Hey law by Mike, what would happen if someone went into a store and the shopkeeper thought that person looked sketchy or something along those lines and said take anything in the store, and they maybe said are you sure and the shopkeeper said yes, and the person did and after they left the shopkeeper called it in to the police. What would happen, and who would be liable?

@@shadowknight_2505It’s because they were looking for the person who spray painted the cop’s car, the teacher lied and said it was his kid, as the cop said he was sorry to waste the teacher’s time, but all along, the teacher had the spray paint in his/her hand, so the cop chased him/her down.
I've always told my kids, never speak to cops, if they want to talk to you. Tell them to call me or a lawyer. If they take your phone the need to call me immediately because I'm about to lose my shit. Lol

This was actually a problem at my old high school. The school cop would almost randomly put kids against the locker and search them without any warning or apparent reason. Including an incident where a 9th grader simply refused a search and then was put in handcuffs and searched anyway. There were at least 10 filed lawsuits and the cop was fired

@@Simply_better22343 Well yes, investigation of crimes is a part of the job description for law enforcement. Additionally, we the people (non law enforcement) are under no obligation to assist the cops in their investigation. Long story short you are not obligated to snitch, admit to doing anything, or even provide testimony of what you saw to the police or any other law enforcement.
Don't set your phone or computer to unlock on your facial image, retina, or fingerprint. Courts can compel you to look at the device, swipe your finger, etc. to unlock it. However, they cannot order you to divulge the passcode.
Fingerprints could be an issue, but face id less so, if you see them holding your phone just make faces when they try to get you to unlock it, after like 5 tries it'll lock until it gets a password. Also if you ever think you're at risk of getting your phone taken away or being arrested, shut it off, if you want to record you can just restart it and record from the lockscreen, so long as you don't unlock it after restarting it'll require the code.

Funny .I live in South Africa and at my high school the cops showed up the one day without consent of parents or the kids and searched everyone and even looked at some people's private areas without their consent to find controband......I'm surprised everyone stayed quiet.i would've sued
In my town, its an automatic warrant, if the principal calls for the K-9 units. Anyone who's searched, will be retroactively given a search warrant for, or a blanket search warrant for anything within school property. As in, if your backpack is in a locker, its fair game. I know, because the K-9 units were called at least twice a month to our high school my first two years of high school. And this was the very nice and forgiving principal. Everyone begged for him to come back after he left, because he believed in every student and really only wanted the drugs gone, not the student themself. The next principal didnt really call the units very much, but his behavior was erratic. On multiple occasions i would be talking abd laughing with him, and suddenly hed threaten to expell me or give me detention. The expulsion one was for saying i got permission from my teacher to see the guidance counselor because i was on the verge of a mental break AND it was 6 weeks before my graduation. He told me the guidance counselors job isnt to talk to students, its to do paperwork and said for suggesting ill knock on his door i can "go out those doors and never come back."
Police should never be allowed to question or search a minor without the legal Gaurdian's concent. And the school should have a legal responsibility to protect that child's Rights until the Gaurdian is available.

Children are not educated on their Rights and don't have the experience to uphold their Rights to authority figures. It's not ok for grown adults to take advantage of a child's ignorance. It is the responsibility of the school to protect the children while in their custody. And all law enforcement have an obligation by law and oath to uphold Constitional Rights.

@lordnazar6382 So the officer takes an oath to uphold the Constitution and protect the Rights of the People that are outlined in the Constitution. This is the first line of duty over and above all else. This why US Tile 18 makes it a criminal act to uphold any law, statute or ordinance that violates an individual's Rights. But if that Individual is ignorant of their Rights it's OK? Sounds like a violation of oath and Depervation of Rights. Just because corrupt judges have set a president and call it "case law" doesn't make it lawful or ethical.
