  • An issue that has plagued Hertz users across the country has impacted a woman in the Lexington area, she said. Trinity Johnson says the company falsely accused her of stealing one of their cars, threatening to alert police so she could be arrested.

    Reporting her as stealing the car when its been paid for is fraud at the least.
    If the car wasn't stolen then the police are making false arrests based on false information from Hertz, that is also a crime.

      Hertz "claims" there's a "glitch" but it has yet to fix it. It's also known that Hertz employees routinely lose the extensions for rental cars being paid for by insurance or the renters. Hetz' "excuses" are just that, excuses and poor ones at that. And to abuse law enforcement with false stolen car reports is an even bigger issue, as filing a false instrument/report IS a crime and punishable with jail time.......

    They have arrested people for no reason. A whistleblower came out and a man who worked for the FBI was arrested for his rental car. Hertz is a HORRIBLE company.

    I also blame the Police - They're simply not asking enough questions - you stop a "stolen" vehicle to find the driver stops willingly, isn't known to police and has the keys and a rental agreement. That should sound a few alarm bells and the police should place a few phone calls and get this straightened out. I'd say they're neglecting their duty of reasonable care.

      This has been going on all across the nation, and the response depends alot on the police department. I heard that some departments have been putting additional checks in place as soon as they realize it is Hertz =- or any car rental company - that is calling in a vehicle as stolen, as opposed to a private citizen.

      Given the large number of false reports, if I were a police chief, I would instruct my officers *_not_* to pull over any car reported by Hertz as "stolen".

    Hertz has been doing this for about 15 years now. The numbers the lawyer gave are low balled, probably because the no conviction rate or hertz drops the case. The courts demanded how many times a year they claim stolen vehicles and it averages about 3600 a year for the past 10 years.
    I saw the cops pull into a gas station and they found a "stolen Hertz rental car" that an ex-federal agent had just rented a few hours before. The federal agent was handcuffed and taken to the police cruise. Even after showing the cop the rental agreement and bank statement they kept him in cuffs for a long time.
    A different man that also had proof of renting the car spent 7 months in jail to have the case dropped once he was able to get to court.
    Hertz is falsely accusing paying customers for theft and it isn't right. Stop doing business with Hertz and it's affiliates. Call your local politicians and demand they look into this. If you have been a victim of this behavior from Hertz then get a lawyer to look into it for you. You may have the right for reciprocation.

      I saw a video about these exact situations. I believe a former ceo has come out against them too. I really don't see the motivation for Hertz but they're obviously doing this.

      In the cases you cited it isn't Hertz accusing anyone. They previously reported the cars as stolen and police did their job. Hertz just never removed the stolen car report in the system. These were cases of laziness. Completely different situation to this lady.

    LET ME MAKE THIS PERFECTLY CLEAR, NEVER, EVER UNDER ANY CIRCUMSTANCES RENT A CAR FROM HERTZ. IF EVERYONE DID THIS THEY WOULD BE OUT OF BUSINESS IN A MONTH OR LESS. DON'T BECOME A VICTIM OF HERTZ, HURT THEM INSTEAD.

      In fact, you should never drive a car knowing it was a Hertz rental even if it is from an employer because once you get arrested/processed/jailed the road to clean your image might be very long.

    I work for them. I knew about the problem. Never thought it would happen to me, one of their own, but it did. When we rent cars from the company, the system automatically puts our employee Id next to it. Whoever looks at it in any state knows who rented it or who has it. I drove from Tucson to Phoenix AZ and got arrested there. Spent 11 days in jail. All the paperwork and my employee badge meant nothing to cops.

      @@celestial4120 I have a GED and they pay me $23/hour. I won't sue them. Not sure I'm going to find another job that pays this much with little to no education. And I work from home as a customer service agent. It's as good as it gets, for now.

    People have been Arrested and thrown in Jail because of this.
    Back in 1994 I rented a Hertz Car in Orlando and mistakenly left my Credit Cards at home so I had to pay a $500.00 deposit to rent it.
    When I went back to return the car I asked for my $500.00 Deposit back and they tried to tell me I never put a deposit down to rent the Vehicle.
    So I looked at my receipt and there it was $500.00 deosit.
    So I showed the counter person my Receipt and she said well it says on the Computer I did not make a deposit so I cannot give it back toi you.
    So I called the Police and waited for them to come. When the Cops arrived I explained what was going on and The Officer told me this happens all the time at this Hertz rental Location and that there is nothing they can do because it is a Civil Manner.
    So when I got home I called Hertz Corporate office and explained what happened and they said they would get back to me which they never did.
    So I went to The New York State Attorney General and explained what happened to me and to my surprise this has been happening to a lot of people from New York that rent from Hertz at this Rental Location in Orlando and they are in the process of investigating it.
    Well 3 months later i get a call from The New York State Attorney General's Office telling me that I will be getting my $500.00 and a Hertz Card good for 2 Rentals at any Herts Location.
    After I used the Two free Rentals I stopped renting from Hertz all together.

      OK, but so they got to use your money for more than 3 months, and then, after you took time and effort, they made a good=will customer courtesy gesture that didn't cost them any financial loss and which they were able to tax=deduct as a promotional expense, without there being a record of wrong=doing on their part.
      It's hard to call that a win for you.

      What can the FBI do? It's a state by state case not federal. The Federal Trade Commission can and should get involved though.

    It started with them charging fees on your card without notice or authorization. That happened to me. I was one of the most frequent customers at my local hertz. The local hertz is closed on Sunday. They always processed the vehicle first thing. Luckily I always have a certain cushion in my account. I noticed a large sum came out. They charged me another hold fee but at 700 on top of another 350 for "no return". I called them on it and pointed out it was fraud. They violated the rental agreement. They could see the GPS and would know it was at the location. They said that even though the location wasn't open and because it was processed Monday it was somehow my fault. I quickly escalated it when they realized I caught them in fraud. That if it was not resolved and not only all the money they stole from my account using my credit card information and refund my rental that it would be turned over to my bank's fraud department along with a police report and a lawyer. The agent on the other end rudely asked why I was upset! I asked her if I could steal 750 from her account if she could afford it. I asked what if do not make what I make or someone else you could have ruined their week or families week. I had it escalated to a supervisor he was just as rude. When I explained how they were caught dead to rights stealing using my info and violated their agreement things changed. I called every 2 hours . Last call was if not fixed by close of business I would do what I said. Next day all money was returned, more points added to my account, a refund of the rental and next rental was free.

    Yup. RUclips Hertz rental nightmares and you'll see tons of these similar stories. One person in GA was arrested for 7 months for a rental car that he legally paid for and finally had the charges dropped by the judge

      Qualified immunity. Anyone can call in a car as stolen. It's up to the courts to decide if there is a case.

      @@taifhassan7936 This has been a nationwide issue and different police departments have responded differently.
      While some even have refused to accept a stolen vehicle report from a car rental company in the same way as when the report came from a private owner, others, especially cops in the field, have very limited information. All they know is that they have a "stolen vehicle" in front of them. They don't know the backstory. They treat the situation like the driver might have hi-jacked the vehicle at gunpoint.
      Many people had their rental contract and were able to get out of the situation, but they had the cuffs on the entire time.
      All in all, not a situation you want to be in.

    She’s a lucky one! Most of these stories are way worse! One gentleman was locked up a put away for seven months because of hertz. Hertz has it coming!

      Completely different circumstances in his case. The car he rented had been stolen and finally recovered, hertz just never cleared the stolen car report from the database so when cops run the tags it comes back stolen. This lady is in a totally different situation.

    They have been doing this to people for a while. Some people unfortunately have criminal records now and have ended up in jail because Hertz keeps filing police reports for stolen vehicles. They deserve to be sued for everything their worth and shut down for good. Messing with peoples lives like this is horrible.

      They don't have criminal records, i.e. a criminal conviction, but they all have an arrest records now. The arrest record stands regardless of how bogus and unfounded the charges are, even if the charges are being dismissed as soon as they are presented to a judge.

    This is a civil issue, not a criminal one. Hertz already knows who these people are and has a contract with them. The police should NEVER pursue these cases. If Hertz thinks a customer they have a contract with has kept a rental car too long, it is up to Hertz to hire a repo company and then try to sue that customer in court. That still does not make this right, but the police should not have ever been involved in these cases. Simple solution in the future: do not rent from Hertz.

      Some police departments, a few I should say, are doing this. They don't accept a stolen vehicle report unquestioningly if it involves a car rental company. But fact is, because cops are armed , Hertz is putting people's lives and health at risk.

      @@Rink03 You misunderstood my comment. Read the third sentence. "The police should NEVER pursue these cases." That means that if Hertz had pursued these customers civilly instead of criminally, then NONE OF THEM would have ever been arrested. No one gets arrested if "police ... NEVER pursue these cases." Also, the police should have told Hertz to pursue these cases civilly since Hertz already had a contract with their customers (unlike some unknown person who steals a Hertz car out of a lot).

      It *_is_* horribly corrupt, but you'll be happy to know that the victims *_are_* suing Hertz. I believe there are currently 231 victims suing the company. I wouldn't be surprised if that number increases as time goes by.
      And yes, boycott Hertz, Dollar, and Thrifty (companies owned by Hertz).

      They wouldn't be able to collect. Hertz, like most rental car companies, is self insured. That said, I would not be surprised if they were able to make some kind of accounting entry that makes their financials look better the moment a car is reported stolen...

    I hope she wins big on her law suit. That's about as ridiculous as can be. I've had to extend a rental but I called the other person's insurance company. They didn't want to extend it but I said I was being cooperative up to that point but had no control over getting lawyers for my car. If I needed to get an attorney I would have mine call that day. I extended for 3 more days until my car was ready.

    A few years ago I rented from Hertz for two days. FL to PA, one way, and returned car. I got a receipt.
    Spent a month in PA and just before returning to FL, my debit card was denied at a restaurant.
    Hertz said I returned car to Kentucky (I've never been)! Charged over $2000. Left me in PA with no money in account. If their computer says it's so, that's what you did! Apparently idiots in Williamsport didn't correctly close out my rental. Took ABC Action News consumer advocate to get most of my money back.
    Don't rent with a debit card! (I now have a credit card for such occasions)!

      Unfortunately he's right. In California police were called to my sister's apartment because her kids were playing and running around, the neighbor called the cops and they came out twice. First time they told her to keep it down, next time threatened said if they had to come out again blah blah blah. Firstly, it was in the day time and not against the law for noise and there was no reason for them to be there but when someone calls they act like idiots that have to do something.

      Why not? polce wont charge to repo a so-called 'stolen' car, a repo company would charge, Hertz is being a cheapskate and using public resources for their financial benefit.

    I worked in collision industry 51 years . Did alot of work for rental companies. Hertz always wanted estimates for damage that didn't exist. I refused and banned them from the shop. What hertz is doing is running a fundraiser!

    Hertz charged a gas fee of $275.00 to a customer who rented an electric car that was returned with a 96% charge, the same as it was received. Hertz should run a new ad campaign using the old TV commercials with OJ Simpson running through an airport to improve their image. I wonder if the law firm representing them is Dewey, Cheatem & Howe.

    That reminds me of a gym I called to inquire about membership.
    They took my card number over the phone and said to make an appointment to go in and sign the charge that same day at 3pm.
    I went there at 3pm and they had already signed, as in FORGED my signature.
    I was in tears upset and revolted. How could this happpen? The manager said: "I thought you wanted us to just 'take care of it'.
    So, I asked what does that mean? Forging my signature?
    I said I had an appointment specifically set up for me to sign.
    Anybody else signing IS FRAUD.
    It was about $230.
    I don"t remember the name of the gym, in Los Angeles county, but later they closed down.
    I don't know if they went bankrupt (those were the signs, based on their fraudulent practices), or if they opened under a different name. Companies who mess up, change their name, too, after being sued.

    I have always thought that car rental companies had trackers on their fleet of cars. I know that some finamce companies do to aid with recovery should a person default on their car loan. Something very wrong with Hertz doing this to innocent people. I would hope that a resolution into this problem is resolved but also the findings as to why and how this has become a common practice for Hertz.

    I rented a car from Hertz last August for a day. I returned it after hours as previously arraigned on a Friday evening. Corporate isn't open on the weekends, so the agent couldn't let them know the car had been returned till Monday. I started getting threatened emails first thing Monday morning. This continued into Tuesday morning. By that time, the agent had already rented it to someone else! This was the 1st & last time renting a car. And I'm in my 60's.

    Hertz should be fined with $10,000 for every false report. They should owe their victim a minimum of $200,000 if someone is falsely arrested. And the threat should be extortion landing the employee in jail and the company owning $10,000.
