      I understand your frustration, but that's the power of live video on Facebook. It's interactive. Viewers on Facebook appreciate that they're acknowledged and have just joined in. Plus, they can ask questions while we're live and I can answer those questions as well. When you repost that video here on RUclips, you miss out on that "Live" opportunity and yes, you're right, it doesn't make sense when you're watching the replay here. Stick with it and you'll find you'll still get tons of great information.

      Not at the price of disturbing/destroying your own speech, that is counterproductive; I really feel like thumbing down. Have too bad illness fatigue and insomnia to concentrate. Honestly, I have never seen the like of this, not even children would expect to be greeted when late. I even suspect it is just a hoax to give an illusion of many ppl joining.Which would be unnecessary too, since a good video is good independent on the number of views or likes. Have been looking for help/info f SO long, SO much and have little time and energy. Sad, because you seem nice with good content apart from that. Thanks.

      Claudia's right. Look at it this way. YOU show up for a lecture ON TIME, and just as the lecturer gets to the point YOU came for, someone walks in, late. The lecturer suddenly stops, smiles and acts like he's just been dying for this latecomer to arrive. He starts over from the beginning! For example, right now, that's what happened to me. I hope "David" enjoyed the video. Me? I missed the whole point because I'm typing this. I'm out of here.

      You really have to stop and interrupting yourself and repeating what you have already said every time a new person joins your session. Very distracting and it takes away from your very informative session.

    Because of 7 or 8 people joining in and getting a personal recap of the story, 11,000+ people get the recaps too. Challenging watch. Great content in between though.

    If the question about prior criminal convictions is asked by opposing counsel at trial though, wouldn't counsel raise an objection on ground of relevancy? If they are asked about it in a depo, relevancy objections are improper. Shouldn't relevancy objections only be raised at trial, if opposing counsel attempts to enter testimonial evidence into the record that is outside the scope of the case?

      It’s a totally appropriate question. It relates to credibility. The reason you make the objection of deposition is that a trial, if the opposing lawyer wants to read sections of the deposition, the objection has already been made and will be made again at trial.

      Hey Adriana. You're right. Would you prefer instead I ignore those people who came to watch during their work hours or took time away from their family and not acknowledge them on a live video? I realize it interrupts the flow on this Facebook live video that you're now watching on replay here on RUclips and I'm sorry you don't get that edited, polished version of the content. I do want to thank you however for coming to watch and hope that the content was informative (besides the interruptions).

      You should have created a separate video for RUclips. It’s a different platform. You wouldn’t act the same way in an informal meeting and in a court room.       Gerry Oginski I have to agree with the others about the interruptions. (Even with Facebook Live it really isn't necessary to acknowledge people who are watching the video. I've watched many, many FB live videos where there weren't these interruptions.) Instead of getting defensive, may I suggest a "thank you" to commentators and say you'll do things differently next time? I went through a whistleblower lawsuit (jury found in my favor and against the hospital on all 6 counts), and one thing my attorney told me when we were going to trial was to not get defensive--it turns off the jury. Wise advice! That said, your video was very helpful and confirmed what I strongly believe, and what helped me throughout my 3-year-long legal ordeal--just tell the truth.

    Great Video. Would this include an expert report? The defense lawyer expert write's a report and during deposition doesnt say the same as his report. How do you handle that?

      In New York, in State court medical malpractice cases, experts do not write written reports. Nor are they deposed prior to trial.

      As you might be able to tell, this was originally done on Facebook Live. It's appropriate to say hi to people who join your live broadcast to acknowledge them.       It was a CIVIL case , They couldn't have treated that way in a criminal case. She actually she the wicked witch of the Pa Esq how big was the dialysis room my husband died in.
      I said as big as this room & half the other
      No she says I want dimensions
      ( I am not a surveyor I said I didn't know) ten minutes late she'd ask the same question over & over .I told her my husband got diabetes when he was 13. She asked what doctor he saw
      I said I was kid & grew up in chicago
      There should be judges at depositions to act as referees

    Hi, Gerry, great presentation. I know I'm jumping in here a tad late but even though a plaintiff did not disclose his past crime to his lawyer, does that absolve the lawyer from asking his client in the early stages of the retainer as to whether his client has a past criminal record?

    But the witness has a right to answer the question properly and explain why her answer has changed for example if I don’t remember certain facts at the deposition because I dint has chance to review my allegations from 4 years back then I can explain that I reviewed my complaint before trial date and now I can give a better answer or if I dint had chance to review documents that my attorney subpoena from the expert witness before the deposition but I reviewed before trial date then I can give a better answer because the documents will have all the facts of my case.

      You could say that, but it still creates a credibility problem if you haven't reviewed the prior testimony. With deposition testimony, the witness is required to review it and make changes before signing it. This confirms that they have reviewed it before signing it.

      A depo is offered for the value it holds, its a memorialization of legal witness testimony. it EQUALS the weight of ur testimony in court. It also carries same penalties for perjury etc. . I'd discuss w my boss/ atty to do redirect and focus questions that allow ur clarifications in ur answers. In my lowly lol opinion, If for example the adverse takes circumstantial indirect evidence and can show a common response from u to a similar question, now those memorialized answers may be valued as direct circumstantial evidence, it may appear as a pattern. Use answers the court can refer to as fact, on point, highest on point authority. Cool. Thats tricky. I like it. Aloha!

    Sir I have Parkinson's with Dementia. I can honestly offer a different answer to the same question with absolutely no intention to offer an untrue answer, its my memory loss and Parkinson's makes me have hallucinations at times.
    Would I still be seen as untruthful? My integrity is the most important thing to me, I would be horrified to be called a liar in a closing statement.
    I may be going to a deposition, will my medical issue be considered?

    My wife's intestine was ruptured during a CS procedure in 2016 and it led to her death, albeit the baby survived. I have reported the matter to the doctors' licensing and regulatory body and they have been conducting investigations into the matter but we are still at the deposition final stages. In their affidavits, the doctors agreed that the intestine was truly ruptured and that the corrective surgery they performed was to correct this anomaly.
    However, they are harping on the fact that I didn't conduct an autopsy.
    Question: Since this is what the autopsy would have confirmed, is this in any way going to be a spoiler for my case?

    .....Instead of explaining, giving a rundown on you just joined viewers, of what you have been talking about, why don't you just tell them to watch this video when you upload it? It's very annoying in every 1 or 2 minutes you say, "Hi Jeff", then later, "Thanks for the thumbs up." Think about the viewers at the time of watching, how annoyed they will get when you do this.

    I have a case in the 11 district for false imprisonment .I became a jail house lawyer whent from state court to district now appeals court .I have evidence of them misrepresenting court papers and providing false information to the district court in a habeas corpus greanted to me by the district court i have a enbanc case greanted by the appeals court for a hearing how long is my statute of limitations to file this to be hard .Or whare do i look it up in jail i had the Lexus program.But i doint have access to it know .I WOULD LIKE YOUR OPINION IF YOU DOINT MIND SIR.1983 LAWSUIT CIVIL RIGHTS VIOLATION 4 AMENDMENTS VIOLATION BY A GOVERNMENT BODY.

    Your video has me wondering about, what I will call a "sub topic", deposition and trial questioning. "Boiler plate" questions, how often are they used and where do they come from?

      They are used by many defense attorneys who think they must ask a series of standard boiler plate questions about background, pedigree, injuries, etc.

    Note that the opposing counsel will try to rehabilitate the witness. If the witness lied under oath, and can be proven, rehabilitation is impossible. Why they committed perjury is irrelevant and will annoy the jury even more.

    Yes, thank you. Get what you need from the witness to discredit them in closing, you’re not there to argue with them. 😂 I saw opposing counsel badgering my witness and the judge did not look happy. I didn’t object, because it was making opposing counsel look bad.

    Very good, very good. Is it true that the plaintiff can only present evidence pertaining to the charges. Let's say the defendant was accused of spatting on the plaintiff and they try to use recordings and video footage of previous dates that didn't happen on the incident date to support there accusations. Would that be considered unmissable in court?

      I can only tell you what happens in a civil lawsuit in New York since that's the only type of case I have experience with. You'd need to speak to a criminal defense attorney near you to answer your legal question.

    Your Welcome! I have a question...how do I prove a document is FORGED?...AND has been need to follow CAsubmitted to court as the basis of a civil suite? I am a defendant in a civil R.E. issue in CA.I perfected a promissory note,and took bavk my land. This guy I'm dealing with is a dangerous felon.And unfortunately lives right next to me. I know i need to follow CA state court rules, and Im trying to do this thing all by myself.It is a bit complicated, but he ha shired an att'y Im all alone on ythis and Im telling you I'm sitting on a forged doc.I'm pretty sure his att'y knows it's forged as well

      I'm a paralegal, and if it was my case I might start w an informal request to adverse to produce that document or even go to the issuer and obtain a clean vouched for copy u can do research off of. Wow. Thats interesting and I'm sorry u r having to deal w this alone. Ck legal Aid see if they have funding for ur type of case and ask advise. I think ur gonna DO IT and u will feel empowered. Im cheering for u! Watch out for any filing of a new case by him and against u. He may be posturing to file a lis pendens and cloud ur title, stop u from proceeding w ur court action til u straighten it out. Its doable but really takes a ride or die attitude. Lol. Paper wars.

    It is weak on cross examination to leave "why" unasked because it will be asked on redirect and you wont get another chance to do damage control.

      By the time you get to trial, you’ll already know “Why” because you will have asked it during a pretrial deposition.

      @@NYMedicalMalpractice yes, you know the why but the jury knows nothing of the sort. For example if Im trying to show the elements of theft, and a prosecutor asks on cross "did you put your hand in the cookie jar" the response is yes, impeachment then becomes bad for Plaintiffs position. Failure to acknowlege the why dehumanizes the defendant, which is worse for the plaintiff because it comes off as overtly manipulative of the truth, as opposed to acknowleging proper prosecutorial discretion, now that were in the era where the courts openly invite lawsuits under the heading of "Mcdonalds made me fat". While we can get away with dehumanizing the government and corporations its not wise to ever dehumanize the opposing party when the party is a natural person. Of course it really depends upon the nature of the why, and what the most obvious answer might be, given the way the human mind works, even if we're trying to deliberately avoid it. Rather, it would seem best to acknowlege shortcommings as to own your case as opposed to having to guess whether the FBI vs. the CIA is the bigger liar which is how civil litigation comes across when the government isnt party. Rather if the jury thinks youre abusing the law its not going to go well.

    Be interesting to see a vid on witness consults. I don't know much about them, but appears these can be used to show jury the witness appears to have been coached, or shown how to tell the truth. Does not seem to be much on consults on youtube vids.

      I understand your frustration, but that's the power of live video on Facebook. It's interactive. Viewers on Facebook appreciate that they're acknowledged and have just joined in. Plus, they can ask questions while we're live and I can answer those questions as well. When you repost that video here on RUclips, you miss out on that "Live" opportunity and yes, you're right, it doesn't make sense when you're watching the replay here. Stick with it and you'll find you'll still get tons of great information.

    I have a question. Let's say the plaintiff John Smith has never been convicted and answered the truth on that. On another hand, another person with the same name, John Smith was convicted. How it's possible to clear this up?

    So this is where Brady vs Maryland comes into play. I’m very confused can they use this to taint you testimony and make you less credible.i have a domestic violence case against my ex feels like I’m on trial instead of him.he has no history I do 7 yrs ago.he is guilty no self defense

      Sister I hear u. My partner had a strangulation charge (in HI) which is a felony. Judge released him, citing that he had a right to secure his hud voucher amd hospital home. THE HOME INALSO LIVE IN AND WGICH LAW KEEPS ASKING WHEN IM LEAVING. On maui many years ago a victim of repeated established abuse went to the grocery store w my friend and her abuser came in stabbed her in the neck with an ICEPICK, then he stabbed my friend. He almost died she IS DEAD. telling women they HAVE to leave is disgustingly disparate treatment by gender and our disparate impact is women believe the system will LET UR ABUSER KILL U. He got 2 years of probation and he is prohibited from drinking alcohol. He drinks everyday despite. In 7 months they have NEVER NOT ONCE U.A.'D HIM TO CHECK FOR ALCOHOL AND SUBSTANCES. The law says they don't have to. Ridiculous I am a student of lua, hawaiian marshal arts. Its very easy to seriously disable a twit w minimal movement and strength. it has cultural aspects uay enjoy, and it also teaches u every injurable spot and layer (nerves muscle fasciae) of the human body. The women lua warriors were serious business
      It also includes a spirituality component. Its so awesome.

    Helpful presentation, but the greetings and repetitions should have been edited out prior to public posting. These interruptions are slightly irritating and distracting from the topic. Also, the talk could have been made shorter, clearer, and more streamlined. A 30 min talk with continuous interruptions and distractions is difficult to follow.

    The real issue here is not in how to discredit an honest witness or evidence, but in how does that person counter your less-than-honest and honorable attempt to discredit them.
    As someone who grew up in a house run by a high-level narcissist. I know exactly what game and strategy you are playing to. You are not an honest or good person looking for the truth. You are a proud ll liar that makes everyone see lawyers as liars.
