    A few months ago, my crazed, drugged up neighbour threatened to stab me. I phoned the police and shouted, terrified, down the phone that this lunatic was making threats, and he could hear him over the phone shouting obscenities at me.
    No one came out to attend the incident, and the guy on the phone said, and I quote, “it was probably just bravado” on the part of my neighbour, and not to worry.
    Two PCSOs came out three weeks later to do a follow up to the incident that wasn’t even attended in the first place.
    You got five coppers for looking in a car window.
    And people wonder why I don’t have a single ounce of confidence or respect in the police…

      I'm surprised you even got the PCSOs. When my partner was threatened in the street, the police came, she was threatened again (in their presence), they still did nothing. I asked what would happen if I threatened the police, one replied "you'd be on the floor".
      They then said they'd do nothing, but she'd get a visit from PCSOs. They didn't come. A week later I came across one of the police and he asked if they'd been round, I replied "of course they haven't".
      He said he'd make sure they came to see her, needless to say they never did.
      It's no surprise that only the very stupid and very rich trust the police.

    Notice that cop snidely waving good bye at 19:00.
    He spent the entire time trying to escalate the encounter to violence so he would have an excuse to go hands on with you.
    The guy is seriously dangerous. He's clearly a violent full blown narcissist with a deep sense of entitlement, but no brains to go along with it.

    Its always amazing in Britain that the police is constantly touted as being underfunded but if you go near a police station and act in any manner that they don't like, an entire army of them crawl out of the station within 60 seconds, no laws broken, meanwhile if you called them at 3:30 on a friday afternoon that someone broke into your house, you'd be lucky to see them that side of the weekend

      I phoned 999 a few times in the past, and got engaged tone. Made a police complaint and each time the police reply is well we got a resource problem, so I say, well report it to your local MP, as we keep getting told by the police everg thing is a civil matter and if you dont like it take it up with your MP. So why don't the police commander / chief constable take it up with the MP or resign for KPI failures ?

    What raised my concerns was when the detective said to the first officer who arrived " are you ready to earn your colors" that just sounds so wrong and fishy to say especially in front of a member of the public. That one comment from the detective caused all those officers to act in a absurdly unprofessional way, definitely setting the right example, detective Finnigan

      It's known as "Pulling Rank" - a senior officer will demand something and the underlings will usually follow orders. They try it on Civilian Staff too but don't really have enough clout to enforce their demands as the "Civvies" have their own bosses and will usually only answer to them (not the uniformed officers).

      Im 40. Always had respect for the police until i was illegally detained for not wearing a mask at a train station and was followed by a police car when walking one evening during “lockdown”. I have been learning about our rights since and boy has it woken me up. The police are a pseudo-military arm of the government and are failing to support the inalienable rights of the people.

    Wow.
    Inspectors led the cop straight to an illegal search, and he was quick to ensure he got the cuffs out. Completely unfounded.
    If 4 officers need to cuff a peaceful member of the public for looking in windows, they are totally inadequate for the job and need to be sacked now.

In the supremely unlikely event that they encounter any disciplinary action, it would simply mean they will be put on "administrative leave" (ie on holiday with full pay until they retire).     Suspicion = opinion without evidence. The fact the Inspector said I think he's an auditor makes the whole search and detainment unlawful. Looking into a car isn't breaking the law, suspicion isn't a crime and you guessed he was an auditor....which isn't a crime. Which would make this a retaliatory detainment and search for auditing. Earning the hate.

      They're very reasonable compared to what they were like when I was young (the 70's). Back then they would have taken him in and beaten him up or search him and find miraculously find something in his pocket, you'd never get away with talking to them like that in a million years.
      I would say though that for just looking in the window they would probably have just told him to clear off at first, they didn't like paperwork.

    section 1 of PACE says they can only stop and search if they feel they will find stolen items. the fact that they are using it to stop and search for looking into car windows ( while covered in cameras ) is an absolute farce and breach of power. my rule of thumb once they say detained it's my right to remain silent.

      person initially objects to the search (at.10 HRA) PC did not state "Object" of PACE s.1 ,, he is looking for , therefore PC searching to "find the grounds" to find an "object" which he never found ,
      where code A 2.11 states :-
      There is NO power to stop or detain a person in order to "find grounds "for a search. now down rabbit hole, no exit
      also the 2 tier test was not met BOTH are required
      code A 2.2 (i)& (ii)........ only (i) was met = suspicion

    When stopped, the police should tell you a number of things prior to carrying out the search.
    If this procedure is not followed, the search is likely to have been unlawful. Officers should explicitly tell you:
    # The reason they want to search you - a clear explanation of the reasons for the search
    #What the specific legal basis of the search is
    #What they expect to find from the search - the object they're looking for
    #Their name and ID number or warrant card (if they are not in uniform)
    #The police station they are based at
    #Where and how you can access a copy of the record of the stop and search

      thats correct and not correct they use a thing called GOWISELY so Grounds, Object, Warrant card, identity, station, Entitlement, Legislation, You are detained.     The really scary thing is that to them, abusing your rights is not a big deal.
    Its not like they are consciously evil people (some are) but they are so used to doing it that they even expect you to be polite and thank them afterwards.
    There needs to be a police training course that teaches them that abusing someone’s rights IS A HUGE DEAL for that person. They need to put themselves in the public’s shoes and develop the empathy needed to remember they need a DAMN GOOD REASON to violate your rights, or the social contract is null and void between us and them.

Regardless they quoted section 1 of pace, stated that they’d seen AB looking in cars and felt that was suspicious but gave no specific legal basis for the search and didn’t advise what they were searching for. As section 1 can only be used when there is a reasonable suspicion that the person is carrying prohibited items, before the search is carried out they must state what items they are searching for. As that didn’t happen it’s an unlawful search regardless of whether they believed he was an auditor.

      I'm on the SOR in Hertfordshire. Some/most of the officers they send to check on me act like this. For many many years. Either comply and they'll use ANYTHING against you, even perfectly legal activity will be given a totally subjective evil intention, or keep quiet and they'll use that as "suspicious" enough to go further. I know, "you deserve it" but this is what you get. It spreads down. Either everyone has rights or nobody has rights.

    They played their hand too early. Would have been smarter to start with a few questions. If they are half the detectives they think they are, they'd have deduced pretty quickly that the guy with the camera is no suspicious but merely looking for a reaction. They fell for it, as usual.

      As a keen photographer I was pleased to see auditing get off the ground as, at that time, you only had to start taking photographs in any town center for some jumped up dayglo to demand you stop and delete your images or they would call the police. They very often did. But we have moved a long way since then. We should acknowledge it. Its far more rare tand 3 or 4yes ago for police to get involved Today in most town centres you can shoot without harassment from officials. If you get grief it's from ordinary members of the public.
      Things have improved so much that they have to video police stations even going as far as to shooting through the windows to goad them into a reaction.
      The downside of all of this us the police will undoubtedly be in negotiations with the home office to have legislation drawn up to restrict footage and certainly drone use in such situations.

    I'm glad you pointed out that the Inspector referred to you as an auditor. That means any suspicion required for sec1 had already been dispelled, and as such from that moment on the detainment, use of force (cuffs), and subsequent search became unlawful.

    Those two guys knew you were an auditor so they got a 'muppet' who they said would 'earn his colours' to detain you, when really they did not want anything to come of them for unlawfully searching you, palming the blame off on PC plod in uniform to do their 'dirty work'. They were smirking which i did not like and IMO patronising to the uniformed officer. Again one admitted at the beginning that he had the right to touch you when you asked him not to, I would hate to think if you didn't have a camera what he could have done to you.
