      AGAIN I say. The fight is to END QUALIFIED IMMUNITY. Nothing will change until this happens.

      the dude put himself in-between the camera and the investigation, meaning he was closer than the auditor who was asked to step back. the dude was allowed to act like an actual deranged dangerous crazy person decently close to the investigation without a glance from them, while man with a camera was argued and fought with to stand decently far back by multiple officers.

      I've lived in Colorado most of my life. Wasn't always like this. You can thank all the transplants that moved here over the past 4-5 years. The cops are overworked and their answer is to not do their jobs.

      If anyone even cares to remember recent history, the prosecutor in the Kyle Rittenhouse trial tried to use that very thing against Kyle Rittenhouse. Tried saying Rittenhouse had no right to defend himself because he instigated the conflict. Fortunately the jury did not believe the prosecution.
      I wish the cameraman would have maced the guy and he would have been within his rights to defend himself against a reasonable threat of violence.

    The very fact that that "cprl" cop told the auditor, if he took one step towards him, he'd be arrested; and nodded to the cop watching everything but doing nothing, to arrest you if you moved, and they were 5-6feet apart; and he compares that to the "publicly drunk/high batterer" getting right up to the auditor, nose to nose, spitting his threats of violence, right in front of the police, is jaw dropping!

      assault requires bodily injury, the cop did ask if cameraman was caused (physical) pain by the the goon, cameraman said no. pain is the weakest version of bodily injury.
      There is the perspective as in viewing angle, line of sight, point of focus, etc. of the cameraman, his camera, the officer, the officer's body camera. Each of these is different, what one captures, the others may not.
      The primary probability threat of damage in assault, is the hands so even when looking at the goon the officer's focus may well have been on those or the waist which is a primary indicator of larger movement.
      The other officer, that was not near the goon/cameraman during the traffic stock when he came over to investigate did ask to view the recording to check its recorded viewpoint to see if Proof of a violation did occur, but then in a SELF FULFILLING prophecy the cameraman refuses to show the officers the recording saying/claiming they wouldn't do anything anyways.
      The goon is a pro bully, at toeing the line between being utterly obnoxious and clearly violating the law in a clear and articulable way that would prevent even officers who want to arrest from doing so without goon being able to win a lawsuit against them for unjustifiable arrest.
      The best I saw, was attempted assault, when goon tried to lick cameraman, but cameraman dodged. If cameraman hadn't dodged then it would be assault, but still a pretty low misdemeanor assault, attempted crimes are typically one or more degrees lower in the penalty tree, so a crime that would be the lowest level of misdemeanor then take an attempt version of that the lawyers and judges are going to laugh that right out of the court system as a waste of court resources. And for misdemeanors, the mere word of another is not PC for arrest, so the officers would need to either review cameraman's camera footage, or their own body cams which may not have a view confirming a crime.
      It is not always about the truth, it is about what one can prove.

      @@idminister dude, there is literally a page from Colorado law that states what qualifies as assault and what degree each one falls under IN THE VIDEO! You can't intimidate and harass someone for filming in public and yes getting in someone's face while threatening them and being so close you're spitting on them and touching them WITHOUT CONSENT is definitely not legal and he would have qualified for multiple charges.

      The discussion of private vs public sector is idealized and doesn't accurately describe the current state of oligopoly in the United States. If you have a cable internet provider like Comcast, Cox, or Cablevision, they don't compete in your area. If their service is poor, you can maybe switch to satellite (and lose good internet) or DSL/fiber (and lose most broadcast channels), but you're not going to find the same product from a different vendor. The same absence of real choice due to absence of genuine competition exists at all levels of the market, whether it's an electric option for a car (this is slowly changing, but was a famous example of oligopoly suppressing innovation) or a soda that doesn't contain HFCS. The big providers in the market have decided that certain options just shouldn't exist, and there's no alternatives to the handful of big vendors that own the entire market share.

    They saw exactly what happened. They know all of it was recorded. They know he will be filing the complaint. All of this and they still absolutely do nothing. That just shows how confident they are that they will not get punished in any way. This is literally the only job in this nation that you can get rewarded after committing multiple felonies. They can murder someone in cold blood and get paid vacation for it.

      A much bigger issue are the numerous SCOTUS decisions that give blanket immunity of duty policy and procedure of law enforcement while in the official authority and duty their job LEGALLY has assigned them, and for which they receive public funding to perform yet regularly do not. Look at all the SCOTUS cases wherein a citizen has filed litigation against an individual/ group of officers department or agency where a Constitutional/Civil Rights infraction has occurred and in how many of those cases SCOTUS has Ruled/decided in favor of law enforcement over the citizen with the written decision basically copsplaining why and how our rights are not applicable or applied in clear bias to governmental authoritative overreach.

      Sovereign immunity is necessary for government to function. Do we really want everyone who dislikes a government action to have standing to file a suit? Qualified immunity is simply defined poorly. One decision that officers can't use dogs against surrendered suspects should be enough, whether the suspect is prone or has their hands up.

    The retaliation is clear. They showed animus for you the entire time, and as soon as you were in danger from that tweaker, they retaliated against you by not intervening.
    That one cop even aimed Terry at you by making it sound like you were working WITH the police, the whole "he's filming for everyone's protection" is what tripped Terry's mental switch. That put in Terry's mind that you weren't on _his_ side, you were on _their_ side. It was immediately after that point that Terry shifted his animus to you. That's when he flip flopped and started saying you don't have his permission to film him.
    It's that interaction that shifted you from what he perceived as his side to the cops' side. They not only retaliated by not assisting you, and lying about the law, they tried to get you hurt by effectively aiming that tweaker at you. They didn't assist you because they caused that to happen. Why would they want to stop it? Terry was now doing what they wanted, and distracting you from them.

    It seems that when the auditor is fully versed in knowledge of the law and ignores unlawful orders, the officers react like they really are mentally unbalanced since their threat of arrest and power to do so is neutralized. So instead of accepting the circumstances and do their jobs as they intended, they result to hostile language and body movements.

Right in front of the police! They better take this all the way. Dereliction of duty after witnessing the crimes within 2-3 feet of that one officer. Oh well judge I told the guy to back up but so quietly I knew he wouldn’t hear me. Sue every cop on scene, the Sargent, oops I mean manager, and city! Everyone.     These Colorado cops don't have qualified immunity anymore and are liable to pay for up to $25000 on lawsuits and they're still acting like clowns.

    It blows my mind that these people who are to enforce the laws only receives 3-to-6-month training. None of which covers the law, most is how to fight and arrest. I went to college for 3 years for my paralegal's degree in criminology and domestics, yet I would not be able to be an officer without their programing.

Honestly, as a proponent of smaller government, I think that independent private oversight over each individual police department is a vital check to balance out the powers and authorities police have been granted.

      @@ctom4932 I've been paying attention to politics for 20 years now (I'm 40), and I've always had bad experiences with cops because I'm a large man, so they get their cop safety on around me.
      I was hopeful when the Right and Left were talking about police accountability for about a year before the whole hands up don't shoot event went national... And political.
      That's when the Right foolishly went all in on Back the Blue and galvanized themselves against any substantive police reforms.
      Police problems are everyone's problem, not just a black community problem. I agree that cops are big jerks with black guys, but they are with white guys too. It's not okay for cops to behave like that with ANYONE

    Given the level of police officer and location, qualified immunity is already not available to these officers. Colorado has, at a state level, removed qualified immunity under the "Law Enforcement Integrity and Accountability Act' which was passed and signed into law.

      Frasier v. Evans says otherwise. Police can issue unlawful orders, destroy evidence, and intimidate auditors throughout the 10th circuit, and they can do so with impunity even if their own training manuals tell them not to.

And the dereliction of duty was actually pretty impressive. They could’ve easily have deescalated the situation but instead they let the one guy who should’ve been arrested just walk away!     The cop wants the videographer to push the offender away or something so he can arrest him instead of the offender. That dude was totally wacked out on something because he wasn’t drunk! Extremely dangerous

    "if I back up 3 feet is that enough"... this is a classic case of officers with a "submission addiction" and all they want is to make you do SOMETHING for a mental fix to their addiction of submitting people, anyone who doesn't submit immediately amps up their emotions and they consider you a dangerous threat because you're not willing to take 3 steps... thats how bad it is... when officers seek a mental fix for their unstable emotions, its a warning sign they are mentally unfit for duty.

    It's amazing that the cop said they didn't think rose to criminal charges, but when someone is handcuffed and thrown to ground there is usually the charge of assault on officer.

    The way it looked to me that the Denver police set it up. I don’t know I wasn’t there, but I wouldn’t put beneath them. I think United States should go to private police I don’t like using the word defund the police department I just say I do away with them. Thank you for going out there and showing people exactly why every day people has to deal with not the rich, not the famous, but the average citizen out on the street or in their home has to deal with the police and treating in their lives and making every situation worse. Thank you.

      I disagree. I find it highly unlikely that “Terry Gillio” is military. And if he is, he may get busted down to private very soon. The Uniform Code of Military Justice has very strict regulations regarding assault and interactions with civilians. Rude behavior towards civilians is a punishable offense as it’s considered a disgrace upon whichever branch of the service you’re in.

    I remember once in London walking around in the wharves for a New Year's eve event. They had closed the underground forcing people to walk 2 stations around in order get to the event. What impressed me is how proud they were of their crowd control skills, there were literally so many people attending the visibility was barely one meter, you could only find your way by following the heard. And in the end they of course messed up. They had not evacuated the homeless of the area and I would not be surprised if more than a couple were trampled to death. But the cops were really proud for their ability to restrict access to the underground to waves of 100 people. Shows what cops really consider their job 2 be. Smiling every time they got to pose an obstacle to the crowd as if someone gave them candy.

      Currently through property tax I pay over $1000 per year to my county police, plus other taxes. It would be interesting if instead I could buy "Police Insurance" and have companies or freelance police officers competing for buisness by having excellent service. The best police officer might make 1 million $ per year but if people choose to have him patrol their neighborhoods he might be worth it, he has a self interest in not getting sued or hurting people for no reason.
      One obvious solution for public police departments is to allow residents to vote on every police officer in the same way we vote for judges or mayors. Why wouldn't residents of a neighborhood be able to choose who provides the service. It is always a small number of people that commit abusive crimes, so voting would work in that situation. A transparent and professional police department will work also, but that does not exist in many places, it is great in places were police are open and honest.
      There are solutions to making non government police less expensive. Obviously we can have neighborhood volunteer police, or for paid police we can have, Police insurance. I have never needed a police officer in my life, so I would be a net loser of money, in the same way I am lucky enough to never need to use my health insurance.
      The difference is there can be competing companies that immediately fire an officer the second bad behavior is witnessed. The company will find the BEST people for the job to avoid losing money or to keep a good reputation.
      The company will assess that a war a drugs is too dangerous and only creates underground black markets that are kept profitable due to police making drugs rare and more valuable. Instead health insurance or clinics will provide safe drugs(mood boosting substances) that will immediately put fentinyl dealers out of buisness. Every fentinyl death is because drugs are illegal and drug users are forced to go to secret black markets.
      These are just my opinions, but I welcome a conversation to anyone that thinks I am wrong or have to rethink something.

      @Nicholas Time Nicholas you didn't really make much of an argument, you just called someone a dinguss... Being able to have "Police Insurance" and choose the best police service would definitely guarantee better results since there is no incentive to hurt people and defend bad police that don't have to have high standards.
      A public alternative would be for residents to VOTE and choose their police officers in the same way judges and mayor's are elected.
      The 3rd option which is to have transparent honest police departments where nothing is kept secret from citizen. That is what should exist currently, but doesn't exist in enough places

      Yea, kinda needlessly antagonistic from all parties, I’d like to say I wouldn’t do that in a situation similar but emotions can get the best of you after being in situations like that. That’s why cops need to be better, to not let those emotions change the outcome. To me there isn’t a need to insult the cops that didn’t do anything to me yet. Respect isn’t handed out but if I’m treated with respect from a cop (while also not having my rights infringed) even though I’m not a fan, I have no reason to cuss them out or call them shit.
