But, a bunch of it is a minor slap that doesn't even cause any sort of damage, or even just touching. Where court ordered anger management and sealing the record might actually resolve it in the long term. Instead, the minimum consequence pretty much destroys lives leading to people just flat out not even reporting it because they don't agree that that level of punishment is appropriate to what happened from their point of view.
Jesus so many prosecutors are out for BLOOD it's ridiculous... They'll try to make ANY accusations against a defendant sound as BAD as possible in front of a judge even without probable cause... That's sad... Our system is fucked!
fyi, the prosecutors are handed a stack of these and sent into these. These are probable cause to actually move forward. This is on the cops arresting this dude, not the prosecutor who was handled the file. They're supposed to zealously and intelligently move forward with the case they were handed if there are probably cause. Notice how it's always the same people? It's just the job, they represent the interest of the state and victims. They come back in every day with no hard feelings for the judge or the defendants. They will argue the case as best htey can but if the cops are shit, the assistant DA they make do this shit.. doesn't really care. It's actually pretty rare that the judge is annoyed at the state moving forward. you can see this a lot in the various things, he doesn't talk down to the people or insult their intelligence. He knows they're just presenting what they were given and that's the best they've got. These cases get handed to them.. pretty much the morning they're presenting this for the probably cause hearing.

@@reginabillotti The DA dismisses cases all the time for lack of evidence or issues like this. But that happens after probable cause. They probably like this judge. He takes out the loser cases for them and saves them the hassle. I have seen for more serious cases this judge is no where near as nice to the defendants.

The cops are sloppy. The prosecutor who barely reviews the case beforehand is forced to go to probable cause and defend their slop like a debate team member forced to defend a point of view he doesn't agree with. I imagine they're actually glad to lose this one.

Do these people even read the charges before taking it to court??!! Seems to me they should get in trouble for wasting the courts time but I know they won't!
All in all though I think judge Fleischer made a good call stating no probable cause in this particular case... He may be a very strict judge but he is also very FAIR... I like that...
In the incident, the defendant was obviously in the wrong and the complainant was obviously in the right. When she got hurt in the scuffle she had the right to get angry and the law enforcement taking her side was understandable. What is questionable is that they then write this non-case up to test it in court. Maybe they just wanted to cause the guy enough trouble to wake him up and additionally get lectured by the judge, and also not openly decline the complainant's request? If so they succeeded. I hope he learned his lesson.
Why can't our Judicial System have more Judges like this man?

Battery isn't defined in Texas because in Texas threats and physical violence are both charged as assault.

The complainant has a solid civil case. But there is no criminal case here.
I know we only get to see a fraction of the cases but it seems like the DA stumble over themselves quite a bit trying to push the case through.
They are never prepared..it blows me away everyday that they go before this judge everyday and still are ignorant to what’s going to happen.
