      If you don’t take the sobriety test it’s an automatic misdemeanor in Minnesota and you lose your license for a year. You said it wasn’t required in Minnesota.

      For a stop like this you MIGHT get ten or fifteen grad if you sue, but you'll probably get nothing. And you'll pay ten grand in legal fees, or more, so a net loss of time and a net gain of nothing. The only time qualified immunity matters is in egregious false arrest where there is bodily injury or property damage.

      The only way to do that is to elect people who don't defend police and their qualified immunity reflexively as a matter of ideology. We all know most people here screaming about unlawful,unconstitutional, illegal and injurious police actions agree with them subconsciously if it happens to people they hate. When it happens to them or people they know and relate to that when they protest .Most will never vote to end those police protections.

      That sounds like a terrible idea. Good cops do exist, and scummy criminals are abundant. Do you know how many of those criminals would financially ruin the lives of good cops just because they can? Even if they never win, the threat of having to deal with personal lawsuits every day would make all the good cops quit.

      is it me, or does it seem as if sheriff departments in general are the main culprits behind the unlawful harassment of citizens...town., city, and state police seem to conduct business with citizens much better than sheriffs overall ..alot of sheriffs as a whole seem to be on this sorta power trip...must be an oversight issue since i'm cure city councils can actually handle local city and town cops who get out of line., while sheriffs have more free reign ..

    Departments need a civilian oversight committee that handles complaints and investigations. Having departments investigate themselves is beyond ridiculous. IA will nearly always side with police despite evidence against police. This needs to stop.

      The city of Austin just voted for civilian oversight by an 80 to 20 percent margin, and the police union says that they'll just ignore the vote. Policing the US is corrupt from the top to the bottom.

      I don't get what cops think their job is, why does he think he should waste so much time "trying to get to the bottom" of why the guy "had an attitude". Surely it's not a part of their job to try to make themselves feel like the traffic stop, if you can even call it that, was right and just. This is a job where you really need to remove emotion/ego from like a lot of others do, seems like cops just have a hard time over it because at the moment they don't have to as they get away with this kinda thing and they have too much power to just make up charges/reasons to breach a person's rights.

      Of the 68 or so Cops that die on duty annually, 42 possibly died from seeing how fast they can speed down the highway, setting a land speed record in a brand new Dodge hemi hellcat on their way to see who can be the first on scene to arrest a granny with dementia for stealing $13 worth of cat food at Wmart. But a good question for officer chicken shi, would be, how many citizens have been shot by police, especially in the back, while unarmed. Cowards with a badge, a gun, massive backup and our tax money. Most cop die from not following training and have a "hero" complex. Who the hell in their right mind would jump in from of a car traveling 60 mph, pop off a few rounds to stop the driver and later the department claims the car mowed him down for no reason. Didn't he/her see how fast that 3000 pound car was swiftly moving in their direction and take cove, hit the ditch or just simply get the hell out the way. So what if the driver stole $45 worth of cheap Chinese made lead based consumer goods off the dollar aisle. At some point in time, the crime has to meet the punishment. Just having my daily fun.     Wow, this officer definitely needs to be terminated ASAP for the actions he took on this traffic stop. If I was in this guys spot, I would definitely make a complaint and also sue the officer civilly in court. This was totally unacceptable! Great video and keep up the great work.

      The police operate in a type of brotherhood- or, at least, that’s what they believe. Police officers believe themselves to be important members of society, at the very top of the ranks.
      Because of this, police officers often consider average citizens to be below them- somewhat like sheep to a shepherd. Cops have to protect average citizens, but the citizens are still stupid

      Why would you want this cop fired? I agree with the driver that there was no need to be approached by the cop, but one less-than-stellar traffic stop hardly calls for the cop to be fired. Put a letter in his file; give him some remedial training. No need to go over the top.

    Anyone else notice cops always say you’re “in the middle” of their scene or traffic stop. They don’t know the law much less the definition of basic words. He was parked fifty or more feet ahead of the traffic stop, nowhere close to being in the middle of anything

    The sheriff of Itasca knows all about retaliatory actions. The city settled a lawsuit on his behalf for over half a million dollars. Makes me think that retaliation is part of the Itasca Sheriff's Office training manual.
    Thanks for all you do in trying to keep people like them in check. I hope Mr. Villa files a suit and takes it to court so it can play out in the public domain.

      Policing has a long history of retaliation across the world. It seems to be an ingrained attitude of the them and us attitude.
      I served for many years and found after front line in a really bad violent area I was getting to hardened.
      It was not my personality.
      It was also a badge of honour to be tough.
      I then deliberately moved to a different role and it went away.
      I eventually took up another career losing my pension etc as I saw to much and could do or say nothing.
      Retaliation could be life threatening.
      An excellent and brave service record means less than bashing and abuse.
      An ex police officer is not popular so you need to relocate far away.
      I am now a senior health professional which suit me better.
      Not all Police start off bad. But they are expected to conform.
      Plus this country did not have the terrible incentive system like USA for money via arrests etc.

    The reason why that officer kept talking and asking “Do you understand my perspective? See where I’m coming from? Wasn’t I being reasonable?” Is to get you to agree so he can use it to fight any coming complaint or lawsuit. That is why you don’t continue to engage in “friendly” chat with an officer when you don’t need to.

    My wife and I were driving back from buying our new truck. I was following her and got stopped because a cop couldn't read my temporary tags due to the red marker.
    She was pulled up in front of me well over 40ft. He asked who it was, and I told him. He was cool. And went on his way. Some of these guys are simply assholes

    This deputy, just like many others, is used to people following his every unlawful demand either because they are scared or they are unaware of their rights. There was no lawful reason the guy had to submit to a sobriety test. I'm sick of seeing these tyrants and this is coming from a former deputy. Another great video. Thank you.

    I recommend never telling them you're going to file a complaint! Don't give them a heads up! File your complaint from the top of the chain of command to the bottom. Less chance of cover-ups or adjustment to reports if they don't know in advance ones intention to file a complaint.

      Me and my manager got pulled over in the white utility body truck because they were looking for a white utility body truck they said.
      That's the first time I kicked on my camera and kept it hidden, I was waiting for some BS.
      He asked my manager where we were coming from and he told him.
      Cop asks if we were coming from another area ,and my manager repeated what he said the first time.
      Cop looked back at his partner with a concerned look ,they were definitely hunting for someone.
      He cut us loose and they burned tire the other way.
      Whole thing took maybe 90 seconds.
      Didnt ask for id or anything, I was waiting for that one.
      I wager since they really were looking for someone, they didnt have time to mess around with the wrong guys (us) and need to drum up some charges.

      I'm allways in awe that in the USA a breathalizer is not the first thing used by a cop if he's suspicious of DUI. Here in Europe (at least in Spain) if they stop you to check if you are sober while driving the first thing they make you do is a breath test. If you pass it but you are obviously not in your best moment, they can proceed to field tests. If you fail the field tests (you must actually fail them, it's not like in the US, there's no quota to falsely fill and police is expected to have standards and professionalism,, as it's pretty difficult to get a job as a cop here: minimal bachelor studies required, a lot of academy studies and training, and after that only the best are given a job because of limitation of job opportunities as a cop; when the government announces new places to fill, every person interested to be a cop must pass a test and get higher marks than the rest to compete with everyone else for that job) they can force you to blood test. Of course, you can deny breath test, but in echange of performing a blood test instead. Usually when police checkpoints are stablished to stop drunken drivers they also carry with them an ambulance with the personal and equipment necessary to perform blood tests on the field.

    Rule #1, keep your window rolled up and never talk to police but immediately record them the whole time. This officer like many others appears to think they can order ID from anyone at any time. This needs to be addressed with every law enforcement agency to properly train on when you can or cannot demand ID.

    I have dealt with this exact same officer before. He is a nightmare and he tried pushing away my rights from the moment of the traffic stop and then he proceeded to pull my buddy out of the car and ask him “does your buddy have any crack or dope on him” speaking about me becausey DL address showed North Mpls and that’s considered the bad area so they figured I must be running drugs up north.

      You've gotta consider how much of an inconvenience it is to be arrested. Not only the time spent in jail, but the potential ramifications. With the guilty until proven innocent mindset ingrained in society, simply being arrested is enough to be fired or denied employment opportunities among other important things. Considering all of this, it's really a shame that false arrest isn't taken as seriously as it is. We truly live in a police state.

    I remember when a California police department or BMV entered one digit of my social incorrectly so I had a warrant on my license. I got pulled over 6 times leaving work before I could resolve the issue. It was harder for them to correct their mistake than it was for them to make it!

      He will never learn from his mistakes because of qualified immunity and unions and the taxpayers paying for the lawsuit. Nothing happens to the officer

    Shit like this goes on because cops want you fear them...Fear that for ANY reason they see fit, you can and will be arrested... To them, fear ensures compliance...fear of arrest, ensures compliance... Violating this guy's rights and admitting to it, I hope he hires a lawyer and gets a significant payday

    ever notice, once you ask for a "business" card they start talking to you, almost like they're trying to get you upset so you forget to ask again. Because we all Know officers love citizens so much you need to ask multiple times.

    Screw these cops. Filing a complaint isn’t enough. Have the lawyer take his ass to court. Press charges. This should be SOP for citizens in this country now.
