Yes but the amount of felony kidnapping he would have both of Peach and the toads most royal families would have executed Bowser for the loss of loyal subjects and the princess for I lost count on how many times Bowser kidnapped in main series, spin off series, and 3D/HD series but it is enough to get a restraining order on him, locked in a military prison, and most likely death by fire flower firing squad

    A few things forgotten:

that would give Bowser 14 counts of kidnapping (each fairy 2 times) plus an extra maximum of 204 years. He also uses his army to kill Mario so he should have another life sentence plus 3x arson and reckless driving sentence.

Three big things I noticed that were missed.
    - In the first game, Bowser turns most of the toads into bricks, which could range from mass mutilation, to genocide if they died from the transformation.
    - As stated in Super Mario World, the Yoshis found throughout the levels where put there forcefully by Bowser after being stuffed into eggs. Mass kidnapping.
    - We’ve seen from Paper Mario and the Mario Movie that Bob-ombs are sentient beings with intelligence and emotions. We can also see from various cannons, dispensers, and pipes spread across the Mario universe that Bob-ombs are most likely manufactured by Bowser. This means that Bowser deliberately manufactures and deploys an entire race of sentient beings with the intent that they die in an attempt to blow up Mario. Don’t know what charge that would be, but I’m guessing a death sentence. This also applies to any game where Bullet Bills detonate after a short time.

    • @masedaace5473
      @masedaace5473 11 месяцев назад +17

Probably only mutilation for the Toads. The spell is undone after he's beaten, and, in spite of the claims, none of them die. According to the manual, Mario punching blocks frees the Toads, hence why he gets coins from them as rewards. Don't ask why blocks still give coins afterwards, its never explained. He also should have multiple charges for attempting to usurp the throne, since that was the primary motivation for kidnapping Peach in most of the games. He later does it because he seems to have become attracted to his hostage.

Technically since Bowser is the leader of a militaristic kingdom, assuming there is a formal declaration of war, most of these "crimes" are allowed wartime activities. As for the war crimes... it really depends. In Super Mario Galaxy, many toads were shown carrying weapons so it could be argued to be a valid military target if brought to a court of international law. It might be a stretch but people have got away with far greater acts of destruction on non-military targets. The new galaxy thing is a bit weirder, and I don't think we have any applicable laws.

    - The instruction manual for Super Mario Bros 1 states that Bowser used black magic to turn the residents of the Mushroom Kingdom into stone, bricks, and horsehair plants, so that'll probably be Mass Mutilation.
    - The first seven Bowsers in Super Mario Bros 1 & the first two Bowsers in Super Mario 3D Land are just regular enemies disguised as Bowser, so I think Bowser would only get charged for the final encounters against him in both games.
    - You missed all of 3D World and just did Bowser's Fury instead. (Kidnapping x7, Reckless Driving x2, Aggravated Assault x3, First Degree Murder)
    - Also I feel like the Mario & Luigi and Paper Mario games should count in a way.

There's been some things I could argue, primarily about the extras.
Most of the extras are the potential for him to kill the same person (Mario) and you can't really kill someone more than once (And if Mario losing a life counts as killing him, you'd have to calculate the max amount of lives Mario could die to Bowser with, which is essentially infinite.) On top of that, you can play some of these games co-op and Bowser can potentially kill everyone else that joins in co-op too.
A lot more of the Bowser fights could also be considered -kidnapping- false imprisonment and/or attempted murder, as during a good portion of them he's seemingly waiting for/approaches Mario and then proceeds to trap him in the room with him before attacking him.
Mario, Luigi and other characters could also be potentially considered law enforcement, since they're at around the same level of authority as any of the toad guards you see in the series and seemingly face no punishment for breaking into any of Bowser's castles or other property, which means extra punishment for doing things to them and adds in things like obstruction of justice.
    - And lastly, there's still other things to cover, like some of the Mario RPG's and the Mario Movie

    • @danemr6808
      @danemr6808 Год назад +7

One thing: A lot of the charges you gave to Bowser came when Mario broke into his castle to fight him. Even though Bowser did kidnap Princess Peach, Mario breaking into Bowser's castle to retrieve her could be considered breaking and entering, making Bowser attacking him be classified as self defense. A lot of Bowser's potential life sentences would also be removed if that is the case since Bowser would be killing Mario in self defense.

Crimes forgotten: You forgot the crimes relating to Bowser kidnapping Yoshi and his friends in Super Mario World. This would be mass hostages and he can get some child abuse charges because at the end of the game, we see that the Baby Yoshis were trapped in each of the eggs and once Bowser was defeated, the seal was broken. And while it was offscreen, in SMB1, Bowser transformed the mushroom retainers into bricks, which has to be some sort of crime. He also traps the Toads behind walls in Super Mario 64. In SM64DS, he kidnaps Mario, Luigi, and Wario, so those are three kidnappings. In 3D World, he kidnapped the Sprixies which are living beings that can think for themselves. Not sure if Yoshi's Island should be in this video since it's not part of the Super Mario series.
EDIT: He also told his children to transform the kings into various creatures which would be multilation and probably usurping the throne.
I'm a bit iffy of the fake Bowsers should carry the same crime but I guess you can argue Bowser conspired with his minions to help him. Also, I'm sure Bowser would've gotten the death penalty already for kidnapping a monarch. I'm also betting that Bowser would be risking some crimes regarding child endangerment with Bowser Jr. Not sure if you could count the Koopalings, since they are retconned to be his minions and there is only detail of them being his children in two game manuals and some game guides.

    A few notes.
1 - They are only war crimes if you lose the war (which in canon he does, but could remove a few life sentences in "extra" which is scenarios he wins)
2 - Super Mario Bros. the first 7 fights aren't bowser, just minions disguised as him, though he presumably ordered them to do so.
3 - Bowser is a monarch, there are many times the monarch is above certain/all laws, it's likely within his own castle/kingdom attempting to/murdering Mario is legal or it could be framed as killing an intruder/enemy of the state. Though when in the Mushroom Kingdom he still has valid charges.
4 - In Super Mario world he also kidnaps Yoshi in addition to Peach, then puts him in an egg (which he seems relieved to be out of when you save him), so that is kidnapping + torture.

Glad you asked I was preparing for this.
Ok, first off, I'm gonna be quick, Bowser is the official king, voted by the majority of his people, as the ruler of the Dark Lands, therefore any acts done to the mushroom kingdom can be declared as warfare. If this is true, then literally all of the crimes, except Forced Marriage and War Crimes, can be easily excused by War Times, as he has a Right to do so as a king among his kingdom. As for forced marriage, In the time, assuming that Princess Peach has that of a medieval government style, it's noted that back then, princesses did not have the right to choose who they marry, so forced marriage can not be applied to her, as her parents have most likely not said anything to stop this.
They aren't dead either, as if they WERE dead, Peach would be promoted to the Queen of the mushroom kingdom, not princess, therefore they most likely allowed this.
As for, war crimes however, I would need to ask exactly what specific war crimes he commits as, I've tried looking through the video to find them, but I can't find them. If somebody can give me the information needed, I'll continue my case.

Would be interesting to see other video game villains be charged, such as Ganondorf. With him tho, an interesting dilemma would be: is he liable for crimes he commits while he is Ganon, his beast/monster form. Typically, he seems to not have control of himself in the form (although exceptions may apply, like in TP), however he typically willingly goes into this form, such as in OoT, but not always (OoX and ALBW).
Here’s a short list of things I thought of on the spot that he’s done (probably missing a lot). Also no TotK here, haven’t done everything in that game, no spoilers please.
    OoT:
    Murder (Deku Tree)
Assaulting a minor (throws a magic ball at young link when he’s chasing Zelda)
Grand Larceny (stealing Triforce, probably also counts as treason given the Triforce’s importance)
Murder x unknown number (likely kills many Hylian citizens, but no way to find number apart from the the redeads in castle town)
    Usurping the throne
    Kidnapping (Zelda)
    TP:
    Prior convictions (sentence: death)
Murder (Probably second degree) (Water Sage)
Usurping the Throne x2 (Techically Zant does this but pretty sure Ganondorf would be charged as well)
    WW:
Assaulting a minor (Link, at FF)
Kidnapping x4 (probably way more but the only ones we are aware of are Links sister, Zelda, and those two girls on windfall.

    OK plenty of flaws here
General:Mario entered the property illegally so killing Mario could be considered self-defense. The exact punishment should be something greater since in most cases Bowser is kidnapping a Head of State (Peach)
SMB1: All of the Bowsers except the last one are fake
Lost Levels: Not mentioned, but if you include the letter worlds you may possibly end up with another charge.
SMW: As this is on his own property and it does not do any damage, the first would not county as arson
SM64: With stealing the castle, it could probably be equivalent to larceny over government property given that the property belongs to the head of state.
Sunshine: Bowser Jr did the kidnapping but the arson would not count as it doesn't do any notable damage.
NSMB: Bowser Jr does the kidnapping. No precedent exists for when Bowser commits crimes as a skeleton or resurrects. If by this point Bowser had gotten a life or death sentence, I would have dropped one as "Sentence Served" and played Baby Blue.
Galaxy 1: Two normal kidnapping charges and one for a head of state. Stomp into space bits sounds like intent to murder.
NSMBW: The arson is on his own property and does no damage. Bowser could also end up killing Luigi, Blue Toad, and Yellow Toad.
3D Land: The first two bowsers are fakes and all the arson is on his own property
NSMB2: The Koopalings do the kidnapping and damage Mario and Luigi. The arson is yet again on his own rightfully owned property. However, Bowser can also kill Luigi at the same time as Mario
NSMBU: Attacking Peach's Castle is a violent crime of sorts against the head of state's real estate. This time the arson is actually arson since Bowser doesn't rightfully own the castle. And Bowser can kill 4 players.
3D World: The base game is skipped, but Bowser does 7 kidnappings over a seeming collective head of state. You fight bowser 3 times in this game, and can kill 4 players.
And who knows what would be added if the Mario Party games and RPGs were added on top

I tried doing this with Joker from P5 a while back; counting every palace as its own nation, the palace's ,main body as private property, the ruler as the ruler of said nation and the shadows as people.
I realize these rules are a bit of a stretch and it was kinda hard to estimate each treasure's value, but he got roughly 9 death penalties (28 if you count destroying the palace as genocide and mass destruction, and the calling card as waging war against peace),
103 life sentences (assuming you're not allowed to kill in self defence mid-crime),
    986,5 years
and a fine of about 7 billion dollars; possibly even more (not counting the $-Infinite he'd have to pay for stealing (and consequently destroying) the Holy Grail).
Whatever the case, I had fun deciding whether certain things were illegal and/or if he'd be charged for them. A higlight was concluding he would not be charged with cyber terrorism against the fake medjed, because the hacking was executed by the actual medjed and the impostor would've had to confess to identity theft in order to charge them, as you can legally hack your own websites.

The issue with that though is most of the possible crimes there would be done by the player since most battles are avoidable and the ones that are not would be self defense. That being said, eating everyone at the start would probably count as attempted murder (not cannibalism since he is a different species), property damage on the castle, I don't quite know what punching a sentient fountain gets you (probably some kind of property damage + a minor assault charge as he didn't know it was alive), a ridiculous amount of arson and property damage, lots of aggravated assault and 1st degree murder since leveling is basically necessary, stealing from defeated enemies (this charge would depend on the playthrough for the amount). Maybe more but that's the bare minimum I can think of.
