    Onshore Partner Visa - Subclass 820/801
    If you are onshore and you have an Australian citizen or permanent resident, you would be applying for the Partner Visa - Subclass 820/801.
    To be able to apply for this visa you:
    • must have a partner (who is called your sponsor) who is an Australian citizen or permanent resident
    • You must be inside Australia
    • You must meet the de facto or spousal requirement

    hello. i would like to know how i can work around applying for a 820 before the end of the 3 years on my 491 visa. as 3 years is a really long time to live apart.

    My mom adopted my kid since she was born so In this case the question asked about my previous relationship and do I have kid but by Australia laws right now my daughter is under my mom responsibility and she is an Australian citizen

    Thank you , great video! I work as a nurse in New Jersey, I am also registered as a nurse in Australia. I submitted EOI for 491 visa in March but does not look like they are sending out a lot invitations at the moment. Can I cancel my EOI for 491 and switch to the partner visa if I meet the requirements?

      Hi, yes currently 491 visas offshore are not really receiving nominations. But the EOI is not a visa application so it should have no impact on any future visa applications. So you can withdraw the EOI and apply for a partner visa anytime. You could even leave the EOI in the system and apply for a partner visa

    Hey, can my partner and I build a house on the bridging visa as we have applied and paid for the 820/801 and was wondering if the banks will approve my partner for finance on the 820 visa

      Banks can give a home loan to anyone. But it certainly makes it more difficult if you don't hold PR. With a sufficient deposit it could be possible

    Does Sponsor also need to fill up the application from his immi account or only applicant's (Partner who is outside of Australia) application is enough?

      The 40sp should be done electronically now. Previously you could submit the paper form.

    I have a tourist visa that will expire on nov2020 and plan to apply for partner visa on aug2020. Does it mean i cant apply for medicare on aug2020 yet since my bridging visa still not taking effect?

      Great question. I believe you may need to be on the BV. I would recommend calling Medicare to confirm

      Yes, you would usually only do it after you have applied

    Hey bud, thanks for the video very useful...😊 just a brief question (I just got granted with 820 partner visa, pretty much like 2 days ago which is awesome, but what is the next step at this stage)? The visa got approved after 11 months and I have not use any lawyer or migration agent.

      Hi, you will need to wait until 2 years after you have applied for the partner visa. immi will contact you and you will be able to lodge the second step (PR Step)

    Hi tnx for this informative video . If the holder of 491 visa apply for partner visa do they get the bridge visa after the 491 expires ? Can they stay work and study on bridge visa suring the partner visa prossesing?

      Hi, I believe there is restrictions on what visas you can apply for from the 491 visa.

    Hi, my partner has just been granted a 820 visa. Do we need to lodge anything further (any further documentations) for the 801 visa? It will be 24 months since the application was lodged this December

      When it comes time for you to apply for the 801, immi will usually send you through an email

    Hi there, does 801 require a further police check from AFP for the applicant? It was initially provided during 820/801 combined application for both applicant and sponsor. Thanks

      @@Pathwaytoaus hi, one last query, I believe you are aware that there is a newly modified form 888 in place which doesn’t need certification from a JP in the form. However, does the id’s of the witnesses such as passport or citizenship certificate need certification from a JP ?

    Hi I heard that if I apply for Partner Visa after entering with tourist visa, I would not be able to work while I hold Bridging Visa.
    Did they change the easy they operate that bridging visa since this video was posted or I am having wrong understanding?

      You would usually move onto the bridging visa after 90 days (when the visitor visa expires)

      Hi Sabrina, most 820 visas are taking about 2 years to process. Partner visas are still processing through covid

    Thanks for all the info. I'm on Bridging visa waiting to granted temporary visa. Medical visa service has been checked and it has been 30 months on this bridging visa right now. Is it possible that my visa will skip and granted permanent visa. Thanks

      Yes that happens quite regularly if it has taken more than 2 years

      If you have been on a bridging visa for more than 28 days, it is very difficult.

      The processing time is about 30 months, coz it is a combined application For travelling u can apply for BVB just during Pandemic u should get exemption first.

    hi.
    im married to australian citizen. we r married and its been almost year and half.
    My visiting visa was rejected twice and my husband lodged 309 offshore visa . Then i was given visiting visa and im in australia now. Since i have to go in and out of the country for 3 months,we contacted the immigration regarding this. We said that we cant go out in this covid situation.
    They told to lodge onshore visiting visa and we did. I was successfully given onshore visiting visa 2 times.
    Its been 11 months since we lodged our 309. We didnt get any response about it.We have submitted all the important documents .
    The problem is we cant not afford to extend the visa every time.Now i cant even go to my native country i may stuck there.
    My question is can we withdraw our 309 visa and lodge 820 onshore since im in australia right now?
    Will we get our money back for the 309 visa that we have lodged?
    Is this process correct ?
    pls reply.thank u

      You would not receive the refund for the 309 if you withdrew.

    If I'm travelling outside Australia when 820 visa decision is made, do I get a warning to enter Australia or does the visa get rejected?

      If it gets rejected, I believe it can be rejected when you are outside. But it cannot be approved when you are outside

    How long does it take to get 801 from 820? And is the 801 considered as PR?

      Hi, yes the 801 visa is PR. We are seeing it take about 3 - 6 months at the moment.

      Yes you can. You would apply for the offshore partner visa. Please note this takes a long time to process and you don't get granted a bridging visa.

      If it has been over 2 years, then yes you may be granted the 801 straight away (once you provide the requested docs). We have had this happen to a lot of clients

      Hi, I believe the processing time for most partner visas is about 20 - 28 months. So you could be waiting a little longer

    Am the wife of an australian citizen i had my spouse visa granted on 20th feb 2020, currently i have a timeline of 7 months validity to enter australia. As its only evacuation flights thats allowed into australia, am unable to get flights, my visa is valid until next year feb 20th 2021 . God forbid if flights aren't available or cant make it by then. Will my visa gets cancelled or would i be given an extension considering global pandemic being the situation .plz advise i need an answer.

      If you don't enter in time, you may need to apply for a new visa.

      Even when there are no flights to australia . How is that our mistake , immigration needs to understand the pandemic crisis and consider to extend my spouse visa if i cant make it in time due to movement restrictions the whole world is facing

      Offshore partner visas are taking a really long time. That is strange than an onshore would take that long.
