to another news article; their mother/his wife had just passed away a month prior to Him going to the Hospital; and he went in a severe bout of depression and drinking, and had alchohol-related pancreatitis. I had idiopathic pancreatitis as a teenager and I don't wish it on anyone; it was one of the most excruciating things experienced.

      A ~quarter of a million die a year from malpractice.

      Yeah but supporting your client doesn't mean getting them off if you know their guilty it means making sure they have a fair trial. If you're a defense attorney for a murderer you shouldn't be trying to get them off/released if there is undisputable proof they murdered someone. It's really crazy that they got to the point where they got their guilty client off illegally and then saw so little problem with it they recorded themselves admitting to the crime and then posted it...

      @@Shyknit lol that's not how the law works. If you have a client that is obviously guilty you can advice them to plead as such but if they maintain their innocence it is your duty as their lawyer to do everything you can within legal and ethical bounds to advocate for that position.

    One of the things I learned when I took Rhetoric in college is that if you can't win with the facts, make the other side the villain and win by emotion. That's exactly what this attorney did. He made the victim out to be the villain and the person who screwed up out the be a saint. Never believe any attorney who isn't presenting facts but trying to blame the other person unless it is criminal court.

    Are people that surprised to see the dark underbelly of being a lawyer? You get paid to win your side of the case. I'm sure after a while, you get numb to the day to day details. It's all just another case.
    I imagine people in grimmer professions often develop darker senses of humor and/or make comments that would make the general public uncomfortable. I'm sure you'll hear plenty of offbeat/dark jokes and stories at a funeral director's convention for example.

      Unless there was some kind of blatant negligence involved, your reaction is entirely unreasonable. Accidents happen, and perhaps he should have his license revoked, or pay a fine, but a doctor should not go to prison for making an honest mistake.
      Just think what that threat would do to the field of medicine! Doctors are already struggling with huge costs for malpractice insurance, but with your plan, they would start refusing treatment for fear of being imprisoned.

    I’ve never heard of or seen lawyers ringing bells or bragging like this after a verdict in a malpractice suit....glad the verdict was thrown out and there will be a new trial.

      this happeneds alot more than you expect. my Brother is a defense attorney and he told me he once celebrate getting 15 years taken off of a murderers sentence. that case got his paid alot. if money can't buy you freedom there's a chance you can buy it here in America

    as a law student, i have been taught from day one you don’t celebrate when you win a case, because even if YOU got out great it doesn’t mean the other party has. celebrating someone’s loss shows more about how you are than them, you can always bet the people who are loud when they win are major sore losers when they don’t

    Many cases have an outcome that has absolutely nothing to do with truth of facts, but who has a more convincing attorney, or bias of jury.
    Innocent or guilty, the doctor has a good “malpractice” case against the former attorney.
    If the doctor loses at the second trial, it’s possible that the previous attorney might ultimately be the one paying out the judgment in the long run.

    That’s why you should always get a second opinion when dealing with them.
    That being they’re all butt buddies in that court house, don’t expect them to go out of there way “Help” you the best they can.

    If I am with the family, I would hire new lawyers. Those 3 are probably very bad lawyers to get a unanimous vote from the jury. This is another chance to get justice for your father, dont waste it by hiring the same lawyers

    Absolutely disgusting behavior from the defense attorney. There's a difference between doing everything you can to try and help a client, and doing everything you can to discredit the opposition. Hopefully the Doctor's new attorney will be more responsible in their defense instead of just misrepresent the accusations, and if the doctor was responsible for the father's death, there should be a full investigation into why things happened as they did.

    Trial lawyers are one of the lowest life forms out there. We do need to adjust the laws to make it illegal for any attorney to propagate theories he knows are false or make knowingly false representations.......he can present true facts that cast the accusations against his client in doubt, but that's it.

    As someone who suffers from medical malpractice everyday this is terrible. People pls be careful going to the doctor try to take good care of yourself and look for natural remedies. It's rare to get messed up on the civilian side but it can still happen to you and I don't wish this suffering on anybody!!! Take care!!

      I worked at a veterans hospital and saw the most horrific post operative complications that occurred from surgeries that were considered simpleand routine. "Nicked" bowels during textbook outpatient laparoscopic hernia repair that led to sepsis, 9 and counting months of having to be in the hospital, multiple other surgeries, a colostomy, and wounds that took over a year to heal. That was just one patient who happened to tell me his story. There was the the veteran who worked at the hospital and was allegedly rendered a quadriplegic on a ventilator who required around the clock 24/7 nursing care due to complications from his surgery. The patient who allegedly had a post op bowel obstruction, was literally vomiting diarrhea because the passage to his 'other' normal fecal exit was blocked. He ultimately ended up dying because his night nurse didn't recognize the severity of the situation. The stories are endless. I quit that very high paying Federal job with extraordinary benefits and retirement because I couldn't continue to see (alleged) outcomes like that and helplessly watch unnecessary suffering.

    GUILTY if I was on jury after the 1st statement "we kinda made it look like ..." ....HOW DID THESE ASSOCIATEs PASS ETHICS? how did he pass ethics? Everything he said says doc was neg but we said the right shit and won....SO FUCKING STUPID AND I HOPE THEY LOSE LIC BUT if i was one of those that worked there, i would be looking fast for another job with an ethical firm.

    Lawyers can’t magically “have” verdicts overruled. There has to be legitimate legal reasoning underpinning the decision. It’s not a carnival game. He was successful for his client, whom the *legal adjudicator* decided had a *valid, legal* way to avoid HUGE liability. It’s not his problem if you don’t like the law or the result. My client and I would definitely celebrate such a success. Why wouldn’t we? We just saved hundreds of thousands of dollars and professional liability for something we’re not legally responsible for. According to the decider of legal things. This is why we don’t have “law by public opinion”. 🙄 Tragic outcomes don’t change legal liability. Or we’d have no doctors at all.

      @@bobroberts2371 This has been proven to be not true. Texas severely limited the awards in lawsuits. It made no difference at all in the cost of Healthcare in Texas and cost rose at the same pace as states that didn't place limits. Fun fact, Abbott the current governor of Texas championed the law for tort reform, of course that was after he himself won millions in damages in his own lawsuit.
