    For all of the people watching this video and hopefully reading the comments, this is the purpose of doing a 1st amendment audit. Not to get a response from police or private business owners, but to educate. How many times during this interview did you hear the officer say, I thought, I didn't know, I wasn't sure? You better believe, if he still has a job, he won't be making the same mistakes again. Well done Jeff.

      @@deltalima6703 if someone breaks/violates a law that doesn't mean that it's no longer a mistake. Even with his actions being intentional or not this cop made many mistakes to take those actions. I hope he is punished and I hope he walked away from that interview with more than regret for getting caught in violating someones rights.

      They are simply NOT the authority on anything. This and so many many many cases demonstrate that they are the opposite of an authority on the law, our rights and even their own policies.

      Professional in that he's probably really polite while he's violating peoples rights. A lot of cops think being polite is the ultimate show of respect and dignity to us citizens. Too bad they're totally sh***ing on us at the same time.

      I reckon if he sorts out his obvious contempt for the homeless, and ceases his propensity to jump to conclusions with handcuffing and searching people for no reason, then he probably is better compared to so many other shouty, bullying bellends I've seen featured on this channel.     His copspeak is so strong, he still is saying legally detained, as if that is what he did. He still says he needed control and that exercising rights is resistive and combative and stuff like that. This cop is no better than he was on that day.

    I've watched these New Smyrna videos a lot. I grew up in The 407 as a kid lost every right i should have had by the hands of law enforcement. It gives me great satisfaction for accountability. Jeff you're the GOAT.

    As of 3 months ago, he no longer works for Smyrna Beach PD... but, like all of these cases, he just moved on to another department in Edgewater, FL. Sickening. No real consequences.

    This officer learned something, whether he wanted to or not. Sometimes, personal accountability, and the embarrassment of doing it in front of your peers, is the best education you can ever get. It certainly burns itself into your brain.

      How can you enforce laws you don't even know, or worse, don't exist?
      Also, in my view that "ignorance is no excuse..." is tyrannical BS. They could pass a law without hardly anyone knowing about it. The burden of proof should be on the State to prove that you knowingly violated a law.
      The exceptions are those based on common law (and common sense). In other words, what a "reasonable person" would believe to be illegal. We can't be expected to study federal, state, county, and city laws (including those of the states, counties and cities we may be visiting or passing through)...AND the rules generated by the various gov't agencies.
      Save the courts and prisons for thieves, kidnappers, sex offenders, and violent felons. For most offenses a citation and a reasonable fine would suffice.

      Who said he was an "expert" ? in fact the reason they have "qualified immunity" is because they are not expected to be experts.

You may know these rights/laws because you have been watching these 1AA videos but I doubt you really know any more than they do, at best. It takes lawyers years to become lawyers and even then they don't "Know" all the laws how could a cop know them with 6 months of training? After their boot camp training aka Police Academy, they should have to have an additional, at least one year, training of "Rights and Basic laws and their proper enforcement"

      If they're not, they shouldn't be out on the street.

    It's nice to see a genuine auditor for a change. Someone who is genuinely trying to improve the police, and I think that he has succeeded in that endeavour, on this occasion. What I see in this situation is a lack of training in what the laws actually are, and a lack of training in terms of understanding that the police are supposed to protect the rights of the homeless as well as local business owners. I know the homeless and other less advantaged members of the community don't always represent themselves in the best light, but it is their constitution too.

      Jeff, do a sworn criminal affidavit agains this cop for kidnapping and sent it to all 12 members of the grand jury. Also send it to the DA, if the DA res fused to present to the grand jury, file a new criminal affidavit on the DA for shielding public officials from prosecution and send it to the grand jury as well.

    I lived in New Smyrna Beach for 10 years. I found the PD to be very professional. It’s too bad the training didn’t include this officer. Jeff Gray is doing a great service to us all!

      What blows it more is the fact they get off with a warning worse case put on paid administrative leave which is paid vacation time at the taxpayers expense they fail to understand they are employed by WE!! The people not the city but it's citizens to protect and serve our communities they fail to understand that they are employed my us the people therfore we have every right to question them or they're authority.     I’m also impressed by the fact (assuming it’s true) that he openly admitted that his Sergeant immediately stated “you basically violated ever right he has.” So someone in this department is at the least aware of the law.

    Every American must appreciate how important this video is - one of most crucial videos in the history of policing in this country. But still Officer Beatty insists Jeff was being "argumentative and defiant" and was "resisting (arrest) without violence" - he still doesn't understand the actual mechanics of basic law and actually still blames/gaslights Jeff for his own willful incompetence...stunning. Jeff proved yet again that his is a living legend.

      I'm glad I wasn't the only one that noticed that. This officer doesn't have a clue what "resisting without violence" actually is. Not cooperating with your investigation isn't resisting. You would have to lay on the ground or something similar to prevent an officer from handcuffing when they legally had the right to do so in order to be resisting without violence.

      @@bommer22 I agree. I caught that & was really hoping the lawyer (or was he an IA investigator?) would then explain "resisting" to him as well. I think he definitely needs more training in this area. They just call anything they don't like "not cooperating" or "resisting" & that's just BS piling on for their own failures. Let's review:
      1) failure to properly communicate with initial officer on scene
      2) failure to know the law in that panhandling isn't a crime
      3) failure to speak to complainant inside the business to reduce friction with Mr Grey
      4) failure to heed the warnings of Mr Grey that his rights were being violated -be aware cops, auditors know their rights!
      5) failure due to unlawful detainment
      6) failure due to unlawful search & seizure of firearm
      7) failure to confirm panhandling on public property was a crime
      8) failure due to arrest threats for "not cooperating" & "resisting" Citizens have NO requirement to assist you in an investigation of themselves!
      But he wants people to believe this incident isn't indicative of his work. See, HERE'S THE DEAL, if we can't trust you on a minor panhandling call to be able to handle that level of an issue legally & with honor how the hell can we trust you to handle or investigate a serious crime or issue? You have no credibility!!!

      Professional auditing is definitely a skill set... Honour Your Oath, Long Island Audit and only a handful of others seem to do audits of this sort, I think the abusive profanity filled types of audits are NOT the way to do it unless all you want is click bait and zero chance of effecting real change and bridging the gap between the community and police... As an outsider looking in on the whole Audit movement this is my 2 cents worth!

    I was only half listening to this as I had watched several other officers give their depositions on this Jeff Gray case. I was almost done with it when my head nearly snapped off. I went back and listent to it twice more in amazement. This litte dude is a BIG LIABI

By saying he didnt know what he was doing at the time was wrong, the court will rule that he personally gets to keep his immunity, and that Jeff can sue the city and police force, but not the cop individually.

      Disproof: Someone who actually represents you-who acts on your behalf-would only have the right to do things which you have the right to do yourself. Those in "government" pretend to have the right to do countless things that you yourself have no right to do, while (bizarrely) claiming that you gave them that right. Also, one who actually represented you obviously would not have the right to boss you around and demand money from you under threat of caging you if you disobey or resist-a right those in power claim to have.
      Myth #2: “Consent of the Governed”
      Disproof: To “consent” means to voluntarily agree to something. To “govern” means to coercively control. The two are mutually exclusive. The term “consent of the governed” therefore makes no more sense than “voluntary slave.” Additionally, someone else obviously cannot “consent” on your behalf for you to be enslaved.       Myth #3: “Voting Constitutes Consent”
      Disproof: Being given the choice of which individual or gang will forcibly extort and dominate you (with "none of the above" not being an option) does not mean that you are free, and does not mean that you agreed to be robbed and controlled.
      Myth #4: “We Gave Them Their Power”
      Disproof: There is no ritual or document through which any number of people can delegate to others rights that none of them had to begin with. For example, ten people who have no right to commit murder cannot give to someone else the right to commit murder. Therefore, if those in power have rights that you don’t, they obviously didn’t get such rights from you.
      Myth #5: “Democracy is Freedom”
      Disproof: Gang rape is democracy in action-a majority forcing its will on a minority. Even if political elections actually represented the will of the majority (which they don’t), democracy would be inherently violent, immoral and illegitimate. Political voting is always about a majority forcing its will on a minority. Even if theoretically that left the majority in freedom (which it never actually does), obviously the minority would not be free.
      Myth #6: “Constitutional Republics are Good”
      Disproof: The Soviet Union, Communist China, North Korea, and the Weimar Republic (which gave rise to Nazi Germany) are/were all democratically-elected constitutional republics, each with its own version of a “bill of rights.” (The constitutions of all of them are easy to find online.) Democratically-elected constitutional republics have been the most destructive, murderous institutions in the history of the world.
      Myth #7: “Servant Government”
      Disproof: If there is a group of people that tells you what to do, demands money from you, and hurts you if you do not comply-and that is always what "government" is and does-then it is not your servant; it is your master.
      Myth #8: “You Agree to This By Living Here”
      Disproof: The so-called “social contract” argument says that by merely living within the territorial jurisdiction of a certain ruling class, one has “agreed” to live by whatever rules those in power decide to call “law.” An actual contract is a specific and explicit mutual agreement. It is absurd to call it a “contract” when one side can arbitrarily decide what counts as the other side “agreeing” to abide by certain terms. To claim otherwise is to argue that it would be valid and correct for any street gang or Mafia to simply say, “By being in whatever area we claim as our turf, you agree to let us do whatever we want to you.”
      Myth #9: “The Land of the Free”
      Disproof: The place known as the United States is far less free today than it was even under the control of a monarch. The list of grievances against King George III spelled out in the Declaration of Independence are trivial compared to what is inflicted on the American people every day by their "own" government. The United States is not the most free country, economically or socially. Various detailed analysis of such things can easily be found online. More importantly, the equivalent of asking whose master is the least sadistic and domineering-which one whips his slaves the least, and doesn’t work them as hard-is not a measure of “freedom.” No slaves are free. Likewise, comparing the relative oppressiveness of various ruling classes is not a measure of freedom. There is no such thing as a “free country,” since the word “country” means the territorial jurisdiction under the control of a coercive ruling class.
      Myth #10: “We Are the Government”
      Disproof: This claim is patently false on its face.       Disproof: The literal reality is that what people are taught to view as “the law” does not come from “the will of the people,” or from “the land,” or from any other vague, abstract source. “Law”-meaning man-made legislation-is nothing more than official demands and commands, backed by the explicit threat of force, issued by the politicians who make up political bodies. The fact that others are allowed to petition, complain, and beg the politicians to enact different “laws” does not in any way mean that it is the people, or the “nation,” that are the source of such “laws.”
      Myth #12: “The Rule of Law”
      Disproof: It is a common refrain to say that Americans are lucky to live under the “rule of law” rather than the “rule of men.” However, since all such “laws” are simply threats and demands written and issued by human beings, it is a distinction without a difference.
      Myth #13: “Due Process”
      The idea that one must be provided with “due process” before one can be deprived of one’s liberty or property (as stated in the Fifth Amendment) is empty and meaningless when the “laws,” the procedures, the bureaucracies, the enforcers and the courts that decide such things
      are all created and controlled by the same group that is depriving people of their liberty and property. This is no different than a street gang saying, “We have carefully reviewed our own actions and have determined that we had the right to steal your car, steal your wallet and beat
      you up; we were merely enforcing the law, and you have received due process.”
      Myth #14: “Government”
      Yes, the very concept of “government” itself is bogus mythology. It amounts to believing in the Divine Right of Politicians-the notion that various pseudo-religious documents and rituals, such as constitutions and elections, can bestow upon a group of mere mortals the right to forcibly rule
      everyone else. It is no more rational or legitimate than the old “Divine Right of Kings” concept; the modern version just uses more complicated and convoluted rhetoric and mythology-such as all of the examples addressed above-to make it sound legitimate, moral and necessary. But it is not, and that is quite easy to prove.

    Wow. Good for you Jeff!! This was very satisfying to watch, as a citizen of the United States. I’m so tired of these police officers and their power trips. There’s a Lot of good and honest officers out there, but the bad ones have to be called out. Also, thank God for cameras because the days of these people violating our rights because they think they can will hopefully come to an end. God bless the auditors keeping the tyrants in check.

    Beatty lied flat out. His said he asked for ID as he thought that a crime had been committed. On Jeff's video he said he said he simply had the right to ask for ID because they were called to investigate. He didn't say anything about threats of servers or anything of the sort. Then he says they detained him to get him to the side of the road. On video he was detained for not identifying.

    The best part of this interview is the fact that he has to sit through this line of questioning in the first place. This video will be forever out there for everyone to see. That includes his family, his friends, his peers, his supervisors and anyone else wanting to see a cop being held accountable. His answers for the most part were still vague in some respects and his “recollection” for a good portion of this was self serving. His knowledge of the law ~ even in this matter ~ is still lacking merit.

    The mind blowing things is none of this would be possible if it were not for body cameras. Assuming this officer did indeed learn from the experience, recognizes his mistake, and acknowledges/understands the correct letter and spirit of the law, he should be kept on the job as a counterbalancing force against inevasible future mistakes and overreach by his peers.

    It is shocking & terrifying how little these cops actually know about the laws they are attempting to enforce. There were numerous points where the cop himself admitted that he was completely wrong.

      @@Deerrus in fact, workers in the private sector often act in contravention of law, public policy, corporate rules, and broadly accepted norms of decorum without any penalty. of course, the difference is that workers in the private sector can't act under color of law and aren't armed to the teeth. in this particular incident, note that the business owner falsely reported to the police that mr. gray was asking for money. yet it appears that the police never even contemplated charging on that basis, notwithstanding that false reporting -- unlike panhandling -- is most assuredly a crime.

    After watching I think he legitimately owned up to his mistake...unlike so many other incidents where real violence occurs and the Dept. Covers, the officer laughs it off and no justice ever gets done. This guy seems to understand he made a serious error of judgement. This is a case where it seems the Dept. is acting in good faith. Some sort of reprimand, Constitutional Training and Formal Written Apology seems in order. Although we do see so many cases of true abuse, I think we own it to our own Civil rights to praise Dept. and Officers who do own up to their mistakes. This will help shame the ones that don't.

    At 17:30 he says he still doesn't know what rights were violated. It was the 1st, 2nd, 4th,and 5th. Thank God he didn't have the power to move federal troops into your house, if he did have that power I am pretty sure he would have went 5 for 5.

      Everytime I read a comment like yours it reminds me of that picture with a cop landing a punch on someone off view with his patrol car that has written "To protect and serve" on it and the cop has dialogue bubble "Let me protect and serve the shit out of you!".

      Because cops are the only ones who are allowed to claim ignorance of the law. However, if they are made aware which rights they are violating and then continue to violate them they open themselves up to lose their qualified immunity and can be sued in civil court.

    The officer performing the interview sounds like Ronny Cox who played Lt. Bogomil in Beverly Hills Cop with Eddie Murphy. Dead ringer for him. Ronny Cox was one of those guys you'd see in a ton of movies and always think, that guy is good. He was in Robocop, Deliverance, Beverly Hills Cop, Total Recall and a ton of other movies.

    Wow. The ONE day that this officer messes up and violates a citizen's rights because he doesn't know the law is the very same day that Jeff Gray happens to film him doing so. Oh, the irony! And he keeps referring to Jeff as 'defiant' and 'aggressively defiant'. Not only does this officer need to brush up on the law he's supposed to defend, he also needs to gain some comprehension skills about the actual meaning of words.

      The thing the officer is trying to sell is that he had probable cause to detain or arrest for Florida's Contempt of Cop statute called "Resisting without violence"... He is hoping that if he has "Arguable probable cause".. He will be shielded from liability for his actions.... i.e. He is trying to set up his qualified immunity defense

      I'd like to point out... while Jeff IS one of the first auditors on YT... it's a bit disrespectful to act like he's the ONLY auditor on YT, that takes their job seriously. Soloyaker, and his channel Armed Fisherman, also have put up their depositions. I'd say Solo's depositions are MORE important to the movement than Jeff's.
      All auditors that share depositions help the cause. So let's remember, there's more than just Jeff.

      Did you vote in you last local election? If your local police are out of line and not held accountable, did you elect new mayor/sheriff to replace the politician not demanding accountability from the agencies they’re in charge of? Not too busy with political agenda and trying to look
      “diverse” rather than competent? Not instituting policies that are intended to pursue justice and serve the community in. It’s best interest and not allowing ego, attitude, or lacking motivation to lead officers to shortcuts or allowing a toxic culture within the agency to persist which treats the public like their shitbag criminal enemy… always assume guilt and bad intentions and treat them as such. Did you have to replace District attorney/prosecutor, judges to put someone in there not wasting time and betraying the public for political reasons…not granting qualified immunity to every cop no matter the circumstances…refusing to prosecute accused police misconduct?

    I strongly believe that the root cause of having so many legally uneducated police officers in the United-States comes from the fact that there is too many provisions and legal protection accorded to cops that acts as a barrier to accountability. It takes someone who does it professionally and therefore have the time to put into that mess to remind them that we have rights.. If you overprotect someone, they don't develop into a better person and certainly not into something that society wishes to live with.
