I have yet to see a valid argument that Trump broke his oath. He was legally entitled to every challenge he made to the election and would have derelict in his duty to his oath if he had not. Being only human, he also makes mistakes in his speeches, but at least you can believe what he says. The court decided that eligibility for the federal office of President cannot be determined by fifty states making fifty different decisions. Makes sense. They threw the responsibility to Congress, through section five, to legislate law to make such a determination. Since this crime has not happened before, Congress hasn’t made law yet. But now it can be argued that Congress, as the newly designated responsible branch of government, has already made the determination in this specific case. Congress has, in the second impeachment, voted and determined by bipartisan majorities in both Houses, that Trump engaged in the Jan 6 insurrection. While he was not convicted by a super majority in the Senate, section three does not require such conviction, just a determination of engagement, which Congress has already provided.

One of my husband's was a Baptist Sunday school teacher. Shortly into the marriage I found out that he did not believe in dinosaurs, nor that man should go into space. Needless to say, the marriage didn't last long. I was expected to not have an opinion nor ever speak in church. And soon he wanted me to walk behind him. Now the Religious right wants to take away what science has discovered and take us back to the past. I walked away from it back then and at 74 I walk away from it now. It's the new kind of slavery, this taking away our rights.

You'll find that the richer someone is, the better they are at using others to do their dirty work, so they can distance themselves enough for charges not to stick. Though having a husband in the highest legal court in the land who is as corrupt as it gets certainly helps.

Why all the fuss about the DC primary? Barely 2500 people voted! The supreme court said that the states can' have the right to decide who is on the federal ballot. But the 14th amendment was passed by congress and approved by the states which gives the states the right whom they have on their ballots. Amazing isn't it? The conservatives are all in favor of states until it isn't in their favor.
Where did these people get their legal credentials?

I have lost faith in this country’s highest court, the Supreme Court, that didn’t follow the Constitution Am14, Art3, which disqualified “oath-breaking insurrectionist.” 😢😮 It’s now up to Congress to pass and implement this rule.

Genuine question from an Englishman, ignorant of US constitutional law: Can someone please tell me….
I gather Article II, Section 1, Clause 5, says that in order to be eligible for the presidency, you have to be a natural born US citizen, over 35 and living in the US for 14 years.
My question:
Who enforces that? Can the states enforce that? If the Democrat nominee was a 30 year old, or if it had turned out that Obama really wasn’t born in the US, what would’ve/could’ve happened to stop them being on the ballot?
Constitutional law is
"self-standing". Anyone who violates section 3 of the 14th ammendment, SHOULD be barred from any ballot, state OR federal, by the federal government. But since they weren't doing thier job, some groups petitioned thier states to ban trump, those battles are ongoing, but it really is the job of the federal government. We just lack the person with the intestinal fortitude to be the first one to SAY IT TO THE SCOTUS. Either congress or scotus could be the first to enforce this ban on the presidential ballot, but nobody has stepped up. 🤷♂️

No new legislation SHOULD be necessary, this section hasn't really come into play since right after the Civil War, when it was written. For that reason, nobody alive today, has ever had it be an issue. Like the "30 year old rule", nobody, under 35, has tried to run for president in our lifetimes, so I'm just going by who are the top federally influential people in our government (who aren't running for the same office) currently, like if a 30 year old applied for president, I don't know WHO tells him no, I just know it wouldn't be like a town mayor, it would HAVE to come from someone in federal authority. I would have to look up who enforced this law back when it was last enforced, which would be shortly after the Civil War. It was written to prevent confederate politicians from running for office in the new union government, because they were, by definition, "insurrectionists", and would do things to thwart the operation of the union government, OR likely try to organize an overthrow. I'll try to find an actual case of this law being enforced in the 1860's, and let you know if I find something. I'd like a definitive answer too! 🇺🇲

I found the last case in which the 14th, section 3 was used.
A county commissioner was removed from office, by a state Judge, in Texas, in 2022.
So I suppose the scotus has the ball here. Scotus JUST overruled Colorado for barring trump from thier presidential ballot, claiming "states do not have this authority in a FEDERAL race, ONLY in state races.' Unfortunately, they didn't also state WHO DOES.
My guess is that is has to be our pro-trump scotus, that's bad news.

As a far-flung foreigner, the more I hear about these Supreme Court rulings the more I think about The Pelican Brief, given how aggressively the Supreme Court has ruled in favour of the 2nd Amendment. Given the radicalisation of US politics, others have to also be thinking about it and at some point it becomes a self-fulfilling prophecy,
