    The young man presents very well and is very likely a really good dad. And clearly he put in a lot of effort to make sure he did as good a job as possible in court. So hats off to him. But to the extent he won in court was nothing to do with magic words, common law or jurisdiction. He won because the judge having listened to what he had to say and what his ex wife and her lawyers had to say, decided he had a more deserving case than she did. From what we've seen of him, polite, calm and intelligent, he probably made a far better presentation of his case to the court than most people would be capable of, and the judge was probably really impressed by him.

I went on sick in 2010 and had to go to magistrates court on many occasions to fight to claim entitlement to benefits. I made covert audio and video recordings of assessments which the judges amazingly accepted with transcripts. When it came to claiming PIP I scored no points so on the mandatory reconsideration to the DWP I informed them that I was preparing to submit all previous court evidence to show they deliberately under played my conditons since 2010..........to cut a long story short I received a phone call offering me more than I was asking for and for the first time didn't need to go to court !

      Say whenever I want to find out whether Willy Gates is tied to yet another shady organisation that wants to help those poor people, I do a search like this: “[organisation’s name, minus the square brackets]+bill+melinda+gates+bmgf”. With and without quotation marks. And then reading up when exactly that tool gave money and to whom. 🙄

    I hate to simplify this but in all honestly he would have won custody regardless. Thd child was already in his custody and had her life with him, had her friends and school etc. No judge is going to uproot a child from stability like that. On the other hand, if the daughter had been in his ex wife's custody at the time then there wouldn't have been anything he could have done to stop it, unless he could have put a good case across to show that uprooting the child would cause harm.

    • @istudios225
      @istudios225 Месяц назад +5

      I don't think it is so simple. There is a bias for courts to award custody of young children to the mother. The mother could also have fabricated reasons why he should not have custody. She may not have had proof about her allegations, but he had prepared all his documents carefully and thoroughly.

    • @SteveP12345
      @SteveP12345 Месяц назад +2

      @@istudios225Yes there is an inherent leaning in favour of the woman. It just reflects a general view in society that women are better at raising kids than men. Of course they arent always, but if I think of my family and that of friends I would agree with that even though I am a man. Thus all things being equal the wife will get custody. However things weren't equal here. The daughter was already with him, was happy to be, and he'd proven he could look after her well. So you might say being a man meant he started 0-1 down, but when those points were taken on board by the judge he went 2-1 up...and won.

    • @chortlemk1
      @chortlemk1 Месяц назад +1

      Not necessarily true. If the mother can present a case that a move to the states would be in the child's best interests for its future then that's a test. The Children's act covers not just the immediacy needs of the child but those in the future.
