I don’t know how many times I have heard the police say, “if you haven’t done anything wrong, why are you worried?” While they are digging through your car or searching your pockets without you giving them permission to do so.

Police cannot search your car absent your permission so why would anyone, regardless of guilt or innocence, grant them permission? I’m a retired cop and would never grant such permission or voluntarily talk w/o a lawyer.

Alan was never "a regular", nonsense, everyone deserves a defense, even the guilty, that's our equal justice clause, perhaps you are not in agreement with freedom. Lindell is a nutbag, but has a right to equal justice under the law.

I’m no fan of the My Pillow guy but wanted to thank you Professor for sticking to your principles by representing him.
When you do a regular search warrant on a premises, you search everything to find incriminating evidence. This also covers information on a phone or computer. Of course, they search for everything on the phone/computer. Incriminating evidence doesn't appear in neon bold text, it's hidden in with all the other data. This guy is totally incorrect and appears to not understand the basics. There are procedures if you think items were wrongly taken during a search warrant. Suing is not one of them. It's a publicity stunt. Lindell is in serious trouble and he is using diversion/delaying tactics to find clear air in a smog. Best of luck with that.

No when you do a search warrant on someone's premises, you have to specify what you're looking for and where on the premises you expected to be. you can only get permission to search that general area. Such as we believe this to be in the master bedroom well you're warrant will specify that you can only search the master bedroom. Very rare have you ever seen a Warrant say you can search the entire premises you have to know what you're looking for and where you believe it to be

The problem with Dersh's opinion (& others like him) is that they will claim any political figure who is being questioned, searched &/or investigated is a target because of their politics whether or not they have evidence of that.
It is entirely fair for an attorney to say they want to ensure that a search warrant was properly ordered. However, claiming that it was not a proper warrant before they have proof of that is, in my opinion, unprofessional. Dersh also knows that law enforcement can physically surveill a person of interest, witness or suspect without a warrant as long as it does not invade their privacy.
Also, he knows questioning must only be stopped after a person is arrested & asks for an attorney and that everyone is free to decline to answer questions from law enforcement.

The "right" to call a lawyer only occurs on arrest.

One thing that confused me about Alan is he once said that Garland was up for a Supreme Court Justice nomination which he didn't get and Alan said he would have made a great Justice... but Garland seems to be violating the Constitution knowing he's doing so, or is he ignorant of the law? So how could Alan say Garland would have been a great justice when he does not put the Constitution first?
They had a warrant for the phone, but they wouldn't let him use his phone to call his lawyer. I can't imagine why they didn't want him to continue using his phone. (eye roll)

OK where was the violation of the Constitution in this case they had to go to a judge to get a search warrant and present evidence to the judge they needed that phone And the evidence had to be valid in a court of law
