      I saw this video and I just have to say... was a dumb thing to have his kids yell out the window to the police, knowing how these crazy, insane lunatics behave.
      Keep your kids out of any police interactions. Teach them but this was not so positive for them as we saw.

      They interrupt to get a reaction from you on their body cam, which can be seen as "unreasonable" and can be the reason for your loss in court. Better to let them "copsplain" and then get your turn to speak on camera. The first time they interrupt you, start calmly noting that interuption verbally and get it on camera as well. Then THEY will be the unreasonable ones. It will go better for you in court.

    The way that Sgt almost loses his cool when Rights Crispy interrupts him and has to stare off in the distance to calm himself down is very troubling. That Sgt is so angry that he literally has to stop himself. I've seen that behavior before and that man is going to come unglued someday. Someone even if they are interrupting shouldn't make you that upset. He shouldn't be an officer much less a Sgt.

      Because the homeless in that area are ridiculous, I live where this video was taken, Newberry and Parker rds in Gainesville FL. The homeless in that area will shit in the bushes right next to the road in full view. Will leave needles on the sidewalk under the overpass where they've made their camp. As seen in the video they will stand on the center median and panhandle and many have been struck by cars because they just step out into traffic off the median. And that's assuming they're not wandering like zombies zooted out of their minds because of what ever drug they're on. They even had to build walls next to he road because they would throw stuff at cars passing by under the bridge.

      Regardless of why a pile of sh_t dressed in police uniform is talking to a citizen, a passerby has lawful right to call out to the pile of sh_t dressed in police uniform "leave him alone". The POS supervisor was another thug. He showed narcissistic tendencies. The first and subsequent things he said to the citizen were what is called gaslighting, "you're using some kind of condescending terms", "you keep interrupting me". Plus the condescending body language and dismissiveness the POS supervisor showed the citizen. When you get gaslighted never defend the gaslight but simply point out that the creature has gaslighted you when they did or said whatever and tell them you are going to gaslight them back. Then you gaslight them back and tell them you have done so and tell them now we are even. Example, "you're using some kind of condescending terms". Response, "hey you just gaslighted me so now I'm going to gaslight you back, why are you such an aggressive public servant, where are your manners, now we are even. They gaslight you again, rinse and repeat. Never let these bullies control you. Another thing, threaten their job and pay packet or put a little seed of doubt in their tiny pea brains that those things may now be compromised. Watch their weak little dumb heads try tom deal with that.

    The courts need to firmly put this notion to rest that merely "distracting" a police officer amounts to interfering. If that's the bar, who isn't interfering?
    A crow caws from a nearby rooftop. A car alarm goes off down the street. A nearby church's bell peals. A group of children are talking loudly in a crosswalk. A neon sign flashes the name of a local business. A man calls out to get his friend's attention down the block.
    If a police officer finds his attention diverted by these things, do they amount to distracting too? Or does that only apply when the cop is upset about something?

      All of them. Cops don’t pay that settlement or award out, so they dont care. Until law enforcement is brought to heel and made to pay out of their own pockets for violating citizen’s Rights, the abuse will continue. A good start would be to start making the police unions pay out the damages, etc.

      The Bill of Rights is "Anti-Police", according to how police think.
      If police departments were as influential in 1791 as they are today, the founding fathers would have never been allowed to create the Bill of Rights.

      You do understand that not even lawyers or judges know all laws, right? There are thousands of laws and ordinances per city/town then there's the thousands of county laws/ordinances, then state, then federal. Expecting police to memorize *all of them* is ignorant. They do however need clear procedures on how to handle situations where they aren't familiar with the specific code they're currently dealing with that does require unlawful detainment.

      @@casey360360 OK, first of all, your argument is ignorant. A cop only needs to know the laws and ordinances applying to HIS city/town NOT EVERY TOWN IN THE U.S./WORLD. He only needs to know the laws he is likely to enforce. If it is illegal to have an inbreed Portuguese hamster, then somebody can look that up while getting a warrant. Or they probably made an entire law enforcement agency to deal with the hamster and he can leave it to them. If they stop treating little shit like CRIME OF THE CENTURY, then they can investigate and research before kidnapping people from the street. Seriously, hospitalizing innocent civilians just in case they might be illegal hamster smugglers that will flee justice is ABSURD.
      Secondly, strangely enough, CITIZENS are required to know EVERY applicable law. The cops who can't be expected to know the law can arrest ME for not knowing the law. And some of these laws of which you speak are really insane. Someone gives me their pet hamster and now I'm facing TEN YEARS in a steel cage.
      Finally, if the cops just understood the First, Second, and Fourth Amendments, some basic Proper Use of Force rules, and didn't act like know-it-all dicks when it comes to everything else, then 99% of these problems would disappear. However, they can't help themselves, and acting like a know-it-all dick actually HELPS them in court because the QI doctrine is severely flawed.

    I actually used to handle accident liability claims in Florida. The sergeant is wrong. If someone had rear ended Rights Crispy, in Florida, the car that hit him would be liable not him. You can't fix stupid.

    It is amazing how they hate to be wrong. The authoritarian attitudes with law enforcement is unsettling. I get it they deal with hard population of people but they see themselves as a hammer and everyone is a nail. It is hard not to treat them the same way. When they ask to see their position objectively and they want empathy and sympathy from the citizen, just have one or two encounters with them where you are exercising the freedoms given to us and boy howdy you will come away thinking they all truly stink

      The sergeant was telling the man he's wrong before hearing his side of the story. The cop looked increasingly frustrated every time the man filming explained his assumptions were incorrect.
      He was more comfortable telling him not to do things that never occured, instead of genuinely trying to assist the man.

    Cops picking on the homeless, that's the lowest of the low, it's disgusting and shame on any police officer that has or will abuse someone who lives on the streets and is far worse off in life than they are. 🤬
    I commended Rights Crispy for what he said to those cops, at least he was looking out for and caring about the homeless man, more than those ego narcissistic, evil, hypocritical, corrupt and tyrannical police officers were.
    The conduct, attitude and behaviour of all those cops in the video was absolutely disgusting, none of them deserve to be a law enforcement officer in my opinion.
    They treated Rights Crispy like a piece of 💩, showed no professionalism and respect towards him whatsoever, all they wanted to do was go on a big ego trip, spout a load of BS and try to punish the auditor in some way by making up bogus charges to cite or arrest him for.

      In Alachua County you can panhandle almost anywhere you want, but it's illegal to panhandle from the median, for very good reason - several panhandlers have been injured/killed because of standing on often very narrow medians.

      He wasn't being harassed, he was panhandling on the center median which is illegal. I live in that exact area in Gainesville FL. The reason it's illegal is becasue when they panhandle there they don't look for traffic and many have been hit by cars.

    It’s always nice to see we pay more money for supervisors that always 100% of the time refuse to actually supervise… it’s every single time that the officers we pay more to are just worse than the lower paid officers… so long as we allow the officers to do this it will always continue… no one does anything so expect the same

    People erroneously believe that ‘educating’ police will solve problems like these. The fundamental issue that you have power mad government goons running around with almost zero consequences. If you want to tyrant cops, either completely change the way police function (private police, perhaps?) or change the way the policing system is governed, organized, and legally accounted for.

    I was pulled over in this county several years back. Literally just pulled out of a gas station at 7:00 in the morning and had not put my seat belt on. Felony stop, two cops, out of the car. Two 50 something’s in a mini van. Then lied, most unprofessional officers I’ve ever dealt with.

    SPEECH IS NOT OBSTRUCTION. The United States Supreme Court recognized this protection in City of Houston V. Hill, (1987) . Offensive language and gestures towards cops are protected speech as long as no direct threats are made. In Hill, the defendant watched as police approached a friend. Believing that the police officers were going to punch his friend, Hill began shouting at police, telling them to "`pick on somebody your own size.'" Hill, 482 U.S. at 454, 107 S.Ct. 2502. Hill was arrested under a municipal obstruction ordinance. In declaring that ordinance invalid under the First Amendment, the Court sagely remarked that "[t]he freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state."

    Any republican should pass a simple law which states that if a cop violates a law (un)knowingly they simply get punished for twice the punishment a regular person would get punished for. And make them require liability insurance so any damages will have to be paid for by an insurance company so they'll do the screening for police officers instead.

    Here is the complaint I filed with the Sheriff's Dept:

    RUclips video depicts driver & his children shout through window of their car at deputies investigating a man panhandling on a street median, "Leave him alone." Upon hearing their words, Deputy Diaz says, "Hey, pull over man. You're yelling at us, interfering in an investigation." When the driver says their words are protected free speech and that interference is a physical act, Dept Diaz says it's not and tells him to "Pull over right here for me please." This constitutes an order that initiates a Terry Stop detention.
    The driver requested the deputy call a sergeant several times, but the deputy refused, saying, "You call him yourself." After the driver pulled over, the deputies let the homeless man go and focused their attention on threatening the driver with arrest for interference.
    When Sergeant Davis arrives, he misunderstood the facts, claiming that the reason the driver was being detained was for stopping in the road (obstructing traffic) to yell at the deputies, and that the deputies told him to move on but he didn't. The driver attempts to correct the sergeants misinterpretation of the facts, explaining that the deputies ordered him to pull over and that it was a detention. The sergeant refused to listen and never understood that the driver had been detained, and that the driver never blocked traffic (he was waiting at a red light when he was told to pull over).
    The sergeant escalated the encounter, failed to investigate the driver's complaint, and attempted to suppress the driver's 1st Amendment rights by telling him not to yell his opinions to deputies in the field but rather to call their office when he wants to complain. Sgt Davis was condescending, rude, interrupted, and escalated the encounter. He then implicitly threatened the driver with "harassing law enforcement" when the driver asked the deputies for their names and badge numbers, read the driver's license plate out loud, and said it would be "flagged as an individual who is intentionally trying to harass law enforcement," a threat designed to further chill the driver's free speech.
    These three employees erroneously believe that shouting, "Leave him alone" through a car window at deputies investigating a pan handler violates the law. It does not. It is constitutionally protected speech. The subsequent Terry Stop was retaliatory and unlawful, since no crime had occurred. In fact, Deputy Aldus claimed the driver had his seat belt off, which was not true, in an apparent attempt to create a pretext for the violation since he may have suspected the driver's speech was not criminal. All three have a profound misunderstanding of the interference statute, and Sgt Davis misunderstood the constraints of the harassment of law enforcement statute (asking for name and badge # is not a violation).
    It is apparent that the content of the driver's speech was what initiated the law enforcement action. If they had shouted, "Thank you officers" as they drove by, this never would have happened. Their behavior has created legal liability for the taxpayers as the driver would likely prevail in a lawsuit. Please investigate this incident with the seriousness it deserves, and provide 1st Amendment training for all personnel who interact with the public.

    Some of these cops will NEVER admit to their wrongs even when the war has been won against them. I use to be very much against questioning a police officer but my granson yrs ago and these videos has taught me alot. There are many upstanding cops but I'm now believing they are few and far between. Tyfs God bless you
