Therein lies the problem with agencies like NOAA and ATF, (just to name a few). These agencies need to reigned in and NEVER allowed to implement laws that will have far a reaching impact beyond their narrow field of expertise. You're right, in Fla. flounder is closed to rec. fishermen from Oct. 15 to Nov 30. Yet comm. fishers have a 50 fish limit. Sounds a bit discrimintory to me.
Why don't they start with banning the Long Line boats off our reefs ? Oh, Wait, we are talking about a Federal Administration aren't we ... always off target. Limit reels to One Thousand Feet of line and single Hook , that should help tremendously.

This may help. The Cheveron Deference rule allowed Federal agencies to create their own bans outside of Congress. It was designed to help agencies do their job easier and lighten the load on Congress. Like all situations like this, it was abused. This ended up allowing all Federal agencies to operate under these guidelines. This is how you get your current problem, by unelected bureaucrats without congressional oversight. The good news. Recently this rule was struck down and overturned by Supreme Court. While it has been struck down, it does not mean that bans are being automatically lifted. Each case has to be brought to Supreme Court to be tested against this rule. It has been used to lift certain firearm bans and many other items that were unlawfully banned. It was intended for the oil and fishing industries, but as I pointed out, the fire arm coalitions have been having a field day with it. The fishing industry is part of the original reason it was created. You should have no problem getting it lifted. It will just take time and money like anything else. Lawsuits have to be filed, if this does not work, you go to appeals court, you get your appeal, it goes to lower Federal courts and so on until you reach Supreme Court. It just may be that a good lower court will throw it out for you. However, you can expect this group you are fighting to appeal. Plan to go all the way to Supreme Court, as I said it will take a while, but it will be the final word and you will not have to do this again. You can start by contacting a judge for a stay to stop them first. I would get a large group together to help fund it, and find an Attorney. It's highly unlikely you will get much from elected officials as they are nearly powerless in these situations. But I did tag DeSantis when I shared your video on X. It also should get you a lot more attention than youtube. I am a fellow fisherman from South TX. I hate these oppressive useless bans. The court stated agencies cannot make laws, but only carry out laws passed by Congress. Potentially, these decisions could be the basis for some sort of legal challenge.
This is an incredibly IMPORTANT issue ... Why can't i find ANY info on this ? Even the website run by the State, everything is so vague, I have a few questions, like how will the average angler be affected ? What will be the Fees if the Ban is broken by a citizen or Licensed Commercial Vessel ?

It's no secret that fishing brings in a lot of money to a lot of people. The question is - are the steps proposed necessary to maintain the fish stocks & prevent them from being depleted? If they are needed, then they will preserve the resource for the future. If they represent unnecessary over reach, then that is a different situation.
Commercial influence in South Atlantic fisheries is the problem. Them blame the recs for over harvesting. This is primarily coming from North Carolina. The overwhelming majority of commercial fishermen are out of Florida and North Carolina. This information is public on noaa website. GA and SC paying the price for this.
The people who made these decisions were appointed by the Secretary of Commerce, from a list, given to them by the Governors of the states involved. After looking at the council, the Republican governors of SC, GA, and FL are ultimately the ones who picked these people

I’m a fisherman in Florida who has been out of the loop for awhile due to disability, but getting back into things slowly. I just watch a lot of RUclips fishing videos, and have seen seen exactly what you’re talking about, especially in these videos. Red snapper was and is a big topic, but I was wondering what you think about Goliath grouper in that same respect?
I don't land a lot of Goliath grouper. I have caught a few juveniles and never had an issue with good releases, however when fishing some of the wrecks I have lost almost as many fish to Goliath grouper as I have to sharks, and that is saying something.
As this guy states, he is not an expert on this subject. People , you need to look into this issue on your own and do not get caught up in sound bites, and or potential misinformation ( which there is a lot of!)
Wow this is a big eye-opener. I will admit. I don't like seeing videos of people harassing and catching goliath grouper. I've been fishing my whole life. When I see people fishing for those from piers. I can only imagine how many are broken off with a hook in their mouth or stomach. I would like to see something done about people targeting them. They've set things up to go around the law. Just like if they cite you for not having a descending device, it's a civil penalty so you can't fight it traditionally in a court of law.
Is this related to the constitutional amendment article 1 section 28: the right to fish & hunt..??? Everything in our country is based on money, that is a fact. I can’t see who would benefit from this unless it is something we can’t see or don’t know. Of course it could be just a big mistake. Who really knows how many red snapper there are. Fishermen say that the snapper have overtaken, of course that is in the spots where they fish, lots of artificial reefs. Researchers say they are declining. Why are there discrepancies at all? My guess is the researchers have more information of the broader picture that they believe to be factual. The fishermen know for a fact that the red snapper is overpopulated on there spots. I don’t think bottom fishing will get shut down. I don’t see how it would be political in anyway, as there is no money to be made in this regulation. Both sides probably are correct

Once again, regulation aimed at entrepreneurs. Living on the coast for 10 years of my life, I have definitely seen how many people make their living by some means of fishing. The federal government just needs to stay out of state issues! Maybe they should learn to listen to local fishermen and wildlife conservationists who actually understand the ecosystem and who obviously need to protect sustainable fishing, as it is their life blood. NOAA doesn't mention anything about "bottom fishing", they haven't released a plan at this time. That being said, all of the fish populations are in the trash and something does need to be done. I don't know what the right answer is, but if fish are being killed from barotrauma then maybe a deep water ban is necessary. Is it possible that this doesn't actually help the situation? Sure, but at least they are trying.
Red snapper populations aren't "in the trash" by any stretch of the imagination. If other fish populations are then it's more the fault of commercial fishing than recreational by far and away. They measure our limits by a fish or a few fish per day. They measure commercial by the ton.

I would love to see all net fishing banned, especially large scale commercial. I would also love to see tournaments banned, and anything else that involves fishing for sport instead of food. I'm a 62 year old commercial fishermen in New Jersey who started off sport fishing in the 70s I watched the sport fishing industry destroy the commercial fishing industry the small ones then they use them like tools in New Jersey we have destroyed our party boat and charter boat fisherman because of regulations and size limits they saved the wolf the striped bass so it could eat everything else this was done on purpose to steal the most valuable property in the country the waterfront property that the small commercial fishermen and sport fishermen used own it was given to the 1 percenters the richest men in the world private sport fisherman in their 2 million outboards and 20 million dollar sport fishing boats they bet 8 million dollars on the Mid-Atlantic tournament then throw the Marlins and tunas in the dumpster after they are done splitting up the money

There is not a pending bill. This is a decision that is going to be made by one unelected bureaucrat, not an elected official.If you listen to the podcast clip I pinned at the top of the comments they explain it probably better than I did.
They've set things up to go around the law. Just like if they cite you for not having a descending device, it's a civil penalty so you can't fight it traditionally in a court of law.

The way they word everything sounds superficially good but there are words in there giving authorities more power to do whatever they want to the rights of hunting & fishing. I smell as usual pure crookedness and evil.

In 2010 the feds proposed a ban then resinded it. In 2023 the Dept. Of Florida Fish and game proposed the new ban. So you need to focus on the State level. So Ron DeSantis and all state legislators need to get in voiced. It is a state proposed mandated.
we get one weekend a year. so it would not effect southern Florida. There is so many other species so the effect would minimal.
This is not a ban on just Red Snapper. This is a total closure of bottom fishing across nearly 5000 miles of ocean bottom.
Also, even if you happen to be in an area that isn't going to be impacted as much as other areas, how long before these same unelected bureaucrats ram rod the next set of ridiculous restrictions that will affect you?

Fishermen say that the snapper have overtaken, of course that is in the spots where they fish, lots of artificial reefs.

Why are there discrepancies at all?
My guess is the researchers have more information of the broader picture that they believe to be factual.

Once again, regulation aimed at entrepreneurs. Living on the coast for 10 years of my life, I have definitely seen how many people make their living by some means of fishing. The federal government just needs to stay out of state issues! Maybe they should learn to listen to local fishermen and wildlife conservationists who actually understand the ecosystem and who obviously need to protect sustainable fishing, as it is their life blood. Once again, there is no common sense!

NOAA doesn't mention anything about "bottom fishing", they haven't released a plan at this time.
That being said, all of the fish populations are in the trash and something does need to be done. I don't know what the right answer is, but if fish are being killed from barotrauma then maybe a deep water ban is necessary.

Red snapper populations aren't "in the trash" by any stretch of the imagination. If other fish populations are then it's more the fault of commercial fishing than recreational by far and away. They measure our limits by a fish or a few fish per day. They measure commercial by the ton.
Like I said. Fish populations overall are in the trash. You're getting defensive about my reply because your against a ban that hasn't even been proposed yet.
I would love to see all net fishing banned, especially large scale commercial. I would also love to see tournaments banned, and anything else that involves fishing for sport instead of food.
We don't have deer hunting tournaments where people run around shooting deer with bean bag rounds until they are nearly dead from exhaustion, do we? Pretty much the same as a Marlin fishing tournament.

You are wrong. It is written in law that access to ALL natural resources is a Right. Granted, our government tries to treat it as a privilege but it is a Right. Having said that, these Rights do come with a responsibility to protect those resources.

I'm a 62 year old commercial fishermen in New Jersey who started off sport fishing in the 70s I watched the sport fishing industry destroy the commercial fishing industry the small ones then they use them like tools in New Jersey we have destroyed our party boat and charter boat fisherman because of regulations and size limits they saved the wolf the striped bass so it could eat everything else this was done on purpose to steal the most valuable property in the country the waterfront property that the small commercial fishermen and sport fishermen used own it was given to the 1 percenters the richest men in the world private sport fisherman in their 2 million outboards and 20 million dollar sport fishing boats they bet 8 million dollars on the Mid-Atlantic tournament then throw the Marlins and tunas in the dumpster after they are done splitting up the money

Actually it's the federal government (agencies) that are the problem. State laws, at least in Florida state waters are at least reasonable. What they are doing in the Gulf is a good example.
