Also Emily... My husband is trying to lose weight and is self conscious. I told him that I'll love him at any size and he said "Nah... you can't know that..." and I'm like "You were skinny when we met 17 years ago and you're not skinny now... pretty sure I've loved you at all sizes in that range." To which he said "I don't see any proof..."
And I yelled, "OBJECTION!!! I HAVE DEMONSTRATIVES!!!" and he stopped in his tracks and just goes "What the fuck does that even mean???"
And I said "I have photographic proof! I still have my first picture I took of you at Wendy's. I have 17 YEARS WORTH OF PHOTOS.... I.... have.... demonstratives... that I have loved you at every size.... SIR!!!"
Just wanted to give you that giggle lol.
I love this. So glad you are supporting him even though he’s a little self conscious about some body changes. Also on my own weight loss journey and supporting your hubby in spirit. 🙌🙌💪
That is epic! Tell your hubby he is a lucky man! My husband also has demonstratives that he has loved me through thicker or thinner, he might not say it but it matters, I promise!
My husband and I literally had this conversation over the weekend and I am so upset at missing out on the opportunity to respond to him with an OBJECTION!!! haha this is epic and i cannot wait for him to mention it again so i can finally seize my moment 🙂
We’ve had this conversation too! His response was “well, I’ve seen you naked & I’m still attracted to you, so…” 😂❤

Questionable a police officer didn’t come out of his home for an emergency at his property. Where were the life saving efforts for a fellow officer?
Right? My neighbor 4 doors down is a cop and comes out for any disturbance…this is sus!
Not even just a fellow officer but a friend of his too, very suspicious imo
@@eroseagle19exactly the friend that was invited to socialise with you. It makes no sense. Leave no man behind mentality went out the window. Alerting him & getting him out to the front lawn would have been quicker by phone or knocking on the door than waiting for the police/ambulance to arrive. Aid: blankets etc. Even offering assistance as more units were arriving.
What it does say is distance. No problem in Jen entering the home moments later.

Hi Emily, I just want to say your streams are such a comfort to me right now. I've just sold my dream home after a divorce - it's really the only home I've had in a long time, and I've just moved into my own little townhouse. My family lives on the other side of the world and the move has been scary and overwhelming (especially as someone with diagnosed ADHD) to do all alone. Having your trial streams on while I was packing a month ago, and now while I'm unpacking, is helping it feel like I'm still home, just home somewhere else. Thank you.
💜
Oh my gosh, you sound like me❤. I know it's tough, but I gotta believe God has a plan for us, and we will see it eventually emerge through the clouds.❤
A huge hug to you as you make your new space a home to heal in and a space all your own. You've got this and we've got like 8 weeks of trial to get it done. Set things up that make sense to your brain, I love my light dimmers and I putting dishes closest to the dishwasher so they are easy to unload. Somewhere to fold clean clothes near the washer because sometimes they will sit there for a minute....etc. You've got this.
We are your lawnerd family! These livestreams are great to be background to me getting tasks done too! Hope you can settle in well to your new home and make friends and connections in the new area. Hugs and prayers, Goblin 😊!

If you heard “I hit him” as you are trying to gather information on how to treat the victim, wouldn’t you have follow up questions? Like “hit him with what? Hit him where?” Etc
Excellent point.
Holy hell, I didn't even think of that. You're right: it seems that would be obvious if one was a responding officer.
Yesssss. No follow up! Hit him with what ma’am? This is so important!
most cops that I know put people in cuffs who confess to hurting/hitting people.
Good point! I didn't think of that. the cop car video didn't seem to show a car in position to have just hit someone, so makes sense to ask "hit with what?".
Canton have voted to audit the PD because of this case.
check out the young jurks to see the first police audit committee meeting.. it was ROUGH
Thank goodness!!
When we as a society give THIS much power to individuals, there MUST be higher requirements of them and good checks and balances. I think we rely WAY too much on the honesty of cops.
@@joliveira18Just watched that video - holy shitballs, that Bob guy has got to go! That video needs to get totally blown up, viral. Get the attention of someone powerful who can go in and clean house. Canton isn’t going to be able to while Bob is in charge. 😞
Gotta check them out! I think that explains why the officers seem so defensive. This case is just wild and it seems pretty clear already that this investigation was completely fumbled, just not sure if it was just incompetence or willful incompetence.
I find the judge sighing repeatedly throughout this whole session so disrespectful and unwarranted. This is your job....if you don't want to be there, don't be a judge? If you can't contain your sighs, mute your mic... Its really offputting for me.

She has to know its all bs.
@@MsTinkerbelle87she actually is bias. Omg right!!!!! So rude and annoying!
1. This trial is NOT about ‘this’ storm!

@@nicolewhite1288Jen, the homeowner’s sister 💜
Even if they didn’t know at first - once Jen McCabe went into her sisters house that morning you would think that any reg cop (b Albert) would come out to see why his cop buddies are out on his front lawn - maybe he didn’t want anyone to see him (was he hiding bruises from a fight? On his hands? On his face? Was the dog inside ? Also were there any animal tracks in the snow near O’keefe ? Defense would want to rule out other possible animals outside near Okeefe to narrow down animal markings? If that is what caused injury to his arm?

Emily, regardless if the house was the scene or not, Jennifer McCabe was a witness AT THE SCENE ON THE LAWN! She should NOT have been allowed to leave the scene until questioned. Certainly NOT to go into the house until they ascertained there was no one in the house she could discuss information with ... which of course, they would not be able to do that since Brian Albert and her sister were both in the house.

My idea of love is when 2 people bring each other Starbucks at work, especially without asking. And then the recipient says thank you and actually means it, not taking the favor for granted. And the bringer of Starbucks actually hears it and feels good about it. And by doing this simple act of kindness repeatedly, love keeps growing.
I'm into it. New standard set
The constant harping on the defendant screaming about the victim possibly being dead by the prosecutor is mind boggling to me. It’s not in anyway an abnormal reaction to those kinds of situations.
God bless. If ever we need emergency ambulatory services, we hope that the paramedics / EMTs are as knowledgeable as Mr. Nuttal!
Emily constantly mentioning how much of a slog direct examination is and me forgetting I’m on 2x speed, but still getting bored with direct is just… I can’t imagine watching this on normal speed omg.
I love this paramedic, he’s stellar. He definitely has a motor that keeps him going.
The thing that sticks out to me, whether or not she is guilty, cops hold too much power.
"Absolute power corrupts absolutely"
You need to watch body cam footage of cops making arrests on youtube...the crap and abuse they put up with is INSANE. I had NO idea how BADLY ppl, especially young ppl treat cops until I went down rabbit hole of body cam footage videos and the DA's are CONSTANTLY dropping assault on police officer charges.
As someone from MA, you WILL hear someone say wicked before the end of this trial 😂
Never seen a case solved so quickly, almost upon arrival, as they didn’t seem to be looking for a cop killer at the scene of a dead officer.
I agree it is very very odd
... Because they thought they were just doing medical. While doing lifesaving measures with no clear reports or 911 calls saying they were shot or someone saw something what are they going to do? For all they know he was drunk and passed out outside but it was clear from the evidence so far that initially nobody thought there was a killer as all they had was a body in the snow.
His body was cold when the first officer checked him for a pulse. He won’t be able to tell you what happened, obviously!
@@Princelover-ip4gn and? They still didn’t question anyone at the house they didn’t door knock. With what we have seen so far it does not even look like they had crime scene out to case. I love but hate EDB's opening and closing arguments cuz they are so good which makes me frustrated the attorney's can't do it like her AND makes me sad well never see her give those actual arguments. But I guess we get to hear them anyway so we are the winners
This prosecutor with “what,if any?” Almost every single question. “It’s not a cure all”! I had exactly the same thought as EDB when I heard the sirens, and I was like “who’s at Station 1?” Ha! When Emily paused and says the judge is like gtfo, her face literally looked like she was saying “GTFO”😂
My theory behind the emphasis on the incorrect logs and address is trying to discredit CPD’s accuracy in record keeping. Accuracy in report on how things occurred. If we can’t trust something as simple as the logs, how can we trust anything else? Right off the rip, incorrect info is being given to the jury. Great strategy
My goodness, I love watching you, listening to you...Thank you for just being there :)
I live in Boston, and I remember that snow storm very clearly. I was potty training my few-month old shorthaired Chihuahua puppy and had to take her outside every few hours, even in the snow! It was brutal. The videos don't totally show how bad the weather was, it was a few inches every hour. It had started the night before and went all day. It was the last big snow storm we've had!
I'm in NY and trying to remember if we had a bad storm then too as it usually hits us first then travels over to y'all. But this might've been just a bad N'orester hitting over there
Nuttall genuinely loves and respects his career.

It’s looking like your best option to evade being investigated at this point
Exactly
If I’m trying to ascertain injuries and cause and someone says I hit him, I would be following up “with what”. A fist is a different situation to a car and important for treatment
If Karen is found guilty, can she appeal based on the objections both the ones from the attorneys and the ones the judge has made off her own back? surely the record needs to show the grounds for all the objections.
this judge seems very much like she does not want to be there, the sighs are so disrespectful to both the victim and the defendant!
She can appeal anything if convicted but it takes quite a bit for a conviction to be overturned or a new trial ordered. It's rare. It needs to be at the level where that error by the court was impactful enough to change the outcome.
@@HaarschmuckfachgeschafttadpoleI wouldn’t call it rare… it’s uncommon for most cases, sure, but it still happens all the time.
Yeah I was wondering too, how does not stating the ground work with any appeals since we don't know why they objected? Like how does the judge know what they are objecting too? Makes it seem like they are so familiar with each other the judge can read their mind or thinking of the objection herself.
Yes! How on earth does an appeal work when there is no record of what the ground were??
2nd half replay crew...because time zones. Love court days. Gavel to Gavel with EDB is absolutely the best way to watch and learn on the interwebs ⚖️
It wasn't the prosecution that said they may not call Proctor. It was the judge challenging the defense lawyer asking her "what if the prosecution doesn't call Proctor" at which point the defense said "then we'll call Proctor" and the gallery broke out in laughter. The judge is extremely biased in this case...I've watched all the pre-trial hearings and she is barely trying to pretend she's unbiased. Shocking really
Her sighing is so unprofessional, imo.

Perfect!
An officer who says “I don’t remember anything?”. Sir sir isn’t that the purpose for your presence at the scene? Police are supposed to observe, but this cop says “I didn’t see anything, I don’t remember”?
This judge feels so biased to me. Her sighing loudly during the defense questioning, the way she speaks to the defense and a few of her rulings really makes it seems like she has already decided the prosecution should prevail.
Also, the lack of grounds on objections is NUTS. Does she just guess what the grounds are?!
Seriously, at one point the defense is questioning and the prosecution objects and she says “He can have that” begrudgingly?!? Seems prejudicial to the jury?!
If they fucked up the little things, imagine what they did with the big things
That's exactly the point of the defense cross!
The defense is coming out strong. Much more confident and put together than the prosecution imo

To me he is as questionable an investigator as Mark Furman . Like any evidence collected by him is poisonous and should be not be used.
So happy I'm not on the jury. I'm already so entrenched in the idea of reasonable doubt. I can't be unbiased at this point.
Unfortunately, especially in smaller towns where there may be less crime, first officers behavior at crime scenes can be very different. My boyfriend called in a violent SA we came across that was in progress. The cops that came were male and female. Whenever a man tried to get near her she (the victim) became hysterical. She wouldn’t even get in the ambulance because the EMT’s were two rather large men. The male police officer became angry that she would get hysterical whenever he came near and rather than letting his female partner take the lead threatened to arrest her if she didn’t calm down. I think non-standard happens a lot especially in lower crime areas.
I should add that the detectives never got the weapon he used because the cops on the scene left without recovering anything or setting up tape.
That is infuriating! Being in a small town is zero excuse for not knowing how to properly handle a crime scene and a female victim! I don’t care if you have 3 cops on the force! Sheriff’s office and state police are there to back them up with a radio call. Deputies or state troopers should take over if the cops are so incompetent. Those photos don’t show any blood. But he was supposedly found in a pool of blood.
I wood love to hear Rob from Law&Lumber talk about the woodwork in this courtroom!!😂❤

I've been watching hearings for this case for awhile and Judge Cannone is ALWAYS like this. It's not a matter of her just being tired the past couple days. This is her norm and she tends to be more snappy with the defense. And she always wants to get the hell outta there. I remember one hearing she told them the next hearing they would have all day. Well that next hearing came and she limited them to 10 minutes!! Defense had to do some serious adjusting real quick. She's awful....in my opinion.
Is it just the defense in this case or is she like this for every case? Because right now she's coming across as very biased.
Completely agree. She is really getting on my nerves! Definitely hates the defense. She also rented her beach house out to someone in the "family & friends" group but the money was paid to her brother! Js

We tried to pass 48/96 but it didn’t pass by a couple votes. My husband does a 4 day tour every other day and then has a 4 day and a 6 day. The Canton schedule seems pretty cushy. Lucky!

I now think that prosecution going out of chronological order is intentional because the timing is so critical in this case that he wants the jury to stay completely confused.
2:36:52 "a significant storm...supposedly" Yeah, that basically sums up New England weather.. you dont listen to the weatherman, they're never right when it comes to snow.. you look out your window.
This story is heartbreaking. I hope they find the REAL murderer
I 100% believe she killed him but it was accidental and the cops did a sloppy job. That makes more sense than framing someone for murder for literally no reason. What reason did they have to frame her?
So you've already decided? I'm still waiting to hear more but I'm leaning that way for sure.
@@Haarschmuckfachgeschafttadpole just keep watching.
@@Haarschmuckfachgeschafttadpole But if it's the cops that killed him, needing a scapegoat makes a lot of sense...
Would be interesting to know if they were having a drunken argument and she lost it, in drunken theory, and hit him intentionally with a ‘serves you right’ kind of way.
Either ways I believe she IS guilty and wasn’t accidental rather led by alcoholic stupidity . Which is why she remembers it vaguely like ‘ yikes did I kill him?’
But this prosecutor will sadly not be able to bring any justice for the family. ( praying that’s not the case but I am scared)
If it ended today. Not guilty. There is so much reasonable doubt on this trial.
If the Ring Doorbell caught all the people moving around WHY didn’t it catch the defended hit him with her car?
The Ring footage we have seen are from the victims house, not from the crime scene. I don't know if there is footage from around the scene.

This trial is actually happening in the town where I'm staying for my current assignment, as well as my previous. That was actually a very bad storm bc of the wind and minimal plowing.
My Lexus will literally slam on the brakes if there's even a hint of something behind me. If they're going to talk about back up camera, they also need to address whether or not this sensor was turned off.
my bunk ass rouge does the same, the last time it was storming it would not stop beeping bc the rainfall was triggering the sensors. i wonder if similar happens with blizzard conditions
Great point
Watching on replay....
If there were furrows on the arm, wouldn't the puffy coat be shredded?
I'm so curious about the clothes and missing shoe defense mentioned! So far the cops don't seem to have much observation but my hope is they interview the hospital he was taken too. They should have an inventory right? and some sort of testimony of what the clothes looked like when brought in from the ambulance right? I'd think a dog attach would look different from being hit by a reversing car?
So the furrows like from a dog biting and pulling the skin, huh? Or a person scratching and pulling?
Lally is doing a great job so far of losing his own case.
😂😂😂😂
Emily, those dispatch logs / call logs should have been reviewed by the center or police department for accuracy before they went to trial. Especially in a case like this. There is no excuse for the records to not have been corrected immediately after the incident. The dispatch center should have addressed this. Errors are made, that’s fine, but the agency needs to know there is an issue before the officer is on the stand. (Retired 911 who specialized in finding errors and working to educate to correct them)
💯
Dang! Emily’s opening statement got me and that was with no prep
As she said - it’s not that hard! What is the prosecutor doing?!?
Watching replay...only saw bits and pieces today. Grew up in Braintree. Now living still on the " South Shore".
I just love being a part of the Law Nerds and watching you!!!! I haven’t been watching much lately, life happens but this one is awesome!!
I’m at the last paramedic- is Lally on his own for the prosecution? I’m a chronic insomniac- I’ve finally found a remedy- I’ve never been so sleepy watching a trial! The judge is giving 89 days til retirement vibes. 1p- GTFO!
Actually she has been transferred to civil court but insisted on keeping this criminal case!🤷♀️🤷♀️
Seriously does every single witness have to give the weather report geez
It's the asking "what if anything so you remember about hearing about inclement weather conditions or anything" like yeah, we all know there was a storm! I don't mind the how did the conditions change or not change, I see that being valid for the ppl there at that time and place. And we're just waiting to hear "wicked cold" or "wicked stormy"
I am also watching the Daybell trial. What I have been doing is watching EDB while she's live. And then watching the daybell trial at 1.75 speed and zooming through brakes
Me too!
Thank you for covering this case. I am wacthing you and 2 other lawyers covering this case to get different perspectives.💕
Who else are you watching?? I know Legal Bytes was live streaming but haven't heard of others.
Attorney Melanie Little knows the entire case. Sean McDonough Going through the motions does very good summaries each night.
No wonder this trial will last so long!! 3 days that they will probably end early. 2 1/2 days. If I was a juror I would be annoyed!! 😮
Oh no, not the frozen molasses! We can make it through anything with Emily as our captain ;)
You Do A Fantastic Job, Emily! Great Analysis!! 💯 👍
Mr. Nuttall is an excellent witness.
I think one or more of these cops is incredibly dirty!!!
I hope the defense calls proctor. That man is vile
I don’t know if the logs are important, per se, but this definitely seems like a lot of reasonable doubt. (And yes, I absolutely agree that this plays well with the defense’s opening statement.)
Agreed. to me it seems common for everyone to have called in at different times (parking the car, turning onto the street, etc) and I'm not sure if the times are reported by the cop themselves (each may have a different clock) or the dispatcher. The log itself isn't strong evidence for me, however I see the strategy to keep introducing doubt as much as possible.
The fact that nobody ever came out of the house would suggest that the people in the house already knew what had happened and were just trying to avoid the police. And the fact that the police never went in the house suggests to me either that the police had already agreed to avert their focus from the house (maybe the owner had already called them and told them what to do?), or were at least aware of who lived there and wanted to protect one of their own - he's a policeman, right? I thought I heard that, but I haven't been paying enough attention.
I think even if the jury somehow agrees that Karen caused this, the prosecution will never be able to prove premeditation on her part, so she'll be found "not guilty" no matter what. They never should have charged her that way. They should've just gone with "vehicular manslaughter" or something and let the judge decide on how harsh the sentence should be (assuming that's how it works there). Though I think there's plenty of evidence that points away from her entirely, like the lack of blood at the scene vs. what was lost from the body, the google search (assuming it took place at the time that the Defense claims), and the marks on the arms.
The Canton chief of police at the time (he was out on medical leave though) who lived across the street from 34 Fairview spoke to media and asked them not to publish the homeowner's name. So it's not a stretch to think officers averted their focus.
I can get behind at first the person was being treated and got out of there to a hospital, but I would think after talking to ladies who were there, you go knock on the house and ask if they saw anything, if they have any video surveillance, what time people came in and out and if they saw anything. When we have snow storms, we all are very much checking out the windows looking at the winds and accumulation, judging if its what they forecasted, how much this will affect our plans tomorrow or the next day. If i see neighbors out shoveling or snow blowing during a storm, especially the elderly, we go out and make sure they are ok and help them - it's usually odd for ppl to be out during those storms, esp with winds. Granted it was early hours and ppl sleeping but usually I'm up going to the bathroom and will check weather! Also if I see lights when down the road I am for sure peeking out the curtains a me I would think of I was police or first responder trained In would go out to help! Not to mention, which are they going to mention? Police band radio or whatever it's called? Don't they all have those calls going on from that? Maybe I'm confused about who lives in that house.
Here in Texas , if a dead body is located on your property you are automatically interviewed. LE automatically would canvass the neighborhood for witnesses and any and all video evidence.
I also love how the defence knows which witnesses are likeable + doesn't badger them. I don't think we've seen that yet where they don't resent them - obviously will happen when the lead detective comes on but not sure he'll be likeable 😂
I’m getting motion sickness from the prosecution questioning. And my blood pressure rises every time I hear “what if any” 😭
Look at the pre-trial motions & the exclusions. Lally working hard to not open doors for the defense
Thanks!
Welcome!
I am wildly curious about this case and the outcome, and I too am infuriated by the prosecutor’s style of questioning. I LOVE Emily’s freaking out about it. Is it ever a bit much? Sure, in that way your bff can be too much but it’s also your favorite flavor of extra so you’re down for the ride.
As a fellow neuro-spicy person, emily is doing what I would. So…. Yeah!!
@@Certarii'm new to the sub, what is nuero spicy?
Love your channel. You did a fantastic job on the summary
I think we are taking this time to educate the local public what their First Responders do on a day to day basis - only reason I can think of for all the double checking & reiterating from all personnel. See the other person was telling the truth 🙄
EMILLY ? I'm following The Post Office Enquiry in UK and the lawyers are THE Best I've ever heard.
Would love to hear YOUR opinion ?
