Just look at Matthew farwell the officer that rapped and then murdered sandra birchmore. 2 of the officers that rapped her are still out on the force.     Failure to disclose followed by a DA or ADA telling me "I don't know what the DAs office has done to follow through on its legal obligations" should be grounds to dismiss any case that this ADA is counsel on. It's a blatant miscarriage of justice and it appears to be "office culture" to lie, so clear out the whole office and start over.

      Winning or losing cases does not affect budget or salaries. There is an endless supply of cases. They certainly are not getting fat coffers off court costs. Defendants can't pay their court costs the majority of the time.

    I think we need to change the law that makes overturning a plea deal not possible.
    The courts these days heavily incentivise plea deals by making not taking a plea deal very harsh.
    Many people take plea deals not because their guilty but because their scared they might be convicted of a crime they didn't commit.

      We had worse here. A cop with 7 years attacked an EMT trying to bring her patient into an emergency room. 3 years later. Which this just happened.
      He pled to a misdemeanor and will remain on paid suspension for the next 10 years until he reaches retirement.
      Our justice system is completely broken. The stupid voters have been voting in corrupt public officials and DA's so long this is considered a good thing.

    The scary part is that there are thousands of law enforcement professionals of police departments, sheriff departments, and other agencies that behave this way...There's a reason why close to 60% of ALL exonerations involve black men, yet racists will claim that black men are responsible for the majority of all crime, but will ignore the rampant unethical, and criminal behavior of law enforcement professionals.

    perjury statute under federal law classifies perjury as a felony and provides for a prison sentence of up to five years.

    What baffles me is the common practice of prosecutors to continue to defend their stance to prosecute someone when there is a clear indication of investigator misconduct. For me in incidents like this the goal isn’t justice for those involved it’s adversarial even in the face of evidence that could be exculpatory. Prosecution doesn’t care about innocence in fact only convictions.

    So here’s the thing: if a Phoenix homicide detective lied, that’s a big deal. Detectives are supposed to stand for truth and integrity, especially in cases as serious as homicide. Lies or misrepresentations can mess up the entire investigation, possibly even risking justice for victims. This could be a game-changer, though-it might lead to a review of cases or, depending on the lie, even some legal consequences.

    The reason this lady isn't being prosecuted is because this happens far more often then you know.
    If every case was scrutinized, a lot of people would not be imprisoned. There is a lot of poor police work that have put bad people in jail but there is also a lot of poor police work. That i've put edison, people in jail, and they need you to believe in the lie

    This is the united states justice system!. They're all criminals with rank, badges, robes, and criminal law degrees. When this happens they're all complicit. If a case shows plain error regarding a wrongful conviction is usually when the opposing party isn't held accountable. When the wrongful conviction is due to corruption usually charges are filed, so why is it the detective(s) weren't held accountable. This shows you how they all work together. Couldn't take her down because there were plenty more they'd also have to take with her, including the trial judge. Favor for a favor!!. That's how dirty they all are. My loved one is in a similar situation.

    I'm a retired attorney from Oregon so I can't speak to AZ law, but in our state it is law that in criminal cases both prosecutors and defense must BY STATE LAW turn over all evidence whether material or not. We had one prosecutor disbarred for not doing this and lying to a judge about it. The judge in this video shouldn't have let the prosecutor off so easily and imposed the ethical rules that even prosecutors as attorneys are held to.

      @@Leroy-df3ee- There’s a guy name Leroy that’s not the sharpest tool in the shed. He probably doesn’t even realize a ton of illegal activity by state and federal law-enforcement have been charged by the DOJ during the last four years. Unless he saying it’s funny to claim the next DOJ will do anything about these departments during the next four years, because if the new guys last term is a pattern, then absolutely nothing will be done. Not “nothing” as in very little, nothing is an absolutely nothing. That was the policy back in 2017 for four years. So I’m not sure if Leroy is a fan of the dear leader or not, but if I had to guess I would say probably so but I really don’t know. But something tells me Leroy probably doesn’t even know anything about the dear leader if he is a fan of his.

    Unless you been down this road, you Know Nothing about Plea Bargains. 5 Years are much Better than 20 when your "FREE" Attorney is WORTHLESS! The prisons are FULL because of PLEA BARGAINS!
