@@thomasryan2679 While that can be the safest course of action, many states have laws put in place to automatically suspend your DL for a set period of time for failing to comply. A lot of cheaper than a DWI as long as you maintain the terms or are lucky enough to not be pulled over during that time frame if you are driving.

Specialized? Lol. They pick a person to go take the classes to learn how to operate their specific brand of breathalyzer. He's his depts specialist because he's only one they sent for the training. Instead of training them all. This was the course of action for small town police dept. I imagine it's a common practice.

Judging by these two officers actions, the very LAST thing they are concerned with is "public safety". Like many others, they ARE interested in power and control. Even after passing the test, the cop just HAD to issue his rehearsed lecture, like talking to a 5-year old.
FST been hilarious and scary at the same time. In Finland cops NEVER run such bullshit test. Loosing your balance, slurred speech etc are indicators of drunk driving but prove absolutely nothing since person just might have bad balance or medical issue that does not effect driving capability. Breathalyzer is used almost every time, and/or "lollipop" (field drug test) and if these tests show over the limit, then person is taken to jail, or if they demand it to blood test that has to confirm breathalyzers or lollipops result. This is cause breathalyzer test is not 100% accurate, but blood test is. Most often these are boarder line cases where its 0.01 over the legal limit and most cases alcohol percentage has dropped below before person gets into blood test, so charges are dropped and this should be the goal of these tests. It wastes drivers time but they are then under the limit so no harm no foul. Our cops also tend to give drivers 5-15 minutes since smoking cigarettes and even hand sanitizer effects the result. Also cops here did volunteer based study and found out that from all the drivers percipients that were under influence of chemical if i recall right 80% were under influence.. of prescription drugs, where alcohol was 10% and rest of the illegal drugs made up another 10%. So i would be more worried about drivers that wont even tap the breathalyzer or lollipop tests...
@@bindingcurve it's also highly subjective by whomever administers it. The cops like them because a "failure" combined with an additional test upon return to the station helps their case. While the breathalyzer isn't perfect, it's objective at least. However a register of .009 is pretty laughable for the cops to say the things he said. A breath mint 15-30 mins prior can register higher than that.
@@Hellsong89 While I think that the smartest thing to do in general is avoid doing FSTs, doing them is exactly what proved to the police that I was ok to drive in the only experience I’ve had with being investigated for a DUI many years ago, and I was probably just at the legal limit or a bit over - this was when the limit was .10 instead of .08 (however, I didn’t do the roadside breathalyzer [which _GREATLY_ frustrated the cops as they tried to convince me a million different ways to do the test, saying I had nothing to worry about if I was below the legal limit etc etc, but I continued to tell them that I simply didn’t trust their accuracy and heard about many instances where they were very inaccurate]; that was my way of calling their bluff... Either they had enough probable cause to arrest me by then after I had done all their FSTs or they didn’t - and I told them I’d do however many more FSTs they wanted me to do because I knew I was acing them, but I absolutely was _NOT_ going to blow into their roadside breathalyzer as that would have likely gotten me arrested).
An inner ear infection would throw your balance off enough to fail a FST. Tiredness would cause you to fail a FST. A strong wind would cause you to fail a FST. A really cold night would cause you to fail a FST. Plus, if a cop has just _decided_ you are DUI, then you’ll fail an FST anyway.
He just said it "it makes our job harder and doesn't improve the outcome." So it makes their job harder & we don't go to jail and they hate it! He definitely would've been charged with DUI, no doubt in my mind if he took the tests!
They use the finger following test before the walk the white line test to throw you off balance. Its like being spun around afew times and trying to walk... Science prob gavem the trick...

I lived in Canton Ga for 10 years about 8 miles north of Woodstock Ga. This is one of the most hated departments in the state. They lost their certification to patrol interstate within their city limits. When they applied to get recertified, people came from all over the state to protest this department getting any kind of certification to do. Traffic stops on the interstate that runs through their jurisdiction!

Meanwhile, the cop runs stop signs, drives in the wrong lane, and speeds, BEFORE, BEFORE observing the driver almost run into the ditch. Now, he takes the breath test, if it comes out higher then .08 he is guilty of drunk driving, if it comes out lower then .08 (in this case 10 times lower) he is still guilty of drunk driving. So, note to all, never take their tests. They will not exonerate you. More lying cops who don't understand why people have stopped trusting them.
Based on what LackLuster said, you pretty much HAVE to agree to some kind of test. And I'd recommend the breathalyzer over the field sobriety test, because even though both are inaccurate the breathalyzer needs to be followed up by a blood test if you show you're over. And that IS very accurate, if done correctly. Failing the breathalyzer also puts you on notice that you need to contact a lawyer ASAP, before the cops get evidence that can be submitted to a court.

When people take the time to understand their rights we become "roadside lawyers". The problem is the average citizen understands more about the law and constitutional rights then the average cop. I'm amazed how he tried to convince this gentlemen of wrong doing.
The ironic thing is a lot of cops believe they understand the law better even making up laws to confuse you...so would that mean a cop that spent three months learning the superficials of searches, holdings, and variois criminal offenses has a similar competency for the law as someone that spent 4 years specialising in it? Had this discussion with a friend thats a cop about asset forfeiture, and insisted that it requires a conviction and be directly tied to a crine you have been charged with everywhere, not just in our state.
I got out of a red light ticket because the cop did not get me on video (not running a red light) and he broke the posted speed limit without lights or siren to pull me over. ALWAYS get their dash cam video and look for their mistakes. They make a living off of ours.

This is a very good example of law enforcement using "professionalism" to attempt to cover up lies, tyranny, unlawful stops etc.. Most of the time, no matter how nice or polite they may seem they are never trying to help you out or protect your constitutional/judicial rights. ALWAYS be informed of your rights in and out of court and know how to effectively assert them, that's better protection than you'll ever receive from any government agent.

Cops job is to put citizens in jail and anything they can do or say to make that happen is a bonus. Citizens weapon against cops is knowledge and cops don’t don’t like knowledgeable people at traffic stops. The second cop was not there to be sure the driver was safe to drive, but instead use the DUI test to say he failed the test. With a breathalyser, he can only go by what the display readout.
What gives cops the delusion that the public has to help them do their job??? We explicitly have a constitutional right NOT to assist any investigation against ourselves!!!!

The DUI cop saying that their presence alone makes some people nervous. That is 100% true. I don't know if it's because I used to have a reason to be nervous (cannabis smoke that would have to drive to pick up cannabis). Now I don't have any reason to be nervous, but my heart rate still jumps when a cop gets behind me even with me doing nothing illegal.
Isn't that just a symptom, or reaction to the overzealous and often times corrupt policing? Add to it that some reactions with police are cordial, and it causes confusion and stress to almost every interaction.

As a roadside attorney thats online too much, I can report that when cops are videoed being pulled over for suspicion of DUI they almost never take the field sobriety test. Hmm, wonder why that is?
Exactly, every time the cops get sued the only public statement they make is, "we cannot comment on pending litigation". Because the cops know, better than anyone, that the smartest thing to do is remain silent!!
The Sam Browne belts they wear, constrict and compress their lower spine. Many cops with this problem will have narcotics dispensed to them via a police oriented physician. Oxycontin is one of these drugs.

This was a good one. Them DUI stops can be super stressful, especially when you know you're not under the influence. But like you said, most people feel intimidated and pressured to convince a cop of no wrongdoing, so they comply comply comply. When in reality it is up to the cop to prove it and you don't have to assist him in obtaining proof against yourself.
And that cop tried to pressure him every way he could into taking those tests. You know where he said and the cops are the only ones that knows the trick to those tests.

It’s great that he obtained the dashcam videos from both officers, I hope he filed complaints against them for their reckless response in pulling him over and actually committing more infractions than they accused him of along with policy violations.
Maybe if the LEO's spent a little more time online they would know exactly where they were going wrong. These videos should be in the training at this point.
I'm glad that the body camera footage was seen on this video. This is a perfect example of law enforcement getting away with vehicle infractions in the line of duty. It's no wonder why the guys ticket was thrown out after they seen the body can't footage. I think that if you're stopped by law enforcement, you should always FOIA the body cam footage for your case. The driver, when asked where his friends house was, said "I don't know the address, but it is two minutes down the road". Then the cop tells the other cop he refused to answer. This is the bullshit that needs to stop.
I had a police officer friend of mine (I was his Mechanic) I asked him to do that test on me just to see if I'd pass & he stated to me the test is flawed & that I wouldn't be able to pass it as he had to practice the movements to give the examples several times & he was correct I was completely sober & I wasn't able to perform the test correctly as he said it it's an agility test that most people will fail.
He shouldn’t have been so respectful. He should’ve told the first officer that he crossed the white line because he was afraid he was about to be rear-ended. Then he should’ve told the DUI officer that he sounded slammed, was slurring his words, and could barely put together a coherent sentence.
Field sobriety tests are absolutely ridiculous, I was given one when I was sleeping in my backseat after driving for 25 hours straight and had my friend drive for me so I can get a few hours. I was woken up by a flashlight in my face and dragged out of the car, being told I am under the influence of drugs or drunk the state trooper kept saying I was even tho he literally just woke me up from a sleep. He kept saying that and kept insisting even though I have not smoked since I was 18 I was 24 at the time and didn’t have a drink of alcohol since I was 23. Cop tried to arrest me because he kept screaming at me even tho I “ passed” his tests but then told my friends in the car I am not allowed in the drivers seat because I was intoxicated. But yet I was in the backseat not even driving but yet I was the only one pulled out of the car and harassed.

A roadside breath test on a breathalyser in the UK, is just an indication test... and an evidential breath test, is then carried out on a more accurate machine at the police station. Sure there are a number of factors that could cause the roadside breath test to be inaccurate, some of which this testing officer performed. Merely using any roadside test, without backing it up with more accurate testing; will always be fraught with subjectivity and could all hinge on whether the police officer is having a bad hair day or not...!

First breath test it's just for reference, but it's close to illegal amount of alcohol in blood then you'll have to perform it again with the more precise machine. However, they usually have this police van that comes to the traffic stop that carries the proper breath machine inside, so there's no need to go to the police station. I've never heard of police making you one of those balance test. Only saw them in American movies (and now on RUclips). I don't think a judge would take them as reliable at all.

The DUI enforcement officer was lying by saying that the breathalyzer showed the driver almost intoxicated and played the suspicious card and the observer driving card to give the other officer the power to do whatever he wanted.
4:05 You can see that the officer's body camera is pointed directly at the tag light and you can also CLEARLY see that the light is illuminated, so this is just another excuse for pulling Ashton over based on the fact that he swerved defensively because the officer flew up on him at a high rate of speed.
So the officer first states that the breathalyzer is inadmissible as evidence in court. The he later states that field sobriety tests ARE admissible. So what he did was CONFIRM that you shouldn’t take the field sobriety test! Duh.
Wonderful. He touches that straw with a finger that was just knuckle deep in his nostril about 10 minutes before. Is there any reason they give this kind of authority to an 8th grade drop out?
If suspicious behavior is more accurate, the second officer's actions were very suspicious. He drove 30mph over the speed limit without activating his lights, he said "put that in your phone" then seconds later he said," pocket", which displays he can't keep his train of thought. He also forgot to put on gloves, to use the breath test, leaving all kinds of germs on the straw. Maybe he's the one who should be tested for drugs or alcohol! Telling the driver the breath test isn't as accurate, after administering it, is exactly why they shouldn't be allowed. The other tests are EXTREMELY subjective, as was demonstrated when a Georgia officer arrested several individuals for DUI, based only on those tests, and not a breath test. Because someone took an antibiotic, he told him that could impair his driving and did a field sobriety test, failing him, and arresting him. His blood work came back 100% clean, and his chief told a newspaper that blood tests aren't as accurate as his officers training in doing field sobriety tests! That's exactly why no one should agree to a roadside field sobriety test. If you haven't been drinking, you could agree to do the breath test, to prove they had no reason to arrest you, if they do. Cops are awarded for the most dui arrests. It doesn't matter if blood tests later determine there were no drugs or alcohol involved. It still counts as a good dui arrest! That only gives cops incentive to cheat the system and arrest innocent citizens! They don't look at them as people, whose lives they are messing up for a DUI arrest. It's very traumatic to be arrested for something you didn't do. You lose total faith in a system that is supposed to protect and serve you. No officer should be awarded anything for doing their job

It’s my way of signaling I do not intend of being in your way whatsoever, if either the other driver is rushing somewhere or I’m driving too slow at night or during inclement weather. I do move away as far as I can from the middle line, as if to say “Be my guest…pass freely and easily. I get that you aren’t supposed to do that tho. I really just got it now tbh. After accusing people of being "roadside attorneys," the officer says, "It just makes our job harder." It actually makes it harder for the police to abuse people's rights when they know their rights under the Constitution. We all have been driving on a deserted road at night and been surprised when someone is suddenly behind you....knowing the only way that is possible is that were greatly exceeding the speed limit. It's obvious to me why the driver moved over the fog line....he was distracted by the vehicle behind him that shouldn't have been there in the first place.

There is a distinction between lying as part of an investigation and false official statements. If a cop tells me I'm legally required to do something, then I do it despite not being legally required to, I'm much more likely to get any evidence produced dismissed, since that lie turns the request into a demand. If a cop tells another cop something about me that's untrue, it becomes a hoax, defamation, slander, etc. Now, far too few jurisdictions do anything to cops who cause these problems, but there is a legal distinction here.

@@MrNabmilf in Tulsa ok early 80s. My friends and left a bar on 11th st. I was in the backseat. A police car passed us on the right, got in front and slammed their brakes causing us to rear-end them. We weren't speeding so it wasn't a major impact. As far as I know that was perfectly fine thing for them to do.
Those field sobriety tests are horrible. I did it once after sleeping in my car on a cold night and the wind was blowing over 34mph. Never could have passed. Took the breathalyzer and blew 0. Still arrested and had blood drawn, came up clean. All charges dropped. I should have never done that field sobriety test.
You got arrested because cops get off on attempting to ruin someone else's life. But, when they get caught doing something they are the biggest cry babies you have ever seen.

A lot of cheaper than a DWI as long as you maintain the terms or are lucky enough to not be pulled over during that time frame if you are driving.

The FST is not proven, just admissable.
FST been hilarious and scary at the same time. In Finland cops NEVER run such bullshit test. Loosing your balance, slurred speech etc are indicators of drunk driving but prove absolutely nothing since person just might have bad balance or medical issue that does not effect driving capability. Breathalyzer is used almost every time, and/or "lollipop" (field drug test) and if these tests show over the limit, then person is taken to jail, or if they demand it to blood test that has to confirm breathalyzers or lollipops result. This is cause breathalyzer test is not 100% accurate, but blood test is. Most often these are boarder line cases where its 0.01 over the legal limit and most cases alcohol percentage has dropped below before person gets into blood test, so charges are dropped and this should be the goal of these tests. It wastes drivers time but they are then under the limit so no harm no foul. Our cops also tend to give drivers 5-15 minutes since smoking cigarettes and even hand sanitizer effects the result. Also cops here did volunteer based study and found out that from all the drivers percipients that were under influence of chemical if i recall right 80% were under influence.. of prescription drugs, where alcohol was 10% and rest of the illegal drugs made up another 10%. So i would be more worried about drivers that wont even tap the breathalyzer or lollipop tests...

While the breathalyzer isn't perfect, it's objective at least. However a register of .009 is pretty laughable for the cops to say the things he said. A breath mint 15-30 mins prior can register higher than that.

While I think that the smartest thing to do in general is avoid doing FSTs, doing them is exactly what proved to the police that I was ok to drive in the only experience I’ve had with being investigated for a DUI many years ago, and I was probably just at the legal limit or a bit over - this was when the limit was .10 instead of .08 (however, I didn’t do the roadside breathalyzer [which _GREATLY_ frustrated the cops as they tried to convince me a million different ways to do the test, saying I had nothing to worry about if I was below the legal limit etc etc, but I continued to tell them that I simply didn’t trust their accuracy and heard about many instances where they were very inaccurate]; that was my way of calling their bluff... Either they had enough probable cause to arrest me by then after I had done all their FSTs or they didn’t - and I told them I’d do however many more FSTs they wanted me to do because I knew I was acing them, but I absolutely was _NOT_ going to blow into their roadside breathalyzer as that would have likely gotten me arrested).
An inner ear infection would throw your balance off enough to fail a FST.
Tiredness would cause you to fail a FST.
A strong wind would cause you to fail a FST.
A really cold night would cause you to fail a FST.
Plus, if a cop has just _decided_ you are DUI, then you’ll fail an FST anyway.

I lived in Canton Ga for 10 years about 8 miles north of Woodstock Ga. This is one of the most hated departments in the state. They lost their certification to patrol interstate within their city limits. When they applied to get recertified, people came from all over the state to protest this department getting any kind of certification to do. Traffic stops on the interstate that runs through their jurisdiction!

Based on what LackLuster said, you pretty much HAVE to agree to some kind of test. And I'd recommend the breathalyzer over the field sobriety test, because even though both are inaccurate the breathalyzer needs to be followed up by a blood test if you show you're over. And that IS very accurate, if done correctly. Failing the breathalyzer also puts you on notice that you need to contact a lawyer ASAP, before the cops get evidence that can be submitted to a court.

When people take the time to understand their rights we become "roadside lawyers". The problem is the average citizen understands more about the law and constitutional rights then the average cop. I'm amazed how he tried to convince this gentlemen of wrong doing.

Had this discussion with a friend thats a cop about asset forfeiture, and insisted that it requires a conviction and be directly tied to a crine you have been charged with everywhere, not just in our state.
I got out of a red light ticket because the cop did not get me on video (not running a red light) and he broke the posted speed limit without lights or siren to pull me over. ALWAYS get their dash cam video and look for their mistakes. They make a living off of ours.

This is a very good example of law enforcement using "professionalism" to attempt to cover up lies, tyranny, unlawful stops etc.. Most of the time, no matter how nice or polite they may seem they are never trying to help you out or protect your constitutional/judicial rights. ALWAYS be informed of your rights in and out of court and know how to effectively assert them, that's better protection than you'll ever receive from any government agent.

Cops job is to put citizens in jail and anything they can do or say to make that happen is a bonus. Citizens weapon against cops is knowledge and cops don’t don’t like knowledgeable people at traffic stops. The second cop was not there to be sure the driver was safe to drive, but instead use the DUI test to say he failed the test. With a breathalyser, he can only go by what the display readout.

The DUI cop saying that their presence alone makes some people nervous. That is 100% true. I don't know if it's because I used to have a reason to be nervous (cannabis smoke that would have to drive to pick up cannabis). Now I don't have any reason to be nervous, but my heart rate still jumps when a cop gets behind me even with me doing nothing illegal.
Isn't that just a symptom, or reaction to the overzealous and often times corrupt policing? Add to it that some reactions with police are cordial, and it causes confusion and stress to almost every interaction.

As a roadside attorney thats online too much, I can report that when cops are videoed being pulled over for suspicion of DUI they almost never take the field sobriety test. Hmm, wonder why that is?

This was a good one. Them DUI stops can be super stressful, especially when you know you're not under the influence. But like you said, most people feel intimidated and pressured to convince a cop of no wrongdoing, so they comply comply comply. When in reality it is up to the cop to prove it and you don't have to assist him in obtaining proof against yourself.

I'm glad that the body camera footage was seen on this video. This is a perfect example of law enforcement getting away with vehicle infractions in the line of duty. It's no wonder why the guys ticket was thrown out after they seen the body can't footage. I think that if you're stopped by law enforcement, you should always FOIA the body cam footage for your case. The driver, when asked where his friends house was, said "I don't know the address, but it is two minutes down the road". Then the cop tells the other cop he refused to answer. This is the bullshit that needs to stop.

I had a police officer friend of mine (I was his Mechanic) I asked him to do that test on me just to see if I'd pass & he stated to me the test is flawed & that I wouldn't be able to pass it as he had to practice the movements to give the examples several times & he was correct I was completely sober & I wasn't able to perform the test correctly as he said it it's an agility test that most people will fail.

He shouldn’t have been so respectful. He should’ve told the first officer that he crossed the white line because he was afraid he was about to be rear-ended. Then he should’ve told the DUI officer that he sounded slammed, was slurring his words, and could barely put together a coherent sentence.

Field sobriety tests are absolutely ridiculous, I was given one when I was sleeping in my backseat after driving for 25 hours straight and had my friend drive for me so I can get a few hours. I was woken up by a flashlight in my face and dragged out of the car, being told I am under the influence of drugs or drunk the state trooper kept saying I was even tho he literally just woke me up from a sleep. He kept saying that and kept insisting even though I have not smoked since I was 18 I was 24 at the time and didn’t have a drink of alcohol since I was 23. Cop tried to arrest me because he kept screaming at me even tho I “ passed” his tests but then told my friends in the car I am not allowed in the drivers seat because I was intoxicated. But yet I was in the backseat not even driving but yet I was the only one pulled out of the car and harassed.

A roadside breath test on a breathalyser in the UK, is just an indication test... and an evidential breath test, is then carried out on a more accurate machine at the police station. Sure there are a number of factors that could cause the roadside breath test to be inaccurate, some of which this testing officer performed. Merely using any roadside test, without backing it up with more accurate testing; will always be fraught with subjectivity and could all hinge on whether the police officer is having a bad hair day or not...!

First breath test it's just for reference, but it's close to illegal amount of alcohol in blood then you'll have to perform it again with the more precise machine. However, they usually have this police van that comes to the traffic stop that carries the proper breath machine inside, so there's no need to go to the police station. I've never heard of police making you one of those balance test. Only saw them in American movies (and now on RUclips). I don't think a judge would take them as reliable at all.
Cops calling citizens "roadside or Google attorneys" should understand that an individual can ask questions related towards that subject with any lawer or judge...

The DUI enforcement officer was lying by saying that the breathalyzer showed the driver almost intoxicated and played the suspicious card and the observer driving card to give the other officer the power to do whatever he wanted.
4:05 You can see that the officer's body camera is pointed directly at the tag light and you can also CLEARLY see that the light is illuminated, so this is just another excuse for pulling Ashton over based on the fact that he swerved defensively because the officer flew up on him at a high rate of speed.
So the officer first states that the breathalyzer is inadmissible as evidence in court. The he later states that field sobriety tests ARE admissible. So what he did was CONFIRM that you shouldn’t take the field sobriety test! Duh.
The blow test portable one at scene is not admissible but the "walkturn,one leg stand,and stig" test are admissible!

If suspicious behavior is more accurate, the second officer's actions were very suspicious. He drove 30mph over the speed limit without activating his lights, he said "put that in your phone" then seconds later he said," pocket", which displays he can't keep his train of thought. He also forgot to put on gloves, to use the breath test, leaving all kinds of germs on the straw. Maybe he's the one who should be tested for drugs or alcohol!
Telling the driver the breath test isn't as accurate, after administering it, is exactly why they shouldn't be allowed. The other tests are EXTREMELY subjective, as was demonstrated when a Georgia officer arrested several individuals for DUI, based only on those tests, and not a breath test. Because someone took an antibiotic, he told him that could impair his driving and did a field sobriety test, failing him, and arresting him. His blood work came back 100% clean, and his chief told a newspaper that blood tests aren't as accurate as his officers training in doing field sobriety tests! That's exactly why no one should agree to a roadside field sobriety test. If you haven't been drinking, you could agree to do the breath test, to prove they had no reason to arrest you, if they do.
Cops are awarded for the most dui arrests. It doesn't matter if blood tests later determine there were no drugs or alcohol involved. It still counts as a good dui arrest! That only gives cops incentive to cheat the system and arrest innocent citizens! They don't look at them as people, whose lives they are messing up for a DUI arrest. It's very traumatic to be arrested for something you didn't do. You lose total faith in a system that is supposed to protect and serve you. No officer should be awarded anything for doing their job

Only mentally disable claim blood test or breathalyzer test is more bogus than field sobriety test.

Yet, when a vehicle comes up fast behind me, I feel almost impelled to make way by moving over, which I suppose qualifies as swerving. It’s my way of signaling I do not intend of being in your way whatsoever, if either the other driver is rushing somewhere or I’m driving too slow at night or during inclement weather. I do move away as far as I can from the middle line, as if to say “Be my guest…pass freely and easily.

After accusing people of being "roadside attorneys," the officer says, "It just makes our job harder." It actually makes it harder for the police to abuse people's rights when they know their rights under the Constitution. And too many police officers don't like it when they can't steam roll over citizens who know their rights.
We all have been driving on a deserted road at night and been surprised when someone is suddenly behind you....knowing the only way that is possible is that were greatly exceeding the speed limit. It's obvious to me why the driver moved over the fog line....he was distracted by the vehicle behind him that shouldn't have been there in the first place.

you have to remember that the police can actually legally lie to you. I truly hope you took these guys to court to show that the second officer broke speed laws safety laws to get to you to tell you you broke the law he thought!
There is a distinction between lying as part of an investigation and false official statements. If a cop tells me I'm legally required to do something, then I do it despite not being legally required to, I'm much more likely to get any evidence produced dismissed, since that lie turns the request into a demand. If a cop tells another cop something about me that's untrue, it becomes a hoax, defamation, slander, etc.
Now, far too few jurisdictions do anything to cops who cause these problems, but there is a legal distinction here.

@@MrNabmilf in Tulsa ok early 80s. My friends and left a bar on 11th st. I was in the backseat. A police car passed us on the right, got in front and slammed their brakes causing us to rear-end them. We weren't speeding so it wasn't a major impact. As far as I know that was perfectly fine thing for them to do.

Those field sobriety tests are horrible. I did it once after sleeping in my car on a cold night and the wind was blowing over 34mph. Never could have passed. Took the breathalyzer and blew 0. Still arrested and had blood drawn, came up clean. All charges dropped. I should have never done that field sobriety test.
You got arrested because cops get off on attempting to ruin someone else's life. But, when they get caught doing something they are the biggest cry babies you have ever seen.
