      Prosecution had so many names and relationships I needed a visual aid to follow. It was difficult. I found the defense to be easy to follow and poke holes in prosecution successfully.lets see if the evidence supports it.

      @@annm9589 Yes, the defense gave a clear picture of what the Jury needs to keep in mind while the prosecution probably just left the jury struggling to understand a whole bunch of witnesses' names.

    Officer O'keefe's mom mouthing along with the attorney when he repeats 'Nope' breaks my heart. She absolutely knows that the PD did the absolute worst to find out what happened.

    Haven't finished watching yet, but even 5 minutes into the defense's opening, they are CRUSHING the prosecution in terms of effectiveness. This is going to be a wild one.

      Apologies for the length, but I had to rewrite the prosecution’s opening statement… Ladies and gentlemen of the jury, the Commonwealth intends to prove to you without a shadow of a doubt that Karen Read intentionally caused the death of John O’Keefe by striking him with her vehicle in the late night or early morning hours of January 28th or 29th, 2022 and leaving him to die in the snow.
      The motive for her actions is what could best be described as a scorned lover exacting revenge, as she had recently caught him in the act of cheating on her mere hours/ days (unsure of timeline?) before his death with another woman they were both very close to. This was akin to ultimate betrayal in her eyes which ignited vengeance in her mind.
      You will hear testimony from multiple witnesses, including family and friends of both the defendant and the victim, as well as read text messages between the defendant and victim, that clearly illustrate the extreme level of anger the Ms. Read was exhibiting towards Mr. O’Keefe. You will also hear from witness that undeniably and wholeheartedly refute the defense’s primary argument for innocence by testifying that Mr. O’Keefe NEVER entered the home that evening once he and the defendant arrived back home after a long night of barhopping and excessive drinking.
      In addition, evidence in this case will also show that DNA from hair found on Ms. Read’s vehicle as well as fabric particles embedded within the tail light were tested and conclusively matched that the victim.
      Based on the facts you will be presented throughout this trial, I’m confident you will be able to definitively conclude there is sufficient evidence to prove that Karen Reed is responsible for the intentional death of John O’Keefe as well as the other three crimes of which she is being accused. We implore you to hold her fully accountable for her unforgivable actions by reaching a unanimous verdict of guilty. Thank you.

      Can’t wait to listen late at night (as is my law nerd habit) for 8 or so weeks and truly make up my own mind for once!

      Same. When I saw EDB was going to cover it, I quickly looked up a 10 min video kinda explaining the basic details, which is basically everything the defence lawyer said in the opening. I just wanted to see if I was going to be interested in watching it. Like Paltrow and murdouch, I didn’t care much about the story so I didn’t watch the full trial- only the quick bits. But THIS trail looks extremely interesting. It reminds me a lot of the Steven Avery case from How to Make a murderer on Netflix. I still question that case :(
      This trial seems as interesting as the Depp trial! I am just heartbroken that someone innocent still lost his life in this case 😢😢

    My daughter is a creative writing major that wants to go to law school.
    The difference between these two openings perfectly illustrates why majors other than poli-sci should consider law school.
    The ability to construct a clear, consistent, logical story from bits of evidence and effectively communicate that story is absolutely essential in trial.

      Yesss! Love that for her! I was on a law school path all of undergrad and studied anthropology and social work because I was focused on human rights. Law needs lots of perspectives.

    Whether you believe guilty or innocent, you cannot deny her lawyers are doing a thorough job on her behalf. I hope John and his family receive justice, but the complications in this case are numerous and wild.

      It's not just complications in this case. It's the fact that he has no vehicular injuries whatsoever from a car let alone a 6,000 lb suv. The Google search at 2:27 a.m. how long to die in the cold compounded by all the other factors and it's quite clear that Karen is the wrong person on trial

      David Yanetti. Her other male lawyer Alan Jackson is just as fantastic. Different delivery but both outstanding. And both extremely passionate about justice and enraged they are framing an innocent woman.

    The amazing thing about the defense’s opening is that from the evidence that’s been out in public, the fuckery Yannetti described is less than 10% of the fuckery they have yet to talk about.

    I don’t consider a 13 year old asleep at 5:00 am to be “left unattended.” I was babysitting at the age of 12. The parents were not leaving their children unattended when I was there ❤.

    I had to Google to be sure but I came back here after someone in the second half of today’s trial mentioned something about her reactions. The woman we can see in the gallery sitting directly to the side of defense table does appear to be John’s mother. The camera panned away for the part that the person mentioned, but I noticed her reaction watching it back to the info about the investigator looking for inappropriate pictures of Karen on her phone and John’s mother looks disgusted.
    I don’t know how she feels about Karen or this trial, but it guts me to think that she lost her second of three children in such a terrible way and that this is what was on the lead investigator’s mind. Not finding out what really happened John, finding inappropriate pictures of John’s girlfriend. This family deserves better than that. Absolutely appalling behavior from that man.

      Why would investigators not knocked on the door and informed them that there was a dead man in the front yard? Police didn’t canvass the neighbors for witnesses or security cameras? They didn’t have a ring doorbell? At a cop’s house? The police should have found out if they knew who the dead man was or how he came to be there? It is as if this took place in a commercial area and nobody was there to see anything.

    Went into this case with 0% information. Prosecutor opening I was falling asleep, defense opening… now I’m interested. So many questions, that’s one of the best defense openings I’ve seen.

      Boston right here- born and raised and I’m embarrassed and horrified that they are allowing this case go to trial. Karen is factually innocent. The evidence is so clear as day. The Alberts are the Murdoughs of MA.

    I think there was a purpose to the prosecution’s disjointed & disorganized opening. It wasn’t just that Lally’s not a good prosecutor.
    The timeline in this case is not the prosecution’s friend. The closer you look the more their case falls apart.
    Normally, it would be the defense you’d expect to hear throwing up a word salad, hoping to muddy the waters enough for the jury to find reasonable doubt. Here, the prosecution is using a defense tactic to hide the weakness of their case.

      I’m watching the replay and haven’t finished… but I feel like he’s (Lally) giving a detailed overview to everything they will hear during this trial… instead of telling the jury who John O’keefe was, that on that night in January of 2022 his life was cut short… this is what we believed caused that, you will hear from numerous people to these reasons/facts as to why we believe the defendant is at fault for this.

    The prosecution's opening statement really did start to sound like Colm from Derry Girls after awhile. It was so hard to pay attention and pick out the key information. And it was further hurt by the defense's opening, which was way more engaging and will linger as I listen to the prosecution's case.

    My Dad died and my little sister was only 4 (younger than my kids), he was her sole caregiver so we adopted her. Paul O ‘Keefe broke me. I was more careful with myself because I knew she couldn’t lose everything twice. Horrified at what sounds like a shoddy investigation, John and those children deserve so much more.

      They lost Karen too. They spent all of COVID home with Karen, they are all so happy in all the fam photos(not FB happy either)...they lost her and were forced to testify about fights because of Dunkin', flirting, and learning to coparent.

    It’s Memorial Day, 84 years since we started this trial, and I thought that I’d revisit opening statements. Oh how young and naive we were at the beginning.

    Replay crew here! The defense had an incredible opening statement (I have a degree in English-the prosecution hurt). But man, what really struck me was Paul’s testimony. I’m the oldest daughter, with two younger brothers, and our age differences are very similar. When I saw him, I saw my baby brother, trying to testify after losing both of his siblings…I hope this family finds justice and peace and healing. I send them love and strength in their grief. I think I’ll spend the rest of my life thinking of them and hoping they’re doing well. Especially those poor kids who have lost too many important figures in their lives. I hope this trial brings justice.

    Runkle caught something I think EDB missed because she was looking at her notes: defense opening said the German shepherd was re-homed, but he also put quotes around "re-homed".

      I saw that. I think it's open to interpretation. I read it as that the dog didn't really need a new home, they are hiding the dog etc.

      Take a quick look at any shelters and rescues near you and you will see how hard it is to re-home an aggressive dog that doesn't like strangers.
      We are told the dog has issues with strangers but then also that the dog's loving family of 7 years sends it off to go live with strangers? Something stinks . . .
      I am interested to know where the dog ended up and if they have no idea where it went then I have even more trouble with the story.
      Either way the defense did a great job of insinuating the dog dissappeared to make sure no comparisons to the wounds on the victim's arm could be made.

    Totally off topic: my foster Paw Nerd had her litter Saturday morning… 4 beautiful (not-so) little kittens after going almost a week overdue! I assisted, because of course the first one was breech and stuck, but in the end they’re all healthy and strong and purrrrfect! 🐈

    My sister’s best friend growing up was murdered, and the dad went on trial but was acquitted. All we knew at the time from the news made it seem like he got off, but reading back now it seems there was indeed a lot of doubt, and it was as likely a murder/suicide of the mom’s making. Being able to see the proceedings in real time is very helpful.

      That is the worse thing about this cases being brought. If it is not guilty people just assume they got off…because I don’t think people realize how rare acquittal is.

      @@sallycinnamon5370yes, and not guilty doesn’t mean innocent. It just means the prosecution didn’t prove guilt to the jury beyond a reasonable doubt. So a not guilty is much more ambiguous than what people realize.

    I started the trial on day 2 so had to come back for this. And wow !! What an opening by the defense. It was all great but what I loved the most I think is the “wait for us”. That would stick for me. Especially now after seeing everything so far. I think I would come back to “wait for us”. So good

    So I’ve been following this case since Day 4, and I’m only now going back to watch these first few days. The Prosecutions opening has been some painful foreshadowing for the kind of representation that Lally will be presenting throughout this trial. It doesn’t get better, and one of the fundamental flaws with their opening that almost feels intentional at this point is not putting all the events into chronological order. He mixes everything up, goes back and forth mentioning details and names that he didn’t provide any foundation for the jury to mount memory or relevance for. Oof, let’s keep it going though!

    I missed the opening statements, but damn, today is Day 18, and I can honestly say, the defense is DELIVERING! What a wild case…. Well worth every hour I’ve spent watching…. I haven’t missed much since day 3.

    My current *speculative* theory: John went in to the house and everyone was drunk. The dog attacked John and in a drunken panic he punched at the dog to get it off and maybe even kicked it. In a drunken rage, the dog owner and his pals beat the tar out of John and kicked him out of the house where he slumped in the front yard and lost consciousness. The one lady made a google search about hypothermia because she saw he was still there out of a window, but was told she was not allowed to intervene and help and that John would eventually shake it off and call Karen for a ride. They all passed out and then got frozen into a pact of silence when they realized John, in fact, died on the front yard. And that’s why the dog had to be relocated out of state. So it would not be possible to match any teeth to his arm injury patterns.
    *I don’t believe this with enough certainty to support the charging or conviction of any Alberts or McCabes-nor do I support or endorse any bullying or harassment of that family unit. Regardless of what actually went down on that evening, if the prosecution can’t prove that Karen did it beyond a reasonable doubt, then she should be acquitted.*

      I think the FBI let it go to trial so they can see how much they lie on the stand. They already said at the last hearing that Higgins was given a proffer from the FBI. You are not given a proffer (basically a deal) if nothing happened!

    During the Commonwealth:s opening. He says "They see the vehicle out front, they see the Vehicle pull away" Did you just admit your witnesses did not see Karen reverse at 27 mph! And hit something. So people in the party were aware the John pulled up in a car with a passenger. How would they know he's in the vehicle? How would they know it's Karen Read dropping him off?

    I am pass day 18 of the trial at this point. John reach out to Karen at the beginning of Covid. She immediately take a role of home stay parent for his children. It is somewhat coincidentally convinient, knowing what we know now, that Karen was called babysitter with benefits.
