    1:01:40 "An that's where the story ends" but it doesn't!! Here's the latest update:
    "The preliminary hearing on the new RO went well. Emma and Natalie were there, and we discovered that Emma is currently living with her great-grandmother and has a guardian ad litem(court-appointed guardian on legal matters). My lawyer thinks this means whatever was found in Natalie's home situation warranted removing Emma, and potentially severe enough that the great-grandmother only has physical custody and the need to appoint a guardian ad litem.
    During the hearing, we went through the whole song and dance, the past RO's, the whole deal. My lawyer turned to Emma's representative and said we were willing to submit to a DNA test and put this to bed. Natalie looked like she was having a conniption at that, and her own lawyer urged her to shush. Emma's representative accepted and we were cheek swabbed in the courthouse. A temporary order is now in place while a second hearing is scheduled in the upcoming weeks for the 'permanent'(two year) order.
    The order covers immediate family on both sides, and as I've detailed in the past, Natalie is actually good with following court orders, oddly. We have about four weeks before we have the definitive test results back, but I'm not too worried either way.
    PS, there was some people who thought the court couldn't 'use charity as a cudgel' was the father. Well, that's Jim. Haven't talked to Jim in 10 years, but Jim is gay, and hated Natalie. He just also happened to be a 'give the shirt off his back' kind of dude, and as long as I knew him volunteered at a food pantry. His protests came mostly from naivety not self interest."

    Having a prenup is like making out your will in your 20s - you don't want to need it, you don't expect to die (or the marriage to die), but sometimes life comes at you very fast.

      Agreed! I’ve always said to my partner that a prenup would be something we would want because if we ever decided to split, the last thing I would want was to have to make decisions together. Chances are that if we actually didn’t want to be together anymore communication would be super challenging. Breaking up is hard enough!

    I'm also married yet not legally, we very much wanted to be married but we are also broke and apprehensive about all the stress and drama related to weddings as we both come from broken families, we "told the bees" like people used to do when a priest just wasn't on the territory. We exchanged vows in a place important to us and we've been living as wives since

    Yes, you can believe marriage is forever and still get a prenup. It's like being a perfectly healthy person who has health insurance. You have it just in case something happens, not because you are expecting it to happen.

    Common law marriages in the U.S. are only recognized in 11 States. I have been with my partner for 10 1/2 years and looked into common law marriages, it's now more of a term for long-term relationships than an actual practice anymore. Though I'm not sure if it is the same with U.S. territories.

    If I were OP in the naughter situation, the next time the ex came by with her child I’d tell her child her mom doesn’t love her bc she won’t take her to get a cheap paternity test to see if OP is her dad so she can get money and care from OP but instead she resists and is stopping her from having a relationship with OP if she is, in fact, his child. That’ll give the ex’s daughter something to think about bc either she’s being manipulated by her mom or is in on it now that she’s a teen

    In one of my favorite shows the couple signs a prenup before marriage. I actually love how they approach it and feel like it is a great conversation to have. They talk about the way that their businesses and other people who depend on them could be affected and the guy talks about how he could never imagine not treating her well but that people change and he cannot predict the future. Even though he has more money he wants the prenup so that she is protected from him should that day ever come. Prenup doesn't have to be a bad thing for either party.

    A prenup is like a seat belt. We don't get into a car expecting to crash but we buckle up just on case. Terrible things can happen in a marriage and you can know your person presently but you can only know your person's future self as much as you know your future self. People can sometime change for the worse for whatever reason and your ability to stay afloat financially could be at the mercy of a person with hurt feelings without a prenup.

    There was an update on the naughter. They swabbed his cheek and her cheek in court. Emma had been removed from her mothers home and placed with her great grandmother (also had a court person who handled her rights in court instead if the grandma). Her mom got arrested (for breaking a temporary RO by throwing a fit on OPs lawn when paternity test said he was not the father) and I think put into therapy but I'm not sure what order that happened in.
    Great grandmother felt horrible for enabling natalie, especially after seeing photos of the home she let them use an hour away from her. She only saw them for some holidays so she was unaware of emmas living situation.
    Emmas mom told her that OP would accept her as his daughter if she behaved and she was told he was the one avoiding a paternity test so when he suggested it in court she thought he was accepting her as his daughter. Her great grandma got her into therapy and they both sent him letters to apologize for the whole situation (great grandma for enabling everything with her funds and the naughter for scaring OPs son).

    Prenup is set in place for the instance something unforeseen happens. If you and your partner are together and you shall unfortunately pass away early and the house was in your name. If the prenup says it goes to your spouse

    6:31 they are based in Europe so yeah it can be very different for the USA and in Europe there are a lot of countries and their law can be so different.

    Tell death do us part could be in a multitude of things that doesn't actually have to be physical death it could be the death of your respect or trust or love for somebody. The only difference is how the relationship ends. With physical death you don't have to get a divorce or anything with the other kinds of death you have to go to the work yourself to get out of the marriage.

    Common law really depends on the state and such. KY got rid of Common Law marriage a while back.

      Only 10 US states still have it and a lot of states that don't won't recognize common law marriages from other states, which becomes a legal nightmare pretty quickly. I imagine that it'll be entirely phased out in the next few decades.

    Even in the US, common law is a looooot harder to get courts to handle than you guys are making it out to be.
    If you split from a common law marriage, you will be fighting for a looooooooooooong time to get the courts to give a piece of the marital assets. Not to mention, if the former spouse lies and says you were a live in boyfriend that she never presented as her husband, the courts will absolutely never believe you. It'll also be a fight in a half to get on your spouse's medical insurance as a common law spouse. Thats one of the reasons gay marriage was fought so hard for. Legal marriage comes with a LOT of perks that are hard to get without it

    To answer Sam’s question about a pre-nuptial agreement, it is logical but not romantic… me and my husband do not have a pre-nuptial agreement if he had asked me for one I would have most likely not married him, because for me marriage is forever and you make it work and grow together… we also had zero assets to split when we first got married anyway…😂😂😂 (married in college)

      I think even if you don't have much it is good to have one. And I think they work like a car's insurance policy: you don't plan on getting in an accident but it would be reckless not to have one
