Fella.... I have said multiple times in your comments section that these people are not medical professionals, they are not medically trained (or at least not by the DWP or the agency who hire them, Capita et-al.) When you deal with them, listen very carefully to how they introduce themselves, some will say "Medically trained / qualified"

I do it by notice through recorded delivery. They lied to me on a dsar. I pointed it out they ran for the hills. So I just sit back and wait for the next breach. By which I will hit them hard. 🤣 DPA breaches, property right breaches and ultra vires among others.

It's common to use pre written wording within DWP. not due to being uneducated but they usually get put together by the Staff that use them. Why? Becausecof Targets / Bench stops have to be made and a certain amount of people per week that have to be dealt with. However Staff are discouraged to use this method as the piece doesn't fit the puzzle. Capita and JCP Staff alike are controlled big time by Top Civil servants applying Goverments requirements. For medical assessments there is an average of people goverment would expect to fail medical. It a money saving exercise to force people to try and get work. In some cases the system does work. For JCP work coaches They have to have out of a case load of 200 customers signing on. That work coach needs around 25% or more into work. But they are pressured to stop people's money for punitive reasons. If customer doesn't carry out the work search that they sign for and agree to do. If its two times after one another or happend regularly say once every month then Work Coach should stop / sanction their benefit. Work coaches are managers and used to have discretion about the decision making process. But from the top it was made more Black and white. Work coaches got to know their Customers. One could be lenient but still warn customer what could happen. Basically knowing persons circumstances. As an ex Work Coach I was fair but didn't like it if customers took the piss thinking I'm soft. My first meeting was I'd help them to get benefit providing they followed the rules. I was empathetic to some. But I told all customers when they stated Inwas best and friendly. I pointed out it could stay that way although not their friend and if they took piss it would lead to money being stopped and no more Mr Nice Guy. Inherited early as discretion was being removed and new UJ was being introduced with tougher sanctions.

My experience of the DWP assessors was a terrible one at that, I was shot in the back of my kneecap during a robbery back in 2003 whilst working and it took the government 7years to come to the conclusion that I was physically disabled and was suffering from PTSD. While I was claiming disability payments and mobility allowance for the next 9 years or so an assessor for capita working for the DWP had concluded that after 20 minutes that I was fit to work and stopped all my payments and left me no option other than take it to a tribunal to which I was successful in getting every thing reinstated, these assessors are not qualified and are not fit for purpose and cause more stress to disabled people. Plus they lied in their statement to the DWP.

I had an assessment on Friday just gone for ptsd/depression and anxiety. However it was by admission from the health care person an interrogation. The assessor stopped the interrogation as my mental health was quite bad on that day, suicidal thoughts, low mood and so on. They called me an ambulance from the mental health team, who phoned me. However, the assessor accused me of phoning them. She was passive/aggressive all the time, but quite aggressive when thought that I had made the call to the mental health team to cancel the ambulance and paramedic. It was not a good experience at all, and my basic human rights were definitely breached and violated. My assessment/interrogation was stopped, and I felt that I had been abused. Terrible , terrible way of handling my case

I had an assessment done by an Atos assessor and she told me she was a qualified pschiatric nurse and had done a course on physcology. I checked with the NMC and she lied about her qualification s. She also lied throughout her assessment. I won my case at appeal. I then made a complaint to the NMC and she had a lawyer who ran rings around me as I was unrepresented and lost my case. Someone lying about their qualifications would normally be stuck off so this nurse may well still be practicing. The damage done to my mental health is now permenant and I will never forgive her.

The Works nurse in the factory I worked at said because of the chemicals I used and the drugs I had to take to stay alive. I was not fit to return to work. The firm I worked for were great they pensioned me off early due to the circumstances. I tried to get some help for 6 months to tie me over till all my pensions kicked In. The nurse I had to go and see decided after about 30 minutes that I needed to get a job. Who would give a job to someone who only needs a job for six months? Who was unfit. I had worked ever since I was 15 yrs of age all full time and that's how I bought my own house, paid off my mortgage, see my daughters through university. It wasn't till I was 60 yrs of age my osteoarthritis was all over and carpal tunnel nerve damage, The wealth of mri scans and ct scans and consultants reports all came back it was advanced and even in my lower back and having to attend pain management at hospital as its 24/7 and you do not even get peace at night. Well being a waspi I was denied my pension at 60 and an assessment by atos for pip didn't go well, despite my records ,a wealth of proof all ignored by the DWP and the NHS paramedic doing the assessment. So it was zero points for me, so no contest, a tribunal all 1 Yr later whilst in hospital for conditions they claimed I didn't have. Well the tribunal took my wealth of information all what the dwp ignored and found in my favour.

Hi I have been going through the various comments left by all sorts of people with varying opinions.
I believe that these assessments carried out by the DWP for PIP or whatever other benefit are not at all necessary, in fact, I think that it clearly shows that the government has no confidence in the medical professionals, if people are assessed for benefit.
If a Doctor is capable of prescribing medication, or handing out a doctor's note then there should no need for any other proof of illness whatever it may be .
Even better if the the person has been to a specialist by referral by their GP . This is my opinion is all the proof that is required.
No one else besides the GP or specialist is therefore qualified to make an assumption of your capabilities or illness .
Perhaps the way I look at it maybe too simple.
This government enjoys making life difficult for everyone.

I even asked the assessor what their qualifications were and she said she's not at liability to tell me.

I personally know a DWP assessor who got his job through being long term unemployed, his experience as an assessor was zero and his 'training' consisted of mostly what I would describe as crib sheets ie pages of A4 with simple instructions on how to 'assess' ie if this condition is met, do this, if not do this etc etc
Very basic flow chart system, very yes or no!😮
Anything that fell outside this very limited info or 'training' was just no dealt with properly.
I was quite surprised at how lacking his training was compared to my very comprehensive training I had for working in the care sector, which was constantly on going and evolving, I went on some really interesting and educating courses.

The DWP will never admit that they mandate failure. This message has become certain through evidence of countless victims who have had to go through unbelievable trauma just to receive the help and benefit they need. DWP assessors therefore do not need to be trained, except to apply the dogma they are instructed upon. It stands to reason with an entity like the DWP, that employing medically trained assessors would involve higher salaries, so lets look for a few whistle blowers, except they are more than likely to governed by non disclosure restrictions. The DWP cannot be described as 'welfare' but more like a cash distribution service, politically driven by mean quotas, so it is never going to be for the benefit of those who are in need, contrary to the mealy mouthed, and cynical lies of incumbent health ministers. Every political party in the Houses of Parliament, historically goad each other on being 'soft on benefits' resulting in more restrictions due to childish reactions to be even more severe, therefore there has to be a mechanism to delay or deny, or better still, nothing at all, as you are deemed 'DO NOT QUALIFY'!

I am currently caught in a WCA - UC loop. Marked fit for work twice.
The first assessor shouted at me for 25 minutes, then softened for the last five.
Oh she was trained alright - a trained psychopath.
When the "Decision Maker" called he listened compassionately to my current issues before asking me whether I thought the assessor understood my issues overall. Nasty trick question.
Without knowing the outcome, it is impossible to know. Call them out on it.
My next fit note was rejected just before I submitted a request for a mandatory reconsideration, triggering another WCA and parking the MR.
I failed the second one too, received a diagnosis four days later, requested a NEW MR and instead the one with evidence four months old was processed.
Then threatened with sanctions after being forced to sign work commitments I didn't agree to, and having a fit note rejected. Helpline said there was nothing they could do.
I stuck to my guns and the change of condition was picked up by the "health agency" (or the gaslighting agency - same thing). My next WCA questionnaire was returned with a few sharp words in the description - my autoimmune is triggered by stress.

It is a trick question, given the way the assessment was conducted. "do you think they understood your issue correctly?" when you don't know what outcome they've given works badly both ways.
I had just spent 15 minutes telling the guy how ill I was, and he gave every impression he was taking it all in. There had been a five week gap between the assessment and the outcome and I'd had test results back which gave evidence of something more serious. I assumed that would also be taken into account.
You are naive if you think they don't plan the assessments this way. Either that or you're working for them.

    • @NothingByHalves
      @NothingByHalves 2 месяца назад

@@crichardson4789 I did express my doubt.
However, this wasn't a PIP assessment, it was WCA where despite not being able to leave the house for three weeks through a gut inflammation that was the equivalent of food poisoning, plus extended chronic fatigue and joint pain they determined me fit for full time work outside and in.
The second Decision Maker said "before we make our decision I just want to give you a call to explain that Universal Credit is a benefit designed to help you find work or prepare for work whether or not you are fit for work right now. You will be able to keep your fit note and you can push back to your work coach if what they suggest is too much for you".
One minute they say they need a diagnosis and a treatment plan, and the next they say the diagnosis isn't important but its how the condition affects me.
So I'm sorry, but you need to be on the receiving end of this to fully understand it.
I recorded my last assessment. I wish you could listen to it and let me know what job I should do. Pure gaslighting.

I will not only go through the complaint process but also at county court on a civil claim for pain & suffering from both parties if not 3 inc thus the DWP itself.

The DWP are currently taking council tax directly from benefit payments but also taking arrears some of which go back to the late 1980’s poll tax. They don’t know how much is owed and when the arrears will be finally paid off. If a test case was taken the claimant would win because a debt has to have the amount owed to pay back. Tens of thousands at least would receive a pay back for wrongfully paying an unknown debt.

I was assessed in a Face to Face situation, while I have more than one underlying issue, the primary issue related to a comparatively rare heart condition, which predominantly affects women [so no research on it] and generally menapausal women, but not exclusively. So the guy asked me loads of questions, not one of which related to cardiac issues. At the end of the assessment he asked if I had any questions; obviously, I did. I asked him when he was going to do a Cardiac assessment. His response was that DWP no longer do assessments for Cardiac issues because Cardiac issues are caused by life style choices. So in effect, what the DWP are saying, on behalf of the government, is that it was my choice to be born female and it was my choice to live long enough to reach menapause. Well, if I'd known all that before the egg was fertilised I would definitely have made different choices 🤣🤣🤣🤣

@@DynamicDuoUK You are quite right, they should be upfront. However, I did challenge this directly with the appropriate Minister, or at least a member of staff, asking the question, why cardiac issues are classed as a life style choice, and yet, if I had chosen to go bungie jumping and broke my neck, that would not have been classified as a life style choice. the initiall response was that cardiac issues are not classed as life style choices and no disabilities are ignored relative to life style choices, or words to that effect, but then heard nothing more. Consequently, I wrote again, asking what was going to be done about this clearly erroneous decision. It took several months to receive a response, obviously they were all on a tea break. Overall, it took more than a year for this to be resolved, but that was only because I was constantly pushing the issue.............. A couple of other issues I experienced at different assessments seem to be in line with the life style concept. I was in fultime employment, strangely enough working for the government in the Home Office, a girl has to live. It was an appeal so a real Dr was present. I had literally just returned from holiday and the Dr mentioned that I had a tan, a very nice tan it was too. I responded that I needed a break and therefore had been on holiday, her response, you can stay at home and rest; I was working fultime, I think I was entitled to a holiday. Again, another appeal and yet another Dr, who, coincidentally lived not far from me, not that I knew him, but he was saying that from my house to the local shop was not a 30 minute walk there and a 30 minute walk back. My response, perhaps not for you but it is for me, would you believe a couple of weeks later I saw him in my local shop and politely said hello, he couldn't get out of that shop fast enough, however, during that appeal the, who ever it is who officiated, pulled this Dr up for bullying me. I would have expected better of both of the Dr's mentioned here
