My comment >:(
@@caenen6869 haha, very funny
I mean it was a long time ago in a galaxy far away.
Not only do the laws that make such acts war crimes not exist yet... but such laws wouldn’t be applicable to the aliens of a completely different galaxy
"You're crazy, Obi-Wan and Anakin. War crimes are not tactics."
"But it's a cool trick!"
in the first scene, obi wan didnt commit a war crime. He genuinely surrendered himself (but not his army), got disarmed and had a conversation with the enemy commander. but as he was taken prisonner he lost authority over his army and couldn't order them to surrender so he stalled for time until he got rescued. it was a strategic blunder from the CIS to think that capturing a general would force his army to surrender.
on the second scene, it's close but it's not. again it's quite tricky, anakin offered to surrender himself and his army, the tactical droid refused the surrender and ordered to open fire. surendering "truce" was over at that time and fighting resumed, but anakin was in a good position to kill the tactical droid. anakin played with the droid rigid programming knowing that the tactical droid would fear a trap and refuse the surrender. would have been a war crime if the droid actually accepted the surrender and Anakin still attacked them. the tactical droid also made the mistake to end the truce immediatly, making him vulnerable.
No soldiers are forced to take prisonners, but if they take prisonners they need to treat those prisonners well and prisonners would need to cease all hostilities during their captivity (they can still attempt to escape). it's good for public relations to take prisonners but based on the situations it is sometime not possible to take prisonners.
@@karhedin This is some good food for thought, and it inspired me to look deeper into the subject matter.
Definition of Perfidy: "It is prohibited to kill, injure or capture an adversary by resort to perfidy. Acts inviting the confidence of an adversary to lead him to believe that he is entitled to, or is obliged to accord, protection under the rules of international law applicable in armed conflict, with intent to betray that confidence, shall constitute perfidy." *
Or, briefly, you can't surrender or negotiate with the intent to create an opportunity to kill/injure/capture the enemy.
In the first case, Kenobi is in violation because he draws out negotiations for the surrender of his forces with the intent of distracting Loathsom from the ongoing battle, hoping to thus enable GAR forces to defeat the enemy. He even admits this was his intent in a later part of the scene; this intent alone is enough to constitute perfidy.
I don't think it helps Kenobi that he "lost authority over his army" while captured by Loathsome. By negotiating, Kenobi implied he was still able to order his forces to stand down. If GAR forces would have obeyed such an order from Kenobi while he was captive, he would have had an ethical responsibility to agree to an immediate ceasefire if he was sincere when he claimed he had "conceded the battle." On the other hand, if his forces would have ignored a stand-down order from a captive Kenobi, then it becomes even more clear Kenobi was "negotiating" in bad faith, and his perfidy becomes even more clear-cut.
Now to the second case.
Skywalker's "surrender" has two consequences: it exposes the tactical droid to attack, and it buys time for Rex to position his jet troopers under the bridge. The text indicates both effects were intentional. For the first, Skywalker's line, "There he is," shows he planned to lure out the tactical droid for the purpose of destroying it; this intent is enough to establish perfidy. Second, when Skywalker signals to R2 to alert Rex, it is clear that this was a planned ambush, so Skywalker intended his surrender as a means to more effectively destroy the enemy; this intent is once again sufficient on its own to constitute perfidy.
The tactical droid's decision to immediately refuse Skywalker's "surrender" does complicate the situation a bit, but I don't think it's decisive. At least according to IRL standards, if you surrender or offer to negotiate a ceasefire with the intent of killing/injuring/capturing the enemy by doing so, and then manage to kill/injure/capture them as a result, you have committed perfidy. I also question whether Skywalker exploited the tactical droid's "rigid programming;" I think it more likely the droid already knew of cases when Skywalker committed perfidy and had no faith in the authenticity of his surrender (see Skywalker's "surrender" of the Defender in Storm Over Ryloth). This illustrates why the prohibition against perfidy exists in the first place: abusing the flag of truce or the protections for surrendered personnel leads to butchery down the line, "boy who cried wolf"-style.
Despite all of this, I must make a major concession to the characters. We're talking about a conception of the laws of war that simply may not exist in-universe. I'd absolutely buy this, since the galaxy had been at peace for about a thousand years before the beginning of the Clone Wars, and the framers of this iteration of the Galactic Republic seem to have attempted to abolish war altogether without making an effort to make any future wars less barbaric through an analogue to the Geneva Conventions. If a normally restrained Jedi Master like Kenobi would engage in this sort of conduct, it probably wasn't viewed as criminal, no matter how clear-cut it would be IRL in modern times.
Thanks for your thoughtful response, and sorry for the massive wall of text. I am happy to report I have learned something from this.

You forget that this is a *fictional universe* of *fictional characters* during *fictional events* set in *outer space* and in *fictional galaxies* where they aren't restricted to our rules and regulations. And of course, but in war, ALL sides will play dirty as it has been *clearly portrayed* all throughout the Prequel movies & TCW show. who even follows these protocols of war exactly? Even real world militaries in our history haven't followed them, at least, not all of the codes. But those rules of war were often ignored by both sides in the SW universe and in general, both protocols that have been mentioned in regards to TCW show & companion TCW books didn't detail every single protocol to follow, just the ones that were the most relevant to follow in the scenes that those protocols were violated in. The codes were also implied to be old enough to be forgotten in time by not only the Seppies, but also the Empire. It makes me giggle every time I hear him say "Bring us something liquid." I can just picture the droid bringing him a glass of motor oil.
The CIS general is unwittingly helping Obi-Wan stall by not being specific with his requests.
I bet after the droid goes back to change the oil can for something drinkable, it still forgets to bring cups or anything to drink off of.

Right, cause the separatists totally didn't commit any war crimes. They definitely didn't use civilian hostages as meat shields, use chemical weapons, test chemical weapons on people, fund actual slavery, fake surrender like they did in multiple episodes, kill children, slaughter and test weapons on P.O.Ws, force prisoners to serve in hostile forces, and forgo due process, as well as assassinating public officials at multiple times.
Neither side was good, the Republic was corrupt and hypocritical, and separatists were lead by a sith and funded by corrupt companies. I say that the separatists were better.

@Chosen One The Bad Batch wasn't a thing in the 2003 Animated Clone Wars
@Chosen One
The old 2d Clone Wars, not the 3d animation
I wish someone would make a remake of the clone wars with this art style idk about you guys but I like the tarakotsky 2d style over the CGI one we got and not to mention the fight scenes would be a hell of allot better in this style like what we got in the 2003 show
@@delta2372 I'd agree however the original problem with the animated version was that it just took too long to make. In 2003 you would have to create each frame over and over again so that's why they didn't do anything like it again. Today they don't have to do that and Disney is really good at animated movies so it wouldn't be as painstakingly difficult as it was in 2003. I think they just don't want to even come close to experiencing the same pain they did when making the 2003 one alrgyi could be wrong.
I really like the 2003 artstyle tbh, feel like this one wasn't 100% spot on but was pretty close. Well done.
Can't be 100% spot on unless you have a studio budget.

The Geneva convention does not exist in the Star Wars Universe. What we consider a war crime here on Earth may not be a war crime in The Galaxy Far Far Away.
Just wanted to point out that whilst Anakin had no intention of actually surrendering, the droid commander did not know this, but still gave the command to fire on what seemed to be a legitimately surrendering enemy, Anakin and his forces had every right to retaliate .

This actually highlights how differently those shows were directed as well.
Genndy would have even made that negotiation scene more visually dynamic.
Not sure where you see that because the scenes are all arranged the same way in this edit. The only difference seems to be simply the animation. And I wholeheartedly disagree, the scenes looked immensely dynamic and gorgeous with all the vast, panoramic painted backdrops, beautiful layered lighting, shadows, realistic VFX and realistic, gorgeous character models, as does the rest of TCW in my honest opinion. I've always loved the 3D rendering and artistry in realism, never been a fan of the 2D material but I respect it, just as how I respect your opinion as well! Both Clone Wars shows are fantastic in their own rights and have both equally earned their places in the saga and fandom. :D And which negotiation scene were you referring to exactly, if I may ask? Great video. Keep it up.
Side Note: I always REALLY disliked how the Jedi use fake-surrender as a tactic to get to their enemies. If they keep abusing it, then no one is going to take surrender seriously.
Which is literally what happens here. And I imagine that somewhere else in the universe, some Jedi was in an impossible situation, and actually really did try to surrender to save the lives of her Clones. Is that really considered a war crime in the realm of Star Wars though? Last I checked, there wasn't an official rule book on how the Clone Wars should be carried out, but I understand why you guys don't like that but still, is this ever a thing established in the lore? After all, this is entertainment at the end of the day and I enjoyed it for what it is. Plus, they're just "ST00PID" battle droids like how Grievous in TCW likes to call them all the time haha. ;)
