- A joint development agreement is signed between the builder and the landowner. It is beneficial for both the parties. The landowner can unlock the value of land. On the other hand, the builder need not invest his capital in land purchase. Therefore, builder's capital requirement is less compared to an outright land purchase.

Development agreement is signed between 2 land owners (brothers) & builder but supplementary aggreement is signed by only one of the land owner not by both land owners ,so pls guide how to get our flats?

IF ONLY SHARING AGREEMENT(SAY 60: 40) IS REGISTERED BUT JOINT DEVELPOMENT AGREEMENT UNREGISTERED AND THERE IS CLEAR CUT DEMARCATION IN REGITERED POWER OF ATTORNEY THAT SAY 60% CAN BE SOLD BY BUILDER AND 40% BY LANDLORD. THEN THERE WILL NO HARM TO PURCHASE FORM LANDLORD AFTER TAKING NON-ENCUMBRANCE CERTIFICATE FROM SUB-REGISTRAR. LANDLORD IS ULIMATE OWNER OF LAND AND THEREFORE BUILDING THEREON ALSO BELONGS TO LANLORD EVEN IF JOINT DEVELOPMENT AGREEMENT IN UNREGISTERED. In few states the Registration charges and stamp duty is very high and to avoid this JDA might be unregistered

Hi Nitin, thank you very much for your videos it's really helpful to get deep knowledge about property development and the rights of the owner and the buyer etc... Further, I would like to know the following points
1.If the JDA is registered at Registrar office and the distribution of flats (owner share(3 owners of land (brothers)) with flat numbers mentioned in it, so is it necessary register the flats on the individual owner's name if so will the cost of individual registration bear by developer or owner..?
2. What are things/documents to take care by the owner while the builder handover the build-up flats?

sir I myself and my father partitioned our ancestral property in 2012 , in 2020 we demolished the old building and gave the site for development. as per the development agreement we got four flats , 2 to my father and 2 to me. I propose to sell my two flats. please let me know how can i get over without paying income tax as the property given for development is ancestral property that too i got the same in 2012 long back. please guide me in this regard. thank you

According to your version, a landowner has to obtain noc from builder for selling landowner's own share of flats. In that case, when the noc has to be taken- at the time of initial agreement or after the flats are being handed over to the landowner and the landowner is selling the flats?

I approached a builder to buy a flat.After negotiating the amount I asked for Developers Agreement.The plot on which he is constructing has three owners all are siblings.But the younger one has became a confirming party in the deed and she lives in some other state with her husband.While asking the builder question that why she has become a confirming party and not first party,he told that she lives far away and also she has some health issues.So my question is that is it a proper deed? Should I purchase the flat or is it very complicating?Can a owner of land become a confirming party in developer deed ?

I have a small query to be cleared. I (land owner) entered into a Joint Development Agreement 3 years ago with a builder. The agreement was registered and a stamp duty of approximately 1.5 lakhs was paid to the sub registrar office. Due to various circumstances the work did not get completed. Now we both have decided to cancel the Joint Development Agreement between us so that i can get my power of attorney back. But the Sub registrar office is asking me to pay the stamp duty again based on the current market value of land for cancellations of deed. I am a bit confused here. Your inputs would largely help me. Thank you

what was the reason is his land example 10 Lakhs and construction value 10 Lakhs by my side as a builder .
I am selling that house with my marketing skills 32 Lakhs..
he is taking total profits .
before construction he was telling profit sharing ratio will be 50 :50 orally.
after that he is giving 10 ratio for me and 90 percent ration profit for him .
10 lk for land, 10 Lakhs for construction.
12 Lakhs business I did he was giving 120000 or 2 Lakhs for me .
