Dershowitz is correct. The Rules of Professional Ethics in New York make it clear, that if you are an attorney, you cannot talk to a represented party without the consent of both the party, and that party's attorney.

Yet Avenatti said the other night that he has been communicating for weeks with Cohen's attorney's and they tried to work out a deal but Cohen refused to come clean about everything Trump had actually done, because he was still angling for a pardon from Trump. So the deal he tried to make Cohen's ATTORNEYS, fell through. Avenatti made that very clear on Don Lemon's show so I have no idea what Dersh is talking about, Just like Avenatti said, Dersh is yapping without a clue and he is getting third hand info from Blakely, the guy at Cohen's lawyer's office, who leaked the fact that Avenatti met with them, because Blakely was trying to make it seem like the deal didn't work because of Avenatti, meeting in restaurants and being out of order, when in reality Cohen not being truthful is the problem and Avenatti won't compromise his ethical position. So Dersh needs to sit his ass down and shut up because he made himself look real dumb here and he doesn't have his facts straight. If he did he would know that Avenatti is the one who is actually engaged in the ultimate in ethical behavior.

They are talking about Avenatti allegedly asking Cohen about something for which he was represented by a lawyer. This is not permitted without the lawyer’s permission, not the permission from Cohen as Avenatti says.
Sorry but you've cited the wrong rule. This rule deals with a lawyer and his/her client's information. The rule you should have cited is Disciplinary Rules (DR) 7-104, which states:
A. During the course of the representation of a client a lawyer shall not:
1. Communicate or cause another to communicate on the subject of the representation with a party the lawyer knows to be represented by a lawyer in that matter unless the lawyer has the prior consent of the lawyer representing such other party or is authorized by law to do so.
2. Give advice to a party who is not represented by a lawyer, other than the advice to secure counsel, if the interests of such party are or have a reasonable possibility of being in conflict with the interests of the lawyer's client.
B. Notwithstanding the prohibitions of DR 7-104 [1200.35] (A), and unless prohibited by law, a lawyer may cause a client to communicate with a represented party, if that party is legally competent, and counsel the client with respect to those communications, provided the lawyer gives reasonable advance notice to the represented party's counsel that such communications will be taking place.
This is referenced by 1200.35 which states:
(a) In representing a client, a lawyer shall not use means that have no
substantial purpose other than to embarrass or harm a third person or use
methods of obtaining evidence that violate the legal rights of such a
person.
(b) A lawyer who receives a document relating to the representation of
the lawyer's client and knows or reasonably should know that the document
was inadvertently sent shall promptly notify the sender.
In BOTH of these instances, there are instances in which collaborating with and/or receiving document/evidence from a represented attorney is legal and does not violate any code of ethics.

Furthermore, it is unethical and potentially illegal for Dershowitz to accuse Avenatti of committing Ethics violations. This would fall under both Libel and Defamation laws.
Without proof, Alan's suggestions are teetering on the brink of being defamatory and, if these things are within his book or written in articles, he could also potentially be hit with a libel claim. Both of which are a matter of ethics.
Even if he has not stated clearly that Avenatti has violated laws, he is acting unethically in rabble-rousing. For someone who has taught at top-notch law schools for 35 years, Dershowitz sure doesn't know much or is purposefully obfuscating the BAR's rules.

If Avenatti did not discuss the Stormy Daniels case SPECIFICALLY then there was no ethics breach, as the law states you cannot talk to the opposing side's lawyer without your lawyer's permission, but only in reference to that particular case which both lawyers are involved in. This means Avenatti could have spoken to Cohen about Karen McDougal, taxi cab medallions, unicorns, the weather, or anything else not pertaining to the Stormy Daniels case.
