      There is no way to solve the problem. They are too old. They should have been far more involved in the parents finances 20 years ago.

    My friend went to go file his taxes Friday and the IRS told him he already filed. Tuesday we went to town and I mailed a packet to the IRS certified with signature required. All because Equifax was hacked THREE FLIPPING TIMES and they didn't tell us until the last time.

      I think she meant to ask him for advice on what her parents should do financially now - sell their house, etc. She was trying to make a financial plan for them. But she got so wrapped up in talking about her sister's betrayal that she got sidetracked. Dave did a good job of keeping her on point.

    I'm kinda surprised he didn't tell her to consult an Elder Law attorney. If the Dad is starting to have mental problems, they may want to put the home in trust or something to avoid the "lookback". I certainly think she should consult someone pretty soon before Dad gets so far gone he can't sign anything.

    My ex brother in laws sister took money out of his parents house through a equity loan when his parents were old
    When he found out he called his sister and said you have two choices
    Either you put the money back or you go to jail
    She put the money back
    It didn’t hurt that he was a retired police captain

    If i was that woman i'd still consult a lawyer about the statues of limitations. if there is large enough gone, depending on the state, it could move the identity theft from being a misdemeanor to a felony and states have different limits on each for prosecution. worst thing is you spend 300 bucks and the lawyer says no luck.

    So they have 235k equity in the house. A 300k house that 2 elderly people live in? Do they not want to downsize? I would advise them to sell it and downsize to a nice ranch. Depending on what part of the country you're in that could be around 100k. Move in there and put the 150 or 200k in the bank.

    My sister kept stealing my mother's identity and charging on cards until the credit card company told my mother she had to pay it or put my sister in jail ($8K that time). She put in her jail. My sister now blames my mother for making her a felon. My sister also got her for an additional $2K on her card while my mother was dying. She was living in my mom's house and blamed my other sister for leaving the credit card statement where she could find it. My other sister who was inheriting the house put her out immediately. My sister blames her behavior on Borderline Personality Disorder. But my mother didn't nip in the bud when she could have years ago. Moral of the story: If they do it once, they will do again! Lower the boom when it happens the first time or be prepared to have a crook in the family!!!

    Sell the house, put the parents in a nice assisted living housing, $65,000 a year plus the sell of the house will sit them well.
    Make sure the lady that called and her other siblings names are on everything and definitely not the sister scam artist.

    First, your parents need their doctor to order a competency evaluation. That's caring for your parents. The same thing happened to our mother but it wasn't worth the bother of prosecuting because there was nothing to recover. Besides, then Sister would just get what she wants--free room and board. Fortunately, brother and I are moderately wealthy (actually, he's quite wealthy as a newly retired physician) and I'm a retired CPA, so medical and money management were right in our lines. We had the same problem this lady had--Mom assured us that everything was OK and we had no way to know about it until third brother saw a credit card bill that Sister and her worthless children didn't hide quickly enough. Advice: Crash in on this situation. If you don't have them already, get medical and general powers of attorney. Retain an elder care law firm that'll get Medicaid if indicated. Retain a private social worker to find a care home where they'll be cared for properly in a nice apartment. We did those things for less than $20,000 total cost and it was worth every bit of it.

    My aunt was doing this to people in our family, mainly to her parents. She died of a heart attack. This is when we found out, because of when we checked her mail. Then, creditors trying to go after her next of kin.

    I don't know where they live, but there may be some remedy in regard to the mortgage taken out. In pretty much all states, anything attaching to the deed of a house involves a title company and a notary public. Both of these are licensed and bonded with a legal duty to assure everything is as it should be. If fraud was committed under either of these, their bond is supposed to cover the damages. Mortgages are also public records that can be easily located in the county property recorder's office.

    It took her 3 entire minutes to say:
    "Hi, Dave. My parents are idiots, my sister and her husband are scumbag criminals, and my mother and I are spineless. They have a 65k/year pension and a house. What should I do?"
    CUT OFF THE FAMILY, Sell the 300k house, buy a 180-200k house, use the equity to pay off any debts, open an investigation/IRS, put the rest into savings, hire in-home care, live on 40-50k/year, put 15k/year into savings and pray that it's enough. Geez, lady.

    My wife's aunt stole from her sister 35 years ago. It was a lot of money in a savings account. They were overseas at the time. My MIL never pressed charges against her sister. She was never repaid. The aunt lost her mom's home & her home to gamblilng.

    OMG she can't answer directly at all. She needs to read Ramsey's policy on Gossip. Medicare + the pension (65k+Social security) is more than sufficient to pay for their longterm care until they die.

    Middle brother saw a charge account statement that wasn't hidden quickly enough and told the other brothers. Little brother, the doctor, contacted her doctor who ordered a competency evaluation. When Mom turned out to be incompetent, big brother, the CPA, took over Mom's finances. The credit card companies were out of luck--they got nothing. They could come after big brother if they wanted but it would get them nothing and they knew it; we didn't hear from them again. So that's the way to do it: get a medical/psych evaluation and take over. The creditors lose out and too bad for them. I do suggest keeping exhaustive records. CPA brother has recorded every nickel since the incompetency determination. If she gave away a quarter, it's in his records and he can report it in great detail. No court has ever seen anything like these records and it's absolutely defensible.

    My sister and her children did this to Mom. But it wasn't as much in this case, and there's nothing to recover from them. I don't think the district attorney will bother with it as a criminal matter, although Adult Protective Services referred the case to the police. Fortunately, my younger brother and I can sustain her.

    Something like that happened to us and our Mom. The roof fell in on them. But there was no criminal prosecution because there was nothing to recover from the thieves. The credit cards companies, when notified, and after a little resistance, wrote it off. "OK, credit card companies, go after the old lady. No chance!" My brother is a doctor who can handle the dementia part, I'm a CPA who can handle the financial part, and we have attorneys on retainer who'll confront you credit card people anywhere. That part of their care problem went away.

    Assisted Living Centers & Nursing homes average 5K a month, thats 10K a month for two. At their age it won't be long before the kids will need the care facilities.

    Awful situation. I wish the parents the best, but it sounds like their approach with one child will now impact the rest of their children. Just a mess.

    With family like that who needs enemies. I put my kids under the jail if they ever did this. But luckily I don't have kids or siblings. LOL.

      If anyone were to steal a million for me, they better pray to God the police gets them before I do. Either that or they better disappear like a mob snitch. Because if I were to get a hold of them, I am going to jail.

    Fiance mom put energy bill in her daughters name without her knowledge after she turned 18. Six years later we energies finally catches up with her in oyr apt and bam! 2100$ due asap. We no longer trust her but we moved on and paid it.

    Family members cannot "put these crooks in jail" if the ones who are violated will not press charges unless they are Power of Attorney and the victims cannot speak for themselves. Elder abuse has already been involved, but the case is closed. They can reopen it if financial exploitation happens again, and the state can press charges under those conditions.

    Yep, brother did the same thing to my mom as an authorized user on her credit card. $16k in the hole so he can show off on Facebook his “jet setting life” traveling the world. My other brother and I threatened him in pressing charges for elderly abuse and threatened to try to get him disbarred from practicing law (he’s a lawyer...go figure 🙄). After he saw how serious we were he set up a payment plan with the credit card company to pay the whole debt off. I have been checking the statements monthly to make sure it was being paid. This was 2.5 years ago and he is nearly done paying it off but I do suspect my mom helped a little towards the payments 🙄 because he is the favorite (first born). Also he hid all this from his fiancée/now wife, as well as a his bankruptcy. Even though my mom wants us to make amends I really keep our relationship at a distance since I don’t want to associate myself with a person who could do that to their own mother and never has apologized for this. He even tried to convince her to file for bankruptcy to clear the credit card debt but luckily she told us and called him out on it and told him she isn’t filing this is your mess.

      yep as the other 2 said. Hard for creditors to do anything with no one to point finger at. Sure creditors will eat few dollars IE 100 even now and then. But not this kind of amount. They need someone to point the finger at. They are after all a business to.
