  • Nicolae Miu, 54, is facing charges of first-degree intentional homicide for the death of 17-year-old Isaac Schuman and multiple counts of attempted first-degree intentional homicide for his alleged role in the stabbings on the Apple River in Wisconsin on July 30, 2022.

    I didn’t see any fear in the group of teenagers. I saw and heard them verbally and physically attack Miu. That’s not what I call fear. They were were taunting him and the guy who was taking the video was getting everyone stirred up. Just so he could get a good video to post on social media. This was so disgusting and unnecessary. I’m not sure how I would respond, but I’m sure by the time the knife came out, Miu was feeling out numbered and in fear for his life.

      I was a cocky know it all teen! I'm sure surrounded by your buddies you feel invincible till the shit hit the fan and this dude starts shaking and slicing! Then the video shows the the real fear those teens had. As soon as they noticed the blood they scattered like Flys. It could've of been our kids out there and we would not be saying "well they had it coming" this dude took it way too far. From the looks of his actions with not talking and the smirk on his face it looks like alcohol played a part as well. In my opinion they're all guilty and should all get some type of punishment but Mr M deserves some time behind bars for killing a kid. The first girl that got stabbed 115lbs what could she of done to hurt this guy? He just started stabbing without thinking.

      Some of my family are law enforcement officers. If they were surrounded by a drunk mob being assaulted, lethal force would be used and justified under the law.

      @@club805clothing What if that was your father out there? I’m pretty sure by the time he stabbed the 115 pound girl, he was in fight or flight mode. The situation had escalated to a full blown attack of Miu. That mob of teens and young adults was out of control before he started stabbing. The headlines in the media would have been “52 year old man attacked and killed by a mob of 13”. I say he had every right to defend himself.

    I really think the state of WI messed up on the correct charge and that may be the defendant's saving grace. They have to prove intent to murder. There are clear instances in the video where the defendant starts walking away from the group and they continue to harass him. They both had equal opportunity to walk away and deescalate. He didnt go into the situation intending to murder someone. I think the state is going to have a really hard time proving intent, which is a big part behind this charge. Just from all the evidence and testimony so far, there is no way they are going to get a unanimous vote from the jury. At least one juror will have the ability to think logically and see there is no way the intent to murder was there beyond a reasonable doubt, unless the jury is tampered with/coerced by public pressure.

      she watched her friend get hit, someone die, her friend get disembowled, multiple people stabbed, and was in the hospital obviously on pain meds after surgery. I wouldn't judge her based on a fox news interview.

      @missvegasable I've watched every single minute and hour of this trial including all the pre trial interviews. I'm very aware how she acting but yelling at someone for punching/slapping your friend isn't a face isn't a valid reason to stab someone.

    The teenagers escalated this entire thing. Took nothing into a chaotic nightmare getting themselves, and those strangers all worked up because they lied, saying he was a danger. Putting out fire with gasoline.... they were hysterically laughing at this guy while involving strangers as well that he was a pedophile. Making it up so that this guy would be further in danger.
    Escalated the whole entire thing. They turned absolutely nothing ... into this. And def not saying what he did was at all ok. He deserves to be accountable for his actions. The whole thing is insane.. just saying who orchestrated the entire thing were these immature drunk and baked kids. Sad.

    She is fibbing he was not the first one to make contact. That would be Madison. They could've walked away themselves. Instead, 13 people surrounded him. I would've been in fear for my life after watching the video. I know one thing for sure, it was not 1st degree murder or attempted 1st degree murder.

But came back because they were still yelling and harassing him.. He was defending himself.

You got to watch the whole trial... He actually started the fight the old man.... That's why they were shouting at him He had his feet in there tubes They didn't show that part nobody was filming at that time....

      Oddly enough though, it is not up to the state to prove guilt beyond a reasonable doubt. The defense has to prove self defense beyond a reasonable doubt. (In this case)

      ​@estrella5935 cuz the video proved he did in fact stab 5 people killing 1. so there is no doubt he did it. the defense has to prove he had no other choice but to use deadly force. the video does show people telling him to leave and his unwillingness to leave he put himself there in that situation and continued to do so.

      Self-defense is an affirmative defense, so the defendant has the burden of producing evidence: He must put on some evidence from which a jury can find he BELIEVED he had no alternative but lethal force. Which, I don't believe he did. I see him check his knife to see if he is capable of lethal force before charging at the boys, before ANYBODY touches anybody.

      I guess if you were a cop you would shoot first then say freeze? You have a weapon you need to declare you are armed. I don't think this is a stand your ground state but either way, had they known Nich had a weapon and still charged him then I agree with self defense makes sense.

      I still think Sharon Tate would be alive today had she and her photographer treated Charlie Manson nicer when he walked into Sharon's property before the murders. Sharon didn't deserve to be attacked but Charlie Manson was already in a bad state of mind due to being rejected for a record contract. Charlie was on that property because Terry Melcher once lived there. Sharon's photographer came on strong with Charlie Manson during a photo shoot and then Sharon gave Charlie dirty looks. Charles Manson was a time bomb! He told his family group that Sharon and her photographer treated him like a turd that should have been flushed down the toilet. It's better to treat people with respect even if they tick you off.

    I feel the only reason why lingered around was that he was genuinely looking for (a) the phone his friend lost (b) the goggles and snorkel and (c) who would try to confront someone who is calling them a fucking pedophile? Accusations like that ALONE could get you murdered whether or not they’re true. Those teens and other adults who came up really escalated that scene into a mob attacking 1 man. Nicholae wasn’t trying to fight anyone or exchange insulted, he just wanted to find the stuff he was looking for and was being harassed by the mob and I felt he was actually confused on why they were all yelling at him and getting in his face; ESPECIALLY those two ugly older “ladies” who came over, so fucking obnoxious. I do think he should have made it better known he had a knife and they should back the fuck off and let him peacefully find the things he was looking for, but when you’re in a situation like that with so much chaos, you don’t always think clearly. Self defense PERIOD.

    I would’ve done the same exact thing I’m 66 I have COPD and if I had 20 people surrounding me pushing me hitting me and pushing me down in the water and I had nobody to help me and I happen to have a knife in my pocket, if I didn’t have a knife, I would’ve picked up a rock. I would’ve done something but this guy is innocent let him go. The guy that died made his own decisions and that’s why he’s dead right now. Bottom line truth let this man go. There was a guy was a baseball bat when the police got there that was gonna go try to continue to kill this guy with a baseball bat I mean come on This was definitely out of hand and these parents let their children do what they’re gonna do in fact, the guy that sent over his two kids, Mr. Carlson owns a bar and he went over there and escalated it even more to a point where they were attacking him and they ended up getting cutcome on it’s a no-brainer let the man go home with his wife

      Not in Wisconsin. 1st degree murder in Wisconsin is simply "intent to kill", not necessarily premeditation.

      Not really. Not even close. He started the story AFTER the point where his client ran up to the victim group (reaching down to make sure his knife was there). You can't just skip the entire portion of events that show your client initiating the confrontation AND the subsequent violence. He also skipped right over Miu punching the first female victim. He also says that his client only feared for his life AFTER being punched and pushed into the water, yet Miu already had his blade out BEFORE and physical violence began. He's off to a terrible start.
      You can prove that this man didn't take kindly to being heckled, but in no way does the defense prove that he was in fear for his life. Miu sought out a fight, initiated a fight, and escalated the fight to lethality.

      The teens thought their mob mentality was funny till it wasn't..
      It's what he thought at that moment, was his defence over the top, how many were there against one man.

    Damn, this is going to be a complex case. Idk if the jury could go murder 1… my heart goes out to the young people that were stabbed, and gravely injured but they were taunting and trying to humiliate him. He was outnumbered by a long shot and I could understand in that situation being in fear. But why did he lie? Why did he try to disguise himself? He did have a chance to walk away, but so did everyone else. Idk this is a hard one any way you look at it. Devastating that a kid with a bright future had to die like this.

      1st degree murder is different in Wisconsin. They don't need to prove premeditation, only intent to kill. I'd say pulling a blade before any physical violence even begins, and then initiating the physical violence, and then proceeding to stab anyone within reach (aiming at their vital organs) is very easily proven here.
      He was considering deadly intent even as he was initially approaching the group (as can be seen by him reaching down to be sure his knife was where he needed it to be). His actions after the fact also show indifference to human life. He attempted to get rid of the murder weapon (which no one would feel that they need to do in a self-defense situation, nor would someone in fear for their life discard their only deadly means of protecting it).
      He then lied to the sheriff and detectives. It was only when he was informed the altercation was captured on video that he even began the "self-defense" angle, up until that point he'd been acting like he heard about the stabbing but had nothing to do with it.
      Mr. Mui's actions before, during, and after the altercation speaks volumes to his state of mind, intent, and willingness to inflict deadly violence. He not only ran up to the large group that he was "in fear" of, but then refused to leave the area when they were repeatedly telling him to. Then, "in fear of his life" he punches a female who is trying to direct him back to his party. He stabbed members of two separate parties.
      All that being said, the defense has a decent chance of winning it they can secure a largely white, baby boomer jury.

    It appears to be self defense. He's an older person and it appears multiple people were shoving him to the ground. Sounds like a bunch of asshole kids trying to get the guy to start fighting. If anything I hope the kids learned a lesson.

The one who died was trying to get the defendant off of another person and was killed, tony was just trying to get him to go and was stabbed, he never pushed or punched him.       @@leahbrehm2657 - Even if he did "first punch the girl", by law, he can defend himself, meaning, being physically assaulted does give you the opportunity to defend yourself at the time of being attacked, but it does not give the attacker (in this case, the girl) the right to retaliate with force and the mob did just that. They knocked him down twice and held him down while hitting him, which is not legal. By law, you can only retreat while defending yourself, not provoke the attack.. and since Mr. Miu was retreating while defending himself, that makes it justified. That's how the law works.

      Yes. I 100% believe it was self defense. I am only a second generation immigrant whose first language is English and even I thought, “for the culture!” was some sort of battle cry to beat him up. The young man who recorded the video and instigated this entire incident claims it means “for the greater good” and that’s a complete lie. It means you do something you want to do even if it’s bad, but you do it “for the culture” anyway. They absolutely wanted to destroy that man, first by threatening his entire career, family, and livelihood by making public and recorded shouts that he’s a pedo (and undoubtedly would’ve posted it online), then by physically mobbing him. The guy in the yellow was trying to push his face under the water after he’s already been pushed, punched, and slapped by young, fit, strong athletes (and this generation famously dislikes “boomers” and older people). I would’ve been fighting for my life, too.

And the older "adults" that were with the group of teenagers, they must have provided the alcohol for these teenagers, will they be ticketed and or jailed for giving alcohol for underage teenagers? I have a HUGE problem for underage drinking, or even drinking altogether. I use to drink, A LOT and have been sober for almost 7 years. So, I have a problem with this.

      I have already found that you can write to the jail easy enough because I wanted to write myself. But you have a super idea here. My mom wrote to a state prison inmate with life in prison for murder, until he died. He so appreciated her letters, I still have them.

      The boy in the yellow shorts (name escapes me) was disemboweled but amazingly survived. Issac had purple shorts but I’m not sure where his body landed, somewhere to the side. I don’t think it gets seen again on camera but I think the blood filling up the water is from him and not yellow shorts. Just because positionally where it’s flowing from, but that part could be wrong. I was confused too. But yellow shorts has now testified.

    Self-defense for sure. The man walked away twice. He took a few steps away from the tubes and the kids continued to yell and laugh at him. Then he walked toward a woman in a calm manner. He was not aggressive at all.
    The group of kids bullied him, pushed him into the water, and smashed his face into the water, the man could've felt as if the kids were going to drown him. The deceased was not a part of the group but decided to jump in and harm the man. He's guilty. All these kids are guilty.

    IN MY OPINION - This man was looking for a friends cell phone ... those boys STARTED IT - plain and simple, they didnt need to bother this guy who was snorkling looking for a friends cell phone .. they asked him what he was looking for and they misheard what he said .. they had no right to be calling him names ... Now I dont know why he ran over to them, that was on him, but they totally surrounded him and he felt threatened ... these kids were bullying him, there were people all around him .... this is a hard case but I see his side too

    The first question I have is why did he have a knife on him in the first place? With that asked I also have to say ok yeah these drink kids were in the wrong for doing what they did but is that make it ok for this at the time 52 year old man to stab and kill a 17 year old boy

    Such a sad and tragic situation for both sides wrong time and wrong day and stabbing teenagers disemboweled a peace maker he should’ve just walked away so none of that would’ve happened.

    There is a video called 'keep one foot in the dark age'. I commented in that video and it does apply here. Freedom is fine as long as one person's freedom does not violate another person's freedom. But today these kids are only concerned about their freedom and what it demands regardless of others freedoms and/or constitutional rights. Old school had to put both feet into the dark age to survive.... Respect brother and for you genZers ... Don't F with old school.

    What the laws and lawyers are teaching today’s society is you can pretty much treat/do whatever you want to ANYONE under the influence of any substance BUT just don’t get caught and if anyone defends themselves you’ll have a corrupt ethical lawyer defend your foolish stupid decisions in life.
