Cops seem to be bored working late night and early morning shift. Not many drivers so easy to do a traffic stop hoping to make a dui or drug bust. The actual violation taillight burned out, license plate out, some minor petty infraction. Instead of a warning and told to fix it a fishing expedition

I like the female prosecutor arguing right through that the officer 'didn't pull them over, the lady approached him' - but at the end, says she'll check with the officer "to understand why he did in fact pull them over", and admits that they were detained. She knows damn well that if the car had driven away at that point, the young man would have been additionally charged with fleeing detention under TPC 38.04.
Cop messed up in their report by not stating the approximate distance they observed the car was from the curb where they were parked. Probably because the car wasn't more than 18" or was so close to it they couldn't actually tell. Still if it was actually legit, they messed up the arrest by leaving that one detail out.
The passenger got out of the car. And? People do that, even at 4am. I also really doubt the officer was going to get out of the car just to write a parking ticket at that hour. Quite the fishing expedition.

The thing on this is the statute says no more than 18 inches, so the officer will just mark that. The car could have been 6 feet off the curve, which is probable cause. According to the statute, he just puts over 18 inches, not the actual distance. So technically, the officer is correct from a legal standpoint. If the car was 6 feet, he could see that obviously. The prosecutor should have brought that up. But whatever, I’m glad the kid got released, but the officer was correct.
The thing is "probable cause" needs to be established. If they aren't observed driving and committing infractions of impairment that is an issue. It seems they were in the car parked and smoking something people do when they are young and don't want to smoke inside the house. Same thing would apply to drinking in an off and parked vehicle. You have to see that person driving or attempt to drive, simply being in the vehicle doing these activities isn't enough. The cop used some BS to make contact with the male in the driver seat and them smoking was an act that gets thrown out due to the statute stating a car "must be parked within 18 inches of a curb" so there is no infraction and thus you had no reason to or justification to legally make contact with them.
"I smell marijuana" is an excuse to harass people and conduct an otherwise illegal search. They teach it at the academy. Fleischer knows that, even if you don't.

Defendant approaches cops without even being confronted about said crime. Defendant reeks of weed. Felony amounts of weed found in the car. If you dont want it to be illegal, dont pass the law. Judge doesn't get to decide whether parking illegally is a crime or not. He simply decides without even hearing the officers testimony that theres no way he couldn't tell whether the car was 18 inches from the curb.
