Hypothetically, if a CDL driver gets DUI or a failed drug/alcohol test in a CMV and is not registered with the clearinghouse, how will they get notified if a violation had been entered in the clearing house, even though the CDL Driver is not registered? He/She gets a letter mailed? 2. I maintain my CDL Class A, I do not work for an employer who utilizes CMVs in any capacity. I also do not drink alcohol or consume recreational drugs, do I still need to be registered for the clearinghouse even if it is not required? ( I have a CDL Class A because I like trucks and It's my backup career).

No, you don’t have to register for the Clearinghouse as a driver, unless and until you need to give an employer consent to run a query on you. That said, even if you aren’t registered, violations could still be reported using your CDL number.

Also can I request a retest? Or a hair follicle/ mouth swab test to confirm? Would a retest make the possible tampering flag disappear?
Good Morning! I was hit a parked CMV in a truck stop parking lot. Police weren’t called, no tickets or citations, however there was enough damage that the truck was towed. Is that DOT reportable being that it wasn’t on a highway? Thanks!!
If the lot isn’t blocked off to public travel with gates or signs, then the accident would still be DOT-recordable. But wouldn’t require post-accident testing since there was no citation.

If they weren’t requiring you to operate a CDL-sized vehicle, it shouldn’t have been a DOT test in the first place and so should not be reported to the Clearinghouse. Whether they know that or not is the question.

It said on the application it was regulated by 49 CFR 391.21 & no request or mentions of the clearinghouse was made to me. So i assumed they wouldn’t be able to report to the clearinghouse. Correct?

So I should be in the clear just in case I didn’t pass. As long as they scanned that paperwork then it should went in as a NON-DOT test? The facility wouldn’t have changed it as far as you know?
Another regulation against cdl drivers and truck companies. GlAD that i quite driving 2019 after the E-Log after 14 year's owner operator. Seance than i say you are brainless to be driving a truck this day's! Stay away to over the road driving will ruin your life in every way and you will never make money. I had an interview with Labatt and had to take a drug test for them well the lady that took my urine was having a bad day or idk what her problem was but she didn’t even look at my pee she grabbed it from my hands and threw it away and immediately asked me to wait another 3 hours before I can test again. So I left. It was a pre employment drug screen for Labatt the job was a driver helper position with a chance to get a cdl in 6months.

@BreadManAustin Just depends if they conducted as an actual DOT test or not. If DOT, they may end up reporting it. If non-DOT, then probably not.
