Food for thought - if a content owner decided they didn't like Bruce's face and issued a DMCA takedown request on a video of Funhaus gameplay because of this, it would presumably also be valid within the quasi-legal space that is RUclips DMCA requests. You'd have to fight tooth and nail to contest the takedown, and in the event you won the juice wouldn't be worth the squeeze. So while there's nothing prohibiting the usage of the DMCA in this way, it certainly violates the original spirit of the law. DMCA is only there to protect content hosts, and as Adam observed, there's a hell of a lot of uncertainty in gameplay and commentary videos. Not a great situation for RUclipsrs to be in, and not a great usage of the DMCA by the developers of Firewatch.
Yeah I feel like this really is the bigger story in this whole drama. Firewatch devs really are abusing the DMCA system if that's their reasoning, however it would be sooo easy for them to claim another reason (i.e. it hurts their IP brand perception) in court and it would be very hard for Felix to argue otherwise. We really need clearer definitions and rules when it comes to what constitutes free use, so people can't abuse the system from either side; ip holder or content creator.
George Berry I don't see it getting too out of hand. I think some devs will go the way campos went but I think many will not. I rarely buy a game without seeing a playthrough or let's play first. I think a lot of people do the same and I think most devs realize that this is where games and society are at currently. Those that do pull footage will make less money in the long run.
Ben Busch it isn't about them allowing let's plays or walkthroughs. It's about giving them the ability to revoke your right to record and post about something you legally own just because they do not like your opinion on a subject.

I think we currently live on a very 'hyperbolistic' era. People are always overreacting to anything and everything, I feel; at least, more than I feel comfortable with. A lot of people either greatly dislike or like something; there cannot be a middle ground.
For a long time I found it very difficult to find a group of people who are interested in the same things as me. I have not only found this in funhaus when I started watching two years ago, but also found a group of people with so much insight, passion and knowledge in this area. i genuinely love this podcast because the FH team are some of the most level headed minded people on the internet and investigate both sides of each topic they review while still giving their opinions. they shouldnt feel like they have to apologize for speaking their minds considering how well informed they are
No matter your ideological stance on the use of the word, the context in which it was used was negative. The history of the word itself is extremely negative. It's a racial slur and there's no reason people use it unless they're purposely trying to offend someone or make a point about the nature of the word itself (like the comedic examples the guys provide). Bottom line: it shouldn't have been said, no excuses.
I love the fact that they have no problem calling JonTron a racist off of comments he made. But can't call Pewdiepie a racist who literally said the N-Word in an aggressive matter meant to be hateful. I was referring to the verbal diarrhea posted right above me, and I feel like we default to "this is meant to be comedy" way too easily. because comedy is meant to be funny, and I don't understand how saying a word that is supposed to be offensive is meant to be funny... I have been watching you guys since you started and through the years I've realized that the editing and the commentary that takes place is not easy. Hey everyone, I'm writing this to brace for the inevitable shit storm that's about to be Dude Soup #139. I've already seen a couple of early responses so I want to make a couple of things perfectly clear to help clarify any issues people are going to have this week. 1. The topic is controversial We discuss the recent PewDiePie/DMCA debacle and racial slurs. As always, we (try to) take no sides and only express personal feelings towards the situation without major emotion. I understand that we have a preceived devils advocate approach to subjects like this and that's because we rarely like to "side" on an issue. In the video we attempt to get in the head of a 20-something who expelled a racial slur on a livestream without straight up demonizing and slandering the person. At the same time, we describe what the person did as immature and possibly career ending. My fear is that people look at the former while ignoring the latter. We're discussing someone who is the biggest RUclips personality in the world, someone who raises lots of money for charities, a guy that can be viewed as figurehead of a lot of our current YT headaches and now has opened up a huge can of worms regarding DMCA takedowns of Let's Play videos. What I'm trying to say here is that we discuss a very popular and polarizing individual, one that probably downplays his own social importance. We try to discuss his actions without being judge jury and executioner. We try to discuss what happened without getting emotionally charged...but with that said. 2. My Personal Thoughts What Felix did was irresponsible, offensive and it crossed a line. Like I said, I try to keep personal feelings or political affiliations out of our videos. I try to be in the middle of the road and understand where all parties are coming from when discussing a heated issue. I understand that this upsets people because it's hard to gauge where I land personally on the side of a story. I do this because history is ever changing. I do not want to be a political shock jock who gets upset at news story without proper context or facts. Just this morning PewDiePie issued an apology video that was released after we recorded the Podcast. I am not saying this excuses his actions but I know that this is going to affect how people view the issue. Which is my point, people's attitudes change and when looking back, I don't want people seeing me taking any sides out of emotional feelings after the dust has settled. 3. Final Thoughts If you have any issues with this weeks show, please talk to me first. I want to be 100% clear that the only side I am on in the video is the law that grants IP/Copyright holders the right to take videos down if they see fit. Not saying I agree with it but at the end of the day it's law, it's black and white, it's simple. In a lot of ways I respect PewDiePie for what he's done for charities over the years and how he's remained relatively sane in being in the position that he's in. What I don't have respect for is casual uses of racial slurs of any kind. This is a personal thing and something I want to make very clear to everyone even though it may not look that way in the video. We go into more detail on the podcast but I feel like even this kind of hateful speech can be turned around into comedy, as evidenced by South Park, Louis CK and others. What we discuss on the podcast was not comedy. It was a reflection of the world we live in today, where a single word with a lot of history of hate is still used with the same vile intent that it had 200 years ago. I don't want anyone watching tomorrow's podcast thinking that I side with hate speech I want you to know that I approached the subject like I do all things when recording videos with multiple sides being addressed: I try to look at all sides and make educated guesses about the subject without injecting personal bias or emotion. I am no expert on this matter or any matter (for that matter - too much matter). The only thing I am certain of is that people are flawed, we do stupid things. If someone or group of people is genuinely good then I hope they are capable of earning forgiveness. I want to believe people are good but it upsets me when things like this happen. james swales From one of your brown fans, I appreciate this response. I try not to judge as well but the first thing that I see is a rich white guy making jokes about other people's suffering. It would be different if it was a colloquial thing, but internet personalities need to understand that they have an audience and whether they like it or not, they influence their viewers, and those viewers live on in real life having the things they watch in their heads.
I enjoy the old school references for movies and shows you grew up with. I'm the youngest of my siblings, but was raised around those same things. It's enjoyable to be able to relate to those things, even though I'm 22.
The problem isn't the people who say words you get offended or hurt by; the problem is that people are teaching their children to be so hurt by specific words.

If I was able to see the real life Roger Rabbit stand in, I probably would have cried. That movie was a HUGE part of my early childhood, and I still love it to this day. It still holds up as a fan-fucking-tastic movie today.

Different, it was used comedically and not as an insult. While I personally don't promote it but it's no skin off my bones. This is different because he used it ( with the hard ER) and as an insult.
My only issue with this (not sure if it's completely true), but the only people who seem to have a problem with this whole debacle are....well... White? I dunno if it's because my friends have been desensitised, but a lot of black people I know don't seem to have a problem with the word being used (possibly because I'm European too?) America is often the place to have an uproar about something like this. Pewdiepie was not in his right to use the word, but again, it's just a word. If we don't want to be offended by it, then people shouldn't claim it as their own.
I have a surprising amount of friends that use it. A lot of them live in the South East Kent with me and its probably the most racist, but people growing up with parents that are actually racist end up using it for irony/jokes and it just becomes part of their language. A lot of my friends from the rest Europe use it for fun ALOT. I know people from Germany and Belgium who use 'fuck' more so than their German counterpart because it just has more power. I think that's why it happened with the N word too. In England it just feels like its part of the humour to be the most shocking, at least it feels that way to me. Like typical FIlthy Frank humour. I dunno. Where I live around London the N word has been so desensitised that it's just the same as every word in my dictionary. The culture differences are weird.
I think it's very much because of the history of the word and treatment of black people in America's past. Don't know how black people were affected in Europe but that's what I think.
My only issue as a whole is that this isn't the first time, or the second. A lot of racist and antisemitic stuff keeps occurring so idk if we can just say 'oh he doesn't completely get it or isnt actually racist'.
I hope the rest of the podcast and the Alliance of Furries won't be overshadowed by Pewdiepie making a mistake while getting mad at a video game. Another enjoyable Dude Soup even though Lawrence and James weren't here, Jon was cool to listen to and Adam and Bruce obviously did their job well as always. No matter your ideological stance on the use of the word, the context in which it was used was negative. The history of the word itself is extremely negative. It's a racial slur and there's no reason people use it unless they're purposely trying to offend someone or make a point about the nature of the word itself (like the comedic examples the guys provide).
Bottom line: it shouldn't have been said, no excuses.

Hey everyone,
I'm writing this to brace for the inevitable shit storm that's about to be Dude Soup #139. I've already seen a couple of early responses so I want to make a couple of things perfectly clear to help clarify any issues people are going to have this week.
1. The topic is controversial
We discuss the recent PewDiePie/DMCA debacle and racial slurs. As always, we (try to) take no sides and only express personal feelings towards the situation without major emotion. I understand that we have a preceived devils advocate approach to subjects like this and that's because we rarely like to "side" on an issue.
In the video we attempt to get in the head of a 20-something who expelled a racial slur on a livestream without straight up demonizing and slandering the person. At the same time, we describe what the person did as immature and possibly career ending.
My fear is that people look at the former while ignoring the latter.
We're discussing someone who is the biggest RUclips personality in the world, someone who raises lots of money for charities, a guy that can be viewed as figurehead of a lot of our current YT headaches and now has opened up a huge can of worms regarding DMCA takedowns of Let's Play videos.
What I'm trying to say here is that we discuss a very popular and polarizing individual, one that probably downplays his own social importance. We try to discuss his actions without being judge jury and executioner. We try to discuss what happened without getting emotionally charged...but with that said.
2. My Personal Thoughts
What Felix did was irresponsible, offensive and it crossed a line. Like I said, I try to keep personal feelings or political affiliations out of our videos. I try to be in the middle of the road and understand where all parties are coming from when discussing a heated issue. I understand that this upsets people because it's hard to gauge where I land personally on the side of a story.
I do this because history is ever changing. I do not want to be a political shock jock who gets upset at news story without proper context or facts. Just this morning PewDiePie issued an apology video that was released after we recorded the Podcast.
I am not saying this excuses his actions but I know that this is going to affect how people view the issue. Which is my point, people's attitudes change and when looking back, I don't want people seeing me taking any sides out of emotional feelings after the dust has settled.
3. Final Thoughts
If you have any issues with this weeks show, please talk to me first. I want to be 100% clear that the only side I am on in the video is the law that grants IP/Copyright holders the right to take videos down if they see fit. Not saying I agree with it but at the end of the day it's law, it's black and white, it's simple.
In a lot of ways I respect PewDiePie for what he's done for charities over the years and how he's remained relatively sane in being in the position that he's in.
What I don't have respect for is casual uses of racial slurs of any kind. This is a personal thing and something I want to make very clear to everyone even though it may not look that way in the video. We go into more detail on the podcast but I feel like even this kind of hateful speech can be turned around into comedy, as evidenced by South Park, Louis CK and others.
What we discuss on the podcast was not comedy. It was a reflection of the world we live in today, where a single word with a lot of history of hate is still used with the same vile intent that it had 200 years ago.
I don't want anyone watching tomorrow's podcast thinking that I side with hate speech
I want you to know that I approached the subject like I do all things when recording videos with multiple sides being addressed:
I try to look at all sides and make educated guesses about the subject without injecting personal bias or emotion. I am no expert on this matter or any matter (for that matter - too much matter). The only thing I am certain of is that people are flawed, we do stupid things. If someone or group of people is genuinely good then I hope they are capable of earning forgiveness.
I want to believe people are good but it upsets me when things like this happen. I just wanted to make that crystal clear to everyone before I am labeled as either a defender or persecutor. I am neither.

I have a surprising amount of friends that use it. A lot of them live in the South East Kent with me and its probably the most racist, but people growing up with parents that are actually racist end up using it for irony/jokes and it just becomes part of their language. A lot of my friends from the rest Europe use it for fun ALOT. I know people from Germany and Belgium who use 'fuck' more so than their German counterpart because it just has more power. I think that's why it happened with the N word too.

How many RT channel podcasts do I hear where the hosts mention something along the lines of "I grew up in a Conservative Christian community and they're hateful, racist, sexist, bigots..." All of them? All of them. How is it okay to paint an entire group of people instead of judging the actions of individuals? Where in any Christian teaching does it say that it's common practice to hate anyone for anything? It doesn't. So obviously, hate in Christianity is not normal, yet I hear so often that that's all we are... I don't get where the disconnect is.

Please show me in the Bible where Jesus tells us to kill others. The Bible records historical events, slavery did happen, cultural normals were recorded thousands of years ago, but in no way does God "condone" killing anyone. Also, when the Bible talks about slavery in the Old Testament... ancient Egypt and all that... Those were Isrealites, God's chosen people, that were enslaved. He knew they were in a bad spot, but promised to deliver them and did.
