I think you misinterpret that question. It is asked because being "Some kind of constitutionalist" explains some of the abnormal behavior these "Policing the police" types display. If your the type of person that is serious about your rights and watching the police, then that explains behavior that would, under normal circumstances be strange or suspect. You often see cops saying that to people who are exercising their 2A rights. Walking up and down the sidewalk with a battle rifle slung over your shoulder is potentially strange and erratic behavior, doing so while speaking about 2A rights is perhaps unusual behavior, but entirely justified, and non threatening. Randomly filming the police raises questions (Also in this video, the cop tells the guy to take his hand out of his pocket) This is a super common thing, they don't know what you have, you can see the gun on his hip, he doesn't know why your hand is in your pocket, and police die because they approached the wrong guy. This guy immediately says "No" I would also like to clarify that I am not defending the cop in this situation, at all. His entire reason for stopping was wrong, this police interaction should never have happened. Taking pictures of the police isn't a crime (And although it is somewhat strange behavior it is not suspicious behavior) but some of these things you see cops say a lot. It is because they are trained to say it, or have learned to say it. I have had a lot of experience with the police, on both sides of the law, I am beginning to know them well. "Are you some kind of constitutionalist" actually (Usually) means "Can I relax around you, is this a display of your rights, or just strange behavior" Keep in mind cops are often fought or killed by people who were shouting "I haven't done anything, you don't have the right!" even when they were caught red handed and moments later are shooting at the police. Assuming the officer did have a bodycam, it would depend on the manner that he drew his hand out of his pocket. If he drew his hand out slowly so that the officer could see if he had any sort of weapon or object and the officer did discharge his service pistol this would be very concerning. I have no idea what was going through that officer's head so I don't want to make any decisive judgements on what I think happened or didnt happen. Edit: Another comment pointed out how relaxed the officer was to take out his cell phone and photograph the suspect. If the officer had shot him or discharged his weapon, knowing this, the officer would probably be found guilty.

I think you misinterpret that question. It is asked because being "Some kind of constitutionalist" explains some of the abnormal behavior these "Policing the police" types display. If your the type of person that is serious about your rights and watching the police, then that explains behavior that would, under normal circumstances be strange or suspect. You often see cops saying that to people who are exercising their 2A rights. Walking up and down the sidewalk with a battle rifle slung over your shoulder is potentially strange and erratic behavior, doing so while speaking about 2A rights is perhaps unusual behavior, but entirely justified, and non threatening.
Randomly filming the police raises questions (Also in this video, the cop tells the guy to take his hand out of his pocket) This is a super common thing, they don't know what you have, you can see the gun on his hip, he doesn't know why your hand is in your pocket, and police die because they approached the wrong guy. This guy immediately says "No"
I would also like to clarify that I am not defending the cop in this situation, at all. His entire reason for stopping was wrong, this police interaction should never have happened. Taking pictures of the police isn't a crime (And although it is somewhat strange behavior it is not suspicious behavior) but some of these things you see cops say a lot. It is because they are trained to say it, or have learned to say it.
I have had a lot of experience with the police, on both sides of the law, I am beginning to know them well. "Are you some kind of constitutionalist" actually (Usually) means "Can I relax around you, is this a display of your rights, or just strange behavior"
Keep in mind cops are often fought or killed by people who were shouting "I haven't done anything, you don't have the right!" even when they were caught red handed and moments later are shooting at the police. Just sayin.

I am not saying that is how this guy was using this. This cop was behaving disgracefully, I am more commenting on why these phrazes crop up quite a lot. Not that they were in any way justified in this situation. The cop was treating this guy like he was a suspect in a serious crime, all because he filmed the police. Portions of this video look completely justified, and normal, until you remind yourself that this guy isn't suspected of armed robbery.

Assuming the officer did have a bodycam, it would depend on the manner that he drew his hand out of his pocket. If he drew his hand out slowly so that the officer could see if he had any sort of weapon or object and the officer did discharge his service pistol this would be very concerning. I have no idea what was going through that officer's head so I don't want to make any decisive judgements on what I think happened or didnt happen.

Another comment pointed out how relaxed the officer was to take out his cell phone and photograph the suspect. If the officer had shot him or discharged his weapon, knowing this, the officer would probably be found guilty.
