    My long-term guest was the seller of the house that I bought. He started to move out and just couldn’t get it together to do it. I did have another house in the back of my house that I was gonna rent out anyway. so I let him stay in there. I figured he built it so he would know how to take care of it well, five years later he was still there. I asked him to move out in January 20 24 and he said he would but didn’t until June he has moved out. He got another place. I had offered him if he wanted to stay there he had to pay rent of a certain amount because my taxes went up and I needed it to cover my cost. He was paying all the utilities which he paid on time and every month, which was good but now my cost was going way up and I needed more money and he didn’t wanna pay it so he left and moved into his new house, but he left all his stuff here and he still gets mail here. His lease is up at his new house and I don’t know what he’s going to do now as I still have all his stuff can he claim this as his residence since his belongings are still here and he gets his mail here even though he rented someplace else? I saw the lease that he rented from and I know where it’s at, but it was a Airbnb house and that’s why he didn’t take all his stuff. He’s now telling me that he’ll get his stuff out by the end of the month, but I don’t think he will. I didn’t go through with the eviction process, but I was going to, but then he got outso I don’t know what to do now.

    Hi Ernie, what are the Specific requirements that Must be in an Order Setting Supersedeas Bond set/signed by a county court judge in Texas?

      @richardd.youngm.s.e.6222 Every court has its own specific requirements. Many courts prefer for the plaintiff to draft a full order for the judge to sign, but some courts like an order with blanks for the court to fill in, and others will draft their own orders. There is no uniform statewide order setting supersedeas bond in Texas.

    Good evening Ernie, I really enjoy your show, I am a bit late today, my question is my tenants just passed and only his name was on the lease, but his wife and children are in the property and the rent is 3 months late what should I do (HELP) ?

      Death is not generally a defense to nonpayment. I'm not sure what state you're in, but you should be able to send written notice to the named Tenant (and probably his Estate) along with notice to the occupants that you intend to evict. Notices are going to look a little different in different states, so you may need to seek out legal counsel. We're in Texas, if that helps.

    If i want to issue notices of default by certified mail (or notice of termination) and say please cure the default within 3 days. How do I write the letter not knowing when the letter will be delivered? Since the time to cure starts from receiving the letter. Thank you !

      I assume you are asking about the Notice of Default vs. the Notice to Vacate. If so, the right to cure the deafult is generally found in the Lease. If your lease offers an opportunity to cure within a certain number of days or upon written notice, then you must provide that reasonable opportunity within the guidelines of the Lease.

    If I have to send a certified letter for notice to vacate, specifying for example “3 days to vacate”. But it is 3 days from the date the letter will be delivered. How would I know what day the letter is delivered and how do I write any certified letters specifying any date?

      We recommend sending the Notice to Vacate via Regular And Cerified mail. Most tenants will never collect the certified letter, but that is not required. You know that the regular mail cannot be rejected and can assume the regular mail was delivered on the day the mailman first attempts to deliver the certified letter. That day is day ZERO. Let 3 full days pass after that, and day FOUR is your first day to file.

    Hello my name is t I move n my place July 2023 how ever a lot of things I ask the manager to fix n did not do I'm also disabled me n my kids we have no heat nor air conditioning I have to use gas stove to keep my kids warm n summer time there time we go to a motel or a friend's house because the temperature n my house is the same outside I have had sewage back up plenty times mices so yes I stop paying rent 3 months ago now have a pay quick notice Bennett Court not once but twice and here it is now 2025 still have to move what do I do

      @tamikaallen6358 Unfortunately, once you are behind in rent, it is difficult to force the landlord to complete repairs. Basic repairs should be demanded in writing while rent is current. I have no idea which state you are in, and I only represent clients in Texas. However, you might want to see if there is legal aid assistance for people with disabilities in your area. There might be free assistance out there for you. Best of luck.

    11:10 pm. Texas. Tenants moved out over a month ago. I had to move in. I moved all last tenants property to garage. Promised to get out by the “1st”… so I feel my garage is free storage. What should I do. I own the home but can’t get them to get their stuff they do want. Please advise.

      @RitaThompson-ne7jj Do you have any way to contact the former occupants? If so, give them a written notice of a reasonable amount of time for them to come and collect their things before you discard them (like a week or two limit). If you have no contact for them, but they used to receive mail at this property, then mail the notice there as their last known address. If they forwarded their mail, they might receive the notice. Thereafter, wait an additional week or two, utilize every method to reach them that you have, but you are not required to hold their property forever.

      @stylicho The few exemptions include: Housing that is operated by private or religious organizations that have limits on who can become a member; a dwelling that has a maximum of 4 units, if the owner occupies one of the units, and single-family homes that are rented by the owner without using an agent.

      That's an option, but it requires extensive travel and coordination in some cases. For me, I prefer to speak with the landlord before the current landlord. That person is the likeliest to spill all the beans.

      @hienha1234 If you only sent it by certified mail and it was never delivered, some courts will not count this as proper notice. This is why we always send our notices to vacate by regular AND certified US Mail.

      No,they get evicted, and you should be able to collect unpaid rent in your judgment and/or from the security deposit. However, if you accept the rent, you will probably invalidate your notice of termination.

    Tenant left owing a high water bill. Can i deduct it from their deposit to pay the water bill they left? The water company has provided me with the tenants' last bill where they stayed owing the 1400.

      @CeciMtz88 If the bill is in the tenant's name, why would you have to pay it at all? If it's not your responsibility to cover the cost, I'd recommend applying the security deposit to other amounts owed.

    I'm in Texas and trying to learn more about section 8 from a landlord perspective. From what I understand HUD sets the price of the house based on the bedrooms in a certain zip code, and the tenants vouchers have all of the payout information. Does the inspection happen before the lease agreement is signed? I'm wondering how a landlord can deny a tenant if the inspector deems the house too low month price.

      @@Dollar_Menu I don't know if that's allowed in OK. In Texas, a landlord can inspect and document the condition of his property, but that wouldn't include the tenants or their personal property. I also wouldn't recommend a body camera as a means of "protection." If you feel unsafe, take another person with you on visits, or communicate exclusively in writing by email or US Mail.

    Very good information, Ernie. I was encountered an applicant who was ready to move in now. He had his move-in money and all his belongings on a U-haul truck. Since I usually dreaded the whole process of advertising a vacant house, then showing the place, reviewing applications, etc. encountering someone eager to move in immediately just made my job easier. It was very appealing, so of course I signed him up with a lease. Big mistake. I later learned he had just been evicted from another place. His tenancy with me did not go well.. I ended up evicting him within six months. NEVER rent to someone who wants to move in fast unless you first thoroughly vet his or her application and try to determine exactly why he's in a hurry to move in.

    What if my bathroom doesn't have a vent. It does have a window, but no screen. There was a beehive behind for many MONTHS. Can I charge the landlord for negligence? Is that them breaking the lease?

      @@moniquebush9317 In Texas, the lack of a bathroom vent probably wouldn't rise to the level of a defect that materially affects the health or safety of an ordinary tenant, so it's probably not a lease violation.
