That's kind of a light sentence for the cops. I would argue they need something more serious to discourage this type of behavior in the future. I think something more akin to what the cops do to family pets would be more appropriate.

It only escalated because he refused to leave when asked and then left only when backup arrived. Hopefully he learns to obey orders after this encounter.
Update: The two main officers involved with Espinoza's illegal arrest were fired a few weeks ago. The same day a judge turned down their motion to drop the federal lawsuit. Just about everyone involved with Espinoza's legal team, third party investigators, and even the dept's Undersheriff all agree a criminal lawsuit should be filed as well - and likely will be.
States have passed to many law that make it to easy for police to behave like this.all the people have to protect us from this is the constitution which means very little to police. We need law that make it easy for the people to hold police accountable
Trujillo shot and killed a man while on duty in October of 2017. According to his background, he should have lost his certification after a prior conviction and domestic violence restraining orders since 2006 and 2007 which makes it illegal to own a firearm.

While normally departments have a policy against turning off the body camera. Digital camera have many known issues. There are a lot of out side factors that can cause them to stop recording. User might even notices your body camera stopped recording inform their supervisor to get a replacement while on duty. A replacement may not be available to them for the rest of your shift. Body cameras are a great tool but do to user error, deliberate actions, and failures out of the users control. No one could say for sure with out an investigation as to what happened and fire them one the spot.
They exist to justify their own existence. They violate rights and then get together and brag how tough they are when people can't fight back. When someone is willing (think Uvalde) to fight back then they are not so tough.

@@hia5235 Actually, there are liability insurance companies that often cover these settlements. Technically, the taxpayers only pay for the insurance premium in those cases. If the public agency/city/state does not carry liability insurance, then taxpayer money would be used.

Exactly this. Hell, I wouldnt have even bothered to make contact. With how far back he was parked, it doesnt scream officer safety to me. LT could easily have just posted up a little back from the truck without even making contact and just observed while he did some paperwork or whatever and everything would have been a-ok.

I read that there is a law that when a cop uses excessive brutality a person has the right to fight back. I may have not used the right wording but I heard that also from a similar video explaining use of excessive force from the blueboys. Just think if this were 1930s germany they probly would of looked for a ditch.
If a department does an internal investigation and finds no wrong doing but an incident is later found to be unlawful, the people responsible for the investigation need to be charged for public corruption and covering up a crime.

My stepdad was a Detroit ccop in the 60s. He carried brass knuckles and a blackjack. I've seen them. He was also a POS and has bragged about hitting specific type of people with them and how hard their heads are so it takes several strikes to knock them unconscious. I hated the man, always have. I realized long ago the only positive influence he ever had on me was to show me at a young age how prevalent, insidious, and disgusting racism is. Oh- and how NOT to treat children.
I've seen it. I was a teenager in the 90s. They did whatever they wanted. I was at a friend's house in 1998 and the cops randomly showed up and searched the entire place because they said one of us was spotted leaving the scene of a crime. They checked in draws, under couch cushions, everything. They didn't find anything and nothing ever came of it lol. I used to get stopped and searched for no reason, just because they were hoping I had something illegal on me. When they didn't find anything, they'd just tell you to leave. Interactions were flagrantly illegal before bodycams.

It would truly be a sweet and blissful taste of righteous justice if these 2 officers were not only imprisoned for their abuse and assault of this man, but if they were also personally sued and turned destitute by being forced to pay their victim the hundreds of thousands if not millions he is owed. I am not one for the mindset of "the sins of the father fall unto the son", but it would be a juicy comeuppance if the officers had to watch their families become homeless from behind bars; their homes sold to pay the man they arrogantly and cruely set their wrath upon, all the while knowing it was their own actions and villainy that caused it. We need to start holding police both criminally and civilly accountable to a higher degree than anyone else whenever they abuse their power and break the law. As soon as they operate outside the confines of the law they deserve no special privileges but rather greater punishment. Knowingly unlawfully arresting someone = kidnapping, assault and false imprisonment charges at the least. Raiding the wrong home with guns drawn = felony breaking and entering with a firearm for every cop involved and assault for pointing a firearm at the occupants. It should be treated absolutely no differently than 10 civilians bashing the sheriffs door off its hinges and holding his entire family at gun point while tying them up. This should extend to judges who sign warrants without a reasonable amount of evidence of any crime committed and DAs that fail to prosecute when there is ample evidence of the police committing a given crime. This would probably cut down on the issue real quick.

As a former police officer, I can't put into words how angry I am watching this video. Those two officers ARE CRIMINALS. I've lost track of how many times I've said "this is the worst one yet" over the past 10 months since I started watching these videos. 🤦 I don't think this was the _worst_ one I've seen (Bryce Masters got it BAD and it was heart-breaking to hear David Dulaney beg the cop to stop hurting him), but it certainly got me more furious than any I remember. (I had to look up David Dulaney's name, but searching for "cop tases mentally disabled" returned a LOT of other cases. 🤦 It was depressingly difficult to find David's case to find his name, and instead, I ended up down a never-ending, infini-scrolling rabbit-hole of dirty-cop videos and found my way back to Dr. Rashad Richey's channel and found the Audit Archive and lost another couple of hours of my life to bad cops. 😒)
As a Colorado resident, this deeply disturbs and scares me! Too many Colorado cops are featured in videos like this by using terrible policing tactics.
You see Colorado a lot because Colorado struck down qualified immunity and police over there are held accountable way more than states that still have qualified immunity. So the fact that you see Colorado in these videos all the time is a somewhat good thing. It means the bad piggies are being caught and held accountable. And if there was no QI in like NY or Florida, they would flood these channels with videos.

It was mostly cell phones that did it I think. I remember being a kid and seeing my FIRST american police execution video taken from a cell. The cop just knelt the cuffed guy in some empty city lot, walked around a bit then shot him in the back all while someone was filming from behind a brick corner. After that one dozens were coming out week by week for a good couple years. The amount of insane incidents like that caught on camera have gotten less over the years, but it does make you wonder why there was a sudden drop in custody mortality rates after cell phones got popular.

Being fired is not enough. I'm sure the victim here will get a large money settlement, (which the taxpayers will pay for), but that's not enough either. These cops need to go to jail. Then there are channels like audit the audit and lack luster who make a living show casing police brutality and unconstitutional conduct. In an ideal world we would have peace officers and not law enforcement officers. You can cry that there are plenty of examples of good police officers, but the fact remains that these youtube channels have a surplus of content to report on. The requirements to become an officer are GED/HS Diploma, a Pulse and can run a mile in a predetermined amount of time. Judges, Prosecutors and Defense Attorneys all have years of schooling to be in that field, yet we give an 18 year old fresh out of high school a badge and a gun. Update: The two main officers involved with Espinoza's illegal arrest were fired a few weeks ago. The same day a judge turned down their motion to drop the federal lawsuit. Just about everyone involved with Espinoza's legal team, third party investigators, and even the dept's Undersheriff all agree a criminal lawsuit should be filed as well - and likely will be.
States have passed to many law that make it to easy for police to behave like this.all the people have to protect us from this is the constitution which means very little to police. We need law that make it easy for the people to hold police accountable

While normally departments have a policy against turning off the body camera. Digital camera have many known issues. There are a lot of out side factors that can cause them to stop recording. User might even notices your body camera stopped recording inform their supervisor to get a replacement while on duty. A replacement may not be available to them for the rest of your shift. Body cameras are a great tool but do to user error, deliberate actions, and failures out of the users control. No one could say for sure with out an investigation as to what happened and fire them one the spot.

If a department does an internal investigation and finds no wrong doing but an incident is later found to be unlawful, the people responsible for the investigation need to be charged for public corruption and covering up a crime.

I thought FOR SURE I misheard or the audio cut out and the cops yelled “don’t leave”. NOPE. They yelled leave, he started to drive away and immediately got a weapon stuck in his face. These thugs should be in prison.

My stepdad was a Detroit ccop in the 60s. He carried brass knuckles and a blackjack. I've seen them. He was also a POS and has bragged about hitting specific type of people with them and how hard their heads are so it takes several strikes to knock them unconscious. I hated the man, always have. I realized long ago the only positive influence he ever had on me was to show me at a young age how prevalent, insidious, and disgusting racism is. Oh- and how NOT to treat children.
I've seen it. I was a teenager in the 90s. They did whatever they wanted. I was at a friend's house in 1998 and the cops randomly showed up and searched the entire place because they said one of us was spotted leaving the scene of a crime. They checked in draws, under couch cushions, everything. They didn't find anything and nothing ever came of it lol. I used to get stopped and searched for no reason, just because they were hoping I had something illegal on me. When they didn't find anything, they'd just tell you to leave. Interactions were flagrantly illegal before bodycams.

Federal system is more than capable of doing an investigation into stuff like this, but they'd never want to hurt their friends. Remember, stuff like this isn't stopped because it *can't*, it's not stopped because the people in charge *choose* not to stop it. I don't know...the pigs who allowed a woman to be hit by a train after leaving her in a car across a train track displayed pretty appalling behavior. We need to start holding police both criminally and civilly accountable to a higher degree than anyone else whenever they abuse their power and break the law.
As soon as they operate outside the confines of the law they deserve no special privileges but rather greater punishment.
Knowingly unlawfully arresting someone = kidnapping, assault and false imprisonment charges at the least.
Raiding the wrong home with guns drawn = felony breaking and entering with a firearm for every cop involved and assault for pointing a firearm at the occupants.
It should be treated absolutely no differently than 10 civilians bashing the sheriffs door off its hinges and holding his entire family at gun point while tying them up.
This should extend to judges who sign warrants without a reasonable amount of evidence of any crime committed and DAs that fail to prosecute when there is ample evidence of the police committing a given crime.
This would probably cut down on the issue real quick.

As a former police officer, I can't put into words how angry I am watching this video. Those two officers ARE CRIMINALS. And they are lucky they have not run into the "wrong" citizen who chose to defend themselves from the outright assault and criminal actions of these two jackwagons. Then when he takes off the officer draws his firearm and yells "stay". like TF is wrong with these cops. I Wouldve drove off and called 911 and told them I think there are law enforcement impersonators in town.

I've lost track of how many times I've said "this is the worst one yet" over the past 10 months since I started watching these videos. 🤦 I don't think this was the _worst_ one I've seen (Bryce Masters got it BAD and it was heart-breaking to hear David Dulaney beg the cop to stop hurting him), but it certainly got me more furious than any I remember.
(I had to look up David Dulaney's name, but searching for "cop tases mentally disabled" returned a LOT of other cases. 🤦 It was depressingly difficult to find David's case to find his name, and instead, I ended up down a never-ending, infini-scrolling rabbit-hole of dirty-cop videos and found my way back to Dr. Rashad Richey's channel and found the Audit Archive and lost another couple of hours of my life to bad cops. 😒)

Why should any of that happen? They are there to do what government tells them to do, not to provide a good service to the people, it is not in their interest to do a good job since they are just there to do what the government tells them to do and this will keep happening as long as the government has a monopoly on police and you keep paying them with your taxes.
For the government firing cops is a bad idea because they need as many people enforcing their laws as they can, it is against their interest to fire bad cops. And the funny thing is that people seeing these videos always think that the problem is that the cop is bad, not that giving the monopoly of police to the government creates incentives that make this happen lol.

It was mostly cell phones that did it I think. I remember being a kid and seeing my FIRST american police execution video taken from a cell. The cop just knelt the cuffed guy in some empty city lot, walked around a bit then shot him in the back all while someone was filming from behind a brick corner. After that one dozens were coming out week by week for a good couple years. The amount of insane incidents like that caught on camera have gotten less over the years, but it does make you wonder why there was a sudden drop in custody mortality rates after cell phones got popular.

Being fired is not enough. I'm sure the victim here will get a large money settlement, (which the taxpayers will pay for), but that's not enough either. These cops need to go to jail. There is a thing about suddenly getting boxed in like that, even with distance. Everyone would be creeped out by that, i for sure would, especially if i dont know the person.

Not all cops are bad. There's plenty of good ones out there. I know several good respectful cops that have integrity and show courtesy. I'm more embarrassed by the plentiful of people I see nowadays that jump to hasty generalizations and logical fallacies. There are teachers that are pedophiles and harass/abuse students. Does that make all teachers bad? Should we all be against teaching in general because of that? Use critical thinking people.

Everyone in the community would hate this teacher and some would wish they were dead. No one would be trying to make excuses for them or finding a way to call them a brave hero. @@pyguy7he simple fact is this. There are constitutional auditors who make a living filming police interactions through youtube ad revenue or law suit settlements. Then there are channels like audit the audit and lack luster who make a living show casing police brutality and unconstitutional conduct. In an ideal world we would have peace officers and not law enforcement officers. You can cry that there are plenty of examples of good police officers, but the fact remains that these youtube channels have a surplus of content to report on. The requirements to become an officer are GED/HS Diploma, a Pulse and can run a mile in a predetermined amount of time.
Judges, Prosecutors and Defense Attorneys all have years of schooling to be in that field, yet we give an 18 year old fresh out of high school a badge and a gun.
A cosmetic beautician needs 18 months of school to get a license to cut hair. A cop needs 6 months of on the job training to legally shoot someone.
When Audit the Audit closes up shop because there is a lack of news stories of police violating peoples civil rights then I will start to believe that the whole of police are good.
