I disagree with the leniency argument. This was straight up murder. He executed the woman after wounding her while she begged for her life. He had no reason to think he was in danger at that point.
Even though I feel bad for for him, you're right. He already wounded her. Should've gone back inside and called 911 immediately. She could've been saved. 😢
Gotta give Bruce a little leeway here. He's looking at this from the perspective of criminal defence and what his direction of arguments would be.
Boomer with brain rot. Just as there’s a minimum age for firearm possession there needs to be a maximum age. So many shootings happen like this when clearly the geezer was not in danger.
It also was practically a hostage situation too. He took her belongings and said she couldn't leave. Just nope.

Yeah, even if she had been a scammer, that's murder. Only defense that could MAYBE work on me if I were a juror is something like an insanity defense--suffering from dementia and didn't know what he was doing was wrong, or some defense like that. (And obviously that would still mean he's locked up for the rest of his life.)

The moment he shot her he was not in danger, then to shoot her two more times was absolutely unbelievable, he should go to jail.

You probably don’t understand modern technology or exactly what’s going on. I would personally be extremely suspicious and probably have a firearm nearby. His mistake was not determining that she wasn’t a threat, and obviously executing her is extremely egregious. I completely think it was an offensive act and should not have happened, but I think his initial concern was understandable. The choices following that were not.

Before he ever started shooting, he had the option to stay locked in his house with his gun for protection, and to call the cops to sort the situation out. She was NOT breaking in. As far as I'm concerned, the moment he chose to leave his house and take aggressive action, he ceased to be a victim and became an attacker. No leniency.
Thank you very well said... but even when we fall for a scam we are not a victim but instead a fool who suffers the consequences and when we commit cold blooded Murder we must suffer the consequences.. we have all made foolish mistakes in our lives and most of us learn from them but there is no excuse for committing murder unless it was self defense....we can't use deadly force unless there was a break in attempt....He chose to take the law into his own hands by leaving his safe place approaching the situation without fear eagerly awaiting to use his gun over an imaginary threat...If she was part of that scam she would have been Smart enough to bring backup.. How do you know staying locked inside is safe? This is what I never understand about self defense cases. If someone were to break into my home and I chase them out how do I know they aren't coming back or there aren't more people on the property.
If some suspicious person were at my front door I'd be wondering if there was someone else around the side of my house or in the backyard. I'd feel tense that entire time and knowing what I know about locks I know they can only save you about a minute if someone actually wants to get in.
Sorry Bruce. This was a straight up execution! She's a woman, non-threatening, wounded, unarmed, backing up, pleading for her life and screaming for help. She's not going anywhere. Just take her car keys, call the police and let them handle it. What he did was no where near in the realm of reasonable.

In fact, he didn’t even have to come out of his home, or answer the phone. He just could’ve called the police.

@@DrigallskiNo, they're all relevant points and they all disprove any self-defense claims the murderer might make. Self-defense only applies when there is a reasonable threat, the threat still exists and there is no way to get away from the threat by backing away (unless you're inside your home, then you don't have to back away, as Bruce said). If there is no reasonable assumption of threat (or there was but it ended), or if it's possible to back away (if outside home), then it's not self-defense.

I was under the impression that he was apparently afraid for his life, in which case it is no longer just a scam and the police would get involved. Besides, even if they don't - having the proof that you called the police and they didn't come in time, forcing you to defend yourself would be a great argument to have. Well, if there was anything to defend from, that is - clearly the woman here was not even slightly aggressive so its just plain murder.

I don't think this would fall under 1st degree murder. To prove it was premeditated would be hard for the prosecution to prove. You have to prove it was deliberate, planned, and willful. However, 2nd degree murder would be much easier to prove. 2nd degree is more of a "reckless disregard for human life", which can easily be seen by the video. He'd still have to spend the rest of his life in prison.
This guy is dangerous. If he has diminished capacity, he still needs to be put away to protect the public.

They said they are holding his relative, that is the threat that controls his actions. Imagine if the women was part of a real kidnap gang. If he does not pay, his relative is dead. That means, if she leaves, his relative dies. She is not a threat to him, but from his view, her leaving is the threat.

My grandfather owned guns, my father owned guns, all of my brothers own guns, my cousins own guns, most of my friends own guns, but not a single one of them has ever shot anyone. Nor expressed a desire to shoot anyone. There are people I don't like that own guns, but they have never shot or expressed a desire to shoot anyone. In all my 71 years, I do not personally know any gun owner that has ever shot anyone other than in wartime. Maybe you are just hanging out with the wrong kind of people if you have acquaintances that want to shoot people.

First, why are Uber drivers collecting packages?
If this was DHL or Postal Service with a clearly marked car and uniform, I would say that it is sketchy.
But unmarked car with a person without uniform stopped in his driveway and person demanded package?
Isn't this why We have uniforms in the first place? So you recognize at the first glance that a person is on the job?

When you're delivering packages for a company their name should have shown on the car. That's why Uber should be sued . Under law if you're working for a delivery service company name should have shown .

I do not think you are legally required to call police when you are threatened. I don't think this should be expected when somebody calls you they want 12k$, or they will kill your family member, and they will kill them if you notify authorities, that you will call the police.
My guess is this guy is old-school military with a screw or two loose. Defending what he holds dear, having some deeply buried PTSD come rushing to the surface, and using what his weapon was intended for. This is a possibility. Though we shouldn't jump to conclusions until all the facts are on the table. Even then, we don't know every detail on what goes on in someone's head, and the world can be a frightening place for an elderly 81-year-old man. It's a damn tragedy for both parties.
What about the old frightening lady that was sixty one years old that's now dead because he decided to call the police after shooting someone..

I am from the UK, and I was just shocked by this cold blooded murder, and being a pensioner is no excuse for coldly killing somebody. He pulled a gun on her, and did not have to shoot, could have told her he was holding her there until the police arrived.. She was no threat to him, and he just murdered her. He deserves life in prison.

Bruce has a unique ability to see and empathize with both sides of cases. I doubt think the old man is evil. My gut feeling from what I have seen is the old man who is probably senile thought she was in on the scam and shot her out of rage thinking with no witnesses he could just claim self defense he probably justified it to himself thinking she is just a crook anyway. Unfortunately he didn’t realize there would be video. Really feel for the lady he shot who was trapped in a bad situation not sure there was much she could done different that would have changed things. Unless there is more context to the case we don’t know about I don’t see how he makes a case he feared for his life.
I've seen so many comments from people defending this guy, claiming the shooting was justified. It's scary how out of touch with reality people are.

The old man didn't even need to leave his house... Just lock the door, don't let her in and tell her to go away... If she didn't leave call the cops... This is such a sad story. That poor woman. I'm sorry, I don't feel bad for the guy. She was walking away, clearly terrified and confused. He didn't even try to assess the situation. He followed her with a gun and then took her out when she was clearly unarmed and scared. We seem to have an issue with paranoid old men shooting people unnecessarily and it's always in "self defense". Your defense lawyer roots are showing when you call for leniency, and your tendency to empathy/compassion. It's good to have a balancing opinion like yours Bruce, but no one should take another person's life unless it's VERY necessary. The video shows that wasn't the case with this woman - she was never armed, backed away, called for help, tried to explain herself...at most he should have had her sit down until cops arrived. If people are going to be allowed to carry guns, they must be held accountable for how they use them. You talk about him being elderly - if age is a factor in standards of responsible use, it should be a factor in ownership.

This old man was never afraid for his life, and he deserves no leniency. If he was afraid, he would have stayed in his home with the doors locked and called the police. He was angry that someone was trying to scam him, and he chose to arm himself while he waited for her to show up so that he could enact some sort of vengeance on her by killing her. Fear was never this mans motivation.

It's good to see comments that argue for the man to be found guilty with no leniency. He had so much time and many alternative steps to take before murdering her. Despite feeling sorry for him about being scammed, threatened, or just being of old age, it was intentional murder. If he was "fearful," he could've called the police and waited inside his house where it's "safe." Instead, he angrily went outside to confront her with a gun and shot her 3 times without being provoked by her. It's also clear that the threatening phone call was made by a different person that wasn't her.
I'm glad it's all on video too. He deserves to receive life in prison and to be remembered as a murderer.

This is so upsetting. I have been scammed as a senior and I also drove Uber for 8 yrs. Driving Uber can be difficult dealing with crazy people. This poor dear woman trying to make a living in her 60s. I am also in my 60s. This is really tragic. This whack job guy should have called the police not mrdered her in cold blood. This is why I would never pick up a package. I feel so badly for this woman and her family.

When my grandma was in her 80s she got scammed in a parking lot at a supermarket. She bought some broken dishes. After that she wanted a gun to protect herself. My aunts and uncles said, ¨No, we can´t let her get a gun. She would definitely shoot someone.¨ Instead they got her a mid sized dog and an alarm system.
This woman was NO threat. She wasn't physically imposing and even had a limp, she tried shouting help and was getting back into her car when that old man shot her. There was no need...if she was there to pick up $12k she surely wasn't being aggressive in getting it. That man had zero emotion afterward...as he sat in the back of the police car he seemed proud of his actions
