Jane acted as usual. He did everything on purpose. The Judge may reject the video BUT people on Court saw it. I love how stiff and correct Lisbon is until she spokes with Jane. He is honest to her..the only person he is honest with. This is Season 2 and the Team were still rather unsure about Jane's way of working. Lisbon is always at his side even if she didn't understand some Jane's actions. What I love in Jane is that he do everything to help the families of victims.

Fair, but I'm pretty sure defendants also get a lot more leniency on such things than prosecutors might. I'm sure it's looked-down on, but the "innocent until proven guilty" bias means that, as a judge, you'd really want to have solid grounds for excluding defense evidence that might be exculpatory, lest you give grounds for appeal. Plus, it was evidence of at least questionable conduct by the prosecutorial team. I doubt a lot of judges are going to insist on possibly-corrupt prosecutors getting a heads-up when evidence of their possible malfeasance is discovered.
It's not evidence relating to the potential guilt of the accused, so it wouldn't have had to be revealed even if the prosecution asked for discovery from the defence.
This remains one of my favorite episodes in the series. Great case, excellent flow, well-acted and directed, and has a great storyline within the shining comedic moments. Jane's interactions with the judge in this episode are the true highlight though. The timing and chemistry were and still are a great watch!

No, they spend about 8 hours repeating known material ad nauseum and then do that several more times over the course of 9 months to 10 years, depending on the case. It takes WAY longer than this to get to anything definitive.
Punching a hole in the heart does tend to decrease blood pressure rapidly, which usually results in unconsciousness fairly quickly, especially in a head-above-heart posture. After initial loss of consciousness, the heart serving either as a drain or an active pump moving blood out of the circulatory system and into the chest cavity would probably keep any appreciable amounts of cell resources from moving to the brain. It's dramatic and convenience, but not necessarily ridiculous. And it's a tone choice.
It's similar to how a person dies from being strangled for 5 seconds. In that world, swimming underwater for any length of time should be an impossibility.

definitely should, one of the best shows i ever watched, well at least until the season where the main plot finish for real, after that they just extended the show because of the fans request, so it was kinda out of the plans and kinda iffy a little, but still good.

Also, to those debating this scene about the trial in this particular scene, I feel it represents a lot about what The Mentalist discusses through most of its run. The right and wrong way of doing things, and such. Patrick Jane gets results, and he does care deep down about fighting for justice of the victim's families, especially when it alludes him throughout most of the show in his hunt for Red John who deleted (see YT rules) Jane's wife and daughter. However, I feel this episode represents a consequence to actions such as illegal searches that Jane does commit here and there throughout the series. However flawed our laws are, there is always the possibility of them holding up in court. I agree that how this is played out is more for entertainment purposes to fit within the plot/storyline the episode is telling, but there is a reality to this. There are people who are released based on technicalities, witnesses changing testimonies, and such. Even though the judge knows who the real mu***rer is based on the video, he has to, as an honest judge, uphold the law that is currently on the books within the scope of California 2010 when this episode aired.

@chris lancaster this is meant to be "contemporary fiction" meaning the characters and situations are fictional but everything else is meant to be true to the world in which we live. That's why the viewer can assume based on positioning that the judge is the judge and the lawyers are the lawyers without it being explicitly explained. The legal proceedings being entirely inaccurate to reality is untrue to the real world and therefore poor writing.

They had to have a court order for search and seizure. These rules exist because nobody wants their rights to get violated by government and powerful people through arbitrary and secret searches, line tappings, or trackings. We don’t want the government or influential people to abuse the use of police force through unjustified accusations. The rules of criminal procedure is a part of the checks and balances system. The police has to learn the law and make sure they don’t get the case dismissed for the lack of legal and acceptable evidence. These sort of situations happen in real life. I understand that it is frustrating to the victims and families. However, the blame rests on the police, not on the judge or the judicial system.

Here in Portugal not many years ago a self taught hacker got into some famous and politics phones/computers and found a LOT of ilegal stuff, from theft, money laundering, corruption, tax evasion even killings and trafficking. Judge dismissed the case because all evidence were obtained through ilegal ways as he did not ask for their permission. Hacker went to jail while everyone else went home. This country's law is a joke.

This would be a major violation of right to privacy and property. This system is easier to abuse than the current system, because the police wouldn’t need to convince a judge that they have probable cause. What if someone crosses a police officer, and that police officer gets so angry that s/he gets a third person to accuse the first person with a heavy crime, so they can search the first person’s house arbitrarily just to pester them. What if a businessman wants to eliminate an opponent for a big contract, so they bribe the local police officers, make/ have someone make a false accusation, tap the opponent’s phone, and find out what the opponent is gonna bid for the contract. I assure you these sort of things and more terrible things happened in the past. These rules didn’t come out of the blue. There is a whole history of sufferings, wrongdoings, abuse of power that resulted with rules we have today. You can’t strike them out because of just one specific example. What the police have to do for these situations is really simple actually: get a court order
