A student of mine paid me the BIGGEST compliment today when she said that listening to me tell stories was like listening to Bailey Sarian tell stories!!! I thanked her, it simply made my whole day!
Can we take a minute and appreciate Bailey’s flow and storytelling? She’s putting on her makeup so she has to say everything in order- she can’t just rerecord something later and add it back into the mix. I have to do that alllll the time because I leave out an important piece of evidence or get a date wrong. Way more appreciation for Bailey after trying to make my own videos!
Not sure why the comment section got so sarcastic. I'm not sure if one got deleted bc they don't even make sense. Anyway. I do give bailey props and love love love her. However. They do edit the videos and have to go back sometimes. I know what you mean though. She is amazingly talented and gorge
Same, but in reverse. I'm a reserved, quiet, calm woman who is drawn big, overt personalities. They bring me out of my shell and I feel I give them notice when they go too far.
You are absolutely right in my feeble opinion. It seems also in some of these cases- when the Mom stayed home raising their children-then getting a job or career as the kids were older and in school- some of these Men- didn't like it when they found out their wife had a brain. I'm going on.60 now. Been engaged 3 times. Non of them worked out it seems what they loved about me- they wanted to change- or take away. Sad.
Exactly!! I'm very extroverted and loud and love attention, however my social battery runs out at some points and I feel like having a boyfriend whos just as extroverted and outgoing as me would just tire me. My current boyfriend is more introverted, plays games, etc. and theres a sense of comfort I feel when I'm with him and it's just us. I bring out a new side in him that usually doesn't come out and he does the same for me.
So I just wanna say, when I was told my best friend in the ENTIRE WORLD had passed, it took me abt 2 days to cry. So I hate the reaction theory to make someone “guilty” not saying he is or isn’t, just that one thing.
I agree. When my grandpa passed I felt sad but didn’t cry. A few days/ weeks later the reality of it hit me as I was in the shower and I was balling. I realized that I no longer would hear his voice.Ever again. I think of him everyday.
I literally didn’t process the fact that my grandma passed away until after the funeral was over. I cried so hard after I got home and was in my apartment by myself. A lot of that is because my culture teaches us to mourn in private. Sometimes people just deal with things differently.
I remember when my HS friend died, I felt bad cause I didn't cry during the funeral mass. There were speeches from friends and family but I didn't cry while everyone was bawling. But just as they put her cofin in the ground, that's when I cried. Sometimes, it just takes time for the emotions to show themselves.
I'm not convinced of his guilt, I'm not convinced of his innocence either, but I am convinced that police and the prosecution didn't do their job very well in this case
@Rebecca Lynn Stewart Then, explain how Jeff's DNA was never found anywhere on Kat's body??? She had no life insurance policy to collect from, granted both their fitness apps recorded their daily movements throughout the day, but that alone isn't enough for an overall conviction. Circumstantial Evidence presented at Jeff's Trial: fitness app daily walking counts No DNA tested: fingerprints, no saliva, no fibers, no touch DNA. The only injury was her head and she was never dragged or picked up off the ground meaning she never moved, which would indicate two separate pools of blood instead of just one. When someone is moved or dragged there would be drag marks indicating that Kat was moved and she wasn't, she was found in the same position, her head was on the curb with her torso and legs in the street with a massive head injury. And explain how the glass bottle that was used never broke or shattered??? And only a sliver of glass fell off, when you have anything glass or ceramic and you hit someone over the head its going to shatter into a thousand pieces or more.
It certainly sounds like the prosecution described the "proof" to suit their narrative. Like: You must be the hit and run driver who killed the nun because your fingerprints are on the steering wheel of your car (gasp).
Exactly! There is way too much reasonable doubt for a conviction. Whatever happened to innocent until PROVEN guilty? If he hit her with the bottle then why would he have used his non dominant hand. And if he had done it, then he would have known about the security system and shut it off or something. This just doesn’t make sense
And they will NEVER let an innocent person out of prison even when presented with hard evidence to the contrary, becuase their egos prevent them from admitting they were wrong the whole time. Sometimes they will say "whoops" after the person has finished all or most of their sentence and are let out. Other times they will occasionally let them out after decades served.
What? Nah. Look how they tried to convict poor.O.Jay. The jiury were psychics. Or-psychotic. Or just plain reverse racists. I was being sarcastic about O. Jay. Sry. Thinking back- I'm glad relations behind the.colors have been repaired. I was just running you. Hope I didn't offend
I honestly can’t tell if he did it or not, but it absolutely cannot be proved beyond a reasonable doubt that he did. He shouldn’t be in prison while the likes of Casey Anthony walks free.
@@jessicamoore6381 double jeopardy applies unfortunately. Frankly, they would need to find something else to charge her with that would give her significant time would be the only way to get justice
As a nurse, ground level falls can result in serious injury, even to a young, healthy person. Ive seen people die from a brain bleed after a ground level fall. That's an error by the medical examiner, IMO.
@@Hello61Jello Unless there was impact, then she moved before there was enough pressure and bleeding at the point she collapsed again. It’s happened before.
As someone who has lost a spouse, I reacted the same way. I was very calm and collected and didn’t cry until 3 days later. My body and mind was in too much of shock. We also had a baby together, and I was only 20 years old. So my first instinct is to put my feelings aside to take care of our son, and be collected enough to arrange his funeral. I didn’t have any reaction until months later when I was in therapy and had a breakdown from what had happened. It was such a out of body moment and you trick yourself into thinking everything is ok so you can function. 3 years later I still struggle with his death. Everyone is different, so I cannot say if he killed her or not. I feel like he didn’t, but who knows.
I’m sorry for your loss, that must’ve been terrible. One of my neighbors was shot and killed in a random robbery a few years back. The wife was obviously not a suspect at all, but people still murmured about her being “emotionless” about his death. I remember thinking, her husband just died and your critiquing her for not crying enough?? Shock is a very real thing and everyone handles grief differently.
I so very sorry for your loss. I cannot even imagine the pain & trauma that you and your family have been through..sending you love & peaceful vibes.. ❤❤❤
A guilty man would have accepted the plea deal that would let him out of jail immediately. Even with a felony on record, he would’ve taken it. The fact that he turned it down and went to court at all is a pretty big sign. Only someone innocent would take that risk to clear their name.
He was a SEAL. He fought for his country, probably faced awful situations, and believed in the military machine would back him up. He didn't take a deal because he believed the Legal System would back him up by playing out, the truth would come out and he would be set free without any stain to his reputation. He was convicted because he 'allowed' his wife the Freedom and Liberty to live her life the way she wanted. Just like he fought wars on behalf of all Americans so they could do the same. I hope he appeals. That jury totally failed him.
I'm just so tired of people being instantly judged for their reactions. Can we stop with that? Everybody reacts differently. Just because they don't react the way you think they should doesn't make them guilty. If you're over-emotional you're acting. If you under-react you must be a sociopath. A lot of people have low to no emotional affect and we need to stop assuming that that's evidence of their guilt.
When my mum died I was in shock for weeks until her actual funeral. When you lose someone THAT suddenly, for me it was literally overnight (it was a heart attack). I got a call from my sister hysterically sobbing really early in the morning. NONE of it felt real. Absolutely none of it. I cried once when they were removing her body then my body immedietly shut off and became numb and felt nothing up until her actual funeral, when it all came out into this sobbing mess. But to my own family I couldn't cry with them or on them when they did, I'd be the one holding them because I was conditioned NOT to cry. Or feel. I thought something was wrong with me because I couldn't cry but it was just a mix of shock, conditioning and the fact I thought it was a sick joke. But that emotion does come out. It comes out to people you trust or it comes out over time. My step-da, who found her, is a veteran and his body kicked into his training mode the second he realised she was cold beside him and couldn't be saved. The only time he cried was when I arrived and we locked eyes, because he had this bond with me where he became like my real dad. He kept it together because of his training too, but you can tell in how he speaks about her that he misses and loves her so much. He once told me he thought he was trained out of being able to love in the military because he doesn't feel it like he used to, but that's all his PTSD and trauma because he 1000% loves. It just feels number in comparison to before he went in and recieved all that training, so it shows in people very differently.
@@TonksTheFool I am so sorry to hear about your mother. I can fully relate to your reaction. I lost my dad at 9 years old, and I didn't have a reaction until about 10 years later, when I had a break down.. We all grief differently, and there is no right nor wrong in how we express or how our bodies deal with sorrow and pain. We are all dufferent. ❤
I actually came to the EXACT same conclusion as you did about her death. Being short doesn't mean you can't smack your head just right that it splits open. I think she got up after the fall running after her phone after knocking herself out, confused and out if it, onto her knees in the grass and set the bottle and phone down, then falls forward onto her face and either passes out or dies there.
I can confirm that not everyone responds to the news of death in the 'expected' way of breaking down and crying... when police came to our house to tell my Mum that her son was dead, she was very calm and collected which she later said was probably her work mode from being a palliative nurse. Coincidentally it was also when viewing the body that she broke down, and from there was pretty inconsolable for months. It can seem suspicious but sometimes it is just how it is.
My mum didn't have a Viewing. We had a Small funeral with her ashes it's been a year and I still havnt cried. Still think she gonna call me at times I even go to call her
yeah, I think that's what happened to Jeff too. He was working in the army, so death isn't that uncommon. At some point he must have had been desensitized by death.
i totally agree. Shock and denial are part of the normal reaction and the time frame can vary. I had a family member die young and initially I had no reaction. I felt nothing, even when I was around others who were crying. Then when others were starting to pull themselves together and we went to the airport, suddenly it hit me that it was real and that I would never see him again. At that point I was the only one crying.
When we were like 17 my friends foot got ran over and one of my friends saw it happen and asked her "DID YOUR FOOT JUST GET RAN OVER?" And she was just like "Yeah but it didn't even hurt" and she didn't feel it until the next morning. Then she felt it for the next 2 months.
Please don’t ever stop making videos. When my two month old daughter gets older I want to be able to watch you with her. 🥺❤️ I watched you every day while I was pregnant and you’ve also got me though so so many hard times in my life.
Specially if she’s wasted, she would definitely be bleeding out. Alcohol thins your blood. She probably got up after the fall when she probably shouldn’t have.
@@itsmaxx8461 particularly when someone hits them on the top of their head with a wine bottle, yes. I saw such an attack on a female outside my bedroom window. A man hit his wife with a wine bottle on the top of her head, she then fell to the ground ( on the pavement) and started bleeding profusely. Katherine had a head wound on the top of her head, not on the back of the head. Proof he hit and killed her with that wine bottle. Bailey Sarian knows he killed her, trust me.
I think that the forensic pathologist's statement (that the wound couldn't have been caused by the fall) should have been challenged by another expert invited by the defense.
Honestly it's totally believable that she fell. My mom and dad nearly had a similar experience, thankfully she found him and was able to call an ambulance. He'd fallen and broken both shoulders and the temperature was in the negatives. If she hadn't found him he could've easily frozen to death and she might've been blamed.
Regardless if he did or not, I think there’s no way the prosecution was able to prove his guilt. Sad that their daughter had to grow up without a mom and a dad.
Honestly, I'm surprised at the guilty verdict for this one. I feel like there wasn't enough evidence. So I'm with you, I don't think he did it either. I'm also with you on the theory of her falling, that's exactly what I was thinking!
Wasn't he also super wasted himself? I think if he did it the crime scene would be a whole lot sloppier with plenty of evidence pointing to him, but it just wasn't there from the sound of it.
I agree with him being innocent. There’s nothing to suggest he did this but plenty to suggest she probably fell and it went a lot like you’ve stated. There wasn’t any “aha!” Evidence. Also do a story on Robert Durst next!
Logic had no place in this case, apparently, everyone in the comments is pointing out different holes in the story but the jury couldn't see it 🤣🤣🤣 Either we're missing some key information of the people at that trial were dumb af
i think she had a stalker or neighbor who tackled her to the ground, then to avoid her ratting them out after she got back up, i think they grabbed her bottle and hit her with it.
I believe parents have great instincts when it comes to their children. The fact that her mother testified on his behalf, makes it hard to believe he’s guilty.
@@adriennepaige4003 notice the word "if". also comment meant to show the absurdity of admitting you are guilty and being free versus saying you're innocent and still ending up in prison
I love how Bailey talks about people like they’re people. She says she’s nonjudgmental and I actually believe her. Her delivery is a triumph of human kindness, really.
She really is non-judgmental, part of her personality and she has proven it many times. Also, when she *is* being judgemental, she admits it by saying, "I'm not judging... but, I kind of am..." and then goes on to explain how and why. Many a times I find myself feeling ashamed because I was judging and she went on to explain how I might be completely wrong. A rare and genuine quality in a person. 🥰
I totally agree with your theory. This was all circumstantial evidence. The prosecution just wanted a win. Cannot believe the court rejected his appeal, which was a couple of months ago.
I was wondering about an appeal…it really didn’t surprise me too much that they rejected his Appeal…I believe he should reach out to a foundation like the Innocence’s Project to request a new POV, Venue, etc.
The biggest thing for me is that he wasn’t left handed. If you were going to hit someone in a moment of anger your first instinct wouldn’t be to use your non-dominant hand, right?
yeah that doesnt line up for me. you might grab a bottle with your non dominant hand to take it out of a shopping bag with other stuff, youd never grab it with a weak hand if youre trying to use it as a weapon
It's thinking that too..BUT what if the table or wherever was on the left side?...I feel it is totally possible he just grabbed it with that hand and ran after her...that's why it was only 10 seconds...then in the middle of the night he started thinking ok what's next?...then decide to go pose her to be able to say 🧔🤷♀️..I totally thought the phone and bottle were staged...
My husband has always said his left hook is much harder than his right. He is also right handed. Idk the logic but he swears by it. But it doesn’t mean everyone is like that. I’m 100% weak in my opposite hand.
Some people just don’t emote automatically. It takes me days to process things most times. Doesn’t mean people don’t feel things or lack empathy, it just takes a while to land. I also don’t emote in front of people I’m not comfortable with or don’t trust. Some people need to feel safe to be vulnerable. The army literally destroys peoples humanity. What do they expect???
I agree 100%. I’m actually a very emotional person when the emotions actually hit me lol but in the moment it’s like I’m trying to wrap my head around whatever it is… Even with my babies, I didn’t cry my tears of joy until a few hours later when it was just my husband and I in the room… same with funerals & even when my husband proposed.. 🤷🏽♀️
Totally. I think sergeants (?) in army yell on top of their lungs in the face of newbies to "break them to build them up again" . I don't think someone from the army will emote that much.
There was that case of a man who had his brain bashed in, got up, got ready for work, and then fell over dead right by his front door. Like, head injuries are wild.
I don't remember the name of that case, but there's even more to that: he shaved half of his face to get ready for work, because of brain damage. Didn't even realize his wife in the bed was dead.
Peter Porco, he even locks himself out of the house getting the newspaper and let’s himself back in with the hidden spare key. Absolutely insane and fascinating.
It's wild to me that no one saw anything or even found her earlier. I live in a very sleepy suburban neighborhood, but there are still people who get home later than 11pm or get up before 5am.
It depends on the weapon and how you trained. In most cases, someone is going to use their dominant hand; however, if someone trained to use their non-dominant hand, they will be better with that weapon than with their dominant hand. That said... beyond specific fighting styles and perhaps HEMA (Historical European Martial Arts, where you might use a shield or a parrying dagger called a "main gauche") it's extremely unlikely someone would specifically train to use any weapon with their non-dominant hand. Also, contrary to popular belief, your non-dominant arm is usually stronger than your dominant; conversely, your dominant arm is usually far more accurate. The reason your non-dominant arm is usually stronger is because we tend to use that arm for grunt work. We'll hold heavier bags, books, our kid, and so on in that arm while using our right arm and hand to do things that require greater coordination. For instance, it's extremely common for parents to hold their little kid with their left arm and use their right hand to fish keys out of their pocket to open the car door because most people are right-handed. In a left-handed person, you're usually see the opposite.
@@MikeTXBC wow I love this reply. That’s a really interesting thought. The only reason I would say you would use your dominant hand in a moment of rage is because there’s no thought when you’re angry. Using your non-dominant hand because it may be stronger seems like that would require thought
I'm kind of shocked that he got 16 years with such circumstantial evidence. I can't say either way if he did it or not because both stories are plausible. Definitely not guilty without a shadow of a doubt.
I'm from Alabama. I remember when this happened and literally nobody thought he was guilty. It was even reported in the local news as a tragic accident.
@@analisaacosta5505 Jan. 7, 2022 The Alabama Supreme Court denied an appeal for William Jeffery West who was sentenced to 16 years in prison in the death of his wife, Kathleen (Kat) Dawn West.
Let’s be real. In Alabama the public opinion and county image are two things. Because it was Calera and especially Shelby county. I’m sure it was just about image. Had this happen in Eastlake, green springs or Trussville, nobody, even the news, would have cared. ☹️
I was thinking the same time. When things like that happen here in Oxford it's a big deal, but something much worse can happen in a more rural area of Calhoun Co and nobody cares.
Terrifies me too. When I had to serve as a Juror on a serious Federal Case I just made sure I wasnt AT ALL biased. Listened extremely carefully to the whole debacle. And made my decision based off of facts. Not everyone is terrible. Most biased people admit this to the judge so they dont have to serve. I wish you well friend.
You make a great point. How is it possible to say “jury of their peers” when people already had made their minds up as to what “kind” of people they were. Not only did they not have enough evidence for conviction, this case should of been granted a change of venue due to prejudice. So scary and sad!!
Absinthe and energy drinks sounds a little bit like an accident to me... I reckon she probably fell and hit her head left the first pool of blood then passed out and went to walk back..? Love the story as always Bailey! Glad you’re back! ❤️
And how likely is she to die from a fall ? No skin embedded in concrete. A fall to cause a fracture of the skull bone is not enough force. she couldve fallen down a flight of stairs and lived and the downward perpetuation causes some force - moreso than just fainting, blacking out or tripping. The force is the evidence- physics.
I agree. And I think the steps on the health app that showed him take a few steps after he said he went to bed could've been him going to the bathroom (because we all take our phones to the bathroom nowadays) and may have assumed his wife was in a different part of the house and hadn't gone to bed yet. The door being open for 2 hours at 1 am is kind of unexplainable to me though.
I’m 5’8” and was paralyzed for 19 months. When it happened, I was training for a marathon. When I recovered my stubbornness got the best of me. I tried to run. I collapsed and evidently hit my head. (I don’t remember that. I still think he’s lying about it. I remember falling on grass but got up and made it home.) I didn’t think it was an issue but the next day I was slurring my words, dizzy, and thought I was just dehydrated and desperately needed fluids. My bf mentioned to the doctor I had hit my head, they did a CT scan and next thing you know I’m being rushed to the hospital. I “hit my” head hard enough to cause 3 hemorrhagic strokes. There were no bumps or bruises on me. My brain was bleeding! I don’t believe he did anything and it is insane he was convicted. I would have hung that jury.
Thanks for this. Today was horrible. I'm so uninterested in everything :( plus there is really nothing to do in my city. I wish I lived in LA or some other city where its hard to get bored :(
16 years is seriously so much time to serve in prison when there was absolutely no proof. I am not sure whether he did it or not, but am surprised the sentencing was so harsh without any real evidence
Same couldn’t do it I hope he fights it. Military men that didn’t do it wouldn’t admit guilt they don’t play that if they didn’t do it they would never take a plea deal even if they didn’t get prison time.
Right. And the fact that they changed the charges last minute is so shady. The prosecution's job is to show that the acused is guilty "beyong reasonable doubt". There was so much doubt in this case that the veredict is pretty messed up.
My gut feeling is that he didn't do it. His story matches his steps. It's rather creepy that someone was opening and closing the front door, though. Yikes!
Agreed. However; I have experienced when I left the door open, the wind closed the door just enough for my security to be tricked into thinking it was closed only to be swung open by the wind yet again over and over. I'm thinking she went outside and left the door open. She probably tripped and dropped the bottle which explains why there's a piece of glass missing. When she came to, she probably found the bottle across the street, bent down to pick it up and the blood loss made her pass out all over again. Any way you look at this, it's tragic.
The front door was opened for 10 seconds at 10:53pm. This is probably when he threw her phone. Her phone didn't track any steps after this. His phone tracked 18 steps between 11:03pm and 11:10pm and didn't track any further steps that night. This is when he probably fell asleep (some reports say he fell asleep on the couch, others say he went to the downstairs bedroom). The front door opened again at 1:51am. This is probably when Kat went outside looking for her phone. The door didn't close again until 5:12am which fits the timeline of Jeff waking up, searching for Kat, and closing the door himself when he saw it was open.
15:19 side note, a fact I learned in the passing of my brother (who was in a DUI accident) blood alcohol levels post mortem actually rise bc of the way it is measured in autopsy and something (insert science here) that happens to the alcohol while it sits in the blood after death…so she may or may not have been THAT lit.
Whether he did it or not, there’s absolutely reasonable doubt in this case- and if he appeals he should be granted a new trial. Also agree that they shouldn’t be able to add a lesser charge right before deliberation. I
its just scary to think they can so easily get someone locked up with such a cloudy, unclear situation and so many unanswered questions. i think they got this one wrong
As a jury member how can you convict someone when you can not know beyond a reasonable doubt. There is no way at all they could know beyond a reasonable doubt. Miscarriage of justice all of the way. Anyone guilty would accept the plea deal... common sense, the jury wasn't allowed to know that I believe they said on the documentary which is infuriating.
how could they have been flirty if there was no DNA on his clothing in general that whole night that's weird unless it was just verbal unless he changed clothing
I thought that was odd, but what if he changed clothes after he said he went upstairs to bed alone? That wouldn’t be sketchy behavior, and if she never came up to bed, there would really be no reason for her dna to be on him.
I know a girl who gave herself consecutive concussions while drinking heavily (she was getting over a break-up), and didn't act like she was in pain at all. Also, I'm short, barely over 5 foot - are they seriously claiming that if I fall on concrete I can't severely injure myself? If I smack my head off the pavement I'm not going to get hurt??? Even if it's the curb??? That is the stupidest thing I've ever heard. Bone density varies between people. A few years ago I tripped on the pavement and fractured my wrist just from reaching out to stop my fall. In school one girl stood on another girl's foot by accident and literally broke it. Human bodies are weirdly fragile at times.
while i agree with you, those examples could be considered different tho. you have your wrist supporting the weight of your entire body and a large amount of that girl's weight on the other girl's foot. if you just fall it is not like something is pressing your head down onto the curb, its just a free fall. im not an expert but theres a lot of debate on what kind of force can cause a head wound, so its just another piece of their "evidence" that CAN be explained by something else (like the upside-down finger prints)
@@cabbagejuice i got a concussion just from hitting my head back against my cushioned car seat of COURSE a concussion would happen if you fell on concrete 🤡
@@asmrtpop2676 no its not of COURSE. every situation is different and some ppl can go through the exact same thing as you did and be fine, as op said everyone is different. but my point was that the WAY you fall/hit yourself on something can affect the injury. her injury would be different depending on the angle, the location that was hit, whether she hit the flat concrete or the curb, whether she was running or standing, if she braced her fall in some way, etc. thats what foresnsic analysts do as a job, they try to figure out exactly how a deadly incident happened to see what method is plausible to get that kind of injury. but it looks like no one tried to analyze irl whether someone could die from falling like that, and they just took the word of 1 "expert" which could be a pseudoscience guy and no one would know. ive seen documentaries where an analyst went on the stand to prove that a girl was bit by a human and it turns out the markings were from wildlife so you cant say for certain someone could get an injury one way or another, theres many possibilities.
@@asmrtpop2676 from a car accident??? Really just curious how anyone can bonk their head on a car seat head rest and get a concussion without exuberant force
But, when you live in a conservative state like that, this outcome is always a risk. They underfund their police, so you can’t expect much from the police or investigation. The society is very judgmental. So, if you step out of line just a touch, you have to expect to be crucified. Honestly, I don’t understand why anyone would choose to live in the American Southern states. It feels so oppressive. And, I don’t just mean the weather.
I’m still stuck on the door being opened after she was dead and he was asleep. I feel like there could have been another person involved and police were so focused on the husband they didn’t look into it enough. I mean it was only 11 at night and she was a beautiful woman outside alone in her underwear and she was wasted.
Doing a bunch of online "adult" stuff comes with that risk. PD seemed so keen on the husband they didn't really look super hard into too many other people.
They were trying to build a circumstantial case against the husband and I'm sitting here going "this isn't enough, she's going to give a plot twist." That twist never came. Not once did I think there was enough evidence with the husband.
I love this -- "the prosecution was 'afraid they were going to lose'". Mmmmm-- I feel like they should be more worried about the truth than winning or losing a case. People's lives hang in the balance, and they are more worried about playing games and their win/loss record.
@@horrorcowboy7338 Commonwealth law system in general. Places like the UK aren't any better dude. Some of the worst court decisions you'll ever see come out of Canada, for instance.
Not sure what they were smoking, but you can absolutely cause a fatal head injury by simply falling from your normal height. That’s the whole reason you’re supposed to keep a person awake after a fall until they’re properly assessed by medical professionals. A lot of behavior in that time can be observed to check for brain damage. Alcohol is a blood thinner. In fact, in moderation, it’s been observed as preventing certain types of strokes in people over the age 65. While I won’t completely rule him out (there’s always a possibility), this case can easily be seen as an accidental death, 100% done by Kat. -Drops the bottle, chips a piece and it goes flying wherever -Loses her footing and falls back, hitting her head -Being inebriated, doesn’t feel the pain and gets back up after a few minutes, leaving blood behind -Gets up, finds her phone, gets turned around trying to make it back home -falls again across the street, phone and bottle in front of her as that’s where she let go of them. Possibly getting ready to push herself up, not having enough strength to do so. Dies as a combination of her injuries and the elements.
There’s got to be a better justice system. It’s so easy for innocent people to go to jail. Prosecutors only care about convictions. It’s also too easy for the guilty to walk away.
Could have been that she was wasted and when she bent down to pick up her phone as she walked close to it then she stubbed her toe and fell forward and bashed her head on the edge of the curb cracking it open. I don't think he did it either but regardless there was not enough evidence to prove beyond doubt that he did so he shouldn't be in jail
You’re so right- I work with The Innocence Project and it’s absolutely heartbreaking at the number of cases we get request to reviews for every single one of them deserve a new trial, but we have only have so much resources 😢it’s so disturbing that we can’t help all who need it
Whether he did it or not, there definitely wasn’t enough evidence to convict. also, changing the charge right before the jury decides definitely should be illegal or regulated in some way!

They believe he committed a crime in 2002 but can’t find him.
I believe your thoughts are absolutely correct. As a nurse I can say alcohol aids in extreme bleeding and hard to clot cuts. Wonder why this was never brought up. As far as her height I'm 52 as well, a crub adds and 4-6 inches of falling from curb to street
Them saying a 5”2 girl can’t have a fatal head trauma from just a fall and then there’s me who is 5”1 and had a fall which resulted in 5 breaks in my ankle. Legit anything is possible
Is it possible that Jeff just hadn’t realized what was going on? As a smoker myself, when stressed, the first thing I want to do is light a cigarette. He was probably stressed about not know where his wife was and stressed about the argument. He was probably having a think while smoking. And the full realization hadn’t hit about the police being there.
i also don't like how the police always looks at the way people react and expect them to be crying hysterically or smth. Something as traumatic as seeing your wide dead on the road probably didn't register in his mind or his mind was trying to ignore/block that out in order to protect him from having a panick attack.

What? Overly nasally and kind of giddy about telling a story? Bailey is a great storyteller , I miss the theme song beginnings though.

He's quiet and calm...I am NOT LOL
Same, but in reverse. I'm a reserved, quiet, calm woman who is drawn big, overt personalities. They bring me out of my shell and I feel I give them notice when they go too far.
You are absolutely right in my feeble opinion. It seems also in some of these cases- when the Mom stayed home raising their children-then getting a job or career as the kids were older and in school- some of these Men- didn't like it when they found out their wife had a brain. I'm going on.60 now. Been engaged
3 times.
Yea they always say this on the morbid podcast.

@Rebecca Lynn Stewart Then, explain how Jeff's DNA was never found anywhere on Kat's body??? She had no life insurance policy to collect from, granted both their fitness apps recorded their daily movements throughout the day, but that alone isn't enough for an overall conviction.
Circumstantial Evidence presented at Jeff's Trial: fitness app daily walking counts
No DNA tested: fingerprints, no saliva, no fibers, no touch DNA.

Right, it's not about DA's furthering their career at ANY cost. Totally not about doing anything to have a conviction added to their resume.
And they will NEVER let an innocent person out of prison even when presented with hard evidence to the contrary, becuase their egos prevent them from admitting they were wrong the whole time.

Crazy
A guilty man would have accepted the plea deal that would let him out of jail immediately. Even with a felony on record, he would’ve taken it. The fact that he turned it down and went to court at all is a pretty big sign. Only someone innocent would take that risk to clear their name.
It's insane how a guilty person can get out easily and the innocent one needs to stay
"She's a woooo!" As a retired "woo" I felt that description in my soul.
Same
I'm just so tired of people being instantly judged for their reactions.
That’s why we convict based on evidence and not on body language.

Thank you! I had someone at work once flip out at me because I chose to go to work the day after I found out my grandmother died and wasn't crying.
Bailey is gifted when it comes to telling the story with respect without being too morbid.
Still think she gonna call me at times I even go to call her

i totally agree. Shock and denial are part of the normal reaction and the time frame can vary. I had a family member die young and initially I had no reaction. Same here! If she was running at some speed, the impact could have been quite heavy.
Facts!
I know right. I wish they'd done that cause wether it was or wasn't it most definitely could've been cause by a fall.
Agreed, agreed. Even if he's guilty as sin, he's gone down on a case with a LOT of reasonable doubt and thats....worrying.
Honestly, I'm surprised at the guilty verdict for this one. I feel like there wasn't enough evidence. So I'm with you, I don't think he did it either. I'm also with you on the theory of her falling, that's exactly what I was thinking!

I'm right handed, but I can throw harder with my left than my right so idk. I really don't think this man killed her though.
My husband has always said his left hook is much harder than his right. He is also right handed. Idk the logic but he swears by it. But it doesn’t mean everyone is like that. I’m 100% weak in my opposite hand.
Yeah I guess so, but I’m right handed and my left hand is better at throwing things, holding heavy things etc.
I’m actually a very emotional person when the emotions actually hit me lol but in the moment it’s like I’m trying to wrap my head around whatever it is…

Just a thought, who in a moment of rage, would pick up a weapon with their non-dominant hand though?
Maybe if they're holding the victim down with their dominant hand... That arm is stronger than the other one.
@@MissCherryBomb69 meh but if he was holding her down that hard there'd be evidence and sign of struggle.
That is exactly what I was thinking!! If I am going to hit someone with a bottle, I am definitely going to use my dominant hand

I'm from Alabama. I remember when this happened and literally nobody thought he was guilty. It was even reported in the local news as a tragic accident.
I hope he files an appeal
A a
@@analisaacosta5505 Jan.
I LOVE that "I'm laughing because..." has now made it's way into your sponsor parts too lol
Yes 🙌🏼. She should add this phrase to her merch!
Oh I'd DEFINITELY buy it!
Thanks for making this public
As a "non traditional" woman born and raised in Mississippi... A jury of my peers is absolutely terrifying.
Yes Bama here & it terrifies the 💩 out of me!! Everyone wants to believe the bad in people
SERIOUSLY YES
You make a great point. How is it possible to say “jury of their peers” when people already had made their minds up as to what “kind” of people they were. Not only did they not have enough evidence for conviction, this case should of been granted a change of venue due to prejudice. So scary and sad!!
Same and I'm a Bana girl! We southern states really need to get out of 1950 and catch up with the times.
The "He was a little.... I'm sorry, not little, a photographer husband" I love her for feeling like she needed to clarify😂 💕 Baileys so kind 💖💖
Absinthe and energy drinks sounds a little bit like an accident to me... I reckon she probably fell and hit her head left the first pool of blood then passed out and went to walk back..? Love the story as always Bailey! Glad you’re back! ❤️
yep, thats what i think and hubs was upstairs passed out asleep. gah sometimes i think juries don't understand reasonable doubt.
Why was He awake though?
And how likely is she to die from a fall ? No skin embedded in concrete. A fall to cause a fracture of the skull bone is not enough force. she couldve fallen down a flight of stairs and lived and the downward perpetuation causes some force - moreso than just fainting, blacking out or tripping. The force is the evidence- physics.
Why didn't do another autopsy? Also, today's absinthe is not the stuff from the 19th Century (sadly). It's just alcohol, no hallucinogens.
I’m pretty positive she had borderline personality disorder. 💯 those texts mirror things we say for no reason out of fear of abandonment.
I was thinking something like that. Like, anxious attachment or something...
"I could get in trouble legally for saying OF" .... *Proceeds to do it several times* 🤣🤣🤣🤣 I love Bailey!
Cause she literally can't get in trouble for saying that...
Right? Hahaha
It’s Bailey Sarian lol
I think she meant get in trouble for stating it as an absolute, which is why she said allegedly...
as a 5’2” woman, i could absolutely fall hard enough for that (ESPECIALLY intoxicated)
on ABSINTHE
Have you died before from falling? Serious question
A friend tripped on a shadow on the sidewalk and shattered her leg. She was in hospital for weeks because she got blood clots.
Love that we got a “I’m laughing because…” in the sponsor before the episode even started! That’s the quality content I’m here for 👏🏻

Random note. The health app isn’t always correct if it’s just your phone cuz you can shake it and it’ll give you steps
Yes. Mine records me Turning in my sleep sometimes as steps, and also he could've just been using the bathroom.
“Sometimes, full on nakeeeyy” made me laugh!
16 years is seriously so much time to serve in prison when there was absolutely no proof. I am not sure whether he did it or not, but am surprised the sentencing was so harsh without any real evidence
Amen! A lady in Arkansas recently killed her kids and there was no doubt due to evidence and what she said. She only got 10 years.
I don't think as a juror, i could find him guilty with such lack of hard evidence.
I was thinking the same thing
Same couldn’t do it I hope he fights it. Military men that didn’t do it wouldn’t admit guilt they don’t play that if they didn’t do it they would never take a plea deal even if they didn’t get prison time.
He may have been better off not having a jury trial and chosen a bench trial. Maybe his lawyers were not keen on the particular judge.
Right. And the fact that they changed the charges last minute is so shady. The prosecution's job is to show that the acused is guilty "beyong reasonable doubt". There was so much doubt in this case that the veredict is pretty messed up.
Agreed
These theories are my exact feelings as well! I feel bad for the dude.
I don’t think he did it either
I think it was a hit and run, someone hit her with a car got scared and dipped
15:19 side note, a fact I learned in the passing of my brother (who was in a DUI accident) blood alcohol levels post mortem actually rise bc of the way it is measured in autopsy and something (insert science here) that happens to the alcohol while it sits in the blood after death…so she may or may not have been THAT lit.
They might have taken that into account when measuring it. Idk
Seriously, no one can relay a true crime story the way Bailey does.
Agree 👍 💯💯💯
Whether he did it or not, there’s absolutely reasonable doubt in this case- and if he appeals he should be granted a new trial. Also agree that they shouldn’t be able to add a lesser charge right before deliberation. I
One can not receive a new trial due to lack of evidence that convicted one. Crazy, right?
@@voteforscience because of double Jeopardy? Wow
its just scary to think they can so easily get someone locked up with such a cloudy, unclear situation and so many unanswered questions. i think they got this one wrong
totally agree, and i want to hear a historical recount of the lindbergh baby??
The prosecution didn’t prove beyond a reasonable doubt. He shouldn’t have been convicted.
Sadly though, people convict based on feelings. Not thinking.
My gut is telling me he isn’t guilty. Especially with her mother testifying in his defence … that speaks volumes to me.
I can assure you my mother would speak in the defense of anyone who would hurt me lol. But yeah besides that there’s no hard proof
My mom certainly wouldn’t.
Mothers frequently take their son’s sides, this is not new. It means nothing they protect abusers.

Right! They didn't hug or anything that whole night?? Very suspicious.
@@Dance567-8 right she did say that that they were flirty n stuff that night sooo...
how could they have been flirty if there was no DNA on his clothing in general that whole night that's weird unless it was just verbal unless he changed clothing
I thought that was odd, but what if he changed clothes after he said he went upstairs to bed alone? That wouldn’t be sketchy behavior, and if she never came up to bed, there would really be no reason for her dna to be on him.
We’ve seen people with wayyyy more evidence they committed a crime be given a not guilty verdict…. unfair

Same height, same fracture,... totally agree with this statement
He was convicted on their lifestyle, not on evidence. The jury threw out reasonable doubt and went for unreasonable opinion.
I completely agree with you.
@@Steampunkkids This is true but also a tiny bit victim blaming.

I’m still stuck on the door being opened after she was dead and he was asleep. I feel like there could have been another person involved and police were so focused on the husband they didn’t look into it enough. I mean it was only 11 at night and she was a beautiful woman outside alone in her underwear and she was wasted.
I agree. Also I wondered if someone followed them home.
Doing a bunch of online "adult" stuff comes with that risk. PD seemed so keen on the husband they didn't really look super hard into too many other people.
Also the wind could’ve shut the door? & she just really hit her head 🤔 This is a crazy case
I was thinking the exact same thing about there being another person who killed her and had walked in and out of the house

They were trying to build a circumstantial case against the husband and I'm sitting here going "this isn't enough, she's going to give a plot twist." That twist never came. Not once did I think there was enough evidence with the husband.
I love how respectful you are when speaking about these peoples stories ❤️
I love this -- "the prosecution was 'afraid they were going to lose'". Mmmmm-- I feel like they should be more worried about the truth than winning or losing a case. People's lives hang in the balance, and they are more worried about playing games and their win/loss record.
Well, that's just the American law system lol. The attorneys and defendants are paid to do one thing: win.

-Drops the bottle, chips a piece and it goes flying wherever
-Loses her footing and falls back, hitting her head
-Being inebriated, doesn’t feel the pain and gets back up after a few minutes, leaving blood behind
-Gets up, finds her phone, gets turned around trying to make it back home
-falls again across the street, phone and bottle in front of her as that’s where she let go of them. Possibly getting ready to push herself up, not having enough strength to do so. Dies as a combination of her injuries and the elements.
Yeah my daughter got a concussion from falling from standing.
You’re so right- I work with The Innocence Project and it’s absolutely heartbreaking at the number of cases we get request to reviews for every single one of them deserve a new trial, but we have only have so much resources 😢it’s so disturbing that we can’t help all who need it

i also don't like how the police always looks at the way people react and expect them to be crying hysterically or smth.
