I just received the complete IA File from New Smyrna Beach regarding my illegal detention by Officers Galt and Beatty.

For all of the people watching this video and hopefully reading the comments, this is the purpose of doing a 1st amendment audit. Not to get a response from police or private business owners, but to educate. How many times during this interview did you hear the officer say, I thought, I didn't know, I wasn't sure? You better believe, if he still has a job, he won't be making the same mistakes again. Well done Jeff.

This leads one to wonder how many peoples rights have been violated by this cop but they just didn’t make a big deal about it because they don’t know the law?
This cop did not make any mistakes. It was all intentional and it will never be punished, just watch and see.
@@deltalima6703 if someone breaks/violates a law that doesn't mean that it's no longer a mistake. Even with his actions being intentional or not this cop made many mistakes to take those actions. I hope he is punished and I hope he walked away from that interview with more than regret for getting caught in violating someones rights.

How can you enforce laws you don't even know, or worse, don't exist?
Also, in my view that "ignorance is no excuse..." is tyrannical BS. They could pass a law without hardly anyone knowing about it. The burden of proof should be on the State to prove that you knowingly violated a law.
The exceptions are those based on common law (and common sense). In other words, what a "reasonable person" would believe to be illegal. We can't be expected to study federal, state, county, and city laws (including those of the states, counties and cities we may be visiting or passing through)...AND the rules generated by the various gov't agencies.
Save the courts and prisons for thieves, kidnappers, sex offenders, and violent felons. For most offenses a citation and a reasonable fine would suffice.

Very telling of where his ego stands. This education should have taken place before rather than after the incident. I do enjoy watching these investigations and finding out how much these officers really don’t understand about their job or presumed authority that they do not have.

As of 3 months ago, he no longer works for Smyrna Beach PD... but, like all of these cases, he just moved on to another department in Edgewater, FL. Sickening. No real consequences.

This officer learned something, whether he wanted to or not. Sometimes, personal accountability, and the embarrassment of doing it in front of your peers, is the best education you can ever get. It certainly burns itself into your brain.

Jeff, do a sworn criminal affidavit agains this cop for kidnapping and sent it to all 12 members of the grand jury. Also send it to the DA, if the DA res fused to present to the grand jury, file a new criminal affidavit on the DA for shielding public officials from prosecution and send it to the grand jury as well.

I’m also impressed by the fact (assuming it’s true) that he openly admitted that his Sergeant immediately stated “you basically violated ever right he has.” So someone in this department is at the least aware of the law.

This guy is a LAW ENFORCEMENT EXPERT. How is it that the general public knows more about the law than him ??
Who said he was an "expert" ? in fact the reason they have "qualified immunity" is because they are not expected to be experts.

Every American must appreciate how important this video is - one of most crucial videos in the history of policing in this country. But still Officer Beatty insists Jeff was being "argumentative and defiant" and was "resisting (arrest) without violence" - he still doesn't understand the actual mechanics of basic law and actually still blames/gaslights Jeff for his own willful incompetence...stunning. Jeff proved yet again that his is a living legend.
Cops are absolute magicians at this. They will show you a video, and then look you right in the face and tell you that you didn't see what you just saw.
These are NOT the droids you're looking for.
I'm glad I wasn't the only one that noticed that. This officer doesn't have a clue what "resisting without violence" actually is. Not cooperating with your investigation isn't resisting. You would have to lay on the ground or something similar to prevent an officer from handcuffing when they legally had the right to do so in order to be resisting without violence.

@@bommer22 I agree. I caught that & was really hoping the lawyer (or was he an IA investigator?) would then explain "resisting" to him as well. I think he definitely needs more training in this area. They just call anything they don't like "not cooperating" or "resisting" & that's just BS piling on for their own failures. Let's review:
1) failure to properly communicate with initial officer on scene
2) failure to know the law in that panhandling isn't a crime
3) failure to speak to complainant inside the business to reduce friction with Mr Grey
4) failure to heed the warnings of Mr Grey that his rights were being violated -be aware cops, auditors know their rights!
5) failure due to unlawful detainment
6) failure due to unlawful search & seizure of firearm
7) failure to confirm panhandling on public property was a crime
8) failure due to arrest threats for "not cooperating" & "resisting" Citizens have NO requirement to assist you in an investigation of themselves!
But he wants people to believe this incident isn't indicative of his work. See, HERE'S THE DEAL, if we can't trust you on a minor panhandling call to be able to handle that level of an issue legally & with honor how the hell can we trust you to handle or investigate a serious crime or issue? You have no credibility!!!

@@grumpyoldman3597 he is using the wording "because at the time I thought it was a crime" to maintain his qualified immunity in a lawsuit. This was a coached, rehearsed interview. By saying he didnt know what he was doing at the time was wrong, the court will rule that he personally gets to keep his immunity, and that Jeff can sue the city and police force, but not the cop individually.

Disproof: The so-called “social contract” argument says that by merely living within the territorial jurisdiction of a certain ruling class, one has “agreed” to live by whatever rules those in power decide to call “law.” An actual contract is a specific and explicit mutual agreement. It is absurd to call it a “contract” when one side can arbitrarily decide what counts as the other side “agreeing” to abide by certain terms. To claim otherwise is to argue that it would be valid and correct for any street gang or Mafia to simply say, “By being in whatever area we claim as our turf, you agree to let us do whatever we want to you.”
Myth #9: “The Land of the Free”
Disproof: The place known as the United States is far less free today than it was even under the control of a monarch. The list of grievances against King George III spelled out in the Declaration of Independence are trivial compared to what is inflicted on the American people every day by their "own" government. The United States is not the most free country, economically or socially. Various detailed analysis of such things can easily be found online. Yes, the very concept of “government” itself is bogus mythology. It amounts to believing in the Divine Right of Politicians-the notion that various pseudo-religious documents and rituals, such as constitutions and elections, can bestow upon a group of mere mortals the right to forcibly rule
everyone else. It is no more rational or legitimate than the old “Divine Right of Kings” concept; the modern version just uses more complicated and convoluted rhetoric and mythology-such as all of the examples addressed above-to make it sound legitimate, moral and necessary. But it is not, and that is quite easy to prove.

When the police say "In this day and age", the response is "Do you mean, now that everyone has cameras, police can be held accountable". Without cameras, this interview would never have happened.

Professional in that he's probably really polite while he's violating peoples rights. A lot of cops think being polite is the ultimate show of respect and dignity to us citizens. Too bad they're totally sh***ing on us at the same time.

I reckon if he sorts out his obvious contempt for the homeless, and ceases his propensity to jump to conclusions with handcuffing and searching people for no reason, then he probably is better compared to so many other shouty, bullying bellends I've seen featured on this channel. The bar is incredibly low. He's still a horrible POS, but it's all relative.

If he would take half the time he spends in the weight room and put that time in the law library, he might have done better in this incident. Maybe that can be his big take away.

This is how officers can actually be held accountable for their actions of violating rights. Making videos and posting to RUclips is great for awareness, but Jeff actually goes the extra mile (which is required for real change) by getting the officer investigated for their tyranny. I wish more auditors did this on a regular basis.
A few have filed lawsuits on really egregious violations, but getting IA to investigate a tyrant cop is a great way to really educate these guys.
IA is an absolute joke in most cases.In this case Jeff got lucky and had an investigator that actually does their job correctly.Not to mention he’s being recorded and knows the public will see it.

That's the entire issue though, he wasn't unclear, he was just wrong. He had no clue that there was anything to check on.
His attitude damn sure needs adjustment, but the factual and procedural mistakes that led to Jeff's detainment actually were training issues. I can't say whether he was trained correctly and forgot, or was trained badly, but I kinda believe Beatty when he said that if he had known, it wouldn't have gone that way.
Just my opinion from the peanut gallery, I don't think he has the acting chops to fake that regret. He needs to enjoy the full range of consequences for what he did, but I believe he did learn the actual lessons there. Investigate FIRST. Look up the statute to verify a crime BEFORE cuffing somebody.
The best part of this interview is the fact that he has to sit through this line of questioning in the first place. This video will be forever out there for everyone to see. That includes his family, his friends, his peers, his supervisors and anyone else wanting to see a cop being held accountable. His answers for the most part were still vague in some respects and his “recollection” for a good portion of this was self serving. His knowledge of the law ~ even in this matter ~ is still lacking merit.

It's actually refreshing to see IA openly share their investigation with you. It's one small step for the people, one giant leap for an open and transparent government entity.
Did they share it or was it obtained with a freedom of information Act request? I don't know; however, it's like pulling tiger teeth without anesthesia usually to get any transparency which is why Amendment Audits are necessary .

I'm starting to think that police are not trained to follow a lawful process, too many from every state as well as other countries act and say the same things. They aren't well versed on how to lawfully treat the public because it isn't a priority either for the officer or those conducting the training.

I watch a TON of auditing vids - but you are my favorite by a mile. First, your demeanor is 100% right for the situation. No one could ever accuse you of being rude or disruptive, and for the most part - you give every officer the chance to learn, consider their decision carefully, and change course if needed. Second, you're willing to take a bullet - meaning go through the arrest process if necessary to make your point. Most of the others wimp out at that point. Third, you spend the time, energy, money, and aggravation to do what you did here - obtain information through FOIA etc to reveal the outcome. Keep it up - and let me know if/how I can help!

I've seen the video that these two were talking about; I want to say that Jeff is an excellent example of professional conduct, in that his behavior was what we (auditors) all can learn from. On top of that, Jeff is well educated in the subject matter. His follow through with complaints is probably the most important thing. I believe that auditors need to make complaints on every single interaction when our rights are violated. No matter how insignificant a complaint may seem, it still needs to be addressed. It is my wish that police agencies across the country become so fed up with our complaints that they take action to address the need for further education regarding the Constitution.
Unfortunately, that's not what happens. What happens is that they try to get laws written that requires auditors to be 100 feet away etc. The corruption starts at the top, and like feces, it travels downward. These cops are at the bottom of that shit-alanche.

Beatty lied flat out. His said he asked for ID as he thought that a crime had been committed. On Jeff's video he said he said he simply had the right to ask for ID because they were called to investigate. He didn't say anything about threats of servers or anything of the sort. Then he says they detained him to get him to the side of the road. On video he was detained for not identifying.

Edit: I, by no means, believe for a second this was out of the goodness of their “hearts” (used loosely). I’d imagine public outrage had a lot to do with this.

No thanks to the NSBPD. Florida has one of the strongest, if not the strongest public disclosure laws in the country, written right into their state constitution. Every public record is owned by the citizens. NSBPD was compelled by law to release this. "It is the policy of this state that all state, county, and municipal records are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency." and "If public funds are expended by an agency in payment of dues or membership contributions for any person, corporation, foundation, trust, association, group, or other organization, all the financial, business, and membership records of that person, corporation, foundation, trust, association, group, or other organization which pertain to the public agency are public records and subject to the provisions of s. 119.07."
Wow. Good for you Jeff!! This was very satisfying to watch, as a citizen of the United States. I’m so tired of these police officers and their power trips. There’s a Lot of good and honest officers out there, but the bad ones have to be called out. I've never seen the end point to any audit video, either a court proceeding or official letter. The fact that cops are actually investigating themselves and finding fault with representatives of their own organisation speaks volumes about public trust. Being able to record public officials in the course of their duties in a public setting was a great win in Turner vs Driver(well done Phillip Turner and the Supreme Court) and you were EXCELLENT in doing simply that. I watched an older Long Island Audits video today, where the “Officer” in question ADMITS he doesn’t know what “Reasonable Articulable Suspicion” (of an actual crime committed, one about to be committed or one in progress) is.
How on Earth can a cop get through the entire 6 (short, lousy) months of police academy training without well-knowing and understanding the very basis for their authority to arrest? It’s completely beyond comprehension.
Training standards for those we entrust with that enormous responsibility is shockingly low. We taxpayers pay them very generously to do that job. You’d think that constant recurring training in basic Constitutional Rights might’ve been a priority to get hired on with any local P.D….

The mind blowing things is none of this would be possible if it were not for body cameras. Assuming this officer did indeed learn from the experience, recognizes his mistake, and acknowledges/understands the correct letter and spirit of the law, he should be kept on the job as a counterbalancing force against inevasible future mistakes and overreach by his peers.

Every department should do this exact process. Its so sad other departments don't take this seriously

When the Officer was asked what Sgt.Kirkland said after he informed him about the arrest. "You violated every right he has". I had to laugh uncontrollably for a minute. Just unbelievable after all the information Jeff gave this Officer plus the basic laws he should already know. Then he states he thinks he is one of the more professional Officer's at the station. Another minute of uncontrollable laughing. Makes you wonder what is going on at that station. If you call yourself professional you dam well better know your job. Also, is falsifying a story to the cops a violation?

Exactly! The cop actually had to the nerve to say he just doesnt go hancuffing people on the street willy nilly but you see the ease in how he went straight for the threat of handcuffs without even hesitating!
@@ocsob007 Nah...his qualified immunity is GONE on this one! Remember under that ruling they use the fact that what any reasonable police officer would have done in that situation and the Sgt screwed him with his statement saying he basically violated every right he had once he gave him the particulars!
I lived in New Smyrna Beach for 10 years. I found the PD to be very professional. It’s too bad the training didn’t include this officer. Jeff Gray is doing a great service to us all!
