Going to court, since she was the only one out of a group arrested for breaking the law, she could argue selective prosecution as a violation of her 14th amendment right to equal treatment since the sole reason for her arrest over the others in the group was her 1st amendment protected speech causing the officer to be annoyed.

I feel like this is a pretty cut and dry case of a cop who got his ego hurt because a kid dared to question his authority. "If my kid starts yelling at me - POW - They're going to their room." Clearly, he doesn't like his authority challenged. I bet the kid doesn't call home any more than they have to once they're full grown.

She literally got arrested for asking questions he couldn't answer. What did I do, and he still couldn't answer then admits she got arrested for attitude. Being questioned to understand why the cops laws applied without answering does not constitute a crime.

That was my thought as well. As far as teenagers in a pinch go she didn't even make a blip on my jackass radar. I think he just wanted to lay his hand on a skinny blonde kid, likely making himself believe he was "making an example" of her to her and the others.

@@MarvinRB3so. I'm gonna say this since I grew up in the area there... This kind of mistake in words is actually pretty common. Given his accent you can tell he is heavily Hispanic so more than likely he grew up in a Spanish speaking household. People who are bilingual sometimes change the order of words. Especially since El Paso/ Las Cruces area use more border slang Spanish than traditional Castilian. I've heard people say " I'm going to broom the house," they're using the noun as a verb. Because in their mind in Spanish they're saying they're going to use the broom. So instead of saying ," I'm going to use the broom in the house" or more commonly " I'm going to sweep" they may end up saying " I'm going to broom". This is also common as when they say I'm going to mop, mop can be the noun or the verb.
He seems like what he was saying was " your red eyes are a sign of alcohol consumption" or any variant of that he said " alcohol in your eyes"

But, given the context, it seems likely he was referring to her eyes being red rather than nystagmus. He never mentioned any movement in her eyes.
@MarvinRB3 we didn't see the whole eye test but he ended it when the pen was far out to the left which is when you can see nystagmus much easier.

The power trip of this officer is insane. He didn't like her question so she's under arrest. How is this a legal arrest? She did not seem angry at all she was just asking a question. This cop needs to be fired and never allowed to hold the power of an officer ever again.
Ya this is insane. He's arresting her for talking back to him, not the alcohol. Did she seem spoiled and give him an attitude, yes. But that's not a reason to suddenly arrest her and give her a more serious charge. Also I haven't watched to the end yet but this arrest will not hold up in court. It's clear he's arresting her for her attitude not the alcohol. Otherwise all four girls would've been arrested. On it's face it falls flat.

Arrest is not always an automatic conclusion of laws being broken.
For example if you are driving and go through a stop sign with a rolling stop instead of a full try second stationary stop that doesn't automatically mean you are supposed to get arrested. Yes you broke the law. No you are not legally allowed to be arrested for that

Well, he's not good with words, as can be seen from him admitting to slapping his children. But what he meant was that the appearance of her eyes might indicate alcohol consumption, as bloodshot or glassy eyes are an indication.
It was at this point that my only hope was that her top tier, A-game sassy, bitchiness kicked in and she no hesitation quipped back, “well, I see total bullshit in your eyes, sir!”.
I think he was looking for the jerky horizontal movement that happens if you're drunk. The nystagmus test.
He's Hispanic and I think bilingual word processing made an incorrect pattern of words come out. I grew up in that area and misplaced words or misspoken phrases are pretty common. Because you may think of something in one language and when you say it in another it doesn't come out properly. I'll use the example. To sweep or sweeping. Many people may say "broom" or " brooming" in that area because in Spanish the order of words is different in sentence structure so they may use the noun as the verb.

This was quite a bad video by ATA which is disappointing. No proof the girl even drank, not much of a shock she was hitting things in the car when she's 18 and unlawfully arrested and not backed up by her mum or friends, and she used her free speech and was arrested for it. But this video's summary supports the cop more than her.

You know, most lawyers would say the officer went to far - and I think most people would agree. Those same lawyers would also berate the kid for not STFU when dealing with the police. Her mother sounds like the kind of parent to say "did you learn your lesson" while also not taking it up as a first amendment violation unfortunately, she definitely was arrested basically for attempting to talk to the cop about the merits of the TICKET and disallowing them to drive away from the scene.

This officer deserved an F. Throughout the encounter he was insulting, patronizing, and antagonistic. He was a bully. In my opinion, his primary motivation was economic.
First, he violated the Fourth Amendment when he ordered them to open the trunk of the car. He knew that he was conducting an illegal search. When it looked like the kids might challenge his allegations, he started lying. There is no way that he smelled alcohol on all of them WHILE THEY WERE IN THE CAR! The comment about "seeing alcohol in her eyes" was just bizarre.
Second, he probably violated the passengers Fifth Amendment rights when he bullied them into agreeing to letting him give EVERYONE a ticket. THAT was the purpose for the entire farce. He was generating revenue.
THIRD, there was NO reason to arrest the young woman. It was a typical case of "contempt of cop."
Finally, he clearly enjoyed the young woman's emotional/psychological distress. Most bullies do.
I think that it was wrong to imply that her reaction might have been caused by some underlying problem or from intoxication.

The issue I have with this law is 1. If you are 18 and can fight for your country, you should be able to smoke and drink like an adult. Adult standard needs to be set nationwide. 2. Drinking alcohol is not that bad. It needs to be a minor ticket at best. Being a bad cop is worse.
The officer is overstepping his authority. He was flexing his badge the entire time. He never stopped flexing his badge and made every effort to arrest someone.
She needs to fight this. Hurting a cops feelings shouldn't mean you get arrested.

You’d be surprised. That behavior could start with the local prosecutor. I went to court tonight, when I heard the plea deal for my speed asked for a trial. They said ok and instead of trial that night, they said we’ll choose a later date… the Trooper already came to court and dismissed my case. The prosecutor retaliated and called the trooper for the next time he would be available. This was an American Woman who did this to me.

how else would you expect to handcuff her when she is not complying although the cop took a wrong approach of her arrest. He should have detained them all for underage drinking to find out who is responsible for it like a breathalyzer test or something .

The one thing I have learned in all my years of driving and getting pulled over is not to say anything unless asked. I have been pulled over for minor infractions and let go without a ticket each time. It takes a certain personality type to be a police officer some abuse that power some do not since you don't know which you are dealing with best to be quiet because the ones that do abuse the power can make things very difficult for you.

@@juliana.x0x0 I think all this stems on the fact that he thought he could arrest these girls for MIP so he didn't have much patience when one of them gave him lip. He figured "I'm letting them go and this one is going to still give me a hard time, I'll take her to jail." It would be the same as someone pulled over for reckless driving being given a ticket even though they could be arrested and then giving the cop an attitude. Then most would just take him to jail at that point.

This cop is a serious problem. He openly stated that if his kids would yell at him, he would just slap / beat them, and then "obviously i cant do that to her, but i can do this" to justify arresting her for asking a question. Asking a question is not illegal. Even if she annoyed him, that's not illegal. Heck she could have used pretty offensive speech without this being illegal, but she did not.
What's should be illegal is for this person to be a cop. Absolutely disgusting. He is on a powertrip, breaking the law, not protecting it.

Arresting a single person for non violent speech and letting "non-contesting" persons go is a blatant exanple of using authority to stifle and deter a person from advocating their rights. I fear that every person involved in this incident has been chilled and set up to not question the authority of the Police, and are likely to give up their protections in the future because this incident has taught them that questioning any Officer will result in retaliation.

In the moment, best thing you can do is shut up, get a good lawyer and ask for the body cam footage. Anything more will only result in more charges. If a cop is gonna arrest you, you’re gonna get arrested then it’s up to the court to figure out who was in wrong… you know like the narrator said at the end of the video.

The c+ is more than adequate. The stop was justified. The suspicion of alcohol consumption and open container is grounds especially since the identification process showed that they were under age. During the questioning they admitted to being out there.
His bad area was retaliation. However he did have patience to make sure the other young adults arranged for alternative transport. Tried to interact with the young lady in the car, called her mother for her, and called EMS to ensure she was physically ok after she started to bash her head. In regards to your bring it up with the judge comment, I've seen people do that and the judges first question was "did you ask or say that to the officer?". Then the judge said "if it wasn't an issue at the time of arrest then why is it an issue now that we are in court?".

I really don’t think she was being unreasonable. He should have just told her she can dispute the ticket in court or something. Her questions were genuine. This is disappointing to see that things were handled this way.
He basically terrorized her to the point of crying uncontrollably and asking to be shot. She was literally the passenger, everyone else was let go with a ticket including the driver who was apparently drunk according to his story. It's insane that people are defending this man. He changed the charges and his story 6+ times in this video alone, along with admitting numerous times that she was being detained due to her 'disruptive behavior', because a 18 year old 90lb girl asking questions bruised his ego so hard he needed to cause distress in her entire family, for asking a couple of questions. He didn't do any sobriety checks or search the vehicle. It would be different if she wasn't cooperating and struggling and screaming etc, but she asked like 3 questions. The cop detained her for DUI charges (when she wasn't the driver), THEN let everyone else go with a ticket. He did infringe on her rights, she was so scared that she wanted to be shot and cried uncontrollably. Police quite literally cannot detain people for attitude, which he stated was the reason for her arrest MULTIPLE times. But he did get officer of the year for district 4 with 42 DUI charges so good for him, I am sure non of those were a similar case to this one.

My dad used to be a CHP, and they loved going as hard as possible on any underage drinking and driving to curb that before it becomes an actual DUI or just fatality. What she should have said in a calm voice was please be quiet until your father and I are there with a lawyer. That would have gone on much better, but the cop did paint the daughter in a bad light right when he got on the phone, he made it seem like she was completely out of control (which she wasn’t), the cop purposely set this girl up with the phone call, he knew he had to lie quickly to gain the mothers support (since we all know teenagers talk back and fight with their parents). If the mother had known the true story, I think it would have been a drastically different conversation. I hope she apologized to her daughter after she saw the bodycam footage. Plus she’s a doctor, they will have the money to take this case all the way.

By giving another person the right to incriminate minors the state of New Mexico violates federal law. As such the State of Mexico is in breach of what is called the right to exist as statehood under the federal by laws in and around the subject of legal means.

I usually agree with how you grade interactions. However, that officer literally admitted to arresting that girl for talking back. That violated her 1st Amendment rights. He also arrested her for a non-arrestable offense, which violated her 4th. He was ignorant of his own state's law, and she suffered for it. He deserves an "F", a lawsuit, and an investigation from CPS based on his comments about disciplining his own kids.

I worked 23 years as a Patrol Officer in a Southern State in the USA and I had the opportunity to arrest a lot of intoxicated drivers, I was SFST certified and I was also a DRE , But I NEVER saw alcohol in an arrestee's eyes, NMSP clearly need to retrain this guy before he makes any more BAD arrest !!!!

Fun Fact: This officer received Officer of the Year for district 4 this summer, with 42 DUI charges. If he could detain a passenger with driving under the influence charges, then arrest that passenger because they 'gave him attitude' (which he stated was the reason for her arrest multiple times), then gives the actual driver a ticket and let them go, WITHOUT conducting a single sobriety test or search of the vehicle and the only proof being that he could 'see alcohol in their eyes', then I seriously question every single one of this guys DUI arrests. Police cannot arrest people for hurting their feelings or bruising their ego, if the passenger really should have been arrested then they ALL should have been arrested. It genuinely makes no sense.

If the tickets were arrestable offenses like he said, and he exercised discretion by not arresting, then he didn’t arrest her for the attitude, he simply decline to exercise discretion because of her attitude. “Arrested for a bad attitude” and “not exercising discretion for a bad attitude” aren’t quite the same thing.
If you get pulled over for speeding and you mouth off to the officer and he says “I was going to give you a warning but because of your attitude here’s a ticket”, I don’t think we’d see a problem.
