  • NEVER lock your tenant out of their rental unit when they’re in default. This is illegal! Under Texas law, they are entitled to the full judicial process.

    This most likely will result in squatters making fake lease agreement and bam 6 month to a year free rent.

      This is specific to tenants and does not apply to trespassers. If a trespasser becomes a squatter, that's usually because the landlord is negligent in monitoring the property. Unfortunately, that negligence does sometimes result in months of lost rent.

    It is called self help eviction which is probably illegal in all states.

      Unfortunately, this happens a lot, and many tenants have no idea of their rights.

    In NYS, "self help" evictions will get you massive legal penalties up to $10,000 and three times the legal aid attorney fees that are representing the tenant.

    So, there are several groups appearing in many states that are legally getting rid of squatters, by squatting on them and providing an actual tennent agreement from the homeowner. When the cops arrive, they have no choice but to honor the "tennent" with an actual signed and notorized agreement, and kick out or arrest the squatters.
    I don't exactly know the legality of this, but if I can ask "Vinnie" from 34th St. to sign this back dated agreement and "Vinnie's good friend Bobby" happens to also possess a notary stamp, then they both go down and "chat" with the squatters, that is good enough for me.
    Vinnie was cheap too, only a few Benjamins got to home with someone else.

    The concept of “Adverse Possession” aka “squatting” has been around for quite some time. This concept takes years in every state and can have other financial requirements as well.
    What’s making the news is people moving into vacant dwellings and not being noticed for enough time to earn “Tennant” rights, these rights protect lessees from illegal eviction or other illegal issues with landlords.
    Start requiring leases to be files with the county you live in, and protect your property

      That's going to require changes in the law. Many states still allow oral lease agreements, and registering leases is not a common requirement.

      @@LandlordAttorney At least that would protect both parties and there is always the idea that someone is renting "under the table" to avoid a tax liability

    One question so what is the help that tenents get in their mail after they have been sie in the jp court some this about eviction stoppers from Houston tx what is that ? Is that something that they will for their tenants meanwhile they are in court process and then the renters pay them back how thoes that work for the tenents sir ?

      I'm not familiar with eviction stoppers. I do know that certain individuals mail information to tenants, but most of it refers to paying these companies money for services that the court offers for free. Essentially, they are selling an eviction appeal, which is already available to every tenant in Texas.

    Well that's insanely immoral, overthrow them. If you can't afford rent, move out before you miss 1 payment. No excuse for stealing from your landlord.

      One reason landlords abandon buildings, go ahead city government try and get the squatters to pay the property tax.
