ConCourt to hear IEC's challenge on Zuma's candidacy

  • The Constitutional Court will on May 10 hear the IEC's challenge on former president Jacob Zuma's candidacy to run as a Member of Parliament for the MK party. The commission is seeking clarity on its implementation of section 47 of the Constitution. The section bars individuals sentenced to more than twelve months in jail, without the option of a fine, from contesting.

    CONCOURT has been INDICTED by Electoral Court for violating constitution and sentencing ZUMA without trial and right to appeal. Judges involved MUST recuse.

      The Electoral court must recall where its bread is buttered. It cannot seek to overrule the highest court in the land otherwise they are violating the constitution themselves. They're attempting to create a tail wags the dog situation.

    The whole of 2023 no judgements handed down by the constitutional court and today acted so quickly to hear the case involving Mr Zuma the people who are singing Wenzeni u Zuma are dead right

      Not really. I think the Concourt will uphold the Electoral Court’s decision BUT, I hope they clarify the remission part because it will come up in future whereby someone who has been fully convicted with all the appeals, but have their sentence remitted. That needs clarification. The issue of appeal is clear however the Concourt needs to understand that direct imprisonment is not god for our democracy and they shouldn’t have done that.

      We can't be ruled by convicted criminals. The IEC understands that we are not a mafia state and the constitution does not allow this type of candidate to stand.

    It is common knowledge that the Concourt has the final say, which effectively means that when a matter is decided at the apex court, it is final. Zuma could have applied to the concourt for a rescission.

    The Concourt is conflicted. The MK party must request the constitutional court to transfer the case to the Appeals Court in Bloemfontein. It is like America asking Israel to investigate its war crimes in Gaza. Israel or Concourt will never find themselves guilty.

    For me, the ELECTORAL COURT is not assessing well the circumstances for Sec. 47 (1) of the Constitution. This section sets the need to have concluded the right to appeal, for situation in which someone needs to run for the election and his/her guilty sentence is still in the process of appeal. ZUMA made the contempt of court at CONCOURT and had to be sentenced there without a trial as he was refusing to appear before the court. Situations of contempt to court usually don't require trial. For example, if someone on receipt of a court subpoena or another document, insult or do anything wrong with witnesses, then the court sends him/her immediately to jail. I in a trial someone, even being the defendant, insults a judge, there will be no another trial, but he/she goes immediately to jail.

    For me, this is a very clear situation that ZUMA is NOT ILEGIBLE and the ELECTORAL COURT is disrespecting the CONCOURT. The provision set in Sec. 47 (1) of the Constitution states a sentence for 12 months (ZUMA was sentenced to 15 months), in the past 5 months, if he had right to appeal. With regards to the right to appeal, there are a few particularities that requires tests as fallow: One: Is there any part of the law or court rules that regulates a need for a trial for someone who refuses several times to come before court to answer questions in terms of a Judicial Commission at CONCOURT?; Two: Is there a provision in law that sets a need to transfer a contempt of court at the CONCOURT to a lower court, when the action was committed at the CONCOURT?; Three: Can't the CONCOURT consider that the RECESSION submitted by ZUMA was a kind of appeal?; and Four: The fact the President prevented ZUMA to return to jail doesn't mean it cancel the sentence by CONCOURT.

    This analysist is wrong because what the analyst is saying was not even articulated by even one of the opposing justices to Zuma's arrest. Zuma did have a right to appeal, he could have appealed directly to the constitutional court for review of his sentence. And this is something he did do on the basis of his medical conditions and all. He failed on review as well.

      You cannot appeal a constitutional court judgement, the constitution does not allow that's why it always has to be the last resort for legal disputes. He filed a rescission application which is completely different from an appeal's process.

      @@andiswamthethwa39 If he went to the Zondo commission he wouldn't be where he is. He made his bed, now he must lay on it. The constitutional court won't come back and say its previous judgment was wrong, forget about it if that's what you hope for. The ConCourt is also not about to create a new precedence where its decisions are challenged by smaller courts like the Electoral court. The ConCourt Judgements are law, they become law as they get handed down. Zuma couldn't do the appeal stellingrad tactics forever.
