    Muting or Deleting or Turning Off body camera evidence should be considered "Tampering with EVIDENCE" and should be grounds for IMMEDIATE dismissal.

    Meanwhile, they arrest people for not even drinking at all, like that college kid who got arrested while conducting a sobriety test in the pouring rain.

      At least that one is getting a payday from what I recall. There's the other young girl who was waiting out in a stopped car, indeed slightly drunk, who has to pay fines, do community service and drive with a breathalyzer on her car because SHE DID NOT WANT TO DRIVE WHILE DRUNK but didn't want top be out in the cold!

If they don't trust the public, they shouldn't be cops in the first place because they are supposed to be peacekeepers who serve the public and sets the example.       The average cop really isn't different from the average person. The number of terrible cops is obvious. So it's equally obvious that cops who deal with a lot of people would see their fair share of terrible ones.

      There are barely any records of 1.3% you are talking about 1.6% she isn't near that level.

    I want to make it a point to mention when asked if she was drinking at 4:30, he replies “eh, I can’t tell”. But if was clearly sarcastic and the reason he said this was not to actually be sarcastic for comedic effect, but to indirectly let the dad know she HAS been drinking but not provide that evidence on camera by admitting to the obvious.
    That was way more calculated than meets the eye

    A bit of trivia: In Chicago and surrounding departments "Watch your step, there's a lot of dogsg!t around here" is often used as shorthand to convey that the situation involves someone with connections that might cause trouble for the officers.

      Its all about DEFINITIONS OF WORDS used within our Laws, Exposing Corruption, and Secret Societies! All Public officials belong to the Fraternal Order of Freemasonry. "Rod Class Attorneys Confession" talks about how all law enforcement, judges, BAR attorneys and Public officials take secret oaths and purposely plot against the People!. Title 49 usc 31301 MOTOR VEHICLE is every vehicle over 10,000 lbs. Title 49 cfr 523.3 AUTOMOBILES are every vehicle UNDER 10,001 lbs. Title 26 usc 5845 FIREARMS is not what we own!

    Bodycams should not be able to be disabeled at all. It needs to be a law just like search warrants. No warrant no entry. No bodycam footage or bodycam turned off NO crime!!!

      Disagree somewhat. There are reasons to shut off a body cam that fall in their victims rights or privacy protection. The most obvious example is dealing with a sexual assault this victim who may possibly have torn clothes etc etc You do not want the immediate aftermath of their trauma to become part of public record.
      That being said the usage should be severely administered in such a way that the punishments should be automatically required outside of those reasons.
      Caveats that if it in an interaction with the public the officer shuts off their body cam for a reason not evident to a known exception fault is automatically assumed to be on the side of the officer.
      I also think there should be a rule that if a state official commits a criminal act they should be automatically subjected to the maximum sentence.

      ​@@phofire77 I get where you're coming from but just because it's recorded doesn't mean it's automatically public. The departments already edit the videos for privacy before releasing them, it would not be that difficult to edit out anything for their privacy. While I get what you mean, turning off the bodycam when coming up to a victim is not only getting rid of what could be absolutely critical evidence, it could put the victim at more risk. If officers are allowed to turn off their body cam when alone with a naked woman do you see how that adds another issue? Whether they do anything or not, it leaves the door open for that accusation. It looks REALLY bad for an officer to walk up to an undressed woman and shut off his camera.

      ​@@phofire77individual cops on the street shouldn't be able to decide what is "private" and what isn't. Let that be dealt with by an independent 3rd party during FOIA requests (they can censor sensitive parts of the footage).

    What most of you don't know is his daughter has been in quite a bit of trouble after this too. She was at a local bar and beat the brakes off another female and good ol' daddy tried to cover that one up too, but got caught.

      It's a lame excuse because nowhere in the footage was speed even mentioned! I live in WV & have been following this closely. The reason there aren't any rules about turning the body cam off is because hardly any of our law enforcement has them! Hell, most of the officers here don't even have DASHCAMS!! This girl has been in trouble many many times & daddy has always helped her. There are a lot of people exposing everything & fighting to make sure they're both held accountable!

      The worst part is that she could actually get in trouble to admitting to a crime even if it's a lesser crime, whereas when cops waive off their crimes by pretending they didn't intentionally do it to hurt people but did it because they're incompetent, they actually do get off scot-free, the law allows cops to claim ineptitude as a defense against malicious criminal behavior. 🤦

They would have to scrub through the officers entire day of footage.. Not to mention why have it on a live feed? Do you think they should hire more officers to watch the live feeds ?

      @@ChickenJoe12 Dude, I deal with getting footage out of 24/7 security cameras. It's not hard at all. You're going to have a general idea of the time any encounter happens, and then you just scroll through the footage around that point until you find the visual of the incident. Don't be ridiculous. And what they mean by live feed is that the footage goes to a server and is stored there in real time so that the cop can't just take out the SD card and delete the footage themselves, because it's already stored on a server out of their control.

    Audit is still by far the best police encounter channel on RUclips. He doesn't take either side, and only uses an in-depth analysis of what the law says. Very educational for we viewers who aren't well-versed in the law!

    Body cameras shouldn't even have the ability to be turned off, or have a muting option... Those cams should be running from the time they punch in until the time they punch out... That should be the "law"...

      There are good reasons on when a body cam should be shut off in the primary example is when dealing with sexual assault victims or when in certain public space is like bathrooms but these should be exceptions and there should be stiff penalties for not accepted reasons

It should be called in and done through a superior and with a legitimate reason... Its already illegal to use a camera in a public bathroom. But all too often police turn off or mute their cam in order to cover something up ect...

    The problem with allowing them to mute or turn off body worn cameras is this. Even if there is some super secret chat between officers, lawyers etc. All of that information can be redacted later. So if you are so very worried about the secrecy of your conversation then maybe have it in a more private setting.

    These body camera policies are ridiculous. There should be no time that an officer can shut off a camera to protect information. That's what they redact information for when you request the body cam footage.

      Livestream bodycams so the citizenry can monitor their police. Livestream can only be deactivated for bathroom breaks. This would also help with citizens who need bodycam footage. I've read cases where people waited 7+ years for footage & faces were blurred! It is also very expensive & an unnecessary expense because we already pay for everything. We pay for it twice when we request a copy.

    Of all the exceptions to use of the BWC during police/citizen interactions and investigations, I noticed one thing: under NONE of them does the continued recording of the BWC represent an actual threat to the physical safety of the officer(s) involved, including TACTICAL engagements, as most BWCs are designed to NOT have an indicator showing they are functioning. Nor is there an instance conceivable wherein a supposed violation of privilege cannot be determined by a judge and edited out of the raw footage.
    Instead, these policies are designed to allow sufficient leeway so that the officer(s) involved have just enough legal discretion to disable the BWC when continued recording would implicate either themselves or (more importantly) their superiors.
    "The use of these cameras will enable us to show everyone just how trustworthy we are, because we'll turn them off in any situation that might possibly result in us looking bad. Or getting charged."
    How nice for them. 🤷‍♂️

    My Grandpa was a sergeant in the Ontario police department.
    When dad would get in trouble he'd beg the officers to lock him up instead of telling his dad. He said he was safer in a cell than getting taken home in the police car.
    Thems were the good old days when kids behaved.

Recently in DC, a mother turned in her own 12-year old child who was involved in a carjacking that led to another 13-year old getting shot and killed. That’s a real parent.

    There is a simple solution to the body camera issue. Make it a crime to terminate or mute the recording for any reason. Any such footage that will have concerns should be reviewed by an independent oversight group. Anything that needs to be redacted or edited for the public may be done so, but the original must remain preserved and archived and made available with a court order.
    BWC footage has been regularly abused and too many cops find loopholes to prevent accountability.

If a Cop tells you to "Turn around and put your arms behind your back!" The Cop better have a very good reason to detain/arrest you and if you don't obey this order, you're likely to be physically attacked. So Obey their orders and fight the illegal arrest in Court and anything after that illegal arrest is thrown out of Court. If you actually read my comment, I explained that the object was to get Cops to actually do their job, to investigate, to know the Constitutional Rights of the Citizens and know the Law that they're employed to uphold.     Full disclosure, I have been following this story on TCRL's channel for some time now, but all I have actually learned from the event is that my "doughnut dumpster" title applies not only to patrol officers who routinely interact with the public, but also to the highest levels of law enforcement, such as this Sheriff of an entire county department.     I'm from WV & have been following this case closely on his channel. There aren't any real rules about turning body cams on or off is because BARELY ANY OF OUR LAW ENFORCEMENT HAS BODY CAMS!! MOST OF OUR OFFICERS DON'T EVEN HAVE DASHCAMS!!
    This girl has been in so much trouble in so many other instances! She's got away with so so much! I'm so happy that they're actually doing something about it! John (civil rights lawyer) has interviews with some others who are working hard to have this sheriff face charges & accountability. The videos on his channel are interesting!
