Legally, they can’t search through your stuff, but they can screw with your education if you refuse without you being able to fight back, so you’ll get punished regardless if you cheated or not.
That’s where a federal civil rights complaint can come in handy with the dept of education OCR

I'm not from the US, so legally you HAVE to be physically present (unless you're physically disabled / violent / don't live in a country). So they made sure she was a target for bullying.
I too fell a victim. We were a VERY poor family who couldn't even afford food (literally. Thanks dad, who went for milk) and one day the school's "psychologist", principal and a director randomly showed up at math class and scolded me for not wearing a uniform. And if my parents can't afford it, "they should just buy the second hand ones around the corner" (and yes, they knew about my situation). I was in 5th grade but was lucky to have changed a school after a litteral hell.
The first day in my new (also public) school was like ascent to heaven. Oh, and the state exams results after high school were very much different too... I was just in time to LITERALLY escape.
As for the girl, as of 4 years ago, her life did not turn out as horrible as it could have. She even got into some sort of community college, with little to no selection, but it is an actual miracle because it was literally a 1 in a million chance for a situation like her's. Most children in her case would end up on the streets / on drugs.
All I can say is that school was a shithole (believe it or not, now it's even worse).

Uncle Grandpa Lawyer Edition
This reminds me of the time I got wrongfully accused of carrying drugs on me more specifically Heroin, apparently a student in my English class saw me taking drugs in the school bathroom and went to tattle to a female teacher that despised me. During a Math lesson this teacher, the principal and this girl walked into the classroom and we were all confused and i was even more confused when i was called to go with them to the principles office. The female teacher did not wait for me to pack my bag up and go with them, instead she stormed towards me and demand i hand over the drugs i had, i was not sure what she was talking about and honestly told her i didn’t have any drugs on me. She didn't believe me and grabbed my school back and threw everything out onto the floor including a really small cooler bag (think of the size of a wallet) that contained a small syringe, unopened needles, a single bottle of medical liquid (my allergy medication), a few plasters. The teacher saw the pouch and picked it up looked inside it, seeing the content inside she accused me of lying because she didnt know what the word on the bottle meant (was simply the brand name and the scientific name for the medicine) and wouldn't allow me to explain myself.
I watched her throw everything in the bin including the bottle of medicine after she broke it, to prevent another student from attempting to follow my bad ways. Went to the principles office, my social worker was called in and i almost got detention until my social worker explained that what they found on me was my allergy medication that i was prescribed by my doctor and that i had to take it every few hours, and that she accidentally forgot to inform the school 2 weeks ago (i thought for 2 weeks that the teachers knew).
After things were cleared up the teacher that went at me like that was forced to pay for another bottle of allergy medication and she was suspended for her behavior towards a student, the student who told on me was give community service for giving false information and lying.

I remember when I was in middle school, my whole class got a surprise search of all of our stuff cause someone in the school was caught with drugs. I never thought of it but it was kind of dehumanizing having your entire class take off your shoes, coats, open backpacks, and walk out in a line with hands behind your head. I wish I was exaggerating

I remember when someone was rumored to have drugs in my high-school so they had police officers with k9 units to sniff everyone's bags.
We had to step out of the classroom and leave our belongings in the class along with bags, and jackets. The dog also sniffed at us just in case it was in someone's pocket

Ya I fought back against a teacher that constantly tried to search me and generally just screw with me. They would suspend me and put me in solo study but that just ended up with me being way more creative in my own life and the best part is I tested above everyone on the OGTs getting a ride for college and admittance into the Post Secondary program. I loved to rub that in their faces and still found time to find ways to mess with that dude. Honestly was mostly just cruising in school until he started to target me just because I got literally a perfect score one time and because of that I went out of my way to show him up and mess with him in other ways.

A teacher once searched me, and found a book where I wrote my thought or a diary and I was only in second grade. After that she read it out loud in front of my class.
I was an extremely behaved student and quiet within class. To this day I still don't know why she checked me and I know it wasn't because of any assignments. I remember distinctively working on math, turning it in and reading a book in my free time then getting checked.
She ended up ruining my entire first semester and luckily after telling my mom who then reported her I switched classes but she still stayed a teacher.

Schools usually skirt around this by claiming since your locker is school property they can legally search it for any reason including no reason.
And if you keep a jacket in there they might just search that as well since they can just claim the item wasn't in the jacket.
So if your school provides a locker don't use it.
Also strip searches by school staff are illegal no matter what grounds they may have.

A teacher actually went through my bag in middle school. And it wasn’t even for a good reason. I think she was just trying to be an ass so she unzipped all my zippers and poured it out in front of the class. It was all just papers and my lunchbox. They weren’t very organized and they were spilled out everywhere on the floor in front of the class for everyone to see, and then she began yelling at me, telling me how at my age I should be more organized. She made me cry, and then gave me detention. I was a little kid and I thought she was doing the right thing and I had no say in it because I was only a kid but now I’m wondering if I did the right thing by not saying anything.
Some teachers are actual abusive psychopaths. I've had one teacher hit me with a carrot and another teacher blatantly stole from my brother. It wasn't even contraband, she just wanted the crayon things he brought. When you're young, you don't know your rights and what's normal. Some teachers take advantage of that.

I had a principal take an unlocked phone from a student's hands directly just to read her text messages with another student. It was from *suspected* cyberbullying *outside* of school, which turned out to be just a rumor. The schoolboard didn't listen to the hundreds of students who emailed and called about it, until months later. I left that school very quickly, and she was reassigned to another school shortly after that.

A teacher randomly decided to search everyone’s bags for electronic devices but I luckily I was informed by my friends almost a whole hour in advance and had time to hide it. I thought about telling them that they can’t search private property but decided to accept so that they would trust me. Had I not been informed, I would of been forced to try to go with legal issues against the whole school team and my class. I really hate my class for that. They were all if you ve done nothing wrong then you ve got nothing to hide. Knowing that I could be been stripped in front of the class and no one would care is pretty terrifying.

Sexual assault is not about being touched without consent, that would be just assault. But when there is sexual intentions behind it, it becomes sexual assault. And since most people are statistically straight it's safe to a asume a male teacher has more sexual intention striping a female student than a male student and vice versa.

I remember my German teacher HATED the smell of perfume in the class that girls put on after PE. She got so sick of it she checked everyone’s backpack for the perfume since nobody fessed up. She found out it was because one girl brought fried eggs to school for lunch.
first, it really depends on the school, school code, and such.
1- some schools will get parents signatures allowing for searches of backpacks and lockers of students randomly.
2- some schools mandate students have clear plastic backpacks, and or allow school secuirty to search students backpacks on entry... some even with metal detectors.
3- some schools have taken the extra step of banning backpacks entirely for fear the students MIGHT be carrying a gun.

There should be regulations around what school can punish you for, since if you don't accept to their search, they can just give you detention or whatever.
Detention doesn't work if your parents wouldn't allow it, it would be considered kidnapping if so. Only works if your parents are fine with it though.

One day, my friend “lost” her book bag she one day went to go use the bathroom and let it at a table. A kid came and took it and gave it to the general. Then when she went back she panicked and looked everywhere and even asked the general. The general lied and said he didn’t have it and soon later she asked again. He lied and yelled at her and even humiliated her saying she was an irresponsible and she was accusing the general when she never was. At the end of the day the general had searched through her bag and that’s why he kept it only caused it had “A device” aka her phone in there. Cause there’s a rule where it says no phones but she never used it in a time period or anything unless asked to use it by the professor. Plus,some parents even will still ask their kids to bring their phones incase an emergency.

During my senior finals my math teacher accused me of giving everyone the answers to the test because it was easy to search online and I was the only person in class "Tech savy" enough to find the results when I didn't need the answers and did my test by myself. I was very close to suing them for defamation because they almost set me back a year because they thought I cheated when math was ALWAYS my highest category in any testing.

When you get a detention for knowing your rights
Our school actually does this stuff sometimes. They would just randomly search all the students' bags to make sure they're not carrying phones (not allowed in our schools idk about other countries) or other stuff that would be "distracting to education" like diaries and not-text-book books.
Try to find if your specific country has laws against that. Y'all probably should say "you can't legally do that!" But you only should if that's an actual law
I will never understand the prohibition against phones. Punish those who use them during class. They harm nothing outside of class and are a means of communication in an emergency. I think I'd just buy my kid an apple watch to call the cops in the event of school shooting if their school had a dumb rule like that.
Also, 'not-text-book books are banned? Well, that guarantees wherever you are has worse literacy levels than us. Ever heard of Edgar Allen Poe? He didn't write a single textbook as far as I'm aware, but I spent months reading his works in school. Preventing kids from reading books for enjoyment and forcing them to read dry textbooks just discourages them from reading. Likewise, diaries encourage writing. Who cares what the kid writes, as long as they're thinking creatively and practicing their penmanship.
I think a lot of the problems with phones in the classroom is a generational thing. In college one of our older professors drew this really intricate diagram over the entire board. Then stood staring at us like we were insane when all of us 20 year olds stood up, took out our phones and started snapping a picture of it. Not one of us actually drew that sucker by hand that day. By the time the exam came around I had it memorized though. Older people just aren't used to them like we are. Just punish those that are actually texting or talking on the phone and let people fail if they're determined to do so.

My 6th grade reading teacher was constantly going through this one kids bag because he kept losing his papers and didn’t want to give him a new paper. It literally tools a fourth of the entire class period.
I play Argument Wars, ICivics, so the 4th Amendment say YOU DO NOT need a search when you have no reason or evidence, but it does not mean if they dont have a reason but has evidence, they could speak that to court or tell the evidence to the judge. And I am not from USA but I just learned this.

They can’t unless it’s probable clause or an emergency!
Example is in a Supreme Court case where the defendant had been smoking in school and the principal had found a pack of cigarettes in the person’s bag. In that case, it was constitutional because the school rules/law is that you cannot smoke nor vape in school!
In an emergency could be like say if you had an allergic reaction to something. Say if you were stung by a bee and you had an allergic response to it that; the teacher had to get your epipen out of your bag, then that doesn’t require permission because they already knew from your parents about your allergies, and it was an emergency situation!

As we were studying the teachers told us to go outside the class for no reason as we went outside they told us to sit and study outside the class . At first we didnt knew what was going on until some 2 to 4 teachers went inside the class and searched all of our backpacks . I knew i was safe since i didnt carry anything bad or smth but ine teacher took all my keychains and never gave them back to me .I never did anything with the keychains as i just kept then in ny back .Till this day they still have it and haven't given it back to me and are using my chains to their keys . Those were really precious to me since it was an merch an all .but even after i insist they still wont give it hack and i dont know what to do

if you sign a contract at the beginning of school that says you consent to said searches, they can (although the parameters of consented searches must be defined thoroughly)
I had my 9th grade history teacher organize my backpack but I didn’t ask her to. Basically, she saw how messy my backpack was (I had a mesh one) and she told me to let her sort it and I was like “uhh okay?” I’m guessing she was secretly seeing if I was hiding something I wasn’t supposed to be hiding in there (she didn’t find anything cause I didn’t have anything that would’ve broken the school rules).
My teacher went into my locker and deemed it too dirty (because it was) and made me go without a locker for two weeks, and I had to carry everything I had to each class. It was frankly an awesome pubishment that I wish they would continue, but it was definitely against the rules
Honestly yeah, I don’t think I would mind that as a punishment as I usually only store things in my locker that I will only need rarely. Everything else I carry on me. But even then if I did use my locker more I don’t think I would be too mad honestly
I do carry in a gun in my backpack though

Mike. Our school district discloses they are allowed to search if they suspect that they may find evidanxe that the student has broken ANY of the things not allowed in the student code of conduct. Cheating would be one of the things.
Of course thats only things on the student. Anything in a locker cubby etc they claim is free game. Ot reads like this inclides whats in a bag inside of a locked locker.

I'm pretty sure in elementary our bags were searched at least a couple times each year, it's not like us kids knew it was something to complain about at the time
It's important to note that it was NEVER for weapons but usually for banned toys or I remember one time they were looking for a lost stapler

Yeah, we had an incident at the school where I work just recently where a student's backpack was seized and searched, all within legal means.

There's actually an old civil case where a school got sued for unlawful searching a young woman's purse because the teacher thought she had cigarettes.

We don't go through anyone's stuff. We have school resource (police) officers for things like that. It's also a felony for underage students to be in possession of smoking or vaping materials on campus - not to mention, drugs, alcohol or weapons, and students narc on each other every single day.
I remember in 5th grade when my teacher said he would search our bags just to see if our food had plastic packaging. Luckily he never actually did it. He would also judge and give us lectures on what we are eating and how bad plastic is and would say we shouldn't have anything with sugar.
So no fruits, or pretty much anything because EVERYTHING BREAKS DOWN TO A SUGAR

When I was in middle school, a teacher threatened to search everyone’s bags. Just because someone squirted perfume and she didn’t like it. She didn’t, luckily. And apparently it was illegal. So good thing she didn’t. 😂
Holy shit, my school breaks all of these rules. I’m genuinely so shocked rn because I have multiple friends that have been strip searched and had their stuff searched through for vapes/drugs that they only had a hunch were there, they didn’t find anything and didn’t even apologize

@@TheGreenKnight500 Kind of, the district is apart of a wealthy tourist town, but the school is thirty minutes outside of town. The administration is awful and says slurs to students. It used be good when we had good administrators and they never did searches like that. Over the years, the school has gotten less kids so income is lower. Some parents are rich and threaten to sue, but for different reasons, they would never say or do anything like that to the students with rich, sue happy parents
